Nissan Sentra in June of 2016.   Mr. [redacted] had an opportunity to inspect and drive the vehicle at time of purchase and it was disclosed to him this vehicle was in used condition.   At that time customer decided to purchase the vehicle and the appropriate disclosures about the vehicles history were signed.   Equity Auto Center sales used cars and tries to give customers to the best of our ability a good running vehicle at a price that meets there budget.  Unfortunately with used vehicles they cannot be perfect.  Customer stated that the vehicle had a bad battery and the breaks were squeaking.  Equity put a new battery in the vehicle and the brakes were inspected and found to be working to manufacture guidelines.  The customer has driven the vehicle for a month and failed to make the agreed upon payments that were contingent of his loan approval.  The down payment that Mr. [redacted] paid with a check bounced, [redacted].  Customer failed to meet the agreed upon terms and because of that the car was taken away.  The customer came in with his mother and she is on camera yelling profanities in our main lobby so they were asked to leave.   Upon leaving Mr. [redacted] is on video kicking and causing damage to the vehicle.   The damages will be assessed, a police report will be filed and Mr. [redacted] will be hearing from our attorneys with the amount he has to pay our store for damages.     Equity Auto Center considers this matter to be closed.   Thank you.     Equity Auto Center [redacted] [redacted]

be in perfect condition.  Equity try’s to sell cars that are in the best working condition, to the best of our ability.  Equity does give customer the opportunity to inspect and drive the cars before purchasing.This is the first time Equity heard that Mr. [redacted] had an issue with the car he purchased.  We were never given the chance to inspect the vehicle before Mr. [redacted] took matters into his own hands.Our store policy is that before we can approve any repairs for a customer vehicle.  The customer must bring the vehicle to our store so we may inspect and deduce what mechanical repairs are required.  Since Mr. [redacted] has already completed repairs Equity Auto Center is willing to give Mr. [redacted] a good faith reimbursement of $100 Dollars. Mr. [redacted] may contract Equity Auto Center at [redacted] to schedule a time to pick up his reimbursement.  us why here...

To who it may concern;   This letter is in response to a complaint filed by [redacted].  Thank you for bringing this matter to our attention.  Equity Auto Center has looked into this matter and found the following. Mr. [redacted] purchased a 2010 Nissan Altima on 5/31/2017...

from Equity Auto Center.  Equity Auto Center fully disclosed to Mr. [redacted] that the car he was purchasing was a Lemon Law Buyback and has all the appropriate disclosure signed by Mr. Dominquez to prove it. Please see attached copies. Mr. [redacted] states that he purchased a salvage title and is wrong.  Mr. [redacted] purchased a “Lemon Law Buyback” not a salvage title that is a completely different thing.  The Vehicle he purchased had a 12 month 12,000 mile warranty from Nissan North America Inc.  Please see attached copies.   There are some credit unions and banks that will finance Lemon Law Buybacks.  As to the interest rate, Mr. [redacted] was given the interest rate he qualified for at time of purchase based on his credit. Equity Auto Center is willing to give Mr. [redacted] KBB Trade in Value for the vehicle witch should be way more than $2,000.00 Dollars toward the purchase of another vehicle. Equity Auto Center will also match the interest rate of the credit union of 4.5% on approved credit.  Please let us know if there is any further information you may need.  Equity Auto Center considers this matter to be resolved.

This is a response to a complaint filed by Julie Morgan complaint # [redacted].  Thank you for bringing this matter to our attention.  Equity Auto Center has looked into this matter and found the following:  [redacted] purchased a 2015 Dodge Charger on 5/24/2016 with 34,532 miles. The Vehicle had manufacture warranty at time of purchase and customer did not purchase an extended service contract. The Customer could have taken the vehicle at any time before 36,000 miles to manufacture for repairs.   Equity Auto Center sells used cars and tries to the best of our ability to make sure those cars are of good quality.  Unfortunately with used vehicle there are certain risks consumers knowingly take.               Equity Auto Center would consider trading Mrs. Morgan out of her car and give her a fair market value towards the purchase of a different vehicle.  Equity Auto Center considers this matter to be closed.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.  After speaking with [redacted] from Equity he is aware that I am truly dissatisfied with the company's treatment of my account.  This account went into default because they chose not to respond to my calls.  I expected a letter from the actual company that is "servicing" this account, and I have received none.  I expect that upon  receipt of my check that will be in the mail tomorrow, Friday, May 22, 2015, I will immediately be mailed the deed to my car as promised.

To whom it may Concern   Thank You for contacting us regarding this complaint.  Equity Auto Center would not be able to give Mr. [redacted] an accurate Fair Market Trade in Value without fist seeing the vehicle.  If Mr. [redacted] would like to take his car into Equity Auto Center at our Phoenix store [redacted] [redacted] Phoenix, AZ 85023 Equity Auto Center would be more than willing to give him a trade in value.

Thank you for your inquiry into this matter.  According to our business office this Gap will not be remitted do to customers canceling the Gap Policy shortly after purchase. This Gap Policy was canceled and a full refund was issued to Wells Fargo Dealer Services in the amount of $895.00. ...

According to our dealer agreement refunds for any after market products must go to the financing institution that provided the loan unless loan was paid in full by customer.  This loan was still in processing when customer was trying to cancel the Gap Policy and no account number was issued.  Therefore dealer had to wait until lender finalized there records in order to accept any cancellations or credits that may need to be posted to that account.  Customer expressed urgency of cancellation and this process was explained on several occasions.  Thank you for your time I hope this helps.

To Whom It May Concern:   This letter is in response to a complaint filed by Terence P Butler.  Thank you for bringing this matter to our attention.  Upon review Equity Auto Center found the following.  Check [redacted] was sent to [redacted] a secondary lender....

Check # [redacted] has cleared our bank account.   Equity has contacted the lender and the lender stated it could take 3 to 4 weeks after a check clears there account before any lien can be released and title can be mailed to dealer.  Equity has not received a title from the lender at this point.  No refund checks are released until title has been received.  A refund in the amount of 566.31 will be available for Mr. Butler from Equity Auto Center to customer one week after title has been received.  Equity Auto Center finds this matter to be resolved.  Please let us know if there is any further information you may need.

looked into this matter and finds the following.  Mr. Figueroa purchased a warranty with the purchase of his vehicle.  Warranties are a cancelable item at customer’s request.                   The Cancelation proses is as follows.  Customers can ask to speak with a finance manager at Equity Auto Center from 9am to 5pm Monday thru Friday.  Warranties are pro-rated and refunds are calculated by how many miles remain that have not been used.  Customer must provide the vehicle so that a finance manager can verify the miles on the vehicle at time of cancellation.  Refunds can take from 6 to 8 weeks before customers can see a credit with their lenders if vehicle has a loan, or same amount of time for the dealer to issue a refund check to the customer if vehicle is paid in full.                 Please let us know if there is any further information you may need.  Equity Auto Center consider this matter to be resolved.  Thank you.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.This complaint has not been resolved.  Equity Auto finally paid off both loans however due to their delinquency in paying I was charged $236.10 in additional payments from [redacted] in addition to $101.00 in bank fees for overdrafts and etc., caused by Equity not paying as contracted.  The sale date of my vehicle was May 30, 2015 with Equity not paying [redacted] until July 17, 2015 and [redacted] Federal Savings on July 22,2015.  This caused my credit rating to drop drastically, negatively affecting my purchase of a new vehicle ( the 2013 Altima purchased from Equity had to be sold due to the engine knocking after having it for only four weeks). My credit score dropped resulting in my having to downsize to a Sentra and being forced to pay A higher interest rate and higher payments.   Let me reiterate that Equity not only needs to pay the two  [redacted] payments Of $236.00 bank charges of $101.00 and report to all three Credit Agencies that the late payments were from no fault of mine and have it removed from all three reports. The complaint is not closed and has not been settled unless the concerns listed above are resolved.Regards,
