not flexible
Bank of America customer since late 80s. Long history great credit. Ran into problems recently. Debt sold to Gurstel. (I am reminded how we tax payers gave 20 billion to BOA in TARP in 2009 and offered coverage for 118 billion in keeping them solvent). So the country helped BOA.
WSith Gurstel missed one or two payments after over a year on a payment plan. Wanting to pay but they opted to garnish ages. Total embarrassment. Wish things were dealt with with better ethics or understanding.

Scam
I have been dealing with this company for years. They are trying to garnish my wages for a private student loan that was paid off 15 years ago. I have called and talk to them multiple times. DO NOT TRUST THEM! The BBB has given them a 1.29-star rating for illegal collection and tactics. I have reached to the MN State Attorney General for assistance. Never trust them.

They collect debts for their clients very well, but they show no interest in following up on settlement requests from the people who they collect from. Just terrible customer service, as if I am an only an account and not a human being.
Terrible especially during a pandemic, just terrible.

I had a settlement account through Gurstel Law Firm on behalf of Discover, of which was litigated in court and then renegotiated in 2018. I have been making payments since the beginning of 2018 to Gurstel Law Firm against the agreed settlement anount. Recently without indicating that they would no longer be accepting payments, did not cash the checks sent to their offices to pay my debt. This occurred for several months with no correspondence or attempt to reach me regarding the change to the agreed plan. I'm now faced with a company who made a legally binding agreement to alter their responsibility in the matter, and allow me to become default while I have made consistent payments in good faith to complete my debt obligation. This now has escalated to a point of frustration, and Gurstel has not accepted any responsibility for their direct part of this situation. Gurstel is completely to blame for both cashing a payment in February that was designated for Discover while conceding they no longer have oversight of the account, and refusing to remedy the situation. I am just attempting for this company to accept their portion as causing me to head to new negotiations and they defaulted on a settlement.

I am rejecting this response because: I do not believe that Gurstel Law Firm has adequately addressed the concern of the breach of a legal settlement conducted by their legal team as an agent of Discover and myself. This was originally settled in court, agreeing to the terms of a binding agreement that stated if I were to default would obligate me for full compensation sought by the creditor, however Gurstel Law Firm has created a condition of default by not meeting the obligation to inform and provide updated settlement arrangement or administrative detail in the case. By stating that they no longer hold a stake in this matter does not express the onus that the company has in this administering the settlement. There is no adequate response to the non transfer of payment sent in good faith to Discover through Gurstel as legally agreed in court, and the discontinuation of such through verifiable correspondence to me in their intent to do so. I am not satisfied in the response that they have no stake, nor that they sufficiently met their obliged notification of canceling a settlement arrangement either through recall or forced default of the terms.

These people are liars, sneaks & cannot be trusted.
1) They did not give ALL the evidence of the case.
2) They would send motions, change motions, send tons of unnecessary paperwork in order to overwhelm you. Many times duplicates & triplicates.
3) Wait a day or 2 to send motion to vacate a judgment I would have won hands down, adding to dismiss with out prejudice; stating WE had come to an agreement. LIE! I NEVER spoke to them, corresponded with them, EXCEPT answering motions or initiating motions.

These are untrustworthy and incompetent group. It's going on month 3 were not a single person can tell me why THEY messed up my account. I, like many others, understand that autopay means that the account will be paid automatically. Well not for the scammers at Gurstel Law Firm. Autopay means that we will auto draft for 6 years until we feel like stopping the payments so that we can place a lien on your property. Autopay also means that they will not contact the payer and let them know any of this happened by will do so quietly as they are hoping to collect when you unknowingly try and sell your house. Had an attorney even ask me "How did you know that there's a lien?" Clearly these actions were done secretly. They're kidding themselves if they think I'm going to let this going without them fixing their mistakes. Tell me that there shouldn't be a lien but will ask that I pay to remove it. This company is fraudulent and action needs to be taken to hold them accountable. Scandalous!!! Don't bother leaving that generic message about making contact. There isn't a single person in your law firm that I have spoken with that is capable of taking responsibility for how you all have wronged me.

I received a statement in my paystub for a wage garnishment from Gurstel Law Firm located in Scottsdale. The debt Plaintiff is listed as Capital One. I have two credit cards which are both in good standing and have never paid late. There is a civil case court number which is listed with the Encanto Justice Court in Phoenix, Arizona. Case CC2007256802. I was never served by the company or anyone else. I had no knowledge of any debt which is past due. The case number listed is not even valid.if this is a real case number it would be from 2007 which is over 13 years ago. I've never received any mail from Capital One or the Gurstel firm regarding the alleged debt. I feel they are overstepping their boundaries and violating the FCRA. They have also garnished money from a paycheck of mine for $174.67 I feel like they have made an I'll attempt to scare me into paying a debt I do not owe. No where in the judgement is there an amount listed which is owed or an account number from the original creditor (Capital One)

we moved into our new home feb 2019. April 2019 I received some court papers in the mail notifying me that a garnishment was going to take place. These papers were dated in early March and I revived them in April?? The court hearing went on behind my back without any knowledge of my knowing. Next thing I know 25 percent of my check is gone. I have two children to take care of, and I am the bread winner. That devastated my family. We almost lost our home. We called gurstel and agreed to a payment plan of 200 a month. Then we get call after call from the company that hired this crooked law firm and they want money from another account we owed on. So I agreed to pay them 200 a month. We called gurstel and asked if we could pay the other account off first and then start paying on their account. They pretty much ignored us. All of a sudden, here comes the paperwork in the mail again. They are garnishing and they won’t work with us. My wife isn’t working right now and my hours were cut back due to the virus, and they don’t care. These people have no human compassion. It’s all about the mighty dollar. Also gurstel, when you read this, don’t give me some half wit response about you looking into it. Don’t insult my intelligence. You are ruining my life.

Have tried to contact Guerstel for several days. Have garnished my wages without my knowledge or any proof that the debt is mine. Have offered a couple of amounts to settle debt but to no avail. Because of the wage garnishment, may lose my home due to lack of funds.

A hold was placed on my bank account with Chase Bank by the Law Firm. I was confused as to why they were holding almost all the money I had in my checking account because I had been making my payments and I didn’t receive any communication from the law firm as to why the hold was placed or that there was an issue with any of my payments. I contacted the law firm and couldn’t get a hold of anyone for 5 days because the specific department that handled my case was always busy. When I finally got a hold of someone they told me that my payment was not received Oct-Jan and I told them that was impossible I had mailed them a check. After looking into my bank account the checks that I mailed were not cashed. I had placed a stop payment on those checks and immediately made an online payment to cover those checks and pay for the current month but the hold was still on my account. I called back in after the online payment went through and again was unable to get a hold of anyone and when I finally did they told me just because I made the payment online it doesn’t mean that they are going to release the funds. The money that they are holding are exempt funds. They are exempt from garnishment the entire balance is. I sent them multiple emails advising them that they are holding exempt funds and I provided statements proving that the money was State retirement funds and an insurance payment from my auto insurance for a collision that toatled my vehicle. All which would be considered exempt funds. However, after giving me a week of the run around and making it seem like they were trying to work with me the attorney notated my account that the info given is not enough to warrant removing the hold on the funds. I asked for carififcation but was advised by the collection representative that is what it says and nothing that could be done.

This company has a collection for a credit card I used to have. They served me with court papers on February 4, 2020. I called the firm immediately to arrange a settlement and even sent in a settlement on their website. I cannot get a hold of anyone and have left multiple messages. I cannot afford to be taken to court considering that I’m in the final stages of filing for SSDI and my husband is underemployed. I really hope I can work something out as this is causing my already terrible anxiety to be worse.

I have continued to provide documentation proving there is no debt in my name. This company continues to harass me and is trying to sue me. Citibank even proved there is no debt and per Citibank Security Operations this is "very suspicious" and I should be "very weary" of providing any information to this company who is trying to sue me for a credit card debt that does not exist with my social security number. I contacted Gurstel Law Firm and waited 2 business days before calling back to ensure this issue is dropped for good. I was told "by the end of the week we should have something". This is unacceptable after a year and a half of proving there is no debt,. There is no signature of mine taking out this card, no authorization for any charges on this card and zero connection of mine on this card per CitiBank and all 3 credit bureaus. Per CitiBank's Fraud Department Gurstel Law Firm is in violation of the Fair Debt Collection Practices act and suggested I file a complaint to the Revdex.com, the Attorney General, and the Consumer Financial Protection Bureau as there is no debt.

On 2/10/2020 The "attorney" at this "Law Firm" called Citibank and confirmed the account was closed, there is no debt but Gurstel Law Firm doesn't know what to tell their client, Unifund so they are going forward with a lawsuit over a non-existent debt.

My bank accounts were emptied from a supposedly court order. I have never been contacted by this firm nor served any documents from the court. I am on SSDI and my income is protected under Federal Law! It is impossible to reach anyone at this company. I will be retaining a law firm to counter sue Gurstel.

Horrible company. Only send out letters to place judgement against you. Will not budge in settling your debt. Expect you to call them to continue to beg for any justice. Beg for proof of credit card debt. Will not send proof of signed certified mail which was delivered . Do not take in to consideration anybody's hardship even if they are sick and unable to pay. Shame on them

I have reached out to this company numerous times with no response. I have sent in settlement requests online and no call back. I have called and left messages and no call back. I now have emailed and written a letter to see if anyone would make contact but I can't seem to get a hold of anyone. I keep getting collection letters and now they are talking about taking me to court. I haven't had an opportunity to discuss this debt with anyone or an opportunity to try to pay it back. This company is not working with me and I can't afford to be taken to court.

This is absolutely the worst business... if you can even call it that!! I can get much more help and professionalism from a scammer than what I can get from this place. I have been trying to get a hold of someone for over a year now. I've tried calling, which the phone will ring for 5 minutes if not longer before someone answers the phone at which point they act like they are put out for even having to answer it in the first place, then, no one is ever available so you go directly to a voicemail (which must be a black hole of unanswered phone calls). I've tried sending numerous emails, with read receipts so I can confirm at least someone has at least opened them; which they haven't. I've tried emailing, faxing, certified letters; even going down to the business to talk to someone which l might add you cannot even get in to try to talk to someone. For someone trying to collect a debt, they sure do an awfully horrendous job at it!! Now, they just sent a court order for wage garnishments to my brand new employer stating they have sent numerous messages and letters to myself without any answer!!!! Is this st for real?!?! I wish this was all just a terrible joke but unfortunately it is not. Do these people, if anyone actually works there, have any idea on what they actually do there.... aside from screwing with people's lives?
