Subcontractor who have come have continued to leave a mess for us to clean up, from paint tape, to wood shaving on the floor to a 5 gallon bucket of Spilled paint. Over a month in many items agreed to be finished before closing are still not done. I still want to enjoy my weekends without waiting for aubcontractors who were supposed to do the work before move in, we had to delay our move in and Lennar knew they had this week to get the work that had been agreed upon done. Lennar violated their contract and is continuing to make us clean up and spend considerable expense cleaning up after their subcontractors. I have been promised a meeting with [redacted] and [redacted] cn [redacted] supervisor many times and this has not happend,

So we are required to miss work for work that was agreed to be finished prior to closing? We have suffered undue expense due to delay in moving (and rescheduling movers), time off of work, and damage to belongings due to subcontractors. Lennar breeched the contract when they did not complete the work as agreed upon. I had a work oufit ruined by a 5 gallon of spilled paint. Lennar has not done the work in 6 weeks. We were told work could be done in the weekend or evenings. We still are waiting mainly on things that were agreed to be done prior to closing

[redacted] has been in contact with our Area Construction Manager, [redacted] is coordinating work to be done. Non-emergency warranty repairs are performed Monday - Friday per the purchase agreement and new-home warranty. We will make every accommodation to complete warranty items in a time convenient to [redacted], but at times, homeowners are required to miss work to have items addressed.
We are happy to reimburse [redacted] for outfits that were ruined by spilled paint.

All items are complete. Lennar has hired [redacted], a structural engineer, is visiting the home on Monday, 5/15/17 at 9-11 to look at the homeowners concerns of possible structural issues. None were noted by [redacted], Customer Care Manager for Lennar during a previous visit

Lennar will be contacting the homeowner to get further information to make a determination.

with all repairs. 5 items remain, 4 to be done today. They are as follow: 1. Replace 3 screens. To be done today.2. Replace shutter that blew off from the winds. To be done today.3. satisfactory to me.
 I have received what what is needed from Lennar on the truss repair warranty issue.  On on the bore hole in the beam upon speaking with Lennar ([redacted]) it was brought to me that my property manager didn't bring that to their attention. So [redacted] is following up for me on that issue now. This issue was not their fault with no response.

Homeowner was sent engineering letter for the truss repair twice. The hole is a new item and she is emailing [redacted] with a picture.

I will meet with Landscaper to see what date this landscaping is actually going to be installed. [redacted] has started landscaping, this will be a priority. I will ensure my reps have scheduled out all items n home to be fixed.

[redacted] was made aware that we aren't replacing the driveway at this point because there isn't a defect. There has been many of Lennar representatives out to look over this driveway everyone has explained to [redacted] that we are not replacing the driveway at this point.  Thanks,

I have received a harassing phone call Lennar rep [redacted] he was very argue mental as usual. he kept telling me it wasn't there problem that I had no air flow in the upstairs of my home and that they do not replace window wells even when they install them incorrectly.
my house is still under warranty until Dec.
I informed [redacted] that I was at the hospital in the [redacted] with my mother in law and we had just gave her last rights and today (Tuesday) was not a good day to keep harassing me that the HAVC meet code. If code is having no air flow and the temps being allowed to dip into the low 50's in the winter and into the high 90's in the summer. Lennar has told me me since the beginning of us moving into this property that the company that put the HAVC in went bankrupt so there is nothing they can do for us. I have used the Lennar web site numerous times with no reponds from there rep [redacted] and when he finally calls he yells at me WHAT DO YOU WANT ME TO DO. I keep telling him I want an air flow and he keeps telling me my house is almost 10 years old. MY HAVC system is awesome on the main floor all the HAVC companies that I have had come look at the system say the same thing it is the way the vents was run, no air flow can make it thru all the 90 degree turns in the vent pipes.
Lennar has horrible issue's in my housing community with little or no air flow in the upstairs and rotting window wells every where.. their reply is always too bad we won't do anything for you it is code.

I spoke in length with [redacted] from [redacted] and [redacted] He told me that Lennar will do nothing for us on his word nor any other Heating companies as they are not Heating and Plumbing Engineers. [redacted] suggested that I call Heating and Plumbing Engineers at Denver Office Location [redacted] St [redacted] Co XXXXX phone number XXX-XXX-XXXX. I have left a message to get an appointment to find out what is wrong with my current system IE no air flow to the upstairs and to find out a solution per an engineer. As soon as an appointment is set up with an engineer we will gladly involve Lennar in finding a solution to no Heat or Air Conditioner in the upstairs due to little or no air flow
As far as my house being 10 years old it was a new build when I purchased it in Dec of 2005, so my house is 9 years old.
Lennars warranty page from our home owner's book states
"The heating system is warranted directly by the manufacturer thru the installation company. Consult the Manufacturer's Owner's Manual for the exact warranty. Should you need any assistance in obtaining warranty service for the heating system, we will be happy to assist you. They go on to state the room should be able to be at 70 degrees 5 ft off floor in the middle of the room."
Lennars responsibility: Should the system not be capable of meeting the above specification, we will adjust the system to operate to the specifications as long as proper window treatments of a sun blocking nature have been installed and in proper use.
I have only ever gotten the total run around from Lennars Customer Care Representatives due to the fact that their HVAC Company Barrett-Barnes filed bankruptcy within a year of the completion of my home.
As far as the window well is concerned we have owned 5 homes in the metro Denver area and never had a rusted out window well. When the rebar is installed in the basement walls in the incorrect place to where the bolts from the window well will come in contact with rebar it will cause an electrical current that when it comes into contact from water in the dirt outside of the window well it causes the window well to rust. Replacing the current window well with the same bolt pattern of another one will not fix the issue of it continuing to rust out. I will need a window well that fits with a different bolt hole pattern or I will need to take that one window well to a concrete window well.

The window well can be moved up or down to install in a new location, should you choose to do so. The window well is not covered as part of the 10-year structural warranty and is four years outside of Colorado's Construction Defect Law. We have provided you with a window well at our expense. As homeowners, you will have to install it on your own or hire a company to install it.
The HVAC system is not covered under the 10-year structural warranty.
All items related to the wall repair in the master bedroom closet will be repaired. I will get with our Customer Care team and have them communicate the completion date for the repairs.

This home was purchased and all applicable contract documents and addendums were signed by both parties including documents stating the earnest money was non-refundable and the model home is being sold “as is”.  There was subsequent correspondence via email stating we would repair and re-paint...

the leak mentioned above.  In an attempt to accommodate the customer we also agreed to add a concrete pad in the back yard at the customers cost. This is a model home and it has never been lived in.  The carpet will not be replaced but we did offer to clean it.  Despite these accommodations the customer expressed a desire to cancel.  As an offer of good will we offered to do a partial refund of earnest money.  The home was kept off the market for this customer for a month delaying our ability to sell it and causing additional expense.

I am rejecting this response because: there is a leak. There is ALWAYS water running off the concrete. I have been told COUNTLESS times that someone is going to come check it out and no one ever shows up for the appointments. This is the worst service I have ever seen in my life. The complaint is almost a year old now and no one will follow through from Lennar.  See you in court

In the real estate transaction, house should be satisfactory to the buyer until the day of closing. Since house was not satisfactory buyer should have right to cancel at any provision. Non-refundable earnest money was not mention while we were signing the paper electronically at her sale’s office. Now they are refunding only half of the amount. If that is the case then I would ask my buyers to think twice to make an offer for the properties build by Lennar Colorado. I would never purchase for myself. I have learned the lesson.
