Yesterday I replied to this complaint saying that I accepted the comment from TimePaymentCorp saying that as long as I did not receive any more messages from them I would be happy, and had the complaint closedHowever today I received the following message from TPC saying the following: Dear *** ***:Your account has been referred to our Collections Department for handlingI would like to try to resolve this matter before additional fees, if appropriate, are assessed to your account. You executed our standard Non-Cancelable Lease AgreementPrior to funding this Agreement, our Credit Department verified with you that the equipment was installed and in good working order, as well as that material terms and conditions of this Agreement.TimePayment is only a financing sourceAny problems you may have with the equipment, or with any service associated with it, are between you and the dealer from whom you acquired the equipmentAny such problems do not excuse your obligation to pay TimePayment under the terms of the Agreement you entered into with usAlso, our Agreement has an agency disclaimer which states clearly that the dealer has no authority to waive or alter the terms of the lease and any representations made by the dealer shall in no way affect the rights and obligations set forth in the lease. Please contact me immediately to resolve this matter.Sincerely,*** ***Collections Representative###-###-####, Extension *** Needless to say, TimePaymentCorp lied to me when they said that the account was closed and no payments are dueI am still receiving collection notices and I want them to stop right nowAs a result, I am officially rejecting their message until we get this matter resolvedPlease help me in getting this taken care of. Sincerely,*** ***

TimePayment has had the opportunity to review your account, and we would like to address your concerns in our responseAs an initial matter, please be advised that TimePayment Corpis a finance lessor, located in MassachusettsWe do not have representatives or offices in the state of Georgia,
and do not have any way of recovering the equipment ourselvesPursuant to the terms of the Commercial Equipment Lease Agreement that you signed (see section 6, “End of Lease Term”), you are responsible for returning the equipment once the obligations under the Lease have been fulfilledOccasionally, TimePayment’s Asset Department is able to make arrangements with remarketing companies more local to our customers, so that equipment can be picked-up, rather than a customer having to ship it to us in MassachusettsBe advised that this is done as a courtesy, as TimePayment is under no obligation to piequipmentWe apologize if you perceived our representative's email to mean that the equipment could be pickimmediately, however that was never stated and TimePayment has no control over the availability and scheduling of other companiesIn this case, your buyout payment was received on June 27, and you were informed that TimePayment’s Asset Department is working to make arrangements with a company more local to you, to have the equipment picked-upWe apologize that the pickup cannot happen immediately, but we encourage you to work with *** in our Asset Department, at *.***, or at *** *** *** ***, to make arrangements for the equipment to be pickin the near future

I have not heard anything back from TimePayment Corp as to what is going on with this fraud accountSeems like they have had plenty of time to look into this matterThey have also reject a request to remove this account from my credit reports! Regards,

As stated within the terms and conditions section of the Lease Agreement, and in our previous response, TimePayment does not offer any warranties for the equipment, and is not responsible for servicing and/or repairs to the equipment As stated in the ”Maintenance” section, located on page 2, you are responsible for maintaining the equipment in good operating condition at your own expense, and TimePayment does not provide servicing of any kind Furthermore, this is an Equipment Lease for security equipment, and not an alarm monitoring agreementTimePayment does not bill you for any services, including monitoring, nor do we have knowledge of which monitoring company you useProblems with your service should be addressed with the service-provider TimePayment does not reimburse individuals for postal fees in the event that the individual elects to send mail to our company certified We have complied with your original request for the account to be closed and the credit bureaus to be notified of the error, and we have addressed your equipment-related concernsWe sincerely apologize that we cannot be of further assistance

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***Please add your rejection comments below. I don't understand how you feel their practices are compliant with all lawsI told you specifically they refuse to stop harassing me about when the payment will be made and you didn't address that at allAdditionally you did not address the fact they threatened to report information on my accountIt appears you assumed I was referring to the name on the accountI have attached a screen shot from our email conversationsThere are several screen shotsI am referring to the screen shots where I specifically requested to no longer be contacted and continued to be emailedAlso I am referring to the screen shot that shows Payton saying she will just report that I am refusing to pay when I said nothing of the sort. Finally, I have included the definition of an LLCRegardless of whether or not I gave you permission to run my credit the structure of the LLC system doesn't allow you to holdme personally responsibleYes, you may use my credit to check my credit worthiness, but not to hold it against meThis is not what believeThis is a factPlease reference the signed lease you sent meWhere is my name??? Under the leasee name it has my LLC, not my nameSo although I signed for it and am representing it, I'm not itThe point of an LLC is to protect me personally from anything like thisAnd even if your contract attempts to alter that fact it isn't possible to do that because of what an LLC isTechnically the person liable for all of this is named evoLLLCIf this were to hold me personally liable, then my name would be on the agreement under name, not evoLLLC. last thing I would request you make note ofThey stated my agreement was for months at approx $a month, then they said my payoff amount was over If you were to do the math, X = I have made a few payments alreadyPlease tell me how this is possible that after making payments the payoff amount is higher than what the initial agreement was for. I really dont don't see how with this information you can say they are following all collection laws for every stateEspecially in regards to harassment.

We completely understand the roll TimePayment has in this contractWe also understand that the installer, *** Securities of the SE, sold the contract to TimePaymentWe have asked repeatedly to have TimePayment assist us in contacting not only *** Securities, but any other third party to have the equipment fixedSince our equipment has not worked for some time now, and the monitoring company is not actually monitoring said equipment because of it not working, we have contacted TimePayment several times only for assistanceWe believe *** Securities of the SE is no longer in businessWe have tried to have a third party come out, but because they did not install our equipment, they would not work on itThe third party only would fix their own equipment and could only suggest getting into a new contract with their companies Our hands are tied and we have made every attempt to work with TimePayment only to be ignored in our efforts time and time again All we have ever asked is to assist us in finding someone that already works with TimePayment, that wold be able to fix our equipment Each time we were told TimePayment would call back with some assistance, we would not get that call and the process would start over againWe have been working on this matter since April,
