Review: I keep getting this company's product ever though I never asked for it. It keeps billing me for $49.90.

I do not want the product and want this company to cease wanting to collect the $49.90 for two products sent to me and returned.Desired Settlement: To cease billing me for the products I do not want and have not used.

Business Response /* (1000, 5, 2013/06/20) */

This client has already received numerous responses. He appears not to read any responses and has sent upwards of 20 emails repeating the same complaint. We immediately responded to him that the trial he offered is only available as a subscription, and we do not accept returns of additional shipments after the trial has expired.

Consumer Response /* (3000, 7, 2013/06/25) */

(The consumer indicated he/she DID NOT ACCEPT the response from the business.)

I have yet to receive a response from the company. I've sent various cancellation notices to no avail. The company has ignored dmy plea to cease sending me the product and has yet to refund my $49.90.

Consumer Response /* (3000, 9, 2013/06/27) */

(The consumer indicated he/she DID NOT ACCEPT the response from the business.)

I doo not accept the settlement until the company ceases to bill me for the product I have never used.

Business Response /* (4000, 11, 2013/07/01) */

As stated previously, we canceled his subscription upon request.

Review: A few weeks ago, using my mobile phone, I ordered a trail of [redacted] a new supplement by Impact Nutriceuticals that claimed to be as good as medication, safe and natural. It was $2.99 and I have not been sleeping due to chronic pain. I did not see any strings attached to the product on the mobile web page that said it was linked to an order for an additional month and when it arrived it contained no paperwork stating this. The product is not natural. It contains [redacted] which is a [redacted]The safety of the product is in doubt as recent reports on [redacted] cast doubt on the safety of this dye.I did not take it.Then on April 6, 2015 my credit card was billed for $49.90 by [redacted]. I requested my money back and was actually threatened with libel by their sales manager on both the phone and in an email when I told them I would publish reviews on the internet of their product.(You will not receive a refund. The terms are made abundantly clear.See attached.Further, having worked as a paralegal, you should know thatidentifying yourself as an expert in nutrition falls outside thepurview of free speech and crosses into libel. All illegal activity or libelous content will receive the appropriatelegal response.Thank you--Best regards[redacted] Customer Support[redacted]).While I may have studied nutrition and be a health promotion professional I still have a right to review a product as a consumer. This product does not compare to medications in any way yet it is advertised as such and they employ poor business practices and actually threaten customers.I want my money refunded and Impact Nutriceuticals to change the way they do business by making the contract for additional supplies more clearly evident and included on the paperwork included in the package of their trail.Furthermore, I believe they are making dishonest claims about the product being natural, safe and effective as medication in treating anxiety and improving focus.Desired Settlement: I want all my money back ($2.99 plus $49.90) and I want the ad for this product modified to clearly show the trail offer means they customer will be billed in the future and I want a disclosure included in the trail shipment reiterating this fact.

Business

Response:

First, [redacted] never makes any claims to prevent, cure, or treat any disease and draws no comparisons to pharmaceutical medication. These disclosures are printed on every page of the website at [redacted].

Review: I purchased a 14 day FREE trial and paid for shipping. I did not authorize any subsequent orders. I did not understand that they automatically will ship orders if I did not cancel within that 14 day cycle. That is not clear. My checking account was charged $49.90 for an unauthorized order. They refuse to refund that money to my account. They have shipped the order without my knowledge. I told them that it would not be opened and shipped back to them in the same shipping they had sent to me. I need your help to be able to get a refund and to report to the Revdex.com that their advertising is very misleading. They also recommend in their advertising to use this product for 90 to120 days to see if it is effective. Another reason I didn't understand having to cancel this product within 14 days in order not to receive any more of their product.Desired Settlement: They should refund my money.

Business

Response:

Hello,

Review: This company offers a trial of their product for fourteen days at a cost of $2.95. I was not made aware that they would bill my credit card for a "subscription" to their product. I have only received the trial package and have not used it but I have been billed $60.70 for an unknown reason. I have asked that they return my money but the refuse to do so, even after two requests.Desired Settlement: I would like the $60.70 refunded. I would also like them to be upfront about the "subscription" as I thought I was ordering a trial and nothing more. These people are preying on ill people that can be taken advantage of very easily. I find it very distasteful that this company is taking money from people suffering from mental illness, that often cannot see that they are being scammed.

Business

Response:

This customer's complaint is factually false in several respects. The trial ordered is only available as a monthly subscription, and the terms of the offer are made very clear numerous times. They are also reiterated on the Order Summary section of the checkout page. Please see attached checkout page.

Review: I purchased their product, a 14 day supply with my bank debit card, and after a month they took out $49.90 for a 30 day supply, with out my permission or concent to do so! The 14 day supply was $2.95, that's all I was responcible for!Desired Settlement: I want the $49.90 credited to my debit card!

Business

Response:

Mr. [redacted] complains is factually false. He specifically ordered a monthly subscription, the terms of which are clearly displayed. Please see numerous examples below and attached. As such we will not grant a refund.

Review: I called this company when I received a package from them in the mail yesterday. I said that I was unaware that they would continue sending this [redacted] Capsule because of a free trial that was advertised while I was shopping online. I didn't even know how much the charge was. The representative cancelled my subscription that I didn't even know I had. I asked to speak to a manager because she would not refund me. She told me it was $49.90. I was so upset. The manager said you knew because it is on every page of our website. This is not the location of the ad and I was unaware of any of these disclosures. He was belligerent about it. He said that I could be fined and imprisoned for trying to dispute my charge. It was very upsetting and scary. Can you help me?Desired Settlement: Please help me get my money back from this company. I've written a review on [redacted]. I've tried to get help from my credit card company. They recommended calling you. I think this company should disclose these refund parameters on their AD pages.

Business

Response:

Hello,

Review: I contacted this business on 05/06/2014 requesting they refund my money they charged on my debit card! I let them know that I have not even opened the products they sent me! As a matter of fact they still have the original seal around the cap, which proves I never opened them! I told them I was willing to pay the shipping and handling fees to send them their product back. I first spoke with a "[redacted]" (the reason I put the quotations is because I feel they gave me an incorrect name to begin with. "[redacted]" said her hands were tied and she couldn't refund the $49.90 they charged on my account! So I asked to speak with someone above her and she had me wait only to tell me that her manager would call me back! Well he did call me back claiming to be "[redacted]." Once again I put his name in quotation because he refused to give me his full name and refused to give me another number or someone higher than him that I could speak with! That itself was a red flag to me! That isn't customer service! I work for the public and when customers come in requesting their money back for an item we sold them 6 months ago we give them their money back because we believe in customer service! Yes we lose out on that item because it's damaged already but that doesn't matter...what matters is that we took care of that customer and they left satisfied! I am very upset that they will not refund my money for their products that I am willing to send back to them! What kind of business are they running if they can't even satisfy one customer that is requesting her money back? customers don't like to hear about the policies of a company (trust me I work for a corporation.) Why is it so hard for them to refund my money and just get it over with? I am very angry and upset at how they are handling this situation! I believe I have a right to get my money back for a product I never even opened and tried! Please look into this business and see what their problem is! I would greatly appreciate it if I get a response back from y'all!Desired Settlement: I am requesting that they return my $49.90 that they removed from my debit account for a product I never even opened! I am willing to send them their product back and never deal with them again! That is not a business they are running! They are just stealing money from hard working people like myself!

Business

Response:

Ms. [redacted] is requesting unreasonable preferential treatment, that we unfortunately cannot accommodate.

Review: This company advertises a antianxiety product called A2X offering a 14 day trial for $3. This so called trial is nothing of the sort because the company will automatically send you the product once a month charging your credit card $49.90 US each time. Although they do indicate this somwhere on there web site I believe this to be misleading to the public. They should not be permitted to use the term "TRIAL" in their ad when its not a trial. Its an underhanded way to rob the public. Thank youDesired Settlement: Having read the product ingredients I have no intension of giving this to my child as the ingredient 'titanium dioxide' is a potentially harmfull substance. I offered to return both bottles which are unopened for a refund of the second charge of $49.90 US and was refused. I would like that refund.

Business

Response:

The customer himself admits that the product is presented properly (although without due diligence as he does not seem to have referenced the site himself.) We try to make the product presentation as well as the return policy very clear in numerous places on the site. We state it no less than 5 times before an order may be placed in addition to requiring a customer to check the box "I agree to the terms and conditions of this sale."

Review: I ordered an anti anxiety medication on line through his company. They sent an additional supply and charged me $50.00. I sent it back but they will not refund my money. I did not open the bottle and did not order the next supply.

The trial is only available as part of a monthly subscription. We make the offer very clear in numerous ways. We also offer a one time bottle for full price which this customer did not choose. We do not accept returns on additional shipments once the trial period has expired. We offered to return the product to the customer (even though he disregarded the return policy) at our own expense, but the customer declined.

Offer is made very clear:

Main page (www.a2xanxiety.com)

Review: I rejected and returned unopened product, but a refund was rejected.

I ordered a trial period product. Subsequently, another order was delivered and my bank account was automatically charged for the ammount. I wanted to cancel any further orders which I cancelled. I rejected and returned unopened the product that was delivered. I requested a refund via e-mail and telephone. My request was rejected via e-mail. I responded that I wanted a full refund and that I would report them to Revdex.com and State of Connecticut Attornet Generals Office of Consumer Affairs.Desired Settlement: I want a full refund for what was charged to my bank account: $[redacted]

The customer first requested to cancel his subscription. His request was immediately processed within the hour. The customer then decided on his own to return the product (we do not accept returns) and notified us of his intent. He was immediately informed that we do not accept returns. The customer then disregarded our policy and communications and returned the item regardless. Please see all communication below:

However, as of today, 3/11, we will not send you any additional automatic shipments. We cannot initiate refunds on shipments because of the possibility of tampering. Business Response /* (1000, 5, 2013/05/06) */

This customer's complaint is factually false in several respects as well as inherently contradictory. First of all, our email address has never had an instance of downtime and can receive and respond to all emails at any time (during business hours.) We can prove our email system operated normally by the email we sent on 4/2/2013 to the client confirming his cancellation request. See below.

The client also contradicts himself. He claims he cannot contact us, yet in the same paragraph he states he spoke with one of our representatives (also untrue as we record all phone calls) and that representative agreed to cancel his membership. Obviously this customer is making inherently contradictory, false accusations.

The customer did leave a message on our voicemail on 4/2 and immediately received the following response by email (successfully delivered.) As such, of course, we will not refund our company's charge. Email below:

Consumer Response /* (3000, 7, 2013/05/09) */

(The consumer indicated he/she DID NOT ACCEPT the response from the business.)

I do except the fact they are removing my name from their monthly shipment and payment for their pills. I do not accept their comments concerning what I wrote. I have copies of both emails I sent to them that were returned to me. I never received the 14 day trail sample. I did call a phone number and was told my " subscription " was cancelled. I have no idea who I talked with. My facts are true, but I know I will never receive my money back, but am happy my wife got through to them and was able to correct the situation. It has taught me a lesson concerning the trusting of offers by business. I'm 83, and learned years ago there is no such thing as a "free lunch" Thank you for your assistance, but I am sure that what was offered is all I can expect. I am satified that they have removed my name from their listing. Thank you.

Business Response /* (4000, 9, 2013/05/10) */

The statements the customer makes are simply false. First, if the customer has copies time and date stamped of the emails he sent, why would he not include them in the correspondence? Secondly, it is impossible for the client to have spoken with a phone representative as we do not employ live phone representatives.

We understand the client is elderly, but the client's age does not excuse a misrepresentation of fact.

Given these circumstances, we will not refund the client's charge.
