I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  
Copying off of Lennar's response I will provide the details as to why this continues to not be resolved...Lennar says the correct HVAC is installed and verified by 2 different HVAC contractors...Please keep in mind that these 2 HVAC contractors are paid millions by Lennar and they will not openly admit their faults- they will continue to fight until they don't have answers and then they will ignore my questions...[redacted] is the contractor who still has not gotten back with us after 2 weeks...and they said it would take 2 days to get back with me...My question was simple..of the 2 addresses I supplied in our neighborhood that were exactly the same house as ours - what is different as to why they have a 4 Ton zoned unit and we have a 2.5 Ton unit downstairs and 2 Ton unit upstairs?  They know that they installed the wrong unit in our house, but can't respond back to an email because it will lead to the fact that they did something wrong.Additionally, the heat load shows 1 Ton is needed upstairs, but yet they put 2 Tons upstairs - 1 Ton wasted...meanwhile the downstairs miraculously called for 2.4 Tons and they put a 2.5 Ton unit (conveniently)..The reports were done after we purchased our house and noted that the original report had 2 obvious flaws..#1 - The report left out 75 sq. ft. of cooling load and #2 - the report had the house facing [redacted] and not [redacted] which any HVAC contractor will tell you (not employed by Lennar) that this will certainly increase your cooling load in your house because the sun will beat down on the [redacted] surface area and windows the entire day.  Lennar says - they offered for the HVAC companies ([redacted] and AirTeam) to come out and check for leaks and make the necessary repairs....History: We had an HVAC company come out the week before and put refigerant in our unit to fill it up..they put 2 lbs. (this is after a 1 year period of the last time we put refigerant in and it was only 2 lbs. low)...[redacted] came out 1 week later and put 5 lbs. of refigerant...in a 5.9 lbs. capacity unit...so you are telling me form losing only 2 lbs. in one year we ended up losing 5 lbs. in 1 week...this is what you get when you have Lennar backed HVAC contractors....After filling 5 lbs. of refigerant they mentioned they could not find a leak in the system - completely flawed and on top of that the HVAC contractor stated that the temperature differential coming from the unit is 15 degrees and that is unsatisfactory so there is definitely something wrong with the system, but that he would have to talk to his supervisor before disclosing the report...Well guess what, the supervisor must have helped him change his tune because the report came back that the unit was not leaking and functioning properly and it was just a FREON problem.......completely flawed ...On top of this, the HVAC contractor at the house stated that if he wasn't paid by [redacted] he would change the downstairs unit to a larger ton unit because it's not configured properly and he also mentioned that they get called out a lot to fix [redacted] issues with Lennar time and time again...  Goes to show you there are issues after issues. On top of all this, I still don't have an answer to the fact that we have a unit upstairs modeled for 200 sq. ft./ Ton , but a unit downstairs modeled for 820 sq. ft. / TON..THAT IS OVER 4 TIMES LESS SUFFICIENT FROM THE UPSTAIRS.  Hence why our bill is 4X higher in the months of May to October and why WE ARE SWEATING DOWNSTAIRS.  Also, on the upstairs 2 Ton unit we come to the issue of over cooling & risk moisture build up which will lead to MOLD which we will have to remedy.This is a product of BAIT AND SWITCH - The model home we walked through prior to buying our house had a different unit configuration (4 Ton unit zoned for upstairs and downstairs)...One of the questions we asked Lennar was, "everything in the model home is going to be like our home that we purchase?" and their answer was "yes, we build to the same specs, hence a spec home."...Well apparently that's not the case because out of the houses in our neighborhood exactly like ours we have this 2.5Ton unit downstairs...meanwhile all others have the 4 ton unit zoned...  Furthermore, when approached with why is our configuration different, Lennar responed with our house was modeled on 20 degree differential while the other homes AFTER ours was based on 25 degree differential...The reason why I know this is a coverup and a weak attempt at silencing my emails and complaints is that OUR HOME WAS THE LAST LENNAR HOME OF ITS KIND IN OUR NEIGHBORHOOD...All of the like houses were built before ours AND have a 4 Ton unit zoned...Another reason is that the [redacted] states what you should model to in the area of [redacted] and that is based off of the [redacted] conditions at 20 degree differential and 50% relative humidity...............This has been one falst statement after another to cover up an issue that the service contractors know is wrong...Why is mine different??NO ONE HAS A TRUE ANSWER.

While we understand that Mr. and Mrs. [redacted] were frustrated with the progress of the construction of their dream home, all of the issues were addressed and corrected.  Our Purchase Agreement states that if the buyer chooses to cancel or terminate the contract that we have the right to retain...

the earnest money and upgrade money for any options that they have chosen.  When they decided to terminate the contract, without giving or new construction team the opportunity to demonstrate that they could make the corrections, we made the decision to return the earnest money.  However, we can not return the option money in order to cover any expenses we might incur due to making changes to the options that they selected to a new buyer.

Our Director of Construction, Ken [redacted], sent an email to the homeowner on 1/26/2015 requesting a meeting on 1/30/2015 to discuss his concerns.  We have not heard back from the homeowner. [redacted]Director of Customer CareLennar

 Their response is absolutely untrue.  The service Technician specifically agreed and told me that something was wrong, and that the unit should not sound the way it does.  He stated that he did not know what else to do.  Lennar sent out their warranty person, someone who is employed by Lennar, which made the claim that it was normal in order to be done with us.  This person's name is Glen B[redacted] and he has lied to pretty much everyone in our neighborhood that has dealt with him.  He is by no means an HVAC specialist and their basis that it is normal is not justified, and simply in their best interest.  How can they imply that it is within industry standards, when absolutely no measurements have been made in regards to the noise.  Sending out an unqualified company representative to say it's normal hardly justifies their determination. My neighbor says the he can hear it sometimes from across the street.  We have 2 other neighbors experienced the exact same problems.  One of which has had a compressor replaced, the same as us. Lennar has recently been in discussion with him to cut down his outside brick and correctly fix the issue.  I am in no way implying that this is what would be required to fix our unit, only that they are trying to avoid having to fix ours. Since this problem of the noise is intermittent, I believe that it would not be out of the question to have someone be here at a defined, scheduled time to listen to the unit. Not just some random 4 hour timeframe window, which usually falls during the day when the unit has been constantly running/cycling.

I am sorry but the wrong email was sent.  We have repeatedly informed the homeowner that due to the age of the home, no further action will be taken.  We have no records of a previous issue with drainage being submitted during the warranty period.  Lennar will take no further action on this matter nor respond to any further emails regarding this matter.
