We have reached out to the customer and have arrived at a mututally agreeable resolution to this complaint.

Please enter your reason(s) for rejecting the business response below.Ms. [redacted] contends that the pledged collateral was no longer mine to retrieve. However, accepting payment for pledged collateral that has been taken after forfeiture is a violation of the Texas Administrative Code and Cash America accepted payment for the collateral on the date in question. The Texas Administrative Code holds that when the option to take pledged goods is exercised, the the property is not eligible to be returned to the pledgor. In our situation, Cash America employees accepted payment for the pledged property after running a NICS check with the FBI for the firearms. If it is in fact the position of Cash America that it exercised the option to take the pledged goods and then offered them for redemption, that is a clear violation of the Texas Administrative Code referenced below:"Documentation of the date that pledged goods have been forfeited and have become the property of the pawnshop must be made in the numerical pawn ticket file or in the electronic records. When the option is exercised to take pledged goods as the pawnshop's property, the property is not eligible to be returned to pledged goods status until another disposition of the property is made (e.g., sale, layaway). If goods have not been taken into inventory and documented, the pawn transaction is still considered an open pawn transaction even if the grace period has expired. The pledged goods on any open pawn transaction may be redeemed by payment of the amount financed and pawn service charges accrued to the actual date of redemption." 7 Tex Admin Code § 85.414.The code clearly indicates that this was either still an open transaction or Cash America violated the Texas Administrative Code. She may choose which position to take.  A further violation was committed when the Cash America accepted payment for the pledged goods and the goods were not in the condition they were when they were accepted unless Cash America had only taken the collateral and returned it in violation of the aforementioned provision. The relevant section of the administrative code prohibiting return of collateral in damaged condition is set forth below:"Any payment may not be accepted from the pledgor and the original pawn ticket must be returned when pledged goods are: damaged and not restored to the condition at the time pledged." 7 Tex Admin Code § 85.413(b). Therefore, the condition of the guns is far from a mute point as Ms. [redacted] contends, but, perhaps, more properly the subject matter of an administrative complaint to be filed with the OCCC should Cash America dismiss this matter as trivial.

MESSAGE FROM BUSINESS:Dear Ms.  [redacted]The last day of grace on Mr. [redacted] loans was May 23, 2015.  Therefore on May 24, 2015 ownership of the guns transferred to Cash America. by operation of law.  As a courtesy to Mr. [redacted] the shop held onto the guns for several weeks.  If any person made a phone call to Mr. [redacted] it was a courtesy call.  The condition of the guns at the time Mr. [redacted] came to pick them up is a mute point since he  no longer owned them.  However, as stated before, it is common for guns to sustain superficial rust when stored after not being properly cleaned and oiled.Sincerely,R[redacted]

I told her that when she call me I old her I want the chain that I paid for! its no way I would have put that chain layway! with cross. ask cash america to give me the chain that I put in layway! I believe [redacted] switch the chain because I told him about my rings. that was stolen! and they are in his show case. !i would accept another chain but not 80.00! that is what she offered me. I want another chain. Thank you so much! please help me! ghe chain was thicker much heavier. that was not my chain!
