RESPONSE:

We
have communicated with our customer and have agreed to terminate the
relationship.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I contacted this company as soon as I saw that they misrepresented themselves which was definitely less than two years I was given the run around I even received two letters this year telling me that they had went out of business but the account was still owed and they had retained the companies rights I spoke to many people over the past few years and for them to say that I did not make this a issue until now is untrue. I can provide a list of some of the people I spoke to over the years some first names and other first and last names or operator numbers as the case may be for those that were not willing to give their whole names. The letters that stated that they were no longer in business or at least the part of their company that sold this to me was signed by [redacted] D. [redacted] President , of Board of Directors GEVC Vacation Owners Association this last letter was dated November 3, 2014.

This
customer did not cancel. They made 12 payments as required and we enrolled them
in RCI in March of this year as required in the contract. The first time they
contacted us for any reason was June 15, 2015 requesting to cancel. The
customer has buyer’s remorse. Global has offered a resolution to these
consumers, should they not accept they are welcome to pursue any action they
wish.

Consumer:                 [redacted]   Customer Review:    [redacted]   Response:   We sincerely apologize for any frustration our customer has experienced.  It is our position that they were clearly informed that this Membership affords you access to over 4,000 resorts in over 100 countries and that all reservations are subject to availability and no specific resort or resort area were promised as part of the contract.  The Membership does not provide any guarantees regarding availability of locations, periods or units.  The documents Mr. and Mrs. [redacted] acknowledged, signed and received at the Point of Sale contain numerous disclosures to that effect. That being stated, we will reach out to the member to see if we can come to a mutual agreement.

I wanted to state that the company that I filed the complaint against said they would contact me to come to a resolution as their reply. I was waiting for the phone call or email and received nothing.

presentation of the facts and is ready to defend its position.  The consumer was enrolled into RCI in March
and has two years to utilize the system as represented to them.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. We cancelled within the 3-day window of opportunity. In writing. In person. On the phone. Every way imaginable except for sky-writing. Now, whether a company accepts a cancellation is another matter. This company clearly is STILL refusing to honor our cancellation, AUTOMATICALLY deducted payments from our account (which we were unable to stop) and gave us the "run around" dodging phone calls, and transferring us to every employee hoping we'd get tired and GO AWAY!!!We're not going to go away.

The Company sent out a letter dated 8/27/16 but we actually didn’t receive it until a week ago. My wife and I have been discussing our options and quite frankly are not happy with their response or “solution”. They want us to only accept $514.32 out of the $1556.74 and they just charged us another $124.27 automatic payment  twice (another $248.54) which we told them not to charge us anymore. So no they have $1805.28 of our money and we still have not received anything back. We would like to recover at least $1300 of that back.

RE:         Revdex.com
Complaint

Dear Mr. [redacted]

              ...

I
would like to address your concerns presented to the Revdex.com.
You were guaranteed a gift for coming to the presentation and received that
gift. The drawing for the car was in addition to the gift you received neither
of which had nothing to do with your purchase. There are over 11,000 members
utilizing the benefit of Global Exchange Vacation Club. I disagree with your
assessment that you or anyone else was duped, deceived or that our
representation was fraudulent.
You state that you have “NEVER” used any
service offered from GEVC. Our records indicate that you used 20,000 points
towards airline tickets in January of 2012. I have enclosed a copy of the
RCI webpage showing availability as of this date. There are over 150,000 available
weeks as of today and every day at an average cost of less than $499. This is
exactly what was represented to you.
I apologize for your frustration in it being impossible to speak to a real person, again
our records indicate that you have not contacted our Member Services department
you have only been in contact with the collections department.
I have enclosed a copy of your Members
Acknowledgment with your signature and initials of the representations made to
you. This document clearly states; your purchase is in Perpetuity. Your
membership is designed for reservation 30 days or less, Extra Vacations and
Last Call Vacations.
You may rent, sell, will or giveaway your
membership, in addition the Club does not offer rental or resell services. All
reservation are subject to availability and no specific resort, resort area or
time of year was promised.
Mr. [redacted], every benefit is available to
you. Please contact Member Services for a one-on-one tutorial on how to use the
system. We apologize for your frustration and look forward honoring our
contract as represented.

Sincerely,

[redacted]
President

We sincerely apologize for the
situation and or frustration our costumer is experiencing. We have no record of
Ms. [redacted] ever contacting Member Services with any complaints, questions or
concerns. GEVC has an Owners Orientation the first Sunday of every month, in
addition, Member Services offers one-on-one tutorials on how to use the system.
I request that Ms. [redacted] contact Member services so that we may investigate
the problems she is experiencing. In addition we can arrange for her to go back
to the showroom for a tutorial on ownership and discuss any issues she is
experiencing.

Ms. [redacted] purchased on October
12, 2014 and is well within the seven (7) day rescission period allowed through
the State of California. We have processed her cancellation and a refund of her
down payment will be credited back to her credit card. I have asked Member
Services to contact Ms. [redacted] to share with us the withheld information on the
contract, pricing and fees she is referring to. We apologize for any confusion
or miscommunication.

We apologize to this member for their frustration,
however our records indicate that the letter sent to us was dated January 13,
2015, not 2014. And our response was mailed January 31, 2015. This member has
never contacted our member services department for assistance in making a
reservation. We have reached out to the member and they have not responded. We
were very confused as to why they would address their letter to us and a Hotel
in Cancun Mexico. There are over 100,000 weeks available at all times. The
consumer seems to have buyer remorse but cannot cancel 2 years after
purchasing. We are more than happy to assist the member in getting out and on
vacation, as represented in 2012, when they purchased and in the response to
their letter of January 2015. The members have never contacted us to use the
VIP week given as a first day incentive, and we are more than happy to reinstate
this expired certificate so they can use it. The member was set up on auto
debit for their payments. When they asked the servicing company for an
accounting, they received it immediately. This information is available on line
as well. This member signed multiple documents confirming that the membership
was for personal use and no person connected with the purchase made any promise
or representation regarding rental, resale or investment. (Paragraph 7 of
Members Acknowledgment).

Response:
We sincerely apologize for any
frustration our costumer is experiencing.  The consumer needs to revisit her documents,
which we are sending her under separate cover. The customer did not buy a
Timeshare but did purchase the use of a timeshare membership for two (2) years.
As of this date there are more than 112,000 weeks available around the world
for $500 or less. Virtually every document signed by this consumer list [redacted] as
the company providing the vacations. We take offense to the accusation that we
misrepresent the product. Global Exchange Vacation Club “GEVC” offers
one-on-one tutorials on how to navigate the [redacted] website and our Member Services
staff is available to assist in getting the customer on a vacation that meets
their needs. We are sure we can get this member out and on vacation. In
addition to sending copies of the documents, we will have the Member Services Department
reach out to assist in booking a week for this customer.

This member has never contacted us with any requests or problems. Her first action is to file a complaint with the Revdex.com rather than contacting the Club or Member Services. We will reach out to this member.  If she is not satisfied, perhaps she can then file a complaint and not an inquiry or request.

this person used and we will reach out to her. We have never in the three and a half years of her membership received any communication with this member of any kind. We keep copious notes on all of our members and she has never called into Member Services. With that being said; if there was any confusion or frustration we would have no way of knowing.

#:               [redacted]   Response:   We sincerely apologize for any frustration our consumer experienced. Ms. [redacted] purchased on September 22, 2016. We received her cancellation on September 24, 2016; her credit card was refunded on September 30, 2016. We cannot be held responsible for the time her bank posted it to her account.  Every bank and/or credit card merchant is different, some take a few days some take a few weeks. Her refund was posted at the same time as all the other cancellations from that week.

We
sincerely apologize for the frustration our costumer experienced. It is our
desire that all who attend a presentation get the same information. The
allegations of misleading information are very concerning. We will do a
complete investigation of the events and have the VP of Sales contact this
member for further information and resolve the issues.

GEVC stands behind its product and the
representation of it. The consumer has the choice to stop paying his
commitment. The lender has the right to pursue the debt to the fullest extent
allowed by law.
