Reporting Act (FCRA) allows ChexSystems, a consumer reporting agency, to report a consumer's name in connection with the information contained on our files.  We have repeatedly explained that ChexSystems is a nationwide specialty consumer reporting agency under the federal Fair Credit Reporting Act (FCRA). ChexSystems provides services to financial institutions and other types of companies that have a permissible purpose under the FCRA. ChexSystems' services primarily assist its clients in assessing the risk of opening new accounts.   As such, contracts for ChexSystems’ services are with financial institutions and companies with a permissible purpose; ChexSystems does not have contracts with individual consumers.  We have also informed the consumer that we have initiated investigations with Citibank and Bank of America based on disputes included in complaints filed with another agency and we will notify him of the results of the investigations when they are complete.  In order for ChexSystems to properly identify all of the information in his file and provide the consumer with a complete copy of his consumer disclosure report, we must receive his full nine-digit Social Security number, driver's license number and state of issuance, date of birth, and any other addresses or other names he has used within the past five years.

Our records indicate that the consumer called again on March 8, 2016, and informed us that he had not received his consumer disclosure report. Due to a clerical oversight the representative informed him that a second report was mailed to him on March 8, 2016, but that was not the case. The report had, in fact, been mailed to him on March 4, 2016. Another copy of his consumer disclosure report has been mailed to the consumer today, March 10, 2016.

complaint.  As is our standard practice when a consumer dispute is received, ChexSystems placed the reported information in a disputed status and sent a letter to notify the consumer of our intent to investigate.  We notified the reporting financial institution of the dispute and requested that they investigate the accuracy of the information they submitted.  The financial institution responded to ChexSystems and verified the disputed information to be accurate as reported.  ChexSystems mailed a letter to notify the consumer of the results of the investigation.  The letter informed the consumer that the financial institution requested he contact them to obtain additional account information and provided a telephone number for them. The letter also explained that if requested by the consumer, ChexSystems will provide a description of the procedure used to determine the accuracy of the disputed information in his file and that he is entitled to request and receive the business name, address and, if reasonably available, the telephone number, of any furnisher of information contacted in connection with the investigation.  Finally, the letter explained that he is entitled to add a statement to his file disputing the accuracy or completeness of the information and provided instructions on how he could submit a statement should he wish to do so.  Reported information is retained on ChexSystems files for a period of five years unless the source of the information requests its removal prior t that time or ChexSystems becomes obligated to remove it under applicable law or policy.  Please note that the disputed information is dated in September 2011, therefore, is due to purge our files next month.

filed with the Consumer Financial Protection Bureau, we contacted Wilmington Savings Fund Society to request that they investigate the accuracy of the information they submitted to us.   The financial institution verified the disputed information to be accurate, and requested that the consumer contact them directly should he wish to pursue this matter directly with them.  Wilmington Savings Fund Society confirmed that the consumer had filed a claim with them and they investigated it but did not deem it as fraud.  They forwarded a copy of the signature card, statements, and deposits to ChexSystems and the documentation was provided in our correspondence to the consumer.  We also informed him that should he wish ChexSystems to pursue the matter further, we must first receive a copy of a valid police report to support his claim.  As of this date, ChexSystems has not received a police report from the consumer.
