Yes, it's true I had signed an addendum stating the phase was undeveloped, and I am not denying that he informed me of thisBut no one at LC Homes explained to me that there was more to the delay in starting construction on my home, other than the phase needing to be developedI had to find out through other sources, including the Town of Middletown that the builder was having issues in having building permits released to them for phase due to *** leaving a substantial amount of amenities unfinished in the communityAccording to the Town, this information was known to *** for the past months, which was BEFORE I signed my contract! This is something I feel that someone at LC Homes, including the sales representative, should have informed myself, and other phase buyers aboutThis is the reason why I feel that the builder was not very forthcoming with certain information, and basically has "taken my money"Regards,

Per the clause in the signed purchase contract, we have a full year to deliver ***’s home, making the deadline April, 2016. We will begin the refund process if we get closer to that date and feel unable to fulfill the contract, until then there
is no required action on our part. We will continue to try and secure the necessary permits to get the house built in the time specified on the contract.

For your reference, details of the offer I reviewed appear below*** I am appalled that you would indicate that you attempted to contact us on May 15th regarding remarketing the lot because that is untrueYou never contacted us regarding remarketing the lot or the conversation you had with the lenderIn my email dated May 20th you indicate that you "thought" *** *** notified us that the lot had been remarketed when I asked you why we were never notified. You replied to my email which is attached "I was informed and it was recommended by Highlands that we remarket your lot weeks agoI'm surprised Highlands didn't contact you earlier, I thought this was communicated to you when it was communicated to me". In addition, our scores did not drop after signing the contract which is another statement. On May 20th we entered the sales room to give additional deposits and NEVER had a conversation with you about credit scores or additional deposits because you were not in the office your assistant *** *** who had no idea why the lot was released and remarketed and could not answer any questions that we had regarding the lot indicating "available"

I find it antagonistic that LC Homes would suggest that I was the cause of our failed business transaction when their subsidiary company Highland Mortgages (specifically *** ***) was grossly negligent in the handling of my home loan applicationThe facts are this, I have a credit report from Highlands Mortgages from June 28, 2015, with a reflective credit score of Mr*** stated on numerous occasions that if I had a credit score of or better that the purchase of this home would go throughSo I vehemently dispute the fact that I had a negative credit scoreIn obtaining the credit score, I was told by Mr*** to challenge items on my report that were old, outdated, or non-reflective of their current standings(I can provide e-mails to Mr***'s suggestions and tips.) I find LC Homes suggestion of "disputed major derogatory credit" to be inflammatory and condescending, since this is Mr***'s protocol for improving credit (not to mention an industry standard)I have been in law school for the last two years it is not uncommon for law students to have periods of unemployment during the course of schoolingI informed Mr*** of my fragmented work history and he stated on numerous occasions that my work history would not be a barrier to this purchaseI have not had an NSFs on my USAA checking account days prior to closing, even still Mr*** had my banking statements since March of Mr*** never raised a issue or concerned until days before closingMr*** ignored several industry customs in the execution of my home loan packetDespite constant communication on my behalf, Mr*** lied or misled me on the details of the purchase of this houseOnly after I spoke with other mortgage brokers that I was told that my income did not support the purchase of the property in question, that Highland Mortgages and LC Homes highlighted these erroneous credit flawsI agreed to a resolution of LC Homes returning my deposit money and I would not seek further litigation or remediesHowever, if LC Homes refuses to take responsibility for the ineptitude of Highlands Mortgages and Mr*** and apologize for the inconvenience, I will be forced to seek legal recourseFurthermore, LC Homes will refrain from any future direct, inflammatory, or suggestive language that somehow faults me with our failed home purchase transaction

I spoke with *** today. The refund check has been cut and now just has to be signed, which can take some time, but she will receive her check soon. She informed me of her new address to which I forwarded on to corporate. Thanks

LC Homes will honor the contract that both parties mutually agreed toOur sales representative *** *** has been truthful about the current status of Enclave and has notified all buyers that we are unable to apply for permits until New Castle County allows us to turn in the permit application
At this point the county has not granted our release, but we are hoping to be released soonFrom that point we are approximately days from the start of construction to deliver the home

LC Homes will not reimburse customer for any actions or decisions regarding his application and/or denial from Highlands MortgageIn regards to customer’s earnest money deposit, LC Homes will review the situation with VP of Operations Patrick Feeney to determine the seller’s positionBased on Highland’s denial it appears that the customer was the sole cause of mortgage denial. Typically in this situation the buyer would forfeit any deposits due to lack of performance per the agreement of purchase and saleSincerely,

Problem:
On April 26, 2015, my husband purchased Lot from LC Homes for a our new home to be builtWe paid them $10, deposit for our new homeHowever, months later they haven't obtained permits nor broken ground on our new home!!!!!!! They have ignored numerous phone calls made by myself, lawyer, and REALTORMy family have not received a phone call with an explaination from Cabano (business owner), nor from project developerThey have taken our money and vanishedThe only person whom we can speak has been the sales rep LindaI wrote a complaint to the Revdex.com last year in September when the closing date came near for completion of the homeHowever, there response then was "per the contract clause we have a year until April before we are in breach of contractOnly then will we move forward with the refund process" They have handled thus situation very unprofessionally and without integrity!!!!!!! How can business ignore their customer for almost a year? They are the worst type of people I have ever done business with!!!!!!! I have had better customer service from McDonalds for cold fries!!!!!!!!!!! Please do not do business with these people!!!!!!!!!!!!!!!!!! They have taken an exciting experience and have made it an utter nightmare!!!!!!!!!! We want our money now, not April 26, 2016!!!!!!!! You haven't built our home!!!!!!!!!! So why are you holding on to our money/contract!!!!!!!! The right thing to do is release us now, not next month!!!!!!!!! Very unsatisfied customer!!!!!!!!!!!!!!!!

I live in an LC Home neighborhood Over the course of the last three years I've had nails in my tires Yes, I live in a new construction neighborhood, however this is is unacceptable I politely approached LC with this issue Their response:
“Unfortunately, you live in a construction zoneI confirmed that LC is having the streets swept once a week and will use a magnet in between to pick up any that are seen, which is usually during framingThe two houses he mentions are in the final stage of completion LC Homes and the developer has never and will not pay for tire repairs.”
I work from home, these nails are not "bad luck" nor are they a coincidence This is poor construction management

We are currently investigating this situation to determine who is responsible for the issue. We hope to have a resolution and strategy to fix this issue within two weeks and we will update if we reach one prior to that date, thank you

Ms*** (the Customer) signed her contract with LC Homes on September 13, with a PROJECTED delivery date of March 30, At time of signing, the sales representative explained that the phase the customer was purchasing in was undevelopedThe customer signed the Undeveloped Homesite
Addendum that explained “The buyer is entering into an agreement to have a home built on a homesite that has not yet been fully prepared for construction…The buyer understands that Seller does not control land development,…local government permit processes, etc…Buyer acknowledges by signing this addendum that the settlement date given is an estimate only.”At the time this document was presented to the customer, it was explained to her that there are no guarantees of delivery date and that anything can happen to delay the processAt signing it would have been impossible for the sale representative to inform the customer that construction would start sometime in March 2016, when at the time of signing that was her projected settlement dateAt no time since the signing of the customer's contract did either the Sales Representative or his assistant gave exact months or timelinesEverything was given as possibilities or projectionsThe delay today was not known on September 13, when the customer signed her contract, other than what was explained to her in regards to street infrastructure. LC Homes has not to this date, received any written notice requesting release from the customer's contract.LC Homes will abide by the agreements signed and we expect the customer to adhere as well

For your reference, details of the offer I reviewed appear below.As I stated in my initial complain, they haven't applied for a permit because they are not in compliance with what was approved on the original plan they submitted the countyThe county is accepting permit application and recently talked to them LCHOMES shifting blames They are practicing deception since the permit situation has been known but they failed to inform potential buyersIt's lies after lies and personally feels their business practice is shadyIt's built on lies

LC Homes is awful We purchased a home in phase of the Estates at StAnnes in Middletown and it was over months delayed and the sales person was incredibly rude and dishonest on numerous occasions The customer service was horrible They did not communicate about the delays at all We had to probe and ask many questions and request to speak to executives in the organization to even attempt to get any information When we did finally get answers, they were excuses that were false
Here is an example of an email we received from our LC Homes Sales Rep during this process
"If you can’t make this work – I’ll have no choice but to cancel your contract for Breach– sell your cul-de-sac lot (that everyone wants) and resell a Waterford for $25k more and…make more money."
Threats to cancel our contract? Telling us you will re-sell our lot and make more money? To me, that was extremely unprofessional
We finally settled in December We were one of the first LC Homes to settle in phase of the neighborhood, yet they were extremely late laying our sodThey did not lay our sod until the summer of We spent a fortune watering it to keep it alive throughout the summer
I would NOT recommend LC Homes

Dealing with Lc homes has been a horrible experience*** *** their mortgage planner is the worstWe were suppose to close on our home since May, Our home has been completed since June,2014.We are still not in our home

Her husband came to our office on the 27th and picked up the check. This issue has been resolved

We will continue to try and work with the client until he is satisfied and closes the case, thank you

We have remediated the situation and returned the deposit back to Mr***We find this an acceptable closure to this situation as both parties are now satisfied
