By law Byers has to submit the credit application to Volkswagen Credit who has the authority to either approve or decline the customer’s applicationThis was done on behalf of Ms*** Unfortunately, VW Credit declined her application, which is why we could not offer her the terms that she requestedByers and VW Credit both use TransUnion fico which cannot be altered or tampered with as the customer suggested that Byers did. This just seems like a case where the customer got an offer from another dealership to get her into the store without having her credit. She was quoted price that only a Tier credit individual could get. That is not her situationThe other dealership in question did not run credit or submit it to a bank, so the payment offer that was given to her by them was not an accurate representation of a lease that was viable based on her circumstances We apologize for the inconvenience to Ms*** but based on the credit decision by VW Credit, the payment terms and lease are not available at the terms she would like

We can install the back up sensors as requestedThis car is equipped with the back up camera which is the upgrade from having just sensors, our service advisor demonstrated the feature to the customer recentlyI can be reached at 614-*** to set up the installation

I am rejecting this response because the Byers Volvo dealership has been very unprofessional since I brought this issue to their attention on June 9th. Obviously the Byers organization’s and my definition of “joy riding “differsI believe going to a bar and a workout facility between 10:00PM and Midnight when *** *** was supposed to be “fixing” my car constitutes “joy riding”(See the attached documents form the Volvo On Call system that proves all the unapproved locations my car was driven and parked).I believe that the Byers organization, Mr*** and Mr*** has purposely left out these details to avoid a public relations issue of unprofessionalismAlso, because of who I am they do not feel my complaint needed to be addressed.I have tried multiple avenues to get my complaint heard, to no avail. I will have this issue handled by the Ohio Civil Rights Commission

I wanted to touch base with you in regards to the above mentioned complaint against Byers Chrysler JeepI have been in frequent contact via email with *** *** *** *** at Byers since Thursday, November 6th, when he requested to reach out to me directly to try to resolve the issue at hand*** inquired on whether I would be interested in purchasing a new vehicleI advised him that I would be willing to work with him to reach an agreement that suits the both of us*** offered to give me a fair market travalue for my truckI informed him on what I would be searching for in a new vehicle and the payment range that I was looking to stay inI also reiterated to *** how every day that I drive this truck it puts me and the safety of my children at riskI also asked about a refund on the money that I spent for repairsI was advised that he would go above and beyond to ensure that I am satisfiedThe last contact that I had with *** was Monday, November 10thWe still have yet to reach a resolution on this case

Cancellation is processed today 2/23/and a check for $will be processed and mailed to lien holder the week of February 26th

We spent several hours with the customer going over everything and coming to an agreement on the price which included refinishing the wheels. We are more than happy to address any additional issues or concerns that the customer may have. Unfortunately, having the work done by
another dealership is not an option

The statements made by this dealer are absolutely and representative of the unsavory business practices at this officeThere was neither cursing nor yelling at any point by anyone in my party To suggest so is defamationMy parents were with me as co-signers and can confirm this to be untrue My father also filed a complaint on my Mother's behalf because her credit report from Transunion did not match the information she had and Byers said because of that they were going to charge a higher car price When we suspected we were being subjected to shady business practices, I simply told Evan M*** that the fact was anything above the agreed price was going to be out of my budget and we were not interested Regarding the terms of the deal, I have all of the communication between Byers VW that confirms the Byers Rep is misrepresenting how they arranged this lease Evan M*** reached out to me to let me know Byers matches or exceeds competitors offers I informed him that we had already filled out a credit app with VW and filled out one specifically for Byers the day before going to the dealership Again, I have documentation for all conversations had with Evan M***

I called and spoke to Tabbatha we spoke about the service visit and I apologized for any misunderstanding on the service work performedWe agreed on the battery replace and the labor then we offed a credit of $on the diagnosis as a goodwill gesture

In response to this complaint Byers Ford did discover that parts of our disclaimer was missing from our website. This was a web provider issue. We noted and corrected immediately. In regards to Mr***, who was the cosinger for his step daughter, the
incentive package chosen was different due to the fact that the contract was a lease. Ford Credit holds the contract for the leaseFord credit, does have different incentives according to the form of payment that the customer chooses Our staff did in fact explain this to Mr*** and his step daughter prior to delivery of vehicle.
Although Byers Ford did not lie as implied by Mr***, we do understand that the incentives can be quite confusing at times. Byers Ford would like to offer Mr*** $

We will not be issuing any kind of refund to Mr***What it comes down to is the vehicle was towed in not running, we replaced the gasket kit on the carburetor and a starter solenoid as stated on his repair orderAfter replacing the gasket kit on the carburetor and starter solenoid the vehicle was able to start and run and Mr *** was able to drive the vehicle from the dealership when he picked it upRemoving and re installing nuts and bolts will not completely remove rust and crud from the bolts/nuts threadsWe have made no claims to have completely rebuild and or clean and soak carburetor or any of it’s componentsWe only stated we replaced essential gaskets and filter to stop fuel leaks. Our technicians wear rubber gloves to protect themselves so you would not see any signs of fingerprintsHad the customer requested to see the fuel leaking before repairs were made we would have been more than happy to accommodate his request however no such request was madeThe customer approved the estimate to replace the gasket kit on the carburetor and the starter solenoidand all work was completed per the repair orderIt is extremely rare to see an older vehicle as this through the shop and we had to go through extra lengths to find parts for itSee attached invoice where parts were paid forWe would not purchase the parts and not install them ….why do the studs on the manifold, which hold the carburetor in place, still have rust and crud imbedded into the studs thread areas? Simply removing a nut of bolt will not remove all signs of rust and debrisBecause, if those nuts had been removed and rotated off of the stud, the nuts would have cleaned the crud out of the thread areas, due to the very tight clearance between the nut and the studs, and would be “clearly” visible to the naked eye.….why is the carburetor, “still” covered with dirt and crud on the exterior body of the carburetor?We have made no claims to have thoroughly cleaned or soaked the carburetor or any of it’s components, only that we replaced gaskets and the filter. Because again, if they had rebuild the carburetor, they would have cleaned it inside and out. It is a natural part of the process, even for any “marginal” mechanic. Otherwise, while the mechanic is handling the clean parts of the interior of the carburetor during the rebuild, they would undoubtedly be contaminating those parts with dirty hands as they handle the dirty exterior of the dirty carburetor.1. … why does the exterior of the carburetor NOT have any signs of fingerprints? Technicians wear gloves when working on vehicle plus carburetors by nature have fuel inside them that spill out when working on them which will remove some signs of grease. Working on cars is a dirty job, and if they had removed the carburetor, there would be fingerprints evident in the long resting dirt on the various surfaces of the carburetor. The same exact dirt that remains untouched, and completely undisturbed today!2. ….why does the gasket on the top of the carburetor have a distinct impression of the ‘long resting’ air cleaner housing imbedded in the top surface of the gasket? Air cleaner gasket was not included in the kit. Replacing the gaskets inside includes replacing the gaskets outside as well, which was clearly not done.3. ….lastly, why does the car start and run, exactly like it had prior to the service? The vehicle did not run or start when the vehicle was brought inThe vehicle was towed in and driven out Typically, a normally aspirated/carbureted automobile has a distinct personality, especially older cars, which I have come to know very well with this car, since I’ve owned the car for years. A rebuilt carburetor would without question, cause a meaningful change in the way the car starts and runs. There has been absolutely NO change in the temperamental ways in which this car starts and drives. This car required a great deal of pumping of the accelerator to get it started… and still does. This car has a lazy choke that will not turn off easily, without spiking the accelerator several times….and still does

I’m replying back to you in regards to case number [redacted], that was submitted by [redacted] against Byers Volvo. I apologize for the delayed response and replying in this format, I could not get my attachments to transmit through your website. I hope this is ok and will serve as a...

response. I want to start by stating that Ms. [redacted] bought this vehicle AS-IS with no warranty. We clearly disclosed this numerous times during the transaction. The first page of the attachment is the Purchase Agreement to this deal. As you can see, it states, “ We are selling this vehicle AS-IS and we expressly disclaim all warranties, express and implied, …” The second page of attachment is the bottom of the agreement where the customer signed, acknowledging and accepting the terms of the transaction.  The third page of attachment is the Buyers Guide. This form is very clear and states-“ AS IS- NO WARRANTY  You will pay all costs for any repairs”. The fourth page is the back of Buyers Guide with her signature, again, acknowledging receipt of Buyers Guide. The fifth page of the attachment is the Delivery Confirmation document that states “ Nothing Owed/Nothing Promised”.  Ms. [redacted] bought this vehicle AS IS.The next two pages in the attachment are the repair order showing that we performed a Used Car Safety Inspection on this vehicle and the accompanying UVI form. I include these to show that we do take pride in the vehicles we sell and inspect everyone, in detail. We sold this vehicle with all the good faith and intentions. The Technician that inspected the vehicle prior to purchase did not detect any of the concerns that appeared after the sale. Vehicles are machines that break for no rhyme or reason sometimes. I feel that we have a very proactive reconditioning process for all our pre-owned cars, to make sure we are trying to sell quality products. Staring all of the above, I’m requesting that you close this case. Ms. [redacted] was at the dealership, in the Sales Persons office, giving him the information that is required for a credit application. We did not try to deceive her in any way. We just tried to help her get the best interest rate possible and she encouraged us to do that.

On Wednesday 5/13/2015 I spoke with Mr. [redacted] regarding his visit to Byers Mazda.  During our conversation he reviewed the details of his interactions with my staff. Mr. [redacted] and I reached a compromise. Mr. [redacted] stated to me that he now does believe that the entire incident was just a...

misunderstanding caused by an honest mistake by a member of our staff. Mr. [redacted] also stated that he does not feel that any of the members of our organization took place in any activity that could be perceived as being deceptive or a bait and switch tactic. Mr. [redacted] was even gracious enough to retract his bait and switch accusation, that he previously made, during our conversation. Mr. [redacted] and I are currently working on scheduling a time for him to take delivery of his new Mazda from our dealership.

Pleas allow me to tell you that we have worked directly with Ron the sales manager and he had fixed everything we had issues with. He has been very very helpful. We only wished Ron would have been in town when we bought the car. Thank you for all your help and now we have the car we always wanted [redacted]
