Chex Systems, Inc. (Chex) has reviewed this complaint. Our records indicate that we have initiated three investigations of the information previously submitted by Woodforest National Bank (the bank).  The first in 6/17 after having been informed of the dispute through a complaint submitted...

to the cfpb, the second in 7/17, and the third in 8/17 upon receipt of communications directly from the consumer.  On all three occasions, the bank verified the information to be accurate and in 8/17 they provided a copy of the signature for the consumer's review.  Since that time, the account information previously submitted by the bank has been removed from the consumer's file because the retention period has expired.  The only names currently listed in the consumer's file are variations of the name he has provided.  We show his first, middle and last name, his first name, middle initial and last name, and his first and last name.  Our records did previously include a name variation with a different middle initial, however, that name variation was removed based on a dispute previously received from the consumer. The disputed address information is associated with disputed inquiries, which have previously been verified by the source to be accurate.  Chex has explained to the consumer that in accordance with the FCRA, he may provide a copy of a valid police report that clearly supports his claim of identity theft or fraud.  Once we have received the police report, we will be happy to review the situation further to determine if the disputed information can be removed based on the police report.  As of this date, Chex has not received a police report from the consumer. Chex has recently received notice of a dispute of inquiries on the consumer's file from a reseller, Factor Trust, and an investigation of the disputed inquiries has been initiated.  Chex will respond to the reseller and they will notify the consumer once the investigation is complete.

I am rejecting this response because:
The name on the bill from [redacted] is not mines and they stated is was paid. Chexsystems is attempted dishonest unethical charges. There is nothing owed to [redacted]. They are not truthful and have bad intentions. I want this removed from my report immediately. I need to see proof with my name on the goddaughter account I reference. They lied. I had to get an attorney request the bill from [redacted] and it’s paid and it’s nit even my name on it.

Chex Systems, Inc. (ChexSystems) has reviewed the complaint filed by this consumer. Our records indicate that we have received multiple communications from the consumer dating back several years. The most recent communication from the consumer did include a dispute of information stating that...

there were multiple inquiries on her consumer file that were not factual and she requested they be removed, however, it did not specify which inquiry information was disputed. Included with the dispute was a copy of a police report listing several companies with which the consumer disputed having attempted to do business. The consumer also requested that a security freeze be placed on her consumer file. ChexSystems placed the security freeze as she requested and mailed a letter to the consumer confirming that action had been taken. ChexSystems also mailed a letter to inform the consumer that we have no record of inquiries made by the companies listed in the police report. A copy of her consumer disclosure report was included with the letter. If the consumer disputes any of the information contained in her consumer file she may submit a dispute to us. She may submit her dispute by visiting our website at www.chexsystems.com, by mail at the address listed in the letterhead of the correspondence she has received from us, or by fax at ###-###-####. We ask that she provide the specific nature of the dispute and that she identify the item(s) being disputed. Under normal circumstances, investigations are completed within approximately thirty days (twenty one days for residents of Maine). If the consumer believes the disputed information is a result of identity theft, we suggest that she obtain a new or an amended police report to include reference of the disputed information contained in her ChexSystems file. Once we have received the dispute and/or the new or amended police report we will inform the consumer of any additional actions taken.

intent to initiate an investigation.  We notified Bank of America of the consumer's dispute and requested that they investigate the accuracy and completeness of the information they submitted to us.  Bank of America responded and verified the account information they reported to be accurate. In addition, Bank of America Missouri informed us that the account was closed based on account activity without a monetary loss.   Therefore, the date the account was closed was added as a Settled in Full date to the reported information.  This status does not negate the reporting of the account to ChexSystems and is intended only to reflect that no original charge off amount was reported.  ChexSystems mailed a letter to notify the consumer of the results of the investigation and included contact information provided by Bank of America Missouri should the consumer wish to contact them to obtain additional information.

By submitting his personal information to ChexSystems, the consumer acknowledges his agreement to provide accurate identifying information and his understanding that ChexSystems may access, store, and use this information to the extent permitted by law. A copy of his consumer disclosure report will be mailed to the consumer within five business days of our receipt of his request. Once the consumer receives a copy of his consumer disclosure report, if he disputes any information contained in his file he has the right to submit a dispute directly to the source of the information. However, if he prefers ChexSystems will be happy to contact the source on his behalf to initiate an investigation. He may submit a dispute using the website referenced aboove, or in writing at the address or fax number listed above. He may also contact our office by calling [redacted] and selecting the option to speak with a representative. We ask that he provide the specific nature of his dispute as well as a description of the item being disputed. consumer disclosure report was mailed to the consumer at the address he provided on May 5, 2016.  The consumer's report contains no reported information or record of inquiries made.  We can only suggest that he contact the financial institution that declined his account to determine why that decision was made.

requests were received via our website. The first was received February 20, 2011 and the report was mailed to him on February 23, 2015. The second was received on April 5, 2015 and the report was mailed to him on April 6, 2015. The third was received June 8, 2015 and the report was mailed to him the same day. All reports were mailed to the addresses the consumer provided at the time of the requests.

I do appreciate the response. Unfortunately though I have not received anything since the request in 02/2011. Address provided on the most recent requests in 2015 was accurate.
If records indicate that a report was mailed on "February 23, 2015" and "April 5, 2015" then we also have a concern regarding disclosure of personal identifiable information without my direct authorization - simply said - if no report came to me then I am curious as to who you did send it to.
