Mr*** purchased a *** laptop computer on December 10, with a 90-day warranty serviced by Liquidity ServicesOn March 4, he started a warranty claim because his computer was unexpectedly shutting down occasionallyOtherwise the laptop was in good condition and fine working orderThe unit was sent for repair and then returned to him on March However, the laptop was improperly packed which caused cosmetic damage and likely contributed to the new problem where the laptop would not power onMr*** then contacted our service personnel to notify them that the unit was still defective so it was returned for repair on June The computer was then sent back to Mr*** from the repair facility on July Unfortunately, the computer once again packed improperly and showed further cosmetic damage and now had physical blotches on the screenFurther, there appeared to be no repairs done to the laptop from its most recent service periodIn sum, the laptop computer returned each time in worse condition than it had been previously due to the carelessness of the warranty personnel
We regret that Mr*** had a poor experience with the warranty services provided by Liquidity ServicesOur company handles the customer service portion of the warranty contract while another business partner handles the repair and replacement servicing portion of the warranty contractOur role is to facilitate the delivery of units under warranty to the repair intake facility, but Liquidity Services does not have direct possession of them afterwardWe will follow up with our business partner to seek an improved resolutionWe apologize for the delay

MFleury The lot was listed as ‘shelf pulls’ condition Among other things, the lot was said to contain signed and certified items as per the manifest on the auctionThis auction was listed on www.liquidation.com and Mr***’s bid of $was the winning bid on 4-23- The total transaction cost after taxes and shipping charges was $ The product was delivered to Mr*** on 4-27-2016, and Mr*** filed a dispute with us on 4-27-which stated the following:I have received the products stated and came to find out there is only one certificate of authentication and that is on the EicheleThe collection that I receved is worth about cent and the cards are worn and yellowedThis person should not be allowed to sell this crap on your siteI''m starting to see that you allow anyone to sell anything on your site with prices and descriptions that aren''t even close to what is receivedI was sent like 30+ of the same junk that are worthlessI will be filling a claim with *** *** if something is not done.Mr***’s claim in the Revdex.com complaint essentially mirrors the claim and correspondence submitted to Liquidation.com for this transaction Our disputes department facilitated a return shipment from Mr*** back to the seller on the grounds that the merchandise was misrepresented Upon receiving the return shipment, the seller filed a counter claim charging that Mr*** failed to include multiple items in the return shipment which in turn lead to additional commentary from both parties including video footage of the seller going through the contents of the return shipment Ultimately, the amount refunded to Mr*** was based on the items the seller verified were returned, weighted against MSRP value in proportion to Mr***’s winning bid amount, resulting in a partial refund of $36. After *** received the additional handbags, he once again contacted a customer service representative and said that out of the original handbags were too damaged to be soldHe said that this was beyond the quantity variance advertised in the auction, which was 2%*** calculated the damaged handbags as a 25% quantity variance for the entire lotHe then suggested a partial refund or replacement items to settle the dispute
Our disputes team reviewed ***’s claim and concluded that the claim could not be honored because his support failed to conclusively show that the items did not fit the broad definition of Returns, given on the auction listing as follows:
Returns were sold to a customer, who then either physically brought the item back to a store or mailed it to a specified locationReasons for returning a product may not have any correlation to its usefulness (i.e., size, color, model, etc.), and as a result that product may be in fine working orderThe majority of Returns, however, do have some operational and/or cosmetic problemDepending on a company's return policy, these items may also reflect a measurable amount of useIn addition, since most of these items are sent through a reverse supply chain (e.g., from a customer back to a store or a centralized warehouse), they can show signs of further handlingThey generally do not come in original packaging and often do not have any of the advertised documentation or additional parts and/or accessoriesAccordingly, Returns can exhibit a wide range of individual product and package conditions that can differ substantially from the original manufacturing
Since ***’s damaged unit claim was denied, the quantity variance does not applyIt only applies to damaged items when calculating a partial refund
Quantity variance is intended to cover missing merchandise onlyIt refers to the quantity of items sentThe definition given on our website for quantity variance follows:
Quantity variance is the percentage of items that are deemed to be either in abundance of or less than the amount listed on the auction; ranging between 1-10% per auctionThe quantity variance is calculated on a per unit price, and pertains to all merchandise within an auction, including missing or damaged itemsHowever, asset condition of the merchandise within this variance may differ from the rest of the auction items
*** believed that quantity variance not only covered the quantity of items but also the condition of each itemHowever, the reference to damaged items in the definition above would only apply to dispute claims for damaged items that were found in favor of the buyerIn this case, the damage claim was rejected
An example of how quantity variance would apply to damaged goods may clarify the matterIf an auction for items had a quantity variance of 10%, then the quantity variance would equate to itemsTherefore, if our disputes team honored a damage claim for of the items with a partial refund, then the quantity variance would apply to that calculationInstead of receiving a partial refund for items, the buyer would receive a partial refund for items while items would be considered part of the quantity varianceIt would be as though the buyer did not receive those damaged items in the original shipment

item with a significant stain and another with a tear in the fabric Among the items received, *** *** suggested that she would only be able to sell a small percentage because the items had not come in matching sets, but were largely mismatched She said that the merchandise seemed to be Returns rather than Shelf Pulls condition sleepwear.Our disputes team reviewed the claim and decided that it could not be honored because the auction was properly listed The support provided showed items similar to those described in the listing Further, there was no indication in the listing that any of the items would be matching sets The two stained and torn items were disturbed as a result of handling as described in our Shelf Pulls definition on the auction:Shelf Pulls were previously available for sale in a retail environment but were never soldThey usually possess one or more price tags and/or stickers, indicating multiple markdowns and have been exposed to appreciable customer contactIn addition, since most of these items are sent through a reverse supply chain (e.g., from a retailer back to a centralized warehouse), they can show signs of further handlingAccordingly, Shelf Pulls can exhibit a
