This merchant called our customer service center the day the transaction occurred and inquired as to whether they would receive money if they processed a stolen credit cardOur representative responded that we could see the transaction in question, advised that merchants are responsible for liability/chargebacks if swiping a chip enabled card and then went on to explain EMV and Chip Liability and how it rests with the merchantEMV Liability shift was an industry wide change for merchants in and we provide multiple equipment options to ensure all our merchant have the option of using EMV compliant equipment, however it is not legally required that merchant use EMV compliant equipmentResponsibility lay with the merchant to ensure they are compliantAs we advised the merchant when they called that they should not process a transaction they suspect is fraudulent and also provide EMV compliant equipment options we will not be issuing any refund for the chargebacks the merchant incurred

I very well know who I had the lease withI also very well know that on May 13th I called Capital Bankcard & spoke with a *** and then also *** *** who authorized the return of equipment to them, who sent us a return label to send the leased equipment back to them; promising to assume or buyout the “Non Cancel-able Equipment Finance Lease Agreement” (for $per month) with “*** *** *** ***(Lessor)”, which we used & returned the Equipment as they instructed.However Capital Bankcard failed to buyout the “Non Cancel-able Equipment Finance Lease Agreement” (for $per month) with “*** *** *** ***(Lessor)”Therefore “*** *** *** ***(Lessor)” has continued to draft our checking Account for the $per month ever sinceAnd we have sent them numerous notices via fax, & email asking Capital Bankcard to keep their promise and assume; buy out our lease which *** & *** *** promised they would.Capital Bankcard holds the equipment (at *** *** *** *** *** *** ** *** in a box with a *** tracking #*** on it, picked up here at *** *** *** *** ** *** June 1st) *** *** *** *** has charged *** *** *** $per month since the 1st of June for equipment we don't even have.I do sincerely thank Capital Bankcard for that refund check #*** for $for that first charge *** *** *** ***charged us on June 1st And also for the $Capital Bankcard Paid with Check #by US Mail; 04/23/2016 Thanks!4-25-I negotiated a pay off balance with *** *** of $2,000.00, which according to *** ***'s promise you still owe us, because Capital Bankcard broke our contract of (“Interchange Plus” pricing @ .30% + $per Credit or Debit Card Transaction, & +$per Pin Debit Card Transaction

The customer did not include any comments upon rejecting our previous responsePer our original response we are unable to refund the chargeback fees the customer incurred as we did not issue those chargeback feesAdditionally it is the merchant's responsibility to ensure they are using EMV compliant equipment in order to avoid incurring EMV related chargebacks. Beacon Payment has EMV compliant equipment options should the merchant decide to pursue upgrading their equipment
