Byers Chevy has tried to work through this with Ms. [redacted] in the past with the attorney general office. They reviewed all the facts and documentation of the purchase and found that there wouldn’t have been a reasonable way to know if the vehicle was in an accident. Some of her statements in this...

complaint are inaccurate. We did offer to trade her out of the vehicle giving her fair value based on condition and not taking into account her claims that the vehicle had been in an accident. During the appraisal process and used vehicle inspection process there were no signs of the accident. There is still nothing showing on any commercially available source verifying these past accidents. Byers explained to Ms. [redacted] that we would end up just wholesaling the vehicle because of the discrepancy on the vehicle history if we did take the vehicle in on trade. At this point Ms [redacted] has driven the vehicle for 2 1/2 years and put nearly 50,000 miles at this point. Our offer is to still give her fair value on her vehicle based on its condition and  based on a clean vehicle history.

We came to an agreement and she has a new car. She is very happy. Let me know if you need anything else.

Unfortunately the material returned by the customer is in non-returnable or saleable condition. items where returned in a Uhaul box, with no original packaing.

[redacted] had this 1973 Mustang towed in on or around 9/5/17. The vehicle would not start however the starter would continue to engage the flywheel whenever the battery cable was connected to the battery. Upon Initial inspection found the carburetor had a large fuel leak. Called and advised the...

customer the carburetor would need a new gasket kit installed to fix fuel leaks before further diagnosis could be completed. Customer approved work on the carburetor. After all gaskets and diaphragm's on the carburetor were replaced we were able to diagnose a failed starter solenoid causing the vehicle to continue to crank whenever the battery was connected. Customer approved replacement of the starter solenoid. After the solenoid was replaced the vehicle started and ran without further issues. Customer then picked up and drove the vehicle home on 9/9/17, customer paid $640.16, remaining $10.00 balance was applied from customers Ford Owners Advantage account. Mr. [redacted] then returned on 9/11/17 requesting a refund for $40 because he found a coupon that applied to his service. As a goodwill gesture Mr. [redacted] was issues a refund of $40 on 9/11/17 even though the coupon specifically states that all coupons must be presented at time of write up.

My name is Josh P[redacted] and I am the General Manager of [redacted] operations in Columbus and Dayton Ohio.  First and foremost, thank you for giving me the opportunity to assist you with your complaint.  After reviewing the file and investigating your claim I have decided to accept your desired...

Revdex.com:
I reviewed the response made by the business in reference to complaint ID 11001561, and find the resolution is satisfactory to me.
I was able to get my car fixed elsewhere, and they didn't charge me as much. Maybe they didn't know there was something wrong with the car I don't trust them due to the fact that when we went up there there was a rude remark made, Not good customer service. I bought the car so there is nothing I can do about that but I can teel people on [redacted] everywhere else about how things went down. I feel they would have never let that happen to any one in their family. Lesson learned.

I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory to me.

To Whom , I am writing today to answer a complaint by Mr [redacted] .  I have reviewed the facts and circumstances and come to the follow position . 1) This Vehicle is a 2007 and was sold entirely As-Is , Signed As-Is disclaimer on file 2) We were NEVER contacted by the customer...

until All the repairs were complete ,customers quote" I knew your Company would do nothing to make this right so I resigned to fix it myself"3) In stead of contacting us and asking for assistance Mr [redacted] went into a Insulting, Defaming, Name calling rampage on social media,  with the full  intent of Damaging the reputation of our business! 4) I am of the opinion that the Damage done to our reputation far exceeds any damage that may have been overlooked on his vehicle . In closing , As stated at the top this vehicle was sold and signed for 100% As-Is .  In that case the only assistance that we could offer would be goodwill .  Unfortunately , we reserve our Goodwill gestures for those who are Good clients and Mr [redacted]'s actions have proven him otherwise . Based on the circumstances mentioned above Byers Imports will honor any and all claims brought forth as a result of the Warranty that was presented at the time of sale and nothing else! Thank you for your time and consideration

I’m writing to you today as a response to complaint [redacted]. This complaint involves Byers Volvo and Ms. [redacted].   I understand that Ms. [redacted] is upset, but she is the one that authorized us to pull and submit her credit. The process we use to obtain consumers credit applications and...

authorization is all done by the consumer at an online, secured, credit portal. The consumer must go online, fill out all personal information, and must read/check the box for a Terms and Conditions statement and a Privacy Notice. In order for the online credit report to be submitted to us, the consumer must check this box that says they have read and agreed to the Terms and Conditions and Privacy Notice. The first page of my attachment shows that Ms. [redacted] is the consumer that filled out, agreed, and submitted the Personal Credit Info and the Privacy Notice. She did this on 12-08-2017.   The second and third page of my attachment is our Terms and Conditions statement. In the Terms and Conditions statement that Ms. [redacted] read and approved it states; You authorize the dealer, as part of the credit underwriting process, to submit this application and any other application submitted in connection with the proposed transaction to the Financial Institutions disclosed to you by the dealer, for review. In addition, in accordance with the Fair Credit Reporting Act, you authorize that such Financial Institutions may submit your applications for review to other Financial Institutions that may want to purchase your contract. You agree that we and any Financial Institutions to which your application is submitted may obtain a consumer credit report periodic[redacted] from one or more consumer reporting agencies (credit bureaus) in connection with the proposed transaction and any update, renewal, refinancing, modification or extension of that transaction.   Our goal was to try and get Ms. [redacted] the best possible finance terms available.  Ms. [redacted] agreed to this. The very last sentence of our Terms and Conditions statement is very straight forward and says; By clicking on "Submit", I acknowledge and declare that I have read and agree with the Terms of Use. I certify that I have provided complete and true information in this application.    We did not, and would not, do anything to harm Ms. [redacted] credit score. We where trying to help her an obtain the best finance package available for her. With the above explanation and the documents attached, I’m sure Ms. [redacted] understands, and I ask that you please close this case. If you have any other questions or need any more information, please feel free to reach out to me. Byers Volvo values the process that the Revdex.com uses, and we are here to help any/all customers.   Thank You,     David K. J[redacted]   General Mana Geo Byers. Sons 614-864-0780 dj[redacted]@byersauto.com

Byers has offered only partial payment of $250 versus the claimed loss of $1,449. In addition, Byers has not addressed the statutory damages of $200 that are normally awarded given their violation of the Consumer Sales Practices Act of Ohio. Please see further the attached document which rebuts Byers' response more completely.

I am rejecting this response because: I spoke with Ron the manager at this store and he stated before he received the Revdex.com complaint that he would look into fixing the rims, sunroof and then on matching paint. But once he got the Revdex.com complaint he said I no longer needed to contact him going forward.. so now I have a 21000 dollar car not up to my standards and they DID NOT SPEND ALL DAY WITH US.. that's a lie.. I'd like these things fix as soon as we can. Thank you
Regards,

I was sold a car by Byers Imports 465 S. Hamilton Rd., and put under the impression that I had a warranty for 3 yrs., 36,000 miles. The car has stopped running after 6 mos. They have refused to even check it, but have even gone further to insist it is not covered under the warranty which according...

to them would only be for power train, engine, and transmission. I was given the impression that the car was covered by full warranty. Their own document requires an initial if the engine/transmission/power train option is the only warrant desired. I have no initials to that effect because I was told my warranty was complete and fully covered by the salesman. I have attached the warranty document. As far as I am concerned my car should be checked and repaired by them s per the full warranty, or trade the car in.

I am rejecting this response because: No vehicle should be sold with bald tires ever at time of purchase this is a safety issue and has been mentioned to attorney general office as well for Byers selling vehicles that are not safe.Regards, [redacted]

[redacted] reached out to us online via an internet inquiry. Mr. [redacted] reached out to Mrs. [redacted] by phone. Mrs [redacted] informed Evan that she had a offer from [redacted] VW on a 36 month lease for a Tiguan S. Evan informed her that as long as her credit would qualify her through Vw credit,...

Byers would match the offer from [redacted]. Customer filled out an online credit application tueday june 28th, Byers followed proper procedure under the Red Flag Rule, and was unable to identify the customer therefore we did not pull credit. Byers did not pull credit until Mrs. [redacted] was in our store so Byers could clear the "Red Flag". Once we cleared the red flags we pulled her credit using TransUnion Fico 08. The customer wag given the risk based pricing notice and was informed of her credit score. Evan told her that this score may affect the final payment. Mrs. [redacted] then informed us that she had a 58 point higher credit score. The customer became so upset that she began cursing and yelling at the sales consultant. At which point the salesan tried to calm her down to no avail. Byers never had an opportunity to try and earn her business with an offer after pulling her TransUnion fico 08 and providing her with the proper risk based pricing notice.

We called Ms. [redacted] on 6/2/15 5:47 Left message, called again 6/3/15 9:32 left message called again 6/3/15 3:43 left message called again 6/3/15 5:10 and was able to get through. After speaking with [redacted] we apologized to hear that she was having troubles and invited her to stop back to have us...

take a look at the car at no charge the appointment was set for 6/6/15She brought the car in at 8:00 am our technician pulled the car in the shop and reset the engine service interval maintenance light then proceeded to inspect why the car would not lock by itself. We were not sure how any thing with the cars settings would have changed because the service was all tune up and oil service related. We plugged in the diagnosis computer to find out this car does not have this feature so there is no way to turn it on or off. The cars system is intentionally set up not to lock by itself becuase if you inadvertently left the keys in the car the car could lock it self with the keys inside. The car does have the feature if you unlock the locked vehicle and do not open the door after a few minutes the car will relock itself and this feature is working. If you have any questions please feel free to call to review and thanks for your business.

Revdex.com,
Sorry for the late reply, I have been out of the office.
To start, I’m sorry that Mr. [redacted] feels that we violated his personal space and that we lacked professionalism. I disagree and feel that we tried to go above and beyond to try to solve the problem his vehicle was having.
Mr....

[redacted] was dealing with 18 year Service Advisor veteran, [redacted]. Mr. [redacted] asked Mr. [redacted] for permission to keep the vehicle overnight to drive and duplicate the issue. This is a very common practice so we can duplicate the same circumstances of when the vehicle is acting up. Example would be cold engine, hot engine, weather related, etc. Mr. [redacted] gave Mr. [redacted] verbal permission to keep the vehicle and try to duplicate. Mr. [redacted] also signed off on the attached repair order that acknowledges; “ that your employees may operate the above vehicle on streets, highways, or elsewhere for the purpose of testing and/or inspecting such vehicle”.
Mr. [redacted] by no means was out “joy riding” Mr. [redacted] SUV, he was driving the vehicle to duplicate issue and was going about his daily life activities. If Mr. [redacted] did not fully communicate what the process was going to be to try to duplicate the issue, I apologize. We did not and will not violate any of our customers personal space and never perform unnecessary road tests. Mr. [redacted] was trying to do the right thing and duplicate the issue so we can fix it.
We appreciate Mr. [redacted] business and would never jeopardize our relationship. This business is about trust and loyalty and I feel we tried to do the right thing and fix his car. Please let me know if you have any questions or I can explain in any more detail. I feel that we followed the correct process, Mr. [redacted] gave verbal and written permission to drive his vehicle and that this case should be closed.
Please let me know if you need anything else.

Tell us why here...Hello, yes the customer did purchase a sunroof frame assy. on 6/30/2016 part number XR854802 invoice 502210 and a sunroof motor assy. on 7/11/2016 part number C2C31827  invoice [redacted]. We also confirmed that the parts are correct for the vehicle identification number provide...

by the customer. From our understanding with speaking to the customer and the Jaguar dealer service department this is the mechanic (non-Jaguar dealer) that originally install the frame and motor assy. did not properly install and tried to modify the frame to work. The sunroof frame assy. originally did not have metal brackets riveted to the frame side. I confirmed this with the Jaguar dealer service department before denying credit on the retuned merchandise. Also, the parts where returned with no original packaging and months after our policy agreement both on the invoice provided with the parts and the website policy were parts where purchased. Our determination is that customer should be looking for restitution from the original mechanic that improperly installed and modified the correct parts.

I would like to apologize for this error. It was never Byers Chevrolet intent to mislead or make a mistake in our advertising. We are investigating exactly how this error occurred. We had set up in our inventory control system a 25% off MSRP discount on all TRAX's we had in stock on October 1st....

Chevrolet was advertising 20% for dealers that enrolled and that required the dealers to sell the Trax at supplier pricing and the difference was a rebate from Chevrolet. We went an extra 5% below that price but unfortunately the 25% discount got applied and an outside source went in and applied another $3500 rebate that wasn't compatible. When this issue was brought to my attention I went in and pulled off the $3500 rebate which should have corrected it on all other websites. I searched again today through Google search and don't see the vehicle on any website as it was sold on October 15th for the corrected advertised price. I would like to talk to you further and will attempt to reach you at the phone number provided to the Revdex.com. Sincerely, Jeremy F[redacted]General Manager Byers Chevrolet614-782-2782

I reached out however I did not get a returned call other than that everything is correct in this complaint thanks
