you the next available business day (11/14/16) to address and correct the discrepancy, update specific business description content as you instructed, and also provided a service credit of $on the next billing 12/1/After we optimized your business information and submitted your data to different directories, time was needed to see the new changes take effect online and help with rankingsHowever, it appears you no longer wish to wait to see the benefits continuing services with usTherefore, I’d like to extend a resolution that is fair for both parties involvedTechnically, you were suppose to notify Local Splash directly regarding cancellation prior to the next billing (12/1/16)Without reaching our Customer Support team first, our automatic billing system processed $on 12/1/at 2:31:AM for month of servicesHowever, to show our integrity, Local Splash is willing to offer you a refund in the amount of $($dispute amount + $for month 2) in addition to processing account cancellation with Local Splash services If you accept this offer, you will be asked to close the Revdex.com case before the refund is processed, but everything will be in writing for your protection and to ensure your refund (instructions would be sent to you if you accept)Please let me knowThank you, *** ***

Local Splash recognizes a duplicate charge was incurred by the clientWe believe this was due to a very rare server timeout that happened at just the right time while trying to process the client's initial paymentBecause of this, we did not have a record of the original transaction and that is

your Local Splash account, I have determined that Local Splash did do everything they were contractually obligated to do for your account; however, the results of that work never resulted in first page placement for your category within your city. Therefore, Local Splash is willing to offer you a partial refund in the amount of $in addition to the $that was refunded on 09/27/2016. If you accept this offer, you will be asked to close the Revdex.com case before the refund is processed but everything will be in writing for your protection and to ensure your refund (instructions would be sent to you if you accept). If you do not accept this offer, I do not know what else the company would be willing to do for you at thispoint and both parties might have to part ways unsatisfied. Thank you, *** ***

Business Response:The client signed up for Local Splash’s services on July 1, They also paid an invoice totaling $on 8/1/and on 11/1/2016.The client claims that Local Splash promised to get them on the first pageHowever, we do sell our packages based on getting our clients on the
first page of ***’s search resultsIn this case, we were striving to rank the client under the keyword “*** in ***.” Due to the amount of competition, this keyword search would likely take more time to rankWe do clarify that we do not guarantee first page results for any of our clients We did explain our Local Splash Performance Promise which states: Local Splash promises that it will apply a credit for Client’s next month of basic service if, after the second payment, Client’s business is not on the first page of a major search engine using any of your search phrases in your local area (e.gAttorney in Santa Rosa)It is the Client’s responsibility to call us before each eligible month’s billing date to receive said creditDue to the performance promise, I have deemed it necessary to refund $to the client for the payment received on November 1, The Local Splash Performance Promise can be found in our Terms and Conditions page on the Local Splash website at ***These are the same Terms and Conditions the client agreed to and electronically signed on 03/26/from IP address ***

Upon review of review of notes and phone recordings between the claimant and Local Splash- there was no misrepresentation of serviceClaimant has made claims that are not accurate and appear to be coached by a competitorClaimant signed up for service on 2/6/During the call with the
sales rep, she was told that if Local Splash was unable to get her business on the 1st page in six weeks then Local Splash will work for free until front page placement is achieved on Google, Bing, or Yahoo She was asked if she understood the "Performance Promise" and she replied, "Yes"The content editing for her page was completed on 2/13/and directory submissions began at that pointOn 2/21/claimant contacted Local Splash stating she was having trouble with her email which may the reason for the delay in getting information to the Local Splash video team for her You Tube video and the Pin Verifications for Google and Bing (Yahoo doesn't require this procedure)Local Splash made several attempts to contact client to get the pin numbers (which are necessary for placement)Local Splash received the pin for Bing on 3/6/Claimant contacted Local Splash on 3/19/wanting to know why she wasn't on the front pageThe aforementioned was explained to her and in accordance to the performance promise, Local Splash issued a one month service credit Local Splash received the Google pin from her on 4/4/She again contacted Local Splash on 5/5/for statusFront page placement had not been achieved so one again a one month service credit was issuedClaimant cancelled service on 5/27/and refused to accept another service creditHad she elected to remain with Local Splash, front page placement would have occurred and she would not have been billed again until she was on the front page Her claim regarding the You Tube video is not completely accurateShe received an email from You Tube (Not from Local Splash) that her video commercial was completed and the email had the title of "Self Storage Space, Agusta, GA" her actual commercial never posted on line with that headerHer complaint also states, "After contacting a more reputable Internet marketing company..." Again, Local Splash was quite clear about the performance promise and this promise is in writing on their Home Page www.localsplash.com and is compliant to Google regulations The "More Reputable" company she spoke with has not given her reliable information. The request for a full refund is not warrantedLocal Splash performed it's service in accordance to the terms and conditions she agreed to Furthermore, Local Splash requests that this complaint be removed from the Revdex.com record because it is clearly coached, it solicits review links to other blogs and competitorsLocal Splash has had many complaints JUST LIKE THIS in the past, however; the company has a complaint-to-client ratio of .6% , and has been been recognized by prestigious organizations such as INCMagazine, Deloitte, and the Orange County Business Journal.Local Splash wishes the claimant well

To include the SEO portion. I was told by *** that on thur 11/25/that by the end of the day the landing page and gallery would be done as of 11/26/8:pm that has not been completedSo they are just buying time. The landing page they did do for me was my own page I did. *** made adjustments is I would expect since I am a novice and he is a professionalThe adjustments were enlarging the video and adding a “CLICK TO ENTER button” which was positioned over the words. So no QA is being done. I gave them my passwords and login info for WIX.COM for them to copy and pasteAnd make changes if needed to bring it to a professional level. I am still seeking a refund for the web site I made that they are just coping. And since I was already lied to on 11/25/stating what would be done ,still is not done. On 2/12/no changes have been made to the website. I told Local splash that the waterfall, home page, and about page has to be completed by Friday. I am seeking a refund since I have had to develop the site and have spent hours and hours and on Friday I will file a civil suit and hire another company to do the job and post the law suit on line so people will know I am serious.

For your reference, details of the offer I reviewed appear belowPlease find below screenshots and explanations as to why I am certain that Local splash has not delivered what they had promised.
To start with this is my website ***We do photography and videographyAnd we are located in *** *** ***While speaking to Local splash and signing up for their SEO services, I said I would like to tap into the the wedding market in *** ***They said they would have my business appear in the top when anyone would search for a "wedding photographer" or "wedding videographer" in *** ***And they said that it would take roughly two months for it happen.
After 8-months this is what they have deliveredKindly refer to the screenshots along with my explanationsAnd thank you for your patienceScreenshot # As you see and can confirm, when anyone searches for a "wedding photographer" in *** or *** ***, our business does not show up even as a small red dotScreenshot #2Here in this screenshot you will see, when the search keywords are changed to wedding videographer", again, we do not appearNot even as a small red dotKindly noteThe above keywords were the two most relevant searches that would help a business like mine.
Screenshot #Before you see this next screenshot I feel the urge to tell you that when I signed up with Local Splash, I wished that my business be visible in *** ***, not just *** and absolutely not just in *** ***As a photographer I cannot and would not wait for clients only in *** *** to have a weddingIt is absolutely limitingAs you can see our website pops up only when you search "wedding videographer *** ***"please note, *** only appears in the list on the left*** does not appear as a red dot like the others photography businessesSo, when I click on *** in the list on the left, this is what happens*** appears as a red dot somewhere in *** close to *** ***.This is not what I had signed up forI would also ask you to judge the matter yourselfIf a client in *** *** wanted to look up a wedding videographer, why would she/he type in "wedding videographer *** ***"Again, I would like to remind you that I was promised top visibility in *** ***, namely Manhattan, *** and BrooklynI had never mentioned *** *** *** is just where my business is registered.
The other cause of my upset was that Local splash was able to deliver the above undesired result only after monthsThey were charging me $200/month, and had promised to have my listing up and visible in less than two months.
So even though I was not happy with the result, they had already billed me a total of $If they had at least delivered on time, I would have cancelled after two months and saved moneyBut when I said I was going to cancel, they begged for more time. After being billed a total of $1000, they tell me that they do not have the capacity or skills to make my business appear in the top in *** ***, and it is not possibleNow, that is not what they said when I signed up.
Kindly look into this matter and I hope that you make a fair and just callPeople like me see dreams of getting more business when SEO companies like Local splash hunt for our websites and call us with great prospectsThey also sell their services saying they will help us pick the right kind of keywords for the search engine optimizationIn my case, I wasn't made aware that the keywords selected for my business were "wedding videographer *** ***"I hope you agree that no prospective client would type in such keywordsAnd even though I am not that internet savvy, I would never agree on such keywordsThese keywords would never serve my purposeI could go on, but I shall stop hereI appreciate you looking into this matter againIf there is anymore information I can provide, please let me knowI look forward to hearing from youBest

Not sure why this complaint is being registered at this point and time? The Claimant did sign up with Local Splash as they state in their complaint, however; events are not completely accurateWhile it is true that we were unable to have his business on the front page of *** in the week time
frame as stipulated in our performance promise, this person was offered a partial refund and continued monthly subscription service, or extended future credits in addition to our continued performance promiseThis person decided to cancel service and was given a full refundThis complaint states they are disputing an amount owed- again, THEY RECEIVED A FULL REFUND
Note to Revdex.com- This complaint seems disingenuous in nature and may be the result of a competitorWe can can provide proof that this person was fully refunded.We request and recommend that it not be a complaint of record

After reviewing the account I found that we did make an error in posting the clients video under another business name we corrected the error as soon as it was brought to our attention In terms of the placement on the search engines we simply cannot guarantee placementNo one can
What we offer is a promise reading " If after your second payment your business is not found on the first page of Google Yahoo or bing using one of your primary search phrases then upon your request Local Splash will credit one month of service towards your account, this promise can be applied as many times as needed."Search engine optimization is a science its not a simple formulaEvery account is different that is why we offer a performance promiseEven though we are continuously working on our clients accounts we don't expect them to want to pay for a service that isn't yet displaying resultsSome businesses take months others take weeks. All depending on market compitition, location, and search demandsThe continual effort of submissions and optimization has continuedWe were unable to come to an agreement with the client that allowed us to prove the value of our service
