Review: I purchased a 14 day trial for 4.95, and searched the website to make sure it wasn't a cam because the email confirmation I received had as little information as possible, and the website itself has no information easily accessible whatsoever. I still have the product because I wasn't pleased with it, and just today received another one, and was charged 87.63. When I called they offered to cancel and refund half, to which I replied is not aceptable, and I am sending the entire, sealed product back. A 4.95 trial that is meant to confuse customers, and leads to a 95% price increase is a scam. I want the entire $87.63, not half. They have purposely designed the website where pages lead away from others, and by clicking back, the page will not refresh. The product itself comes with no documentación informan you of a contracto, in fact it comes with a walmart ad, and a teeth whitening ad.Desired Settlement: $87.63

At Fat Burn X, every customer is given the option to try their first 30 day supply without charge for 10 days after receiving their order. During the 10 days, if the customer is not satisfied with their product, they are to contact customer service via phone or email with a notice of cancellation and the product must be postmarked for return within those 10 days. If the customer keeps their 30 day supply after 10 days from the date of delivery, they are automatically billed for the product and then billed and shipped a new 30 day supply every 30 days thereafter. The customer has the ability to cancel at any time by calling customer service or emailing [email protected]. If a customer needs to contact customer service, the phone number is listed on www.fatburnx.com, the product, the pamphlet that arrives with their order, and the package the product is shipped in. The terms are disclosed clearly on www.fatburnx.com where the customer would have ordered the product. The customer also has to click “I agree to the terms and conditions” twice before the order is processed. If the customer does not click the box to agree with the terms, the order will not process. The terms and conditions are disclosed directly on the ordering website, at the bottom of the first page, and also highlighted in a large white box on the second page where the customer inputs their billing information, as well as sent out with the product. The customer placed the order on 01/11/15. This is when they paid the initial $4.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply they were sent. Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed for the 30 day supply on 01/26/15 as explained in the terms and conditions which they agreed to. There was a second billing of $87.63 applied on 02/25/15 for a monthly bottle of Fat Burn X. The consumer contacted Fat Burn X on 03/03/15 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the call, the customer service agent offered to issue a refund of $43.82 that day, but the call was abruptly disconnected by the consumer. We have refunded the amount $87.63 from 02/25/15, due to this complaint, however we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. We state the terms and conditions clearly, and send a synopsis card with our contact information, with each order. Terms and conditions are located on all ordering websites, and should be read as they are there for a reason. Please refer to our website, www.fatburnx.com or www.fatburnx.com/main/index.php. Below is a brief explanation of our terms and conditions:Terms and ConditionsYou will have 10 days from the date you receive your bottle to decide if Fat Burn X is right for you. You must pay a shipping and handling fee of $4.95 for us to send you a full 30 day supply of Fat Burn X. We ship the product the day after you place the order (orders placed Saturday-Sunday will be shipped the following Monday). If you are unhappy with the product at any time during those 10 days, you must call us at [redacted] and cancel your order to avoid being billed for the full cost of the product. If you are satisfied with our product, then do nothing and we will bill you $87.63 for your initial order, and every 30 days thereafter we will send you a new 30 day supply of the product for $87.63. To cancel automatic delivery and billing, please call us at 1-855-894-4436 during normal business hours (Monday-Friday, 8am-4pm PST) or email us at [email protected]. Please read our terms and conditions for more details.

Review: I was called about a promotional trial offer of 2 weight loss pills. Alpha Rush Pro and Fat Burn X. The guy who called said I would only be charged S3.98 for both bottles, which ended up being 2 separate charges of $1.99 which I was fine with. It took over 1 week to get the pills and when I received them, the bottles were not the promotional amounts they had told me I would receive, they were the full bottles of the pills. I didnt know what was going on. so a week later I look in my bank account and the 2 companies had taken $47.33 out for each bottle that I never agreed to. I tried to call the customer service number provided but I got put on hold for 20 mins and then it just hung up on me. I called again and left a voice mail for them to call me back. About 4 days later I get a call from a very rude person saying I was supposed to spend my own money to send those back through the mail and that if I wanted a refund I would have to send the product back to them. I told her I had already paid for shipping to be sent and that I could return the product if they would send me a prepaid envelope to return the pills because I never once asked for more than the trial offer and also I never agreed to pay for anything other than the $3.98 for both bottles. So now I had to cancel my debit card and call my claims office twice because the fat burn x tried to take money from my account twice now. They never once told me I would be charged for anything other than the $3.98 and I even asked the guy when I got the pills if it would only be that amount and he said yes. so now I have to spend money again to send the pills back to a company that stole money from my account. My bank will refund the money but I just wanted to warn others about this company!Desired Settlement: I just want people to see what kind of company this is and that they cant tell you one thing and then send you more than you order and take money from your account. I want them to send you the right amount for what they offer. Also they need their customer service people to stop being rude and hateful.

Once a refund is processed, it takes 3-7 business days for it to be credited back to the customer’s account.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

When I went to the website and only put in my info to go to the next page I received a phone call from the company. so I didn't finish any order online!!! Also you said I get a free 30 day sample to try once I received my order and then you changed it in your message that it starts the moment they mail it out... so which is it?? The customer service who calls people need to explain the process that you have to go through after you pay the $1.99. If I had been told and was aware that I would have been sent more and charged for it after, I would have never accepted in the first place. If I had known that I would have to use more of my OWN money to return a product that was supposed to be a trial offer, then I would have never accepted it either!! Your product is misleading and people have no idea what they are getting into. Also to address that we can call and cancel at anytime, I did call and was put on hold for over 20 minutes and then they hung up on me after I waited. I called twice just to see if it may have been my phone, but No! I was put on hold again through the automated service and hung up on again. I received my refund and will never purchase anything from your company again. When I did receive a phone call back days later after I called 1 more time after leaving a voice mail, I was called by one of the most rude and hateful people I have ever talked to in customer service! I will make sure others know about how you scam to get away with taking people's hard earned money!

At this time, the consumer has been refunded in full, including the shipping cost, for Fat Burn X. We have gone over the terms and conditions which were provided to the consumer. There is nothing further we can do at this time.

Review: Company advertised trial usage of product where only shipping was required to be payed, never disclosing that they would charge a fee of $87 and change. They advertise two week trial, but it took ten days for the pills to arrive so even if they are charging after two weeks I did not even have the pills for two weeks.Desired Settlement: I would like for the company to refund my $87 and change plus the $35 overdraft charge my bank charged me for this.

Review: On the mobile site of fatburnx.com it is not clear that the "free trial" is in fact an $87 cost. the mobile site said nothing of the sort upfront when agreeing to the free trial. the customer service reps refuse to fully refund me even though I will be returning the items. I have contacted my credit card company and reported the fraudulent transactions. had I known or had it been clear that the trial bottle cost $87, I would never have ordered the supplement. I fear that many people are suffering from these types of claims to offer "free trial" just pay for shipping and handling false advertisements. a company should not have to sneak around and steal money if the product they offer is a good one. the words free trial does not mean $87. I will pursue this claim and my refund to the fullest extents available to me.Desired Settlement: I want a full refund and for the retailer to stop advertising "Free Trial" when in fact it is not "Free" it cost 87$, I want a full refund 100%.

Review: I ordered the trail product Fat Burn X dietary supplement on 19 Jan 2015. I received the trial product and used it for a period of time and was had no positive results in weight loss as the advertisement stated. Below is my initial offer payment on 19 Jan 2015.

01/19 01/19 [redacted] FATBURNX.COM PORT LOUIS MU $4.95

On 3 Feb a unapproved charged appeared on my credit card bill for $87.63 from Fat Burn X.

02/03 02/03 [redacted] FATBURNX.COM PORT LOUIS MU $87.63

I called the company customer service rep on 4 Feb and expressed my displeasure with their shady reorder/billing tactics and worked out with the rep to recoup half of the money charged to me. This was all recorded as they proceeded to remind me several times during the phone conversation. Refund to credit card below.

02/04 02/06 M [redacted] $43.8202

On 22 October 2015, I received a letter from a collection agency, [redacted], out of Woburn, Ma stating that they were attempting to collect a supposed debt totaling $175.26. This total is $87.63 for Fat Burn X and $87.63 from Alpha Rush Pro who I assume are affiliated company paired together on their advertising scheme since I ordered both trial offers sequentially, linked together during the trial offer and the collection agency has both of these products together on the letter of indebtedness sent to me. (I will be filling a separate complaint on this company also).

I sent all pertinent documents to the collection agency but have heard nothing in response. I have not contacted the company to resolve this since I feel strongly based on my conversation with the customer service reps in Feb of this year that they are operating a less than reputable scheme and their recent action to report me to collections in attempt to have me just capitulate and send them the money to make this go away.

I believed that this problem was completely resolved in Feb of this year and completely applauded that they would resort to this without ever contacting me.Desired Settlement: I want the agreed upon $43.82 refunded to me for wasting my time in dealing with this frivolous attempt to extort money out of me, a letter from the collection agency "Collect Pros" that this is formally resolved, and a formal apology from Alpha Pro Rush for attempting to defraud me of my money and slander my credit.

Business

Response:

We apologize for any inconvenience this has caused to the customer. The customer's account was closed on 2/04/2015. A collection notice was mistakenly sent via a third party. The customer does not owe us any fees for products and we can assure the customer that this will not show on their credit. We have taken the necessary steps to make sure this does not happen again. The customer is welcome to contact us directly if they would like any further information.

Review: This business entity is a scam artist, selling a bogus product offering a 14 day Free Trial, no money back guarantee.

That's fine; however, it should not be legal to continue sending and charging a consumer for a product that is worthless. I accepted the first charge but received a new package in the mail; in which, I am returning and disputing the charge through my bank.Desired Settlement: I want it documented along with others taken by such schemes to help enforce legislation to outlaw these types of scams. NOBODY reads the extremely long, small-printed disclosures. Consumer rights should be broadened so that these type of sellers are not allowed to make such tiny and long disclosures that allow them a legal loop hole to rip people off.

Review: Under their "Terms and Conditions", they agree to both Ship their product the next day, and to ship using a specific shipping method which was USPS First Class Mail. They shortened the time I should have been afforded to try their product by 5 days. I lost 1 day to them not shipping in the time they agree to in their "Terms and Conditions", and 4 days by not using the proper shipping method. USPS First Class Mail is a 2-4 day process vs. the 8 day process by using the UPS Mail Innovations service. If those 5 days are deducted from the overall time between the date I placed my order and the date I cancelled, I would have been well withing the allotted 14 days. I am required to fulfill my end of our agreement by cancelling within the required 14 days, but they did not fulfill their end of the agreement.Desired Settlement: I am seeking the ability to return my unopened product in exchange for a full refund of the $[redacted] I was charged.
