Sirs: This involves Ditech's response to my initial complaint, case #***Ditech's representative, Jared ***, misrepresented the actions his company took and my responsesDitech purchased my mortgage from Residential Credit Solutions who confirmed all my insurance policies were up to date and in full complianceHowever, just a few months after Ditech purchased my mortgage, I received notification from them that my insurance was not in complianceI sent several emails and a letter to them detailing how upset I was that they did not do their due diligence when they purchased my accountThey received correspondence from both myself and California Casualty that my home owner's policy and hazard insurance was up to date and on fileI then received additional notifications from Ditech that they needed a Master PolicyI emailed them information for both my Condo Association and the association's insurerMy association informed me they never heard from a Ditech representativeAdditionally, Ditech purchased a policy in the amount of $Their claim that sales and transfer of servicing rights is common in today's lending industry is accurate, but does not take away my rightsMy contract stipulates that nothing changes in terms of my mortgage or any fees upon sale of my mortgage to another lenderDitech did not do their due diligence and in fact violated my rights. :I would like copies of all correspondence and phone records that Ditech made to both my Condo Assocation and its insurerI would also like the policy to be cancelled and a written apology from all parties involved in DitechI especially want to know why they did not have proof of a Master Policy when it was on file with Residential Credit Solutions and should have easily been found by them when they purchased my mortgage

I went to my bank to get the letter Ditech asked I should get to send to Payemnetus, unfortunately this isn't something they can produce there and then so "corporate" had to sign off on thisThe bank emailed me days later to tell me the letter was readyI went to get it and sent it immediately to PaymentusI got a call back about days later from Paymentus stating they have received the letter and my account will be "unflagged" in about to days and if Ditech had any old pending payments that they should be removed/cleared so I wont get debitedHe said moving forward I should have no problemI called Ditech told them that the situation with Paymentus was resolved and if there are any old scheduled payments that they should be removed then I scheduled a payment for 12/16/with the repAfter this I went online to see if this scheduled payment should up and it didI thought that was the end of that and to my surprise my account was debit today!Seriously now I am way over drawn, who will pay my over draft fee? This has caused me so much grief and stress its really unbelievable that no one wants to take responsibility for thisI want them to pay my overdraft fees because I did all Ditech and Paymentus told me to do and I am still getting screwedUNACCEPTABLE

ACH confirmation letter that was mailed to Ms*** dated February 1, 2016, advising the first debit would occur on February 26, In addition, Ms*** spoke with a Ditech Representative on February 22, and was advised half of the February payment would be debited on February 26, 2016, and the next debit dates would be March 11, and March 25, We apologize for any misinformation or misunderstanding; however, automatic payments are never scheduled to be debited on Saturdays.Unfortunately, we do not have a record of receiving an additional ACH application from Ms*** until June 3, This application indicated Ms*** wanted her debit date to occur on MondaysHowever, due to our ACH system, we are unable to make changes to the automatic payment debit date without first canceling the automatic payment and receiving a new applicationMs*** was advised of this in a telephone conversation with a Ditech Representative on June 7, At that time Ms*** advised that she would call back if she would like to cancel the ACH.On June 17, 2016, Ms*** spoke with another Ditech Representative and the ACH was canceled at that timeEnclosed is a copy of the cancellation confirmation mailed to Ms*** dated June 17, Please note that the request to cancel the ACH was not sufficient time to stop the June 17, debit from occurringThis payment was already in transit to MrTucker's bank.As Ms*** was advised, in order to setup the ACH on her account again, her account will need to be paid one month aheadFor example, if Ms*** would like to sign up for ACH in July 2016, the account should be due for the August payment.Our records indicate that the ACH payments were debited as requested by Ms*** and not a Ditech errorHowever, on June 24, 2016, we reimbursed Ms*** $for fees that were assessed by her bankWe have also waived the late fee assessed to the June 1, payment.If Ms*** has any further questions, she should contact her account representative Jarod Nat ###-###-####, extension ***, or Jessica Sat extension ***Our Customer Service Department is also available to answer any questions or concerns and can be reached at ###-###-####, Monday - Friday, 7:a.mto 8:p.mCT, and Saturday 7:a.mto 1:p.mCT

I am rejecting this response because: *** *** *** *** attended my closing in person and received a payoff check that included a per diem through August 3rd, By physically appearing at my closing and receiving a check, *** *** *** *** acted as legal agents and representatives of DitechAdditionally, I paid $for this required action to occur (see supporting docs that include closing legal fees required by Ditech.) From a legal, professional and ethical standpoint, *** *** *** as an agent and extension of Ditech in a legal capacity was in receipt of my payoff as of July 31st, at 2:pm and my account should reflect the exact date and time of the receipt of that payment Ditech cannot force their internal process as a means to penalize me, keep daily per diems and report falsely to credit bureaus while charging me a closing fee to have their attorneys at my closing on July 31st, If this was the case, then wire instructions should have been sent to my attorney and the $*** *** *** *** closing fee and attendance would have been avoided At this point I am requesting one of two options:ADitech corrects my payoff date to accurately show a payment for July 31st 2017Ditech accurately report to all Credit Bureaus and show a payment was made in July 2017Ditech issue a Per diem Reimbursement Check from August 1st to the 3rd for inaccurate posting of paymentorB. Ditech leaves all information as is Ditech issues a $reimbursement check to cover necessary *** *** *** *** closing charge.Bottom line, you cannot force a consumer to pay $to have your attorneys attend a closing, collect a check and then post said payment whenever you wantIt is illegal and unethical and I am willing to go to the end of the Earth to rectify this issue in a fair and just manner
