filed with the Revdex.com (“Revdex.com”) received in our office via email
on March 25, 2015. CMS is committed to
responsible lending and servicing and we would like to address any concerns you
may have. The following is our response
to the issue(s) raised in your inquiry
As we understand your complaint, you claim that you were pre-qualified
for a mortgage loan by CMS to purchase a condo and that the closing was
scheduled in January 2015. You further
state that the Loan Officer, *** *** asked you to obtain a thirty (30)
day extension to close as there were some problems with your credit. You state that the closing was extended to
March 31, 2015; however, you express concerns with the credit problems raised
by CMS since the debt in question was already on your credit report when you
initially applied and nothing had changed since then. In addition, you allege that the Ms***
and *** *** would not respond to your emails or answer your calls, and that
as of April 2, 2014, your loan application process stopped costing you $12,000.00. Lastly, you claim that you called the CMS
Corporate offices but those calls have not been answered either
Upon review, our records show that on October 29, 2014, contact
was made with Ms*** *** at which time you discussed your desire to
purchase a condo in the amount of $345,and wanted to apply for a
mortgage loan with CMS. Upon review of
your credit report and score, Ms*** informed you that you would not
qualify because your debt to income (“DTI”) ratio was too high and your credit
score was too low. In addition, the
Homeowner’s Association (“HOA”) for this condominium complex was not Federal
Housing Administration (“FHA”) approved; therefore, you would need to qualify
for a conventional loan
On November 10, 2014, you informed Ms*** that you
had paid down some of your credit debt. On
December 8, 2014, Ms*** obtained an updated credit report and found that
two of the credit cards that you had paid down had not been updated, affecting
your overall credit score. Also, your
DTI ratio was still too high to obtain a pre-qualification at that time. On December 21, 2014, contact was made with
Ms*** and you informed her that you would be getting a raise at work and
that you had paid down two more credit cards
On January 15, 2015, you notified Ms*** that you had
received the expected raise at work. Therefore,
on January 25, 2015, Ms*** obtained an updated report and the results
showed a credit score high enough to meet a conventional loan minimum
standard. Subsequently, Ms*** provided
you a pre-qualification letter. This pre-qualification
letter outlined the terms and conditions of the pre-qualification, and also
requested documentation needed to complete your application to submit to
underwriting for review and disposition.
A copy of this letter is attached for ease of reference
On February 17, the final
missing items were received from you. On
February 18, 2015, the closing date was extended to March 6, 2015. On February 22, 2015, the file was referred
to underwriting for review and processing.
On March 5, 2015, the underwriter identified an issue with a creditor
(Ford) who had updated their credit reporting in November 2014. You claimed that this debt should have been
discharged with your prior bankruptcy in and you began to work with this
creditor to make the necessary changes to the credit reporting. Additionally, an extension to close was granted
to March 31,
On March 25, 2015, Ms***
was informed that Ford had declined your request to change how the account was
being reported. Ms*** and Mr***
requested that the underwriting team approve an exception on your loan application;
however, this request was declined due to conventional loan lending guidelines.
On March 27, 2015, Ms***
researched other possible financing options for you. Ms*** contacted the director of the HOA
for the condominium complex to ask if they were interested in obtaining FHA
approval. They responded that they were
interested and therefore began the processMs*** then processed your
application using an automatic loan underwriting system under FHA lending
guidelines and the results showed an eligible approval. On that same day, Ms*** contacted you
and your agent and explained the credit issues and that because the request for
an exception had been declined CMS could not move forward with your application
for a conventional loan. Ms***
also discussed the FHA loan option with you; however the FHA loan option would
require an extension to close. Mr
*** also talked to your realtor to explain the situation and offer alternatives.
On March 30, 2015, Ms***
spoke with you once again and reiterated that based on the current credit
report a conventional loan was not possible; however, she once again offered
the possibility of an FHA loan as an alternative but you did not want to
proceed with that option. Subsequently,
your conventional loan application was denied
Based on the foregoing, we
believe the record is clear that CMS has diligently assisted you in processing
your loan application to obtain a mortgage loan through CMS although CMS was
unable to grant a favorable decision on your conventional loan application due
to a credit issue that you were unable to
clear. Lastly, our review found
no evidence to support your claim that CMS Corporate office did not respond to
your calls or telephone message regarding this matter.

If your loan gets bought buy Carrington do yourself a favor and refinance now!!! They will not honor assessed or appraised home value paper work to drop your PMI instead using only the loan to value ratio on record Second they do not record your positive payments to any credit recording agency therefore your credit rating suffers Finally, if you call them with a question you will not get an answer, the people who answer the phones are strictly call takers who know nothing about mortgages, in other words don't waste your time Refinance with anyone else as soon as possible

For the past year I have been able to use an existing saved bank account to pay my mortgage Last month when I went to pay the save account was not there and I had to re-key in my information in order to pay that months mortgage A letter was mailed days after making my payment, not received, telling me that it was the wrong account number Every indication from their site and confirmation stated that the last digits were correct and the Bank routing was correct so I had no idea that what I entered was incorrect Now of course my mortgage payment is late and I am being charged a late fee This part I wouldn't mind so much if I didn't know that my credit and my ability to refinance with another mortgage company was being affected There was no call or email to let me know this was the case however their refinance team calls me times a day to see if I will refinance with them and leaves a message

I used my billpay feature at *** ** *** (***) to pay my mortgage I requested a delivery date of 6/13/in time to have it paid prior to late fees being charge The bank issued the payment on 6/it cleared 6/On 6/I received notice from Carrington (CMS) that my payment was not received and late fees assessed I called themThey needed a fax which I do not have My bank sent the fax on my behalf I called CMS back they informed me that bill pay only indicates that the bank removed the funds from my account not that the payment was received by them I called *** back - *** called Carrington and conferenced me in *** confirmed with CMS the check was endorsed and that Carrington received the fax of front and back CMS insisted it would take time to days to research but could be expedited by my providing my bank statementI refused as they should not need my statement when they have the cancelled check They also said if pymt was not made by 6/they would rep

As we understand your complaint, you are concerned regarding negative credit actions taken by CMS in connection with the receipt and application of making bi-monthly payments from your financial institutionYou stated that you initially spoke with a Customer Service Agent and were advised that sending bi-weekly payments was not a preferred method; however, that it was allowedDuring the same conversation you allege the ramifications of sending payments in bi-weekly were not addressed during the conversationYour desired resolution is to confirm there was no negative impact to your credit for submitting bi-monthly payments to CMS
We have completed a review of the loan, and our records indicate a complaint was received by our Customer Research Department on August 27, disputing negative reporting as a result of submitting bi-weekly payments to CMSAccordingly the loan was researched and a response was issued on September 15, which advised the above-referenced loan reported to the credit reporting agencies (***, *** and ***) as “current” in August For your ease of reference, I have included a copy of the response issued to you by the Customer Research Department on September 15,
On August 3, 2015, our records indicate you spoke with a Customer Service Representative who addressed the application of partial payments received to your loanDuring the conversation with our agent, you were advised that the payment you made on June 25, was inadvertently applied incorrectlyThat same day, CMS corrected the error and applied your payment using the effective dates CMS received full payments and no late charges were assessed to your account
In addition, you were notified that credit reporting must be suppressed for sixty (60) days from the date you filed a notice of error on August 26, Therefore, CMS has not reported the receipt of the August 1, payment as of the date of this letterHowever, since our records indicate your loan paid in full on September 15, 2015, CMS will report your loan to the credit agencies on October 10, with a final status as “paid in full” and “current.”
In closing, we sincerely apologize for any miscommunication in your initial conversation with our agent in regard to the submission of bi-weekly payments from your financial institution to CMSOur records conclude there has been no negative impact to your credit report and all payments you made were applied to your loan accurately using the effective dates payments were received

After reading other reviews, I was scared silly when Chase sold my mortgage to CarringtonHowever, I have been immensely please with Carrington so farI have not had to deal with customer service so I can't speak to that aspect, but Carrington allows me to pay online, allows me to direct additional funds to either principal or escrow, and the most recent escrow analysis reduced my monthly payment by about $10/mo
My advice is to just make your payments on timeCarrington is a mortgage servicer and just wants the payments to be made as promised in your loan agreement

My mortgage was bought buy Carrington mortgage services (CMS) from *** ** *** in feb/mar The escrow analysis was done incorrectly not once, but twice The first time around some one from CMS placed an extra zero on a tax bill analysis so I had to pay more until this corrected After the second analysis they left a tax bill off all together At least now though my monthly payments are correct, even though I have to now pay that tax bill with out utilizing the escrow Every time you call their customer service department you can't get anywhere I'm in the process of moving my mortgage to another company RUN, don't walk, from this company!

As a preliminary matter, please note that our Customer Service Research Department originally received an inquiry from you on June 8, which raised the exact same issues as this current complaintAccordingly, CMS researched the loan and a response was sent to you on June 30, 2015. For your ease of reference, attached hereto please find a copy of CMS’s response dated July 30,
We regret that you were dissatisfied with our initial response to your inquiry. CMS is committed to the highest standards of customer satisfaction and professionalism. For this reason, we take all legitimate complaints regarding the conduct of our business very seriously. Although we understand you are not pleased with the outcome, your inquiry was investigated fairly and we believe it was resolved appropriately.
Nevertheless, solely as an expression of our commitment to the highest standards of customer satisfaction, we would like to take this opportunity to clarify and address any outstanding concerns in this matter.
At the outset, please note that the servicing of this Federal Housing Administration (“FHA”) insured loan was transferred from Bank of America N.A(“BOA”) to CMS on or about April 2, 2015. At the time of the service transfer your loan was showing due for the April 1, payment.
Upon further review, our records show that on April 8, 2015, CMS received a payment in the amount of $1,which was applied to the April 1, payment. After the application of this payment the interest on your loan was paid through March 31, 2015. It is important to note that the interest on the loan payment is paid one month in arrears on this mortgage loan.
On May 5, 2015, CMS received a request for a payoff statement and on May 7, 2015, a payoff statement was generated and sent to your attention which provided a payoff amount of $139,good through June 1, 2015. The payoff statement also includes an explanation regarding the interest due and payable on FHA loans. The disclosure is outlined on page two of the statement under; “Important Notice for FHA Loans”, and below are the details for ease of reference:
This is to advise you of the procedure which will be followed to accomplish a full prepayment of your mortgage. Carrington Mortgage Services, LLC will accept the prepayment (without penalty) whenever tendered with interest paid to the first day of the month following the date prepayment is received. Prepayments received after the installment due date (the first day of the month) must include interest to the next installment due date. For example, if the next installment due date is December 1; prepayments received after the installment due date (the first day of the month) must include interest to the next installment due date. For example, if the next installment due date is December 1; prepayments received on or after November will need to include interest to December 1.
Please note that unlike principal (which is paid in the current month’s mortgage payment), interest earned by the mortgagee the previous month must be paid in the next month’s mortgage payment since the interest must be earned by the mortgagee before it is owed by the mortgagor; and the interest being charged to the next installment due date with regard to repayments is, in fact, interest that was earned the previous month and has yet to be paid by the mortgagor.
A copy of the payoff statement is also attached for ease of reference. On May 12, 2015, the payoff was received and applied to your loan in the amount of $139,522.39. Below is a summary of how these funds were applied. The interest amount of $1,represented interest due from April 1, through May 31, 2015.

This company has a TERRIBLE practice of soliciting unwanted services! I have been called no less than 25-times since Chase sold my account to Carrington for offers to refinance My number is on the Do Not Call Registry, I have asked not to be called, and have also emailed them and asked not to be contacted anymore--several times! They continue to contact me! This is SO SO ANNOYING! I have filed a complaint with the FCC and my State Attorney General and plan on filing whatever other complaints I can until this stops! Apparently these people are to stupid to understand STOP!

I did not ask this company for a Mortgage I was as many transferred by Bank of America They have terrible customer service My home insurance and taxes went down and they continued to raise my mortgage until I contacted the Consumer Financial Protection Bureau and wage a complaint and then adjusted my account and sent me the credit amount in a check They took it personal and retaliated treating me as a rival and not a customer by slandering me personally in their response thru the consumer financial protection bureau If you need help concerning them contact the Consumer Financial Protection Bureau asap!!! My complaint thru CFPB helped me get my payment where it was suppose to be and get the extra monies back Carrington is horrible!!!!!
