I am responding to a complaint regarding deed interest and termination of ownership in hopes of resolving this matter. This is the third complaint the Resort has received from Mr*** and our response will remain the same. Lost Valley Lake Resort purchased more property about
years ago allowing our deeds to go from a 1/10,undivided interest to a 1/14,undivided interest. Meaning the ***’s will share interest into the said property with about 14,other ownersAt this time Lost Valley Lake Resort has about 6,active owners The dues increase was not voted on by owners as an assessment but put in place as a maintenance fees, as maintenance fees are used for the upkeep and maintenance for the ResortHence the completion of a new swimming pool and sewer treatment plantAccording to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionatelyFees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of DirectorsDues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose. to Article VI Section 3, mail notification of meetings, “This violates Article VI Section regarding how notice of meeting is to be given”. Article VI Section states “meeting of the membership”The recent meeting on Jan 21st was a regularly scheduled Board of Directors meeting, not a membership meetingThe BOD meetings are the same time each year and widely published, all owners are encouraged to attendIn fact, there were 20+ owners present at the Jan 21st annual meeting A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for reviewThe BOD only received the final project costs and recommendations from the engineering company hired for the project on Jan 18, Time was of the essence for the Board to determine funding for the projects which would be discussed and settled at the annual BOD meeting open to all owners on Jan21, Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all ownersWith that being said payment plans were designed to help owners with the increase. Mrs*** and Mr*** do not own a timeshare with Lost Valley Lake ResortMrs*** and Mr*** purchased, per the attached Retail Installment Contract, executed on April 30, 2006, deeded property and own an Undivided Interest as a tenant in common in and to certain real propertyOn item 1, of the attached Acknowledgement Mrs*** and Mr*** acknowledged they were purchasing an undivided interest in Lost Valley Lake ResortOn the backside of Mrs*** and Mr*** Retail Installment Contract, under Security Interest, Mrs*** and Mr*** were notified that by virtue of Buyer's Ownership of Undivided Interest they would automatically be granted membership in Lost Valley Lake ResortIt states, Buyer is obligated and agrees to pay Lost Valley Lake when due, all dues and assessments required by or pursuant to the Bylaws of Lost Valley LakeLine item number eight states, Mrs*** and Mr*** acknowledged they were not high-pressured or coerced into the purchase, and that the purchase did not present any undue financial burden to them

The Bylaws state, "The Club shall do whatever is necessary, conducive, or incidental or advisable to accomplish and promote the objectives and purposes of the Club." Additionally, "The acceptance of a membership or conveyance of any interest in the real estate which is part of the Property shall constitute an agreement that the Restrictions, these Bylaws and the Rules and Regulations as they may be amended from time to time, are accepted, ratified and *** be complied with." These actions are necessary and to the benefit of Mrs*** and Mr*** to protect and maintain their undivided interest in Lost Valley Lake Resort
Mrs*** and Mr*** are aware of their obligations to Lost Valley Lake Resort:
Item 4, of the attached Acknowledgement, Mrs*** and Mr*** acknowledged current annual dues and there purpose
Mrs*** and Mr*** have paid their annual dues on a recurring basis, thereby acknowledging their obligation to Lost Valley Lake Resort

I am rejecting this response because: I was told many different answersI was told the Lodge would be completed years ago, it has not been completedI have had explanations to this, still not happyI don't like the way the resort has special meetings, where I need to go out of my way to stay informedAlso I feel the meetings are more for the resorts benefit than mineI have been fishing and not caught any fishI spook with a employee, and was told employees fish the lakes and he caught fishNo need to wonder why there are no fish in the lakes that the owners maintenance fees pay for.....I am sad to here the fact that the public is gaining access to the resort, I don't know how I missed the information on this changeIt could be I felt pressured to go to meetings and am very unhappy with the resort, and did not know the resort would open to the publicAs a owner I am very upsetI want my membership canceled and my deed or whatever I own bought back at full priceI am considering filing a class action suit, and I believe if I go with this action I can generate many angry owners and be successful with legal action, or picketing the resort on private property is an option.......Also I was given incentives from the sales staff to buy, and the coupons where no good, I complained and was told those sales representatives don't work there any more

regarding dues increase in hopes of resolving this matter. The Board of Directors, also owners, meet each year to discuss the annual maintenance fee. At this board meeting it is voted to see if the dues will increase or remain the same for all owners. The Board of Directors meetings are listed on Lost Valley Lake Resort’s web page, in the new letters that are mailed to all owners quarterly and also in the yearly calendar. As it has been in years past, we strongly encourage all owners to attend the meetings to stay up to date on the current Resort events.  If the owner’s wish they may attend the next Board of Directors meeting being held here at the Resort on May 20th at 10am to have their concerns addressed by the Board. All Board meetings are held on Saturdays, normally mid-morning, making it easier for owner’s attendance.  To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the increase in dues will be included in the annual billing statement. Dues for all owners increased for the following reasons:New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. Recognizing this fact, the Board retained MECCO Engineering to develop a plan for meeting the Club’s needs in accordance with new Missouri Department of Natural Resources and Federal Waste Water discharge requirements. Our Current plant permit expires on November 1st, 2018, so a new treatment plant must be operation by then. With an estimate build time of six months, it is imperative we fund this project now. New Swimming Pool: The Board has exhausted all efforts to maintain the swimming pool in sufficient working order, but our thirty-year old pool now has to be replaced. The pool leaks up-to 10,000 gallons of water per day and the filtration system cannot keep up with the demand upon it. Construction is planned to start after Labor Day 2017 and to be completed by Memorial Day 2018. Again, it is imperative to fund this project immediately. Again, this information plus an additional three pages depicting the increase was included in the annual statement or it may be viewed on line at LostValleyLake.com.  Another updated on the sewer treatment plant and the swimming pool is going out all owners this week. Lost Valley Lake Resort will continue to post updates for the owners to follow. The FAQ’s are attached in this response. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.          The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors.A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for review. Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, 2018 there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all owners. With that being said payment plans were designed to help owners with the increase. Lost Valley Lake Resort is allowing owners who can’t pay the increase in dues before April 1st, to be set up on a payment arrangement. As long as a minimum payment of $150.00 is made in the month of March and every 30 days thereafter, owners may still have access to the Resort with the exception of major holidays until the balance is paid in full.   Lost Valley did increase transfer fees in 2015. This was made aware to all owners in the quarterly news letters that are mailed and also on our website at LostValleyLake.com. I have enclosed a resale packet for review. At this time Lost Valley is currently handling, on average, about six successful transfers per week. New memberships continue to be sold in the $8,000.00-$12,000.00 range, depending on the amenities selected. The $1,500.00 administrative charge for “transferring ownership” was implemented to cover the expense of introducing and transitioning new members into the Resort. This charge has not prevented individuals from selling their undivided interests in the real property on which the Resort facilities and amenities are located. As Lost Valley’s Marketing and Sales agent, Mid-America handles the transfers of Ownerships for Lost Valley Lake. The $1,500 has been in effect for 3 years now. After 30 years, the fee was raised to cover the cost of labor, utilities, deed work, supplies and overhead expenses. After surveying various resorts in our industry our rates are not the highest nor the lowest but moderately priced. What we have seen since the increase is the number of non-paying dues Owners has decreased because of the increase – prior to the increase approximately 20% of the individuals that purchased a transfer did not pay their dues. Furthermore, the increase is protecting the value your / our Ownerships. Prior to the change, Ownerships were being given away for free. Please review the attached Acknowledgment signed on April 28th, 2013.  Mr. [redacted] and Mrs. [redacted] purchased their wilderness ownership from another individual at that time. The process for them to relinquish their rights remains the same as when they purchased.  Repair/Upgrade QuestionsThe roads were supposed to be finished but there are many roads worse than others. LVL is repairing the roads. This is a multi-year project. Road repair is being done out of the operational budget and done as funds are available. Road work has been completed from the entrance to the to the top of the “S” curve, in front of the indoor swimming area past Lake Expo, up to the 600/700 area, the entire 600/700 area, villa area, both condominium parking areas, road leading down from condominium area and the sales parking lot. This year work has begun from the “S” curve past the Lodge, up past the old bathhouse and tee-pee area.Playground equipment needs updated. Yes, we agree however, once again the budget can only sustain a limited amount of expenditures. Major projects such as roads and the infrastructure of the Resort currently are at the top of the priority list. Fees QuestionsWhy were we not given notice of the increase? Simply put the Board too was not given a large lead way of time to consider future actions. For example, the engineering company finished their report and immediately meet with the Board on January 18, 2017. The maintenance fee statements were already late in being mailed pending the regular Board meeting scheduled for January 21, 2017. With only three days’ notice and time being of the essence the Board considered the engineering company’s proposal and moved forward with their decision. The dues increase was discussed with Owners who were present at the January 21 Board meeting. Additionally, notice was mailed in November to Owners from the Resort Manager advising what future projects for 2017 would be determined by what needs to be done with the sewer treatment plant.Will my Dues / Maintenance Fees increase in 2018? The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry.  The Board anticipates the short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. With that said, if funding for these two projects falls short the Board will revisit dues for 2018.Why were the dues not separated and the dues left normal? The 2017 increase was a dues increase not an assessment. Therefore, the dues were billed as they are as dues.Is there a better way to bill Owners? What are your suggestions. Currently, the statements are mailed out in January and are due March 1 of each year. Then a second statement is mailed typically in March with the dues becoming delinquent March 31 of each year. Payment arrangements are always available thru the Credit Department. This year given the circumstances surrounding the increase all late fees have been waived if you are set up on a payment plan.How is this going to affect them as they make payments throughout the year so their dues are paid in full before new bill come out?  Payment arrangements are available by simply contacting the credit department at [redacted]. Payment arrangements have been available for many years and used by Owners. The policy as it has been for many years is your dues must be paid in full to use on a major holiday. If you do not make monthly payments, then you will not be allowed usage of the Resort.Why could we not of gave something better for the extra money like split it up into payments, why did they have to wait till everyone screamed. I am not sure of the question so I will take a stab at it. Nothing has changed since the Boards original guidance. Dues increased, payment arrangements have been in place from the very first mailing – in fact the dues statement even states “payment plans are available, please contact a customer service representative for further assistance.”  The Board also chose to waive late fees for the Owners – in 2016 the Resort collected $75,000 in late fees which we have waived in favor of our Valued Owners. Additionally, based on the timing to start and have both projects completed the Board could not wait for multiple years to secure funding.Where is all the money that is paid into maintenance going? Why is it not being used for the sewer and pool? Our Dues / Maintenance Fees are used for operating expenses and to maintain, repair and replace, when necessary, improvements, facilities, and recreational areas. This past year, as has been the case for the past few years, the Club, through its annual dues, has been able to meet budgeted operating costs, despite large increases in propane, electric, lawn maintenance and common area repair.  Also, this past year, the Board has realized that it is necessary for the Club to re-invest in the operation, improvement, and maintenance of the Club and the Club property. The sewer treatment plant and pool projects require the Club’s immediate attention at an estimated cost of $2,227,398.00 above our normal budgetary operational requirementWhere is, the extra money going every year that is not used? Typically, all funds are used. However, if there are any un-used funds they will be carried over to the next year to help offset the next year’s budgetary shortfalls. With that said operational needs and improvements use all funds in the given year.Owners want to see where all the money goes. The financial statement sent out now is not broke down enough. The Easter Egg hunt was hosted in an area which is not frequented by the wildlife. Dues shall be used for the operation, improvement, and maintenance of Lost Valley Lake and the property and for no other purpose.    Mr. and Mrs. [redacted] are aware of their obligations to Lost Valley Lake Resort: ·       Item 4, of the attached Acknowledgement, Mr. and Mrs. [redacted] acknowledged current annual dues and there purpose. ·       Mr. and Mrs. [redacted] have paid their annual dues on a recurring basis, thereby acknowledging their obligation to Lost Valley Lake Resort. ·       The Bylaws Mr. and Mrs. [redacted] has acknowledged they received states the dues shall be paid annually prior to the first day of March.   Mr. and Mrs. [redacted] are aware that they may will, sell, or transfer their Lost Valley Lake Resort interest and that Lost Valley Lake Resort will not repurchase or resell their interest. Please refer to the attached acknowledgment line item number 6. Mr. and Mrs. [redacted] were notified of the transfer fee and transfer process when they filed a complaint with the Revdex.com on May 8, 2017. Per the Bylaws Section 3 “The Club shall be conducted at all times as a not-for-profit organization and no part of the net earnings of the Club shall inure to the benefit of, or be distributed to, its members, directors, officers, or other private persons, except that the Club shall be authorized and empowered to pay reasonable compensation for services rendered and to make payments and distributions in furtherance of the purposed set forth in Section 1 of this article.” I have enclosed a copy of the resale packet that is given to owners and listed on the Lost Valley Lake website for owner’s knowledge on the transfer process.   I have attached information, which is beneficial to Mr. and Mrs. [redacted].  If Mr. and Mrs. [redacted] need further guidance on the procedures to transfer their Ownership, they may speak with a customer representative at Lost Valley Lake Resort.  Mr. and Mrs. [redacted] will be responsible for ensuring their deed is transferred. I filed a complaint against Lost Valley Lake resort I had not got any emails until today saying my complaint was closed.... I want to respond back please!!!!!! They can not do new computer structure. Without owners votes and take it on dues. This is a vote and is an assessment. With this being said there is numerous other things that the resort is three different businesses one of them is a nonprofit is the one that we own ownership out of the other two are Prophet but they're all ran out of the same address how is that legal? Also how is it considered a private Resort and we have ownership but they are going to allow the public free access to it?We as owners are having a meeting February 18th at 2 p.m. off site and we would like somebody to come and talk with us we have so many questions and there's no way of getting out of our ownership without paying a lot of money in dues and in the transfer fee this is unreal they are really playing the system and you guys really need to audit them.Thank you

All Board meetings are held on Saturdays, normally mid-morning, making it easier for owner’s attendance.  To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the 76.25% increase in dues is included in the annual billing statement. Dues for all owners increased for the following reasons:1.      New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. Recognizing this fact, the Board retained MECCO Engineering to develop a plan for meeting the Club’s needs in accordance with new Missouri Department of Natural Resources and Federal Waste Water discharge requirements. Our Current plant permit expires on November 1st, 2018, so a new treatment plant must be operation by then. With an estimate build time of six months, it is imperative we fund this project now. 2.      New Swimming Pool: The Board has exhausted all efforts to maintain the swimming pool in sufficient working order, but our thirty-year old pool now has to be replaced. The pool leaks up-to 10,000 gallons of water per day and the filtration system cannot keep up with the demand upon it. Construction is planned to start after Labor Day 2017 and to be completed by Memorial Day 2018. Again, it is imperative to fund this project immediately. Again, this information plus an additional three pages depicting the increase will be in with the annual statement or it may be viewed on line at LostValleyLake.com.  According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors.A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for review. The BOD only received the final project costs and recommendations from the engineering company hired for the project on Jan 18, 2017. Time was of the essence for the Board to determine funding for the projects which would be discussed and settled at the annual BOD meeting open to all owners on Jan. 21, 2017. Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, 2018 there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all owners. With that being said payment plans were designed to help owners with the increase. Lost Valley Lake Resort is allowing owners who can’t pay the increase in dues before April 1st, to be set up on a payment arrangement. As long as a minimum payment of $150.00 is made in the month of March and every 30 days thereafter, owners may still have access to the Resort with the exception of major holidays until the balance is paid in full.  According to the [redacted]’s Acknowledgement they may will, sell or transfer their interest and Lost Valley Lake Resort nor its employees will re-purchase or re-sell for them. If the [redacted]’s are wanting to recoup any funds from their investment they will need to locate a buyer to do so. I have enclosed a copy of the Acknowledgment and a Resale packet for their review.On February 4th, 2017 Mrs. [redacted] called the office to go over her options. At this time the transfer of ownership was mentioned along with terminating her ownership. On May 22, 2004 the [redacted]’s signed an Advantage Plus Ownership Addendum. In this Addendum the [redacted]s have the right to Quit Claim the property back to Lost Valley Lake at no additional charge but they will not be paid by the Resort for their ownership. According to the contract, in order to receive a Quit Claim Deed no money can be owned against the account. As was explained to Mrs. [redacted] on February 4th, she must have this process started on or before February 28th, 2017. Come March first the maintenance fees are due and the [redacted]’s will be responsible to pay them in full before terminating their ownership. Monetary compensation is money paid to an employee in exchange for the use of the employee’s labor. Upon attending the Board of Directors meeting, if a vote is required, they, the owners, can subject one vote per ownership.   According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.    Given the substantial increase in dues Lost Valley Lake Resort is more than willing to work out a payment plan with the owners. Maintenance Fees are due March 1st and delinquent after March 31st and fees are normally asset April 1st. As long as the owners call the Resort and set up payment plan before the end of March the Resort will waive any late fees or re-bill fees and also allow access to the Resort with the acceptation of major holiday usage. According to the Acknowledgement line item 8: The owners acknowledged that they have not been “high pressured” or coerced into purchasing and that this presents no undue financial burden to me (us). The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. Again, the Board regrets having to levy this dues increase as much as you may dislike having to pay it. But, hopefully all of us recognize the importance of protecting our investment and keeping our facilities in good operating condition; unfortunately, there comes a time when repairs no longer suffice and when replacements must be made. This is deeded property and the owners will have to treat it as such. The Resort spoke with Ms. [redacted] on January 7th, 2017 about transferring her ownership but not about a permeant release option. Ms. [redacted] does have an Advantage Addendum with her current General Ownership. In this Addendum it allows Mrs. [redacted] to Quit Claim her ownership back to the Resort as long as no money is owed against the account. Ms. [redacted]’s annual maintenance fees are due March 1st. Lost Valley Lake Resort will send Mrs. [redacted] the documentation she needs to close out her account. This information will be prepared by the Resort and mailed out to her next week. She will need to have her signature notarized on the documents and have them returned to the Resort before the maintenance fee due date of March 1st. If this documentation is not received before March 1st. Ms. [redacted] will be responsible to pay the annual billing. I have enclosed copies of the notices sent with this year’s current billing statements along with a copy of the Advantage Plus Ownership Addendum. At this time the Resort went over the transfer process and mailed out Mr. [redacted] a resale packet for his review. This packet was mailed twice once on February 15th and again on February 21st, 2017.   Mr. [redacted] must will, sell or transfer their interest in the Resort if he wishes to no longer remain an owner. I have enclosed a copy of the Resorts resale packet for review. I am responding to a complaint dated
October 21st, 2016, regarding the [redacted]’s Lost Valley Lake Resort
ownership, in hopes of resolving this matter.
 
The [redacted]’s have been Lost Valley
Lake Resort owners since June of 1997. When they first became owners,
purchasing a Charter level ownership, they agreed to the terms and conditions
of the Resort and also to the selling / transferring of ownerships. The [redacted]’s
then sold this Charter ownership to another individual in August of 2007, then
purchasing an Executive ownership from an already existing owner. At the time
of both transfers a transfer fee was implemented by Lost Valley Lake Resort and
had to be paid in full at the time of transfer.
 
The process to transfer ownership remains
the same as it was in 1997. New ownerships continue to be sold in the
$8,000.00- $12,000.00 range, depending upon the amenities selected. The
$1,500.00 administrative charged for “transferring ownerships” was implemented
to cover the expense of introducing and transitioning new members into the
Resort. This charge has not prevented individuals from selling their undivided
interest in the real property on which the Resort facilities and amenities are
located. Lost Valley Lake Resort is currently handling five to eight, on
average, resales a week. This increase was not implemented in 2015 as depicted
in the complaint but was put into effect in May 2014. This increase information
was made available to all owners on Lost Valley Lake Resort’s website, managers
meeting which all owners can attend and in the owner Resale and Transfer
packet.
 
Mr. and Mrs. [redacted] are allowed to
vote on changes that take place at the Resort by attending a Board of Directors
meeting which is made up of owners. At the Board meetings owners voice their opinions
on the changes to their Resort and vote for or against these changes. If Mr.
and Mrs. [redacted] don’t attend the owner meetings they will not have a voting
voice. I have attached a copy of the Contractual Worksheet and Agreement signed
and initialed by the [redacted]’s showing [redacted] as the voting owner for this
ownership.
 
As also stated on the attached
Acknowledgment the [redacted]’s acknowledged that Lost Valley Lake Resort nor its
employees will repurchase or resell their current ownership. There for advising
the resort to pay Mrs. [redacted] $1,000.00 for her ownership is not an option.
Lost Valley Lake Resort is still currently selling new ownerships there for
they will not assume hers.
 
Lost Valley Lake Resort is limited on
the number of ownerships that can or will be sold. According to the [redacted]’s
General Warranty Deed, paragraph number 3, the [redacted]’s hold a 1/14,000 undivided
interest in to the described land. This meaning they are shareholders of the
property along with 14,000 other individuals. At this time Lost Valley Lake
Resort hasn’t come close to reaching the allotted capacity of ownerships sold.
 
When the [redacted]’s signed their first
contract in 1997 and the second in 2010 they agreed that there are a limited
number of trailers and condominiums for rent by Mid-America as a convenience to
owners on an availability basis. Advanced reservations are required. Please
view line item number 7 on the attached Acknowledgment.
 
The Rules, Regulations and Bylaws
were also given to the [redacted]’s at the time of purchasing both ownerships.
These rules are what govern the Resort and also depict the transfer process and
fees involved.

of resolving this matter.   Upon the [redacted]’s last stay at the Resort in May 2016 a condo was of preference. Upon speaking with the Resort manager a statement was given about the stay. “We do take request for certain units; however, if there is some type of maintenance or any other issue with the unit we reserve the right to mover owners. There is a statement in the annual calendar that states we do not guarantee specific units. We certainly don’t want owners staying in a condo that has issues. We move owners to the same type of unit they requested if a specific unit is requested we call the owner to let them know there is an issue but if they request a certain type we move them to that unit type.” “As to specific request this owner had, we have a note in their file stating they wanted a no smoking / no pet unit.”   I’m apologetic that the [redacted]’s last stay was not up to par with the way we rate our Resort. This issue has been taken to the Resort manager for review. A two night stay, paid for by the Resort, is being sent to the [redacted]’s for their troubles.   If the [redacted]’s wish to pursue legal action, this is their purgative and they may do so. At the time of finalizing Mrs. [redacted]’s paperwork she was made aware that in order for her to relinquish her rights she must sell her ownership much like the transfer that took place that day in 2013. According to the Acknowledgment signed, Mrs. [redacted] must will, sell or transfer her interest to another individual if she wishes to no longer remain an owner of the Resort.   Lost Valley Lake Resort has not altered the terms of Mrs. [redacted]s contract. The Retail Installment Contract ties back to the Rules, Regulations and Bylaws given to Mrs. [redacted] at the time of closing in July 2013. According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Lost Valley Lake Resort offers Resort usage 365 days a year to all of the amenities. Mrs. [redacted] has full access to her Resort any time she wishes. As Lost Valley’s Marketing and Sales agent, [redacted] handles the transfers of Ownerships for Lost Valley Lake. The $1,500 has been in effect for 3 years now. After 30 years, the fee was raised to cover the cost of labor, utilities, deed work, supplies and overhead expenses. After surveying various resorts in our industry our rates are not the highest nor the lowest but moderately priced. What we have seen since the increase is the number of non-paying dues Owners has decreased because of the increase – prior to the increase approximately 20% of the individuals that purchased a transfer did not pay their dues. Furthermore, the increase is protecting the value your / our Ownerships. Prior to the change, Ownerships were being given away for free. Lost Valley did increase transfer fees in 2014. This was made aware to all owners in the quarterly news letters that are mailed and also on our website at LostValleyLake.com. I have enclosed a resale packet for review. At this time Lost Valley is currently handling, on average, about six successful transfers per week. New memberships continue to be sold in the $8,000.00-$12,000.00 range, depending on the amenities selected. The BOD meetings are the same time each year and widely published, all owners are encouraged to attend. In fact, there were 20+ owners present at the Jan 21st annual meeting.  According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.           The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors.A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for review. The BOD only received the final project costs and recommendations from the engineering company hired for the project on Jan 18, 2017. Time was of the essence for the Board to determine funding for the projects which would be discussed and settled at the annual BOD meeting open to all owners on Jan. 21, 2017. Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, 2018 there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all owners. With that being said payment plans were designed to help owners with the increase. Lost Valley Lake Resort is allowing owners who can’t pay the increase in dues before April 1st, to be set up on a payment arrangement. As long as a minimum payment of $150.00 is made in the month of March and every 30 days thereafter, owners may still have access to the Resort with the exception of major holidays until the balance is paid in full.    The [redacted] do have an ownership with the Resort. They are able to utilize the facilities 365 days a year. The outside groups being referred to are Coast to Coast members. Lost Valley Lake Resort is affiliated with other traveling groups. When “outside groups” use Lost Valley they are going through a discounted traveling group to do so. They must stay a certain period of time and are not allowed to use the facilities as a normal owner would. Lost Valley Lake Resort deed holders may use the Resort at any time day or not unlike the Coast to Coast members.  Mr. and Mrs. [redacted] have a General Warranty Deed meaning they hold a 1/14000 undivided interest in the Resort. I have enclosed a copy of the deed for review.  Mr. and Mrs. [redacted] must will, sell or transfer their interest in the Resort if they wish to no longer remain owners. Board of Directors, also owners, meet each year to discuss the annual maintenance fee. At this board meeting it is voted to see if the dues will increase or remain the same for all owners. The Board of Directors meetings are listed on Lost Valley Lake Resort’s web page, in the new letters that are mailed to all owners quarterly and also in the yearly calendar. As it has been in years past, we strongly encourage all owners to attend the meetings to stay up to date on the current Resort events. If Ms. [redacted] wishes they may attend the next Board of Directors meeting being held here at the Resort on May 20th at 10am to have her concerns addressed by the Board. All Board meetings are held on Saturdays, normally mid-morning, making it easier for owner’s attendance.   To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the increase in dues will be included in the annual billing statement. Dues for all owners increased for the following reasons: New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. Recognizing this fact, the Board retained MECCO Engineering to develop a plan for meeting the Club’s needs in accordance with new Missouri Department of Natural Resources and Federal Waste Water discharge requirements. Our Current plant permit expires on November 1st, 2018, so a new treatment plant must be operation by then. With an estimate build time of six months, it is imperative we fund this project now. New Swimming Pool: The Board has exhausted all efforts to maintain the swimming pool in sufficient working order, but our thirty-year old pool now has to be replaced. The pool leaks up-to 10,000 gallons of water per day and the filtration system cannot keep up with the demand upon it. Construction is planned to start after Labor Day 2017 and to be completed by Memorial Day 2018. Again, it is imperative to fund this project immediately. In Ms. [redacted]’s complaint she mentions the $150.00 for a three (3) month period to pay dues in full. Ms. [redacted]’s annual maintenance fee was billed for $1054.50 and at $150.00 per month this would take seven (7) months to pay not three (3) as noted.   Ms. [redacted] received her ownership from another individual in 2012. The process to relinquish interest in the Resort remains the same as when she purchased her ownership. According to the Acknowledgment Ms. [redacted] may will, sell or transfer her interest. Lost Valley Lake Resort will not buy back or re-sell this for her. New ownership continue to be sold in the $8,000.00- $12,000.00 range, depending upon the amenities selected. The $1,500.00 administrative charge for “transferring ownerships” was implemented to cover the expense of introducing and transitioning new owners into the Resort. This charge has not prevented individuals from selling their undivided interests in the real property on which the Resort facilities and amenities are located. Currently the Resort is handing, on average, about five-six successful transfers per week. I have enclosed a resale packet for Ms. [redacted]s review. Maintenance Fees are due March 1st and delinquent after March 31st and fees are normally asset April 1st. As long as the owners call the Resort and set up payment plan before the end of March the Resort will waive any late fees or re-bill fees and also allow access to the Resort with the acceptation of major holiday usage. The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. Again, the Board regrets having to levy this dues increase as much as you may dislike having to pay it. But, hopefully all of us recognize the importance of protecting our investment and keeping our facilities in good operating condition; unfortunately, there comes a time when repairs no longer suffice and when replacements must be made. [redacted] is owned and operated by Mid-America Resort. The people who purchase a lease for year around housing are also owners who are subjected to the same increase as all the other owners. At this time there are currently only 5 permanent residents living at [redacted], this does not affect our sewer treatment plant. The owners who purchased these residence have paid substantially to obtain housing. The sewer treatment plant was first installed in 1986 and paid for by Mid-America Resort not the owners. After all these years of wear and tear, growth of the Resort as a whole and maintenance to scrape us by the Department of natural Resources and Federal Waste Water states our system is no longer up to code, to small and must be replaced. We are past the point of fixing what is currently there. The next board meeting will be held here at the Resort on May 20th at 10am in the Monroe Meeting Room. I strongly encourage the [redacted]’s to attend this meeting and address their concerns with the Board of Directors. I have enclosed copies of the notices sent with this year’s current billing.
