your account, to allow you the ability to make payments online and over the phone, and to correctly apply all of your payments towards your loan As a preliminary matter, please accept this correspondence as confirmation that CMS does not engage in any type of illegal activity of predatory practicesSpecifically, please know that CMS strives to meet the highest standards of customer satisfaction, abides by all applicable federal and state laws, and does not discriminate against consumers in any protected class With regard to your payment, our records indicate that on June 30, CMS received a payment from you in the amount of $3,At the time that CMS received your payment, your loan was contractually due for the May 1, and June 1, mortgage payments in the amount of $3,along with a late fee balance in the amount of $That same day, CMS applied $1,towards your May 1, mortgage payment and the remainder, $1,625.36, towards your unapplied funds credit balanceRegrettably, due to an request to the appropriate business unit Thereafter, on July 11, 2016, you called CMS to inquire if we had applied your June 1, mortgage payment as you had previously requested during your July 5, phone callThe CMS representative proceeded to confirm that our Cashiering Department would credit your payment and that our office would also perform any necessary corrective action to ensure that your credit report would not be adversely impacted due to CMS’s inadvertent clerical error On July 15, 2016, you again called CMS to inquire if we had applied your June 1, mortgage paymentDuring this phone conversation, the CMS representative confirmed that our Cashiering Department was still working on your request and reassured you that your payment would be applied to your accountWe note that during this call, you advised the representative of your intent to make your July 1, mortgage payment and that the representative offered to process your payment and waive the pay-by-phone feeNotwithstanding the representative’s offer to waive the pay-by-phone fee, our records indicate that you elected to reject the offer and wait until CMS applied your June 1, mortgage payment before authorizing your July 1, mortgage payment On July 18, 2016, CMS applied your unapplied funds credit balance to your June 1, mortgage payment in the amount of $1,and to your late fee balance in the amount of $with a payment effective date of June 30, That same day, CMS also made certain that your credit report would not be adversely impacted by a thirty (30) day delinquency for the June 1, mortgage payment We would like to take this opportunity to remind you that all of your mortgage payments are due on the first (1st) day of each month, and are considered late as of the second (2nd) day of the monthIf the payment is not received by CMS on or before the sixteenth (16th) day of the month, a late fee will be assessed to your accountAlso, any payment received by CMS after the month in which the payment became due may be reported to the credit reporting agencies as delinquent As it pertains to your concern that CMS locked your online account which prevented you from processing The Customer Advocate Department of Carrington Mortgage Services, LLC (“CMS”) is in receipt of your complaint filed with the Revdex.com and received in our office via email on May 4, 2015. CMS is committed to responsible lending and servicing and we would like to address any concerns you may have The following is our response to the issue(s) raised in your inquiry
As we understand your complaint, you claim that after the service transfer, CMS sent you a billing statement with incorrect amounts due, and when you contacted CMS to inquire about the amount due on the billing statement, CMS informed you that the fees reflected on the billing statement were fees that were assessed by the prior servicer You indicate that you contacted the prior servicer who informed you that all your outstanding fees and late charges had been waived prior to the service transfer. In addition, you claim that the monthly payment amount on the loan should be $1,not the amount being billed by CMS of $1,213.66. You further state that you have faxed CMS documentation to support your claims; however, CMS has informed you that your fax has not been received.
At the outset, please note that the servicing of this Veterans Administration (“VA”) insured loan was transferred from *** ** *** *** (“***”) to CMS on April 2, 2015. At the time of the service transfer the loan was showing contractually delinquent and due for the March 1, payment.
Please note that, while CMS began servicing the loan on April 2, 2014, the Real Estate Settlement Procedures Act (“RESPA”) at USC 2605(d) prevents CMS from treating any payment as late for any purposes until the expiration of sixty days after the effective date of the servicing acquisition. This sixty day period is specifically intended to allow the acquiring servicer the necessary time to receive the acquisition file from the prior servicer and to ensure the records of the acquiring servicer reflect the correct loan information. Included in that process are the reviews and complete post-transfer diligence and escrow analysis that are due within sixty days of the acquired date.
Upon review, our records show that at the time of the service transfer the loan had an outstanding principal balance of $140,747.50, a corporate advance balance amount due of $210.75, late fees due in the amount of $524.16, a suspense credit balance of $48.34, and a monthly payment amount of $1,213.66. Please note that your monthly payment amount has not changed and has been in effect since May 2014. Attached is a payment history that shows the payment transactions on your loan at the time of the service transfer and thereafter through the date of this letter. Also, attached is a copy of the payment history that was provided to you by *** on April 29, which outlines the details of the late fees and property inspection fees assessed to your loan. It is important to note that these fees have been assessed to your loan on the month when a payment was not received within the grace period and are reflected in the payment history which clearly shows these fees have been assessed to your loan in a consistent fashion since May 2013. In addition, due to the past due status of your loan, property inspections were also performed and subsequently these inspection fees were also assessed to your loan.
On April 16, 2015, CMS received your March 1, payment in the amount of $1,213.66. On May 20, 2015, an escrow analysis was completed which resulted in a payment change from $1,to $1, beginning July 1, and a copy of this analysis is attached for ease of reference. On April 28, 2015, CMS received your payment in the amount of $1,which was applied to the April 1, payment in the amount of $1,and $to late fees. On April 29, 2015, you contacted CMS to inquire about the $amount due in fees. During this call, the CMS representative explained the amount in question was for property inspection fees at which time you disputed these fees and indicated you would be sending CMS a request to provide you a breakdown of the fees due. On May 21, 2015, you contacted CMS in response to a call made to you regarding your past due May 1, payment and you informed the CMS representative that your payment would be paid by the following Tuesday. Subsequently, on May 25, 2015, your payment in the amount of $1,was received and applied to your May 1, payment. As of today’s date, your loan is contractually current and due for the June 1, payment
Based on the foregoing, we conclude that the aforementioned amounts due on your loan that are also reflected on the CMS billing statements dated April 16, and May 18, are accurate, due and payable In preparing this response, we also contacted B of A and confirmed that the fees in question had not in fact been waived

Per the response from Carrington Mortgage Services (CMS), the day that rent is due I am able to add additional principle to my monthly mortgage payment. Also, per the response from CMS, my rent is due on the 1st of every month with a day grace period. Attached is a screenshot displaying my payment options for today 10/1/2015. As can be seen from the attached screenshot, I am currently unable to pay any additional principle towards my mortgage. I believe that this clearly demonstrates that CMS has not complied with my request, and the information that was provided in their response is inaccurate.Additionally, if the information provided in the CMS response message is accurate, I question why this information was not made available to the associate I spoke with previously on the phone so that the situation could have been explained to me then instead of having to go through this entire process. I'm sure many people have this same issue, so providing this level of information to the appropriate CMS personnel would save everyone a lot of time and trouble

Carrington Mortgage services I have had no issues with this company till now they stared charging for online payments so I set up auto draft this was only free way do make payment online .The 1st auto draft did not work right house payment was not paid on time I know this as soon as I found out I called and made the payment I have paid years always pay 1st day payment is due .I talked to customer care they said yes we see what happened don't worry your payment history is great well not only charged me late fee but reported me to credit services - points on my credit rating .I know they have the right to do what they did but you cant make even one mistake ? and that happened when I was responding to your request to set up auto pay .That is not very good customer service and the only contact I ever had with you guys has to be like this at this point if some as me I would not give a positive review

Since our mortgage was purchased by Carrington they have called us repeatedly trying to get us to refinance our mortgageOur separate occasions my wife and I have both listened to their pitch and both told them they we would rather not refinanceHowever, they continue to call constantlyI have asked them to quit calling us and was told there was nothing they could do about it and that they would keep callingWe've begun to block the phone numbers they call from and they've started mailing us with the same offer as the phone callsYesterday they called my mother-in-law trying to reach usMy mother-in-law is in no way associated with my mortgage and her name and information was never provided as a contact person or otherwise in regards to our home purchaseWe have never missed or been late on a mortgage payment, but we are being treated as though we are irresponsible customers by getting bombarded with phone calls, mailings and now getting other family members involved

Carrington acknowledged that they received a refund for over payment of property taxes on my behalfThey issued me a check for $in August of The check was incorrectly made out to Carrington Mortgage instead of meThey asked me to return the check to them so they could issue a new oneI November, I received the replacement check, but it was also made out to Carrington MortgageI was again asked to return the check to themThis time they stamped it with their endorsement and returned it to meI was now able to deposit the into my bank accountBefore it cleared, Carrington issued a stop payment, and the funds were returned to themI had spuratic contact via email, but now I'm being told to contact customer service againI've told my story to half a dozen different customer service representatives thereI really don't want to start over againI would like my money or at the very least, why they issued a stop payment on the check

The *** *** Department of Carrington Mortgage Services, LLC (“CMS”) is in receipt of a complaint filed with the Revdex.com (“Revdex.com”) regarding the above-referenced loan received in our office via email on July 18, CMS is committed to responsible lending and servicing and we would like to address any concerns you may haveThe following is our response to the issue(s) raised in the inquiry
As you are aware, our Customer Advocacy Department originally received an inquiry from you via the Revdex.com on July 13, which raises the same issues as this complaintAccordingly, the loan was researched and a response was sent to you by CMS on August 4, While the August 4, complaint response has provided you with twenty-six pages of documents to support CMS’s response to you, CMS is not providing another copy of the documents that are immaterial to your most recent complaint in an effort to avoid unnecessary duplication of efforts
As we understand this most recent complaint, you state that CMS’s August 4, response to you did not resolve all of your concernsYou reiterate that if you were aware that your mortgage payments increased by $28.00, you would have submitted the full contractual payments to CMS, and you also claim that based on your loan payment history you have never paid a late mortgage payment to CMSYou claim that CMS has reported incorrect information to the credit bureaus indicating that CMS received payments after the month in which the payments became dueYou also state that CMS never contacted you to notify you of the payments that you made that were less than the full contractual paymentsFinally, you state that you will not be fully satisfied with CMS until the derogatory information is removed from your credit profile
Please be advised that CMS is unable to comment on whether or not you personally received or viewed the October 28, escrow analysis upon its delivery to your correct mailing addressHowever, CMS respectfully submits that CMS properly notified you of the increase to your mortgage payment from $to $effective with the December 1, mortgage payment by issuing you the attached escrow analysis on October 28,
Contrary to your claim that you have never made a late mortgage payment to CMS, our records show that CMS did not receive your full contractual payment for December 1, until January 8, 2015, did not receive your full contractual January 1, payment until February 9, and did not receive your full contractual February 1, payment until March 9,
Your loan payment history that was previously provided to you within the August 4, response letter supports the above referenced information and further shows that CMS did not receive your full March 1, mortgage payment until April 9, or your full April 1, mortgage payment until May 13, Regretfully, the fact is that CMS was not in receipt of your full contractual payment within the same month that each of the above referenced mortgage payments became dueIt is important to note that credit reporting is based upon the date that CMS receives the full contractual payments due and is not based upon the date that a partial payment may have been received by CMS
Although CMS is not required to contact you to notify you that the payments received from you were less than the full contractual payment amount, CMS typically attempts to contact borrowers in an attempt to secure mortgage payments during the month that the payment became due
As you have been previously notified, CMS is obligated by federal law to provide timely and accurate credit reporting in regard to the current loan status, payment history and loan informationWe have determined that the information reported to the major credit bureaus properly reflects your payment history and loan informationWe are, therefore, unable to make the requested changes to the reported information
After a thorough review of your most recent correspondence, CMS is unable to identify any new issues that have not been previously addressed in detail by CMS as your most recent hand written correspondence appears to be substantially similar, or even identical to, correspondence previously addressed by CMSAccordingly, no further response from CMS is requiredMoreover, because we have now addressed these issues on multiple occasions, CMS will not respond to future correspondence raising substantially the same or identical claims
Based on the foregoing, we believe the record is clear that CMS did in fact issue you an escrow analysis on October 28, that notified you of the payment increase from $to $effective with the December 1, mortgage paymentIt is also clear that CMS has properly reported accurate loan and payment information to the credit bureausShould you wish to further discuss any aspect of your loan, we encourage you to contact our Customer Service Department at *** *** for further assistance

I got a statement that I owed Carrington on a mortgageI informed them that another bank had foreclosed without adding 129,dollars and you cannot transfer a deed to secure debt after the factAll of the documentation from Carrington says this is a FHA mortgageI have email from FHA that says it is not an FHA mortgageThey keep the 129,dollars,sold the property for 54,then sent me a for205,dollarsThe last letter I received stated that I didn't owe them any monies and apologized for their mistake but refused to take it off my creditIf it was foreclosed on by another bank they should send me the as foreclosureThe Carrington sent says the property was abandonedI am not going to pat income tax on 205,I want the gone and the debt off my credit

Carrington Mortgages holds my mortgageThe company double payed my escrow account and recalculated my payment using this estimateThey failed to notify me of any payment change, until sending me a "late payment notice" because my payment was not the full (new) amountUpon calling they realized the mistake and were supposed to fix itI called again the next week and it wasn't fixedI have spoken to them more than five times and promised a fixFinally, they fixed the payment issue that was showing me a month behind on my billThey left a late charge on my account and have told me each month it would get removedThe account still has the late charge and they have only empty promises of removing it
