Chex Systems, Inc. (ChexSystems) has reviewed the follow up complaint filed by this consumer.  ChexSystems has not refused to resolve the matter as claimed in the consumer’s complaint.  In accordance with the requirements of the Federal Fair Credit Reporting Act (FCRA), ChexSystems notified Wilmington Savings Fund Society of the consumer’s dispute and requested that they investigate the accuracy of the information they submitted to us.   The financial institution not only verified the disputed information to be accurate, but confirmed that the consumer had filed a claim with them and they investigated it but did not deem it as fraud, and provided copies of documentation to support their reporting in the form of copies of the signature card, statements, and deposits.  Although the reporting financial institution verified the reported information to be accurate, in accordance with the FCRA, ChexSystems informed the consumer that should he wish ChexSystems to pursue the matter further, we must first receive a copy of a valid police report to support his claim.  A law enforcement agency does not require the victim of identity theft or fraud to know who committed the fraud in order to file a police report.  If the consumer sends a police report to ChexSystems that clearly supports his claim of identity theft or fraud on the account reported by Wilmington Savings Fund Society, the disputed account information will be removed.  Otherwise, it is ChexSystems policy to retain reported information for a period of five years from the report date unless the source of the information requests its removal or ChexSystems becomes obligated to remove it under applicable law.

providing this service Chex abides by the requirements of the FCRA and any applicable state statutes.  Chex neither approves nor declines accounts for our clients.  The decision to open an account is entirely up to an institution and its policies.  In response to an inquiry made by a client, Chex may return a message of approve or decline on the screen but the message is based on the parameters chosen by the financial institution based on their policies. While the number of inquiries may be used in assessing the risk of opening an account, as explained above, Chex does not make account opening decisions for its clients, and therefore, cannot determine why the bank declined the account application. Our records show that during the consumer's 1/29/18 conversation with a representative, she requested a call back from a supervisor.  When the supervisor accessed her file to return the call, he discovered that the consumer had called back on 1/30/18 and had already spoken with another supervisor, so no additional attempts were made to contact the consumer. The complaint references lien information shared with Chex by Lexis Nexis, and states that the liens reported have been released.  Based on this dispute, the consumer's file has been forwarded to the appropriate personnel for handling. We will contact Lexis Nexis to notify them of the dispute and will request that they investigate the accuracy of the information they shared with us. Chex will notify the consumer of the results of the investigation once it is completed.

Chex Systems, Inc. (ChexSystems) has reviewed the complaint filed by this consumer.  Our records indicate that we have had multiple communications with her.  We have explained that there is information on our files that is similar to hers, however, the Social Security number listed on...

the reported information does not match the number she provided to us.  The information in question continues to be linked to the consumer because it lists the same name, address and date of birth provided to us by this consumer.  ChexSystems did initiate an investigation of the reported information and it has been verified by the source to be accurate.  Should the consumer wish ChexSystems to pursue the matter further, we can only suggest that she contact her local police department and obtain a copy of a valid police report that clearly supports a claim of identity theft/fraud since the reported information does include her name, her previous address and her date of birth. Once we have received the police report, we will be happy to review the situation further and will inform the consumer of any actions taken.

I have requested copy of my report with no success! And I must be on the Chex System because of what a bank told me. I expect Chex Systems to contact me to rectify this I am tired of chasing thru their system to not have any response! I am sending a certified letter today and reporting it to the Revdex.com as well as the FCC!

history of account mishandling. In providing this service, ChexSystems abides by the Federal Fair Credit Reporting Act and any applicable state statutes. ChexSystems neither approves nor declines accounts for our members. The decision whether or not to open an account is entirely up to an institution and its individual policies.
Our records indicate that we have not received a dispute from the consumer, however, we have received and responded to two requests for a copy of his consumer disclosure report. The reports mailed to the consumer clearly show record of multiple Inquiries Initiated By Consumer Action, which refer to inquiries resulting from transactions initiated by the consumer. This may include completing an application at a financial institution. Record of these inquiries is part of a consumer's credit history and may be included in our reports to others.
If the consumer disputes the completeness or accuracy of the information in his consumer disclosure report, he has the right to submit a dispute directly to the source of the information. However, if he prefers ChexSystems will be happy to contact the source on his behalf to initiate an investigation. I do not have accounts which were mishandled nor in current debt. The only thing I will agree is that I have been attempting to open a savings account, and each financial institution using Chex Systems have declined. I was not aware it was suspicious or illegal to attempt opening a savings account, and I do not know why Chex Systems does not notify the consumer and instead opts to erroneously have information about a person like multiple names. Because of Chex Systems I had one account in good standing suspended, and another one on hold. Both of them pointed to Chex Systems, and only when I presented myself at a branch with passport and id, was the hold and suspension lifted. I haven't heard of this organization before and I am really upset that because of whatever erroneous information Chex System has which is not supposed to, I was subjected to discrimination based on ethnicity. One "fraud investigator" went so far to say that "Spanish people" use multiple names and accounts. I also have made 2 requests to Chex Systems and this is correct, and so far have received nothing so that I can dispute the criminal factor they have of me in opening an account. There are politicians with many bank accounts, and some overseas and I am sure Chex "systems" do not check their true illegal activity.

Also as we stated in our initial response, we have provided the consumer with copies of his consumer disclosure report. I am rejecting this response because: I will accept the investigation of the release liens. However,  I have already faxed over proof of the released liens from the Tax Department of West Virginia verifying the information ChexSystems provided was incorrect. I am choosing to decline the response of ChexSystems due to the lack of acknowledgement to the concerns in my complaint. As I have previously stated, I would like to have the 2nd inquiry from FNB removed from my file due to incorrect information being provided by ChexSystems. I do not believe that this should be negotiated, and want this to be addressed and recognized. Once again, if the information on file would have been correct, there would have been no reason for FNB to request the information again. This error could potentially cause a decline from a financial institution in the future, as stated by ChexSystems in the previous response, "While the number of inquires may be used in assessing the risk of opening an account". Furthermore, why should my file contain 2 hard inquires from the same institution when it should have only had one. I was approved for a checking account from FNB because THE VICE PRESIDENT REVIEWED MY FILE AND DETERMINED THERE WAS NO REASON I SHOULD HAVE BEEN DECLINED THE FIRST TIME. Also, as I stated before I want ChexSystems to have accurate contact information for Lexis-Nexis so that bother people that are experiencing issues with their report have the correct access to the resources they need.

Chex Systems, Inc. (ChexSystems) has reviewed the additional complaint filed by this consumer.  A letter has been mailed to the consumer explaining that ChexSystems does not communicate with consumers via email or unsecured fax, therefore, we are mailing her a copy of the letter initially sent to her on February 1, 2018, which notified her of the results of an investigation.  We explained that the information contained in the consumer disclosure report that was enclosed with that response may have changed and provided instructions on how she can submit a request for a current copy of her consumer disclosure report.

ChexSystems' clients regularly contribute information on closed checking and savings accounts, referred to as Reported information.  Reported information pertains to accounts reported for mishandling, closed for cause, and/or suspected fraud activity.  ChexSystems' current practice is to retain reported information on file for a period of five years unless the source of the information requests its removal or ChexSystems becomes obligated to remove it under applicable law.  The reporting member institution is under no obligation to remove accurate information, even after payment of monies owed.  However, the member is obligated to update the report with a paid in full or settled in full date when applicable.
 
Our records indicate that we have received communication directly from the consumer regarding the disputed information.  We have informed the consumer that one of the reported accounts is listed with a paid in full status.  The other account is listed with a closure status of Unpaid, therefore, as is ChexSystems' standard practice when a consumer dispute is received, we notified the reporting financial institution of the dispute and requested that they investigate the accuracy and completeness of the information they reported.  The financial institution responded to us and confirmed that the account is unpaid and should remain on our files as reported.  ChexSystems mailed a letter to the consumer on August 29, 2016, to provide the results of the investigation.

Chex Systems, Inc. (ChexSystems) has reviewed the complaint filed by this consumer. Our records indicate that the most recent dispute we received from the consumer was submitted through our website on March 9, 2017.  A letter was mailed to him on March 13, 2017, to notify him of our...

intent to investigate.   Letters have been sent to inform the consumer of various addresses and name variations that have been removed from his file. We have also explained to him that investigations of inquiry and reported information are still progress and we will notify him of the results of each investigation as they are completed. ChexSystems did receive a copy of a police report from the consumer on March 10, 2017, however, it was not legible.  If he would like to resubmit a legible copy of the police report, ChexSystems would be happy to review that document and inform him of any actions taken. The consumer’s complaint also states that his dispute of information submitted by [redacted] Bank was not verified within the required timeframe.  The dispute of the [redacted] Bank report was received on February 27, 2017, and has been completed.  A letter was mailed to the consumer on March 3, 2017 to notify him that the disputed information submitted by [redacted] Bank has been verified to be accurate as reported, and therefore has been retained in his file. The letter also provided contact information for [redacted] Bank should he wish to contact them directly to obtain additional information.

Chex Systems, Inc. (ChexSystems) has reviewed the follow up complaint filed by this consumer.  We have attached a copy of the illegible police report narrative for your review. As previously stated, if the consumer would like to resubmit a legible copy of the police report, ChexSystems would be happy to review that document and inform him of any actions taken.  In the meantime, we will continue with the investigation process and will inform him of the results of the investigations as they are completed.  The complaint states that he has provided multiple notarized affidavits.  Our records show that we have received notarized dispute correspondence from the consumer, however, we have no record of receiving notarized identity theft or fraud affidavits. Our records indicate that the consumer requested "method verification" in his correspondence dated March 15, 2017, which was received in our office on March 20, 2015.  It is our standard practice to provide the description of the procedure used to verify disputed information upon the completion of the investigation.  However, based on his reference to this in the complaint, ChexSystems has mailed a letter to him today, March 29, 2017, to provide that information to him.
