According to our records, a modification agreement was executed in July 2013, copy enclosed, and the modification was applied to the account on June 18, In May 2015, we determined that the capitalized amount was incorrect and the modification was reversed and reapplied on May 26, The amount capitalized in June 18, was $10,268.64, and the correction capitalized $10,After the modification was reapplied, our internal ledgers were incorrect which caused the modification to be reversed a second time on June 10, 2015, and reapplied on June 23,
Please be advised, during the time the modification was being reversed and reapplied, billing statements may have reflecting an incorrect amount dueIn addition, system generated notices were sent indicating the account was past dueThe reversal of the loan modification did not cause late fees to be assessed or negative information to be reported to the credit reporting agenciesAs of August 2014, the account had an outstanding late fee balance due of $The April 1, payment was not received until April 20, 2015, and a late fee was assessed on April 17, 2015, in the amount of $23.86, creating a late fee balance of $As of today, the account is past due $703.99, less the unapplied funds account balance of $510.79, to satisfy the July 1, due date, and has a late fee balance due of $A payment history is enclosed

Thank you for this response from Ditech
Background on DitechThey are actually Green tree per the
SCC online inquiryGreen tree was known publicly for thousands of class action
suits filed against them for their practices and was fined million dollars
by the FTC and CFNPThey changed their name after all the publicity they obtained
What Ms*** is failing to address is the fact that
what I was told on 3/21/in speaking with Andrea *** director of customer
service and someone name Heather in loan processing relayed that the error that
occurred to my account for months stemmed from a system glitch from an
upgrade they did that was unable to recognize my payments being sent every
days (I CAN SUPPLY THAT RECORDING SHOULD SHE WANT TO REVIEW IT!!!)
Let’s take what she saidShe said they reallocated the
fundsHowever, if applied correctly if every month overage is to be applied to
principle then interest is to decrease(WORDS FROM THE DIRECTOR AND SUPERVISOR
ALSO CAN SUPPLY THAT RECORDING ALSO)When the reallocation was applied the interest
amount increasedThis caused me to inquire with both an accountant and a
member of the family who works for the IRS who both conveyed that the
allocations were incorrect However,
each time I have called to speak to or written someone to review the details of
the allocations I am met with representatives hanging up on me, unanswered
voicemails, and unanswered emails. I
have called John *** AVP of customer service, I was told he would
investigate matters and he would return my call That was on 4/3/I have
left messages for John *** the VP of customer services and never received a
return callI have emailed Ms*** every day since the 3/29/and have not received
a reply However, this is the practice of this companyI am attaching a conversation
with Ms*** regarding follow up and follow through and how it is handled
Now let’s discuss the amount she claims is still in
suspenseShe stated
“ As of the date of this letter, the account is due for the May 1,
payment of $and has a credit balance of $1,000.00, pending
systematic application to the account, in unapplied funds.”
On
3/21/in speaking with Ms*** and Heather I was informed I had $in
suspense and waiting for additional payment to be received so that when the
entire amount $is received it would be applied to May 1st
payment It would only stay in suspense for hours
On
3/30/an additional $was released to apply .On 3/31/I spoke to a male
representative who confirmed that the payment was received but had not been
processed yetOn 4/3/17after checking n ditech intranet I noticed the payment
was still not applied and called and spoke with three individuals: customer
service rep, a supervisor, and loan processingThey all said that no payment
was receivedI found that to be odd when on the 3/31/I was told it was but
had not been processedI did an inquiry with my bank who sent me a
confirmation of when the check was received on 3/30/and when it was cashed
I call 4/4/because now I see on my payment activity that the payment was
posted as received on 3/30/on ditech websiteI inquire to when it will be
applied to May 1st payment and I am told by a supervisor at the end
of the nightToday I log on and I see that the funds are still in suspense and
never applied to May 1st payment an ongoing problem with this
company- not doing what they say they are going to doNow she is referring me
to contact Bibi G which I am told handles collections of delinquent accounts
Why would I need to talk to her if my account is paid up until May and
everytime I attempt to call I am told she has no voicemail
This
matter has surpassed my patience and I am currently in the process of suing
them for breach of contractThis company is a fraudulently holding money to accrue more interest they are reallocating and submitting funds incorrectly and based on the contracts I was recently able to retrieve with the assistance of the FBI they are in violation of additional criminal activities that I will pursuing all of them on They still have not applied my payment for May like they said they would on 3/21/17 *** ***
I am rejecting this response because:While I do wish to close this complaint and bring resolution to this concern, I felt the need to bring clarity to a few statements provided by Ditech in their response to my complaintOver the course of several days and after speaking to several individuals, I was consistently given different variations of information regarding the release of the title and lien releaseThis inconsistent information makes this company untrustworthy and unreliableAlso, when someone did finally tell me that it could take days to provide the much needed documents, I was told that it was a Delaware law which I found to also be untrueI never received a lien release or title until 10/31/which is consistent with a mailing date of 10/28/A lien release was never sent to me on 10/24/I did receive a payoff letter which served me absolutely no purposeI appreciate Ditech working with their outside consumer to expedite the much needed documents, however their customer service representatives need A LOT of training to ensure their delivery of accurate information
