The Customer Advocate Department
of Carrington Mortgage Services, LLC (“CMS”) is in receipt of your complaint filed
with the Revdex.com received in our office via email on February 17,
2016. CMS is committed to responsible
lending and servicing and we would like to address any concerns you may
have. The following is our response to
the issue(s) raised in the inquiry
As we understand your complaint,
you claim that CMS assessed a property inspection fee to your loan in the
amount of $15.00, and you are disputing this charge because you claim you made
your December 1, and January 1, payments timely to CMS in accordance
with the terms of an approved loan modification
At the outset, the servicing of
this U.SDepartment of Agriculture (“USDA”) insured loan transferred from *** *** *** *** (“***”) to CMS on or about October 2, 2015. At the time of the service transfer the loan
was contractually due for the September 1, payment. In addition, on August 24, 2015, ***
approved a Non-HAMP Loan Modification. Your
signed loan modification documents were received by *** on September 3, 2015,
but the system changes on the loan were not completed prior to the service
transfer to CMS
Please note that, while CMS began
servicing the loan on October 2, 2015, the Real Estate Settlement Procedures
Act (“RESPA”) at USC 2605(d) prevents CMS from treating any payment as late
for any purposes until the expiration of sixty days after the effective date of
the servicing acquisition. This sixty
day period is specifically intended to allow the acquiring servicer the
necessary time to receive the acquisition file from the prior servicer and to
ensure the records of the acquiring servicer reflect the correct loan
information. Included in that process
are the reviews and complete post-transfer diligence and escrow analysis that
are due within sixty days of the acquired date.
Upon review, our records show
that CMS requested property inspections on your loan pursuant to the loan servicing requirements
for this USDA insured loan. It is
important to note that the loan servicing of USDA insured loans requires CMS to
complete monthly inspections on loans that are thirty (30) days or more past
due in order to identify occupancy status and property condition; and to
determine if property preservation is required.
Accordingly, CMS requested property inspections on your loan when the
your showed a past due status. On
November 6, a property inspection was requested, and this inspection was
completed on November 28, 2015. A fee in
the amount of $was assessed to your loan on December 15, 2015. On December 6, another property
inspection was requested, and this inspection was completed on December 28,
2015. A fee in the amount of $was
assessed to your loan on January 29, 2016.
Additionally, our records show
that after the service transfer, the CMS Home Retention Department completed
its review of the approved loan modification in order to continue with the CMS
Loan Servicing System (“CLSS”) changes, and during this review a typographical
error was identified on the signed modification documents. The term date on the modification document
showed May 1, instead of November 1, 2043.
On November 9, 2015, a CMS Home Retention Specialist spoke with you and
informed you of this oversight, and also informed you that CMS was in the
process of correcting the modification document, and the corrected document would
require your signature. Subsequently, on
November 18, the CMS Home Retention Specialist called you to let you know
the corrected loan modification document was completed, and would be
forthcoming to you by federal express mail.
In addition, you were informed that you monthly payment amount would be
$beginning December 1, 2015.
Subsequently, on December 9,
2015, CMS received the corrected signed modification document. That same day, CMS received a payment from
you in the amount of $854.24, and this payment was applied to the suspense
account as the changes to the CLSS had not been completed. CMS completed the CLSS changes on January 6,
2016, and that same day CMS applied your December 1, payment in the amount
of $from suspense
Additionally, our records show
that CMS initially completed an Escrow Analysis on November 20, 2015. This Escrow Analysis was completed as part of
the post service transfer requirements mentioned above. That same day, CMS sent you an Annual Escrow
Account Disclosure Statement (“AEADS”).
A copy is attached for your ease of reference. This AEADS informed you that your monthly
payment would be changing from $to $beginning with your January
1, payment. On January 7, CMS completed
an updated Escrow Analysis due to the loan modification changes that were
completed on your loan on January 6, 2016.
That same day, CMS sent you an Annual Escrow Account Disclosure
Statement (“AEADS”). A copy is attached
for your ease of reference. The updated AEADS
informed you that your payment amount had changed from $to $
beginning with your January 1, payment.
Additionally, on January 7, 2016, CMS received a payment from you in the
amount of $and as this payment was less than the required monthly
payment of $901.27, this payment was applied to suspense. Subsequently, on January 28, CMS
received a payment from you in the amount of $and this sum was combined
with the funds in suspense to complete your January 1, payment. That same day, CMS applied your January 1,
payment from suspense in the amount of $901.27. Attached for your ease of reference is a
payment history that shows your payment transactions from February 1, to
March 4, 2016. As of the date of this
letter, your loan is contractually current and next due for the April 1,
payment in the amount of $
Based on the foregoing, we
conclude that the property inspections were completed in compliance with the loan
servicing requirements of this USDA insured loan, and in accordance with the
terms and conditions of your note. It is
important to note that CMS requested the two property inspections in question
appropriately based on the contractual due date of your loan at the time of
these requests. Nevertheless, we
acknowledge that these property inspections could have been avoided had the
modification been finalized in September with system changes being
completed in October as initially intended, as the contractual due date on
your loan would have changed to December 1, per the approved loan
modification. Therefore, CMS has agreed
to waive the property inspection fees in the amount of $30.00. We would like to take this opportunity not
only to express our sincere apologies for any inconvenience that you may have
experienced in this matter, but also to thank you for bring this matter to
CMS’s attention. CMS is always
interested in how we may improve service levels, and your feedback is
important.

Advocate Department of Carrington Mortgage Services, LLC (“CMS”) is in receipt of your complaint filed with the Revdex.com (“Revdex.com”) regarding the above referenced loan received in our office via e-mail on April 14, CMS is committed to responsible lending and servicing and we would like to address any concerns you may haveThe following is our response to the issue(s) raised in your inquiry
As we understand the complaint, you allege that your loan was recently sold from *** ** ***, N.A(“***”) to CMS and that you did not receive any notification from CMS about the saleYou go on to say that the only notification you received was from *** on March 12, informing you that your loan would be sold in April and that all payments after the sale needed to be sent to CMSAdditionally, you state that as of April 11, you had not received any correspondence from CMS regarding the service transfer or any details on how to make your mortgage paymentConsequently, you proceeded to call CMS and were advised by a CMS representative that the Customer Service Department was not openDuring your phone call, you allege that the CMS representative asked for your phone number and promised to return your callAfter your phone call, you state that you sent an e-mail to CMS asking for your new loan numberLastly, you allege that you never received a call back or a reply to your e-mail and were unable to reach anyone at CMSUltimately, you state that you wish to avoid any late fees and negative credit reporting and that you want to understand why CMS states it is a debt collector
At the outset, please note that the servicing of your loan was transferred from (“***”) to CMS on or about April 2, At the time of the service transfer your loan was contractually current and due for the April 1, payment
Based on a review of your loan, please be advised that CMS sent you a Notice of Servicing Transfer (“Hello Letter”) on April 6, The Hello Letter was sent to your home address at *** *** *** *** ** ***For your reference, a copy of the Hello Letter is attached hereto as Exhibit “A”The purpose of the Hello Letter was to advise you that CMS would start collecting your mortgage loan payments effective April 2, and to advise you that your prior servicer, ***, would no longer accept payments received from you after April 1,
Additionally, the Hello Letter made you aware that, pursuant to federal law, CMS would not assess any type of late fee or report any delinquency for the first sixty (60) days following the effective date of transferAlso included in the Hello Letter was the address to submit the monthly mortgage payments, the address to our Customer Service Department, and the phone number to our Customer Service DepartmentLastly, the Hello Letter also enumerated the various methods available to you for making a payment and it included the processing fee for each method (if applicable), instructions on how to complete your payment, and instructions on how to create your online account on CMS’s website
Subsequently, CMS sent you a Notice of Sale of Ownership of Mortgage Loan (“NSOML”) on April 9, The NSOML was also sent to your home address at *** *** *** *** ** ***For your reference, a copy of the NSOML is attached hereto as Exhibit “B”The purpose of the NSOML was to advise you, as required by federal law, that ownership of the mortgage loan had been sold, transferred or assigned to a new creditorMoreover, the NSOML confirmed that your loan was sold on April 2, and that your new creditor was CMS
Furthermore, the NSOML reminded you that your new servicer was CMS and provided you with a contact number and a scope of responsibilities that CMS would handleLikewise, you were made aware that CMS would handle the ongoing administration of your loan which would include receipt and processing of payments, resolution of payment-related issues, and answering any other inquires you may have regarding your loanAdditionally, the NSOML further explained that the transfer of the lien associated with your loan would be recorded in the public records of the local County Recorder’s office for the county or local jurisdiction where your property is located
We acknowledge that, during the period immediately after the transfer of the loans from ***, CMS experienced an unusually high volume of callsConsequently, although CMS strives to answer all customer calls promptly, customers calling CMS may have occasionally experienced infrequent hold periods longer than we prefer while waiting to speak with a CMS representativePlease know that CMS did everything in its possession to speak with all customers and answer as many calls as possible within a reasonable timeframeNevertheless, CMS understands your frustration and we sincerely apologize for any inconvenience you may have experiencedAdditionally, we believe that the underlying causes for the delays have been resolved and it is unlikely that you will experience similar wait times going forwardOnce again, CMS sincerely apologizes for any inconveniences you may have experienced and we will continue to improve on our services in order to offer a better experience for all of our customers

Terrible businessOur mortgage was sold to carrington and it has been terribleDo not use them for your mortgage needs

How can Carrington Mortgage Services have an A+ rating when 96% of custumer review are Negative? Can Revdex.com answer this question for me?
Bank of America, whom, I've never had a problem with, sold my mortgage to them and I have had problems with this company since from the first month since Carrington took over my mortgageI have two homes and have had other mortgage company's in the pastCarrington Mortgage Services is by far the worst!!!

My Husband and I started working on Loan with Carrington Mortgage on 4/16/and THE NIGHTMARE BEGINS!
My first Loan Officer was Katrine M started working with her on getting all the paperwork together because closing was 5/well this date came and went and the lists kept coming but it was for things they had already been sentGot an extension till 6/and this date came and went with no end in siteDuring this time we could call our loan officer and she would answer the phone but had no information we neededThey would listen to our questions and concerns but then never call us back with resolutionShe had also asked us to do the Appraisal which we paid for but they ordered it, it also needed a foundation inspection which we had to pay forKatrine told us that if it were her she would get this stuff done so everything will be in order in time for closingNot Happening they then brought in another Loan Officer William W
what a guy first trying to get a hold of him was like a act of Congress so I would call Katrine and she would see if he was at his desk , yes he is, I would hang up call him and get his voicemailHe also sent a list for things that had already been sentHe never returned phone calls or emailsAll I can say is BORROWER BEWARE! To get to the point it, July and William called my Husband and told him that we couldn't hold FHA loans so were done!! I can't believe that this company has so many people working for them that don't know their job!!! They cost me ALOT of money including the Ernest money I put down because we got extensions!! There was so much in this month nightmare that went on it nutsI wouldn't want my worst enemy to deal with them

I am trying to pay my mortgage off early, Carrington is making it impossible for me to do so When I see my monthly payments has been received I later send in extra payments to be applied to my principle, however when Carrington receives the payments it's either placed in an unapplied fund, applied to the previous months or treated as a partial payments This is Carrington's way to continue collecting money for the interest On numerous occasions I talked with the Customer Service Representative, *** ***, ID # ***, she told me not to talk with anyone other than her, she would get my problems resolved Now when I call Ms*** refuse to talk to me and will not return any of my calls Ms*** told a representative, *** to tell me the problems has been resolved I told him the problems has not been resolved *** said he would have his supervisor, *** to call me It's been over a week *** has not call me The representative on April 8, said, she

Escrow analyst deficiency notice provides and misleading informationThis year I received my analysis from Carrington in late January stating: "YOUR ESCROW SHORTAGE IS281.20- * * THIS SHORTAGE THAT WILL BECOME PART OF YOUR MONTHLY PAYMENT
WILL BE COLLECTED FOR A PERIOD OF MONTHS FROM March 1, IF YOU CHOOSE TO PAY THE ESCROW SHORTAGE IN FULL IN A LUMP SUM PRIOR TO THE EFFECTIVE PAYMENT DATE, YOUR MONTHLY PAYMENT WILL BE REDUCED BY THE MONTHLY SHORTAGE PAYMENT AMOUNT."
On 2/7/I went online to the Carrington website and paid February's mortgage (and bogus late charges they applied) along with a payment of $directly to my escrow account to cover the deficiency (they have a section on their online payment portal to specify payments for escrow)A few days after paying that bill and deficiency, I receive my March Mortgage statement and as usualmy bill still increased by the amount listed in the analysisI called Carrington, & the rep I spoke to told

THE WORST COMPANY EVER!!!!! Revdex.com they are NOT an A+ company! They have put their customers over a barrel when it comes to making paymentsThey charge $to make an online payment! You HAVE to do automatic payments, oh & to make a payment over the phone $20! RIDICULOUS! I want to pay an escrow shortage & they don't include a payment voucher, because they don't really want you to pay itI have to mail in a check (because I refuse to pay the $phone fee & if I wanted to pay the $fee to pay online I couldn't) & then wait until I see the funds have come out of my account, THEN I have to call them back & have another escrow analysis ran! You would think that when someone pays the shortage they would automatically rerun the escrow analysisHappy customers is not their goal! Chase had our loan before & I miss them terribly! (I am only giving them star because I have to to submit my reviewI give them NO stars!)

I get roughly calls a month stating my payment is late before my due dateNo voicemail messages are left and calls are done by a robo call systemI called them back one time and they stated it was late reminder message even though no voicemail nor email is sent It's becoming harassment

My loan was sold to them and I got the notification on January and my loan payment was due on Feb 1st and I called them to make a payment and they said that they hadnt gotten the info yet to let me make a payment and they would send out a letter with the information, I still hadnt gotten by the 13th of feb so I called them back and they said everything was OK and that I wouldn't be charged a late fee I got the info on the 16th and went on the website to make a payment and set up payments and it had the late fee added I contact them and they claimed the would give me a one time late fee waiver since I was a valued customer Move ahead two months, I get a notification that now if you pay online you will have to pay a dollar service charge unless you sign up for automatic withdrawl I know its not much but I actually preferred chase to these jerks and chase is considered one of the worst companies in America How on earth are they A+ rated????

Carrington Mortgage Services got our loan thru a computer system I belive its abbrivated as MERSAlso they have gone out of there way to keep telling me my documents for a loan modification arent correctNo matter whay angle I go to try and stop my foreclosure they have reasons they can'tI cannot get a single point of contact with anyone in the companyThey don't call out to anyone for missing infoThey refuse any paymentsI looked at getting help and were informed we have the right to file a federal complaint, for how they obtained the loan and how they are handling the loan modificationwe have never had a modification and our debt to income ratio is goodHowever they are pushing us to the point where we lose the house before they will approve the loan modificationI feel they are be untruthfulThey put all blame on us, and have put us off so long we now owe over 6,and they know we dont have that just sitting in our bankThey will not work out payment arrangements

Carrington bought my mortgage from *** in November, and I have called them at least times at about minutes per call, sent faxes, and contacted them through USPS
I was told it would be days before it would be reported to credit agencies, but it took days This negatively impacted my credit score
My monthly payment increased by $because Carrington decided that two months' mortgage - instead of the usual one - is now required for escrow
I was charged $for an unauthorized appraisal
Although I canceled my auto draft the week before the due date and paid my mortgage online for February, my auto draft bank account was still charged; additionally, I was penalized with a $non-sufficient funds fee I was told that my new auto draft account would be active in March, but the old (now closed) account was charged on March 1, and yet another $NSF fee was accrued to my payment
As a result, I can no longer use the auto-draft, online payment

Carrington Mortgage loss drafts dept has been awful to deal withover a month ago I sent in the final check made out to myself and Carrington mortgage for some damage to my home that was covered by insuranceall repairs had been made and inspected by a Carrington mortgage inspector prior to me sending in the check yet they still have not sent the check back to meI am not behind in my mortgage payments or anything along those linesCarrington Mortgage is holding $and i'm not a happy customer
