02/03/17       Revdex.com Complaint # [redacted]   RE:  Lost Valley Lake Resort Account # [redacted]         [redacted] and [redacted]   To whom it may concern;   I am responding to a second complaint received on January 3rd, 2017 after responding to the first complaint on January 26th, 2017.   I have attached the first complaint with the Resort’s response as our position remains the same.   Wither this billing was mailed out as an assessment or in addition to the annual maintenance fee these current projects still have to be funded. Without the sewer treatment plant the owners of Lost Valley Lake Resort will have no water for bathing, flushing toilets, swimming and all of the other actives that require water. The outdoor pool is a major attraction during the summer time so it goes without saying that it also must be replaced.   According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.          The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. Again, the Board regrets having to levy this dues increase as much as you may dislike having to pay it. But, hopefully all of us recognize the importance of protecting our investment and keeping our facilities in good operating condition; unfortunately, there comes a time when repairs no longer suffice and when replacements must be made. The new Sewer treatment plants estimated cost is $1,677,398.00. When the Resort opened in 1983 the sewer treatment plant was put in by Mid-America Resort to help start the growth of the property. Since 1983 we have obtained more property and more owners. Mid-America Resort is covering the equipment cost for the placement of the new plant. A lot of the heavy equipment needed to put in the new plant will cost as much as $200.00 an hour to run this machinery. Mid-America Resort is helping to fund this project but some of the cost must fall back on the owners who use this luxury.   Lost Valley Lake Resort will remain a private club. This year the Resort will be opening its gates during the solar eclipse for anyone to attend this event. This is a onetime thing. If you are not an owner of the Resort you must be on the Resort as a guest of another owner any other time.   If Mrs. [redacted] wishes to meet with a representative of the Resort on February 18th contact must be made with the Resort manager in order to do so or they may attend the next Board of Directors meeting which will be held on May 20th, 2017 at 10am here on the Resort.     Sincerely,

Directors meetings are listed on Lost Valley Lake Resort’s web page, in the new letters that are mailed to all owners quarterly and also in the yearly calendar. As it has been in years past, we strongly encourage all owners to attend the meetings to stay up to date on the current Resort events.  If the [redacted]’s wish they may attend the next Board of Directors meeting being held here at the Resort on May 20th at 10am to have her concerns addressed by the Board. All Board meetings are held on Saturdays, normally mid-morning, making it easier for owner’s attendance.  To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the increase in dues will be included in the annual billing statement. Dues for all owners increased for the following reasons:1.      New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. Recognizing this fact, the Board retained MECCO Engineering to develop a plan for meeting the Club’s needs in accordance with new Missouri Department of Natural Resources and Federal Waste Water discharge requirements. Our Current plant permit expires on November 1st, 2018, so a new treatment plant must be operation by then. With an estimate build time of six months, it is imperative we fund this project now. 2.      New Swimming Pool: The Board has exhausted all efforts to maintain the swimming pool in sufficient working order, but our thirty-year old pool now has to be replaced. The pool leaks up-to 10,000 gallons of water per day and the filtration system cannot keep up with the demand upon it. Construction is planned to start after Labor Day 2017 and to be completed by Memorial Day 2018. Again, it is imperative to fund this project immediately. Again, this information plus an additional three pages depicting the increase will be received by all owners in the next week in the annual statement or it may be viewed on line at LostValleyLake.com.  Article VI Section 3, mail notification of meetings, “This violates Article VI Section 3 regarding how notice of meeting is to be given”.  Article VI Section 3 states “meeting of the membership”. The recent meeting on Jan 21st was a regularly scheduled Board of Directors meeting, not a membership meeting need no vote from the owners was imputed. The BOD meetings are the same time each year and widely published, all owners are encouraged to attend. In fact, there were 20+ owners present at the Jan 21st annual meeting.  According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.           The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors.A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for review. The BOD only received the final project costs and recommendations from the engineering company hired for the project on Jan 18, 2017. Time was of the essence for the Board to determine funding for the projects which would be discussed and settled at the annual BOD meeting open to all owners on Jan. 21, 2017. Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, 2018 there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all owners. With that being said payment plans were designed to help owners with the increase. Lost Valley Lake Resort is allowing owners who can’t pay the increase in dues before April 1st, to be set up on a payment arrangement. As long as a minimum payment of $150.00 is made in the month of March and every 30 days thereafter, owners may still have access to the Resort with the exception of major holidays until the balance is paid in full.   Lost Valley did increase transfer fees in 2015. This was made aware to all owners in the quarterly news letters that are mailed and also on our website at LostValleyLake.com. I have enclosed a resale packet for review. At this time Lost Valley is currently handling, on average, about six successful transfers per week. New memberships continue to be sold in the $8,000.00-$12,000.00 range, depending on the amenities selected. The $1,500.00 administrative charge for “transferring ownership” was implemented to cover the expense of introducing and transitioning new members into the Resort. This charge has not prevented individuals from selling their undivided interests in the real property on which the Resort facilities and amenities are located. Dear Sirs,
I am responding to a complaint filed with your office on April 22nd, 2015 in hopes of resolving the transfer issues pertaining to the [redacted]'s Lost Valley Lake Resort interest.
Mr. and Mrs. [redacted] purchased their Lost Valley Lake Resort interest on July 3rd, 1987 with the understanding that they had purchased an undivided interest that would have to be willed, sold or transferred to relinquish ownership rights. Mr. & Mrs. [redacted] signed and initialed an Acknowledgement pertaining to the sale of ownership in July 1987 and the same rules apply today in 2015. I have attached the Acknowledgement for your review along with Resale information that will be very helpful in the transfer of the [redacted]'s Lost Valley Lake Resort interest. Lost Valley Lake Resort does [redacted] fees pertaining to the transfer of ownership to cover the cost, time and effort put into the transfer of ownership. A copy of the Notice of Change of ownership is also attached for a breakdown of the transfer fees charged by the Resort.
Mr. & Mrs. [redacted]'s annual maintenance fee was substantially lower in 1987. Due to the cost of living increase over the years Lost Valley Lake Resort's maintenance fees have also increased with the Board of Directors approval, who are also Lost Valley Lake Resort owners. Lost Valley Lake Resort strongly encourages its owners to attend the board of director's meetings, listed in the calendar, to vote on the changes taken place at the Resort. If the [redacted]'s fail to attend the meetings their voice and opinions go unheard.
If the [redacted]'s wish to transfer their interest to the other party listed in their complaint they will need to contact the Customer Service Department Monday-Friday before 4pm. The Resort will need to obtain information from the [redacted]'s buyer to prepare the documents needed by the Resort. In most cases the buyer is responsible to pay the transfer cost which is due at the time of signing. In the [redacted]'s case the annual maintenance fee for the year has not been paid and is now delinquent. The maintenance fees have to be paid in full at the time of transfer as well. This $578.90 maintenance fee is also part of the transfer fee the [redacted]'s refer to in the complaint of $1996.00. Mr. and Mrs. [redacted] are aware of this annual due as they have now received four billings from the Resort requesting payment.
Lost Valley Lake Resort is currently handling, on average, 3-5 successful transfers a week. The transfer or resale of the [redacted]'s interest can be done and Lost Valley Lake Resort is more than willing to assist them through this process as long as the [redacted]'s complete their part of the process.
At this time Lost Valley Lake Resort is still selling new ownerships and are not in a position to purchase or re-sell the [redacted]'s ownership. The Resort request that the [redacted]'s to locate a buyer so we continue to receive a good dues paying customer as we are a business and must maintain our customer base.

The last Board of Directors meeting being held here at the Resort on May 20th at 10am which over fifty owners attended to have their concerns addressed.   To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the increase in dues was included in the annual billing statement for January and May. Dues for all owners increased for the following reasons: New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. The $1,500 has been in effect for 3 years now. After 30 years, the fee was raised to cover the cost of labor, utilities, deed work, supplies and overhead expenses. After surveying various resorts in our industry our rates are not the highest nor the lowest but moderately priced. What we have seen since the increase is the number of non-paying dues Owners has decreased because of the increase – prior to the increase approximately 20% of the individuals that purchased a transfer did not pay their dues. Furthermore, the increase is protecting the value your / our Ownerships. Prior to the change, Ownerships were being given away for free. Lost Valley did increase transfer fees in 2014. This was made aware to all owners in the quarterly news letters that are mailed and also on our website at LostValleyLake.com. I have enclosed a resale packet for review. At this time Lost Valley is currently handling, on average, about six successful transfers per week. New memberships continue to be sold in the $8,000.00-$12,000.00 range, depending on the amenities selected. Mrs. [redacted] will need to contact A[EH1]lternative Recover Management (ARM) to work out a payment arrangement. ARM has been subcontracted out by Lost Valley Lake Resort to collect on the past due funds. Upon attending the Board of Directors meeting, if a vote is required, Mr. and Mrs. [redacted]g can subject one vote per ownership.  According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.    Given the substantial increase in dues Lost Valley Lake Resort is more than willing to work out a payment plan with the owners. Maintenance Fees are due March 1st and delinquent after March 31st and fees are normally asset April 1st. As long as the owners call the Resort and set up payment plan before the end of March the Resort will waive any late fees or re-bill fees and also allow access to the Resort with the acceptation of major holiday usage. The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. Again, the Board regrets having to levy this dues increase as much as you may dislike having to pay it. If Mr. and Mrs. [redacted]g wish to relinquish their rights to the property they will need to will, sell or transfer the ownership to another individual as depicted in the Acknowledgement they signed on September 22nd, 1988.  Lost Valley Lake Resort is currently completing, on average about five transfers per week. It is up to the Owner to locate the buyer. Once this party is located the Owner will need to contact the Resort so we may assist in the transfer process. In the resale packet attached, are listed local websites where it is free to advertise the ownership. Lost Valley Lake Resort see most of the turnaround from those sites. In 2010 Lost Valley Lake Resort purchased more property allowing us to take our deeds from a 1/10,000 undivided interest to a 1/14,000 undivided interest. Meaning the [redacted]g’s own an interest in the Resort with up to 14,000 other owners. Lost Valley Lake Resort will provide the [redacted]’s with copies of any of their file documents upon request. I have enclosed a copy of the Deed Application filled out by the [redacted]’s in August 1993. Lost Valley Lake Resort sent the Mr. and Mrs. [redacted]g their General Warranty Deed on October 4th, 1993. At this board meeting it is voted to see if the dues will increase or remain the same for all owners. The Board of Directors meetings are listed on Lost Valley Lake Resort’s web page, in the new letters that are mailed to all owners quarterly and also in the yearly calendar. As it has been in years past, we strongly encourage all owners to attend the meetings to stay up to date on the current Resort events. If the [redacted]’s wish they may attend the next Board of Directors meeting being held here at the Resort on May 20th at 10am to have her concerns addressed by the Board. All Board meetings are held on Saturdays, normally mid-morning, making it easier for owner’s attendance.   To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the increase in dues will be included in the annual billing statement. Dues for all owners increased for the following reasons: New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. Recognizing this fact, the Board retained MECCO Engineering to develop a plan for meeting the Club’s needs in accordance with new Missouri Department of Natural Resources and Federal Waste Water discharge requirements. Our Current plant permit expires on November 1st, 2018, so a new treatment plant must be operation by then. With an estimate build time of six months, it is imperative we fund this project now. New Swimming Pool: The Board has exhausted all efforts to maintain the swimming pool in sufficient working order, but our thirty-year old pool now has to be replaced. The pool leaks up-to 10,000 gallons of water per day and the filtration system cannot keep up with the demand upon it. Construction is planned to start after Labor Day 2017 and to be completed by Memorial Day 2018. Again, it is imperative to fund this project immediately. Again, this information plus an additional three pages depicting the increase will be received by all owners in the next week in the annual statement or it may be viewed on line at LostValleyLake.com.   Article VI Section 3, mail notification of meetings, “This violates Article VI Section 3 regarding how notice of meeting is to be given”.  Article VI Section 3 states “meeting of the membership”. The recent meeting on Jan 21st was a regularly scheduled Board of Directors meeting, not a membership meeting need no vote from the owners was imputed. The BOD meetings are the same time each year and widely published, all owners are encouraged to attend. In fact, there were 20+ owners present at the Jan 21st annual meeting.   According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.          The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors. A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for review. The BOD only received the final project costs and recommendations from the engineering company hired for the project on Jan 18, 2017. Time was of the essence for the Board to determine funding for the projects which would be discussed and settled at the annual BOD meeting open to all owners on Jan. 21, 2017. Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, 2018 there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all owners. With that being said payment plans were designed to help owners with the increase.   Lost Valley Lake Resort is allowing owners who can’t pay the increase in dues before April 1st, to be set up on a payment arrangement. As long as a minimum payment of $150.00 is made in the month of March and every 30 days thereafter, owners may still have access to the Resort with the exception of major holidays until the balance is paid in full.     Lost Valley did increase transfer fees in 2015. This was made aware to all owners in the quarterly news letters that are mailed and also on our website at LostValleyLake.com. I have enclosed a resale packet for review. At this time Lost Valley is currently handling, on average, about six successful transfers per week. New memberships continue to be sold in the $8,000.00-$12,000.00 range, depending on the amenities selected. The $1,500.00 administrative charge for “transferring ownership” was implemented to cover the expense of introducing and transitioning new members into the Resort. This charge has not prevented individuals from selling their undivided interests in the real property on which the Resort facilities and amenities are located. Please review the attached Acknowledgment signed on September 21st, 2010.  The [redacted]’s purchased their wilderness ownership from another individual at that time. I am responding to a complaint, filed with your office on July 26th, 2017, in hopes of resolving this matter.   Mr. and Mrs. [redacted] purchased their Executive Lost Valley Lake Resort interest from another individual on March 3rd, 2005. This was not a direct sale from Lost Valley Lake itself but from another already existing owner. In previous conversations with the [redacted]’s Lost Valley went over the steps of the transfer process to locate a buyer for their interest. As was and still is the same process from when they purchased their ownership interest in 2005.   Mrs. [redacted]’s explains in her complaint an issue from May 2016. Lost Valley Lake Resort has addressed this issue with her on two separate occasions, May 9th, 2016 & May 31st, 2017. The Resort does have rules that have to be implemented, when it comes to Associate owners utilizing the facilities. Associate owners listed on the owners associate form may utilized the facilities without the owner present given they are in possession of an associate card. These cards are $100.00 a year and are good for a year from the date of purchase. The Associate owner does not have to be in possession of an owner associate card if they are present with the owner and the owner is in possession of his or her card, which are free to the owners unless lost. Here at Lost Valley Lake Resort our reputation and customer relations are of the upmost importance. We strive to provide the best representation and with that comes the willingness to facilitate the needs of our customers.   That being said, we are still a business and must operate as such. Lost Valley Lake Resort is able to maintain our five start status in the camping industry by assessing the annual maintenance fees to its owners. This annual fees is what maintains the five hundred plus acres on which the Resort is located. All levels of ownership did receive a 76.5% increase to the annual dues amount. As the [redacted]’s stated the increase was implemented for a new sewer treatment plant and swimming pool.             Why do we need a new Sewer Treatment plan? Essential point is the Federal and State Waste Water discharge requirements have become more restrictive over the years. We have worked diligently to meet those requirements over the years however, with the combination of more restrictive standards and increase in usage we have not and will not be able to comply.  Our first facility built in 1982 was designed for 30,000 gallons per day. This facility was upgraded in 1993 to a design flow of 60,000 gallons per day. A flow meter was installed September 2015. Wastewater flows vary from a low of 3,400 gallons per day to a high of over 220,000 gallons per day. Flow during the month of July 2016 averaged more than 130,000 gallons per day for the entire month. Please note that in past years even with increased usage we have been able to meet standards however, with the more restrictive codes we can no longer meet the requirements. What happens if we do not build a new treatment facility? The answer is simple, the State will close the Resort until we meet requirements. Our current permit expires November 1, 2018 so to avoid closing the Resort we must have a new treatment facility operational by November 1, 2018. Have we exhausted all means to maintain the treatment facility? Absolutely, in fact both the LVL Maintenance Manager and the MAR Maintenance Manager go to schooling and maintain State certification. Thru out the years we have updated and fixed the treatment plant and have exhausted all avenues to avert this problem. However, with the Federal and State regulatory requirement tightening over the years we have reached the point (and MECCO agrees) that we must replace the facility. All of us recognize the importance of protecting our investments and keeping our facilities in good operating condition; unfortunately, there comes a time when repairs no longer suffice and replacements must be made. How many bids have you gotten for the Sewer Treatment Plant?  We have received design options coordinated thru MECCO engineering. Based on the studies conducted by MECCO they have given us their recommendation on how to proceed. We are to early in the process to put the Sewer Treatment plant out for bids. We have just recently submitted our application for the Antidegradation Review Summary for Public Notice then we will accomplish the Request for Geohydrologic Evaluation of Liquid-Waste Treatment facility/site. Then MECCO will complete their report and submit to us for review prior to the finished report going to DNR. DNR approves the facility plan and then we can move forward with the design phase. So probably after DNR approves the facility plan we can move forward with a request for bid. The whole process is on about a nine-month time table. Why do we even need an outdoor swimming pool? Simply put, the outdoor swimming pool is one of the most popular amenities LVL has. Our outdoor pool is thirty years old and has served us amazingly well. However roughly, ten years ago, problems developed. The acrylic walls, the concrete floor, the patio, and steps used for entry and exit all began to crack. In each instance, repairs were made immediately. Concrete zero depth entry and exit replaced the steps. Acrylic walls have been patched with fiberglass and marine grade sealants. The concrete was also patched. Each repair was performed with the intention that once it was repaired, it would never again be a problem. It is pleasing to report we have done relatively well in this regard. In spring 2016 however, a new leak arose and it showed itself to be the worse leak to date. The pool is now leaking 1,000 a day and upwards of 10,000 gallons of water per day. For example, in filling the pool this year we pumped in water for 120 hours and let the pool sit for 120 hours and had a zero gain. After 120 hours, the pool leaked back to the original starting point. Have we consulted with professionals regarding the pool? Yes, we have consulted with professionals in the pool industry during the fixes we have performed, additionally, we have hired contractors to perform some of the repair issues for us. Furthermore, we have consulted with various leading pool industry experts to garner their input on the issues we face. How many bids have we received for the swimming pool? This project is out for bid. We currently have one bid and a conceptual drawing which is posted on your website, lostvalleylake.com. LVL says no pool plans have been drawn up. This is not correct. LVL currently has one quote and a drawing – so the cost was not determined by an artist conception. LVL has requested bids from six different companies so the scope of the current quote may change. LVL shared the current cost estimate based on the quote that was received at the time. Is the pool really leaking 10,000 gallons a day? Yes, the pool does leak upwards of 10,000 gallons of water per day – on the extreme side of things. As an example, we filled the pool for 120 hours then stopped. 120 hours later the pool had leaked to the exact sport where we started filling. It appears as the weather warms things seem to expand and the leaks slow to a more manageable pace. American Leak Detection has been scheduled times to inspect the pool – each time they have cancelled due to inclimate weather. We will continue to investigate the pool.    Will the pool have to be closed for the summer if we don’t get enough money because the sewer would be the first to be replaced as it is essential? As far as priorities go yes, the sewer treatment plant is the priority. We are currently in the enforcement phase with the State because our treatment plant does not meet their requirements. If we do not move forward with our plan to bring the treatment plant up to the State’s requirements then we will be penalized daily for non-compliance and eventually the State will cease our operations. As you can see time is of the essence to complete these projects.   According to the Rules, Regulations and Bylaws, given to all owners at the time of closing: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. At this time the past due amount is almost five months in delinquent and after 90 days, susceptible for collections. Lost Valley is always willing to work out a payment arrangement with our owners but when those attempts fail collections must follow. The [redacted]’s may reach a settlement offer with Alternative Recovery Management (ARM) for the closure of their ownership. Please contact them at #[redacted] to arrange a solution to your problems. I am rejecting this response because:
This does not address the fact that this is a business scheme that was never explained as a lifetime debt never to be relinquished from.  This ownership is not worth $1,500, and if it were, they would not be requiring owners who can no longer afford it to have to pay $6,294 to get out of it.  This interest can't be sold through normal truthful  sales channels, and my parents do not have the resources to continue to pay.  This business may have written up contracts to legally justify what they are doing, but it isn't moral or ethical to require people who didn't understand the commitment, to continue to have to pay for something they no longer use.  If this is such a good deal, than let my parents off the hook, and terminate their interest.  They will walk away with $0, even after all they have paid through the years.If this were a normal interest, this company would say, YES.  Look at all the money we made off of them, and now we can resell it.  I understand they don't want to resell it, because they would rather scam somebody else into paying a ton of money, and siphoning from them too.This is unacceptable.  They need to terminate the interest rights and move on.  If they were a decent company, they would do so.

As long as the owners call the Resort and set up payment plan before the end of March the Resort will waive any late fees or re-bill fees and also allow access to the Resort with the acceptation of major holiday usage. The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors. Again, the Board regrets having to levy this dues increase as much as you may dislike having to pay it. But, hopefully all of us recognize the importance of protecting our investment and keeping our facilities in good operating condition; unfortunately, there comes a time when repairs no longer suffice and when replacements must be made. According to the Acknowledgment signed by Mr. and Mrs. [redacted] on November 25th, 1990, line item 6: We understand that our individual interest can be willed or sold by notifying Mid-America and the Club. Mid-America, its employees or sales representatives will not re-purchase or re-sell this ownership. Also stated on line item 8: We have not in any manner been “high pressured” or coerced into purchasing. We attest that this purchase is being made for recreational usage as opposed to an investment, and that this presents no undue financial burden to us. Upon review of the [redacted] stay history, they are correct in stating they have no utilized the facilities in years. Lost Valley Lake Resort is willing to offer them a onetime Early Termination of Ownership Agreement. This agreement does require a payment of $1018.00 for documents, recording fees and an early termination fee. If the [redacted]’s wish to take advantage of this offer to permanently close out their account they will be given 30 days to do so. I have attached the document that needs to be signed by the [redacted]’s and return back to the Resort no later than March 16th, 2017 in order to receive a Quit Claim Deed. If the [redacted]’s refuse this offer it will be up to them to locate a buyer to transfer their interest. I have enclose a copy of the Resale packet for review. Lost Valley Lake Resort is finalizing on average about five (5) transfers per week. Upon locating a buyer the [redacted]’s will need to contact the Resort so we may assist them in the transfer process. Lost Valley Lake Resort received a call from an associate owner on the [redacted] account. This conversation was heard by other employees of the office and started out on a bad note from the beginning. After being accused of discriminating owners, asking questions that the employee wasn’t given the option to answer the call was put to an abrupt end. The employee did inform the caller that if she wasn’t given the time to answer the caller’s questions and the caller didn’t stop yelling at the employee the call would end, this was the end result.   Lost Valley Lake Resorts Customer Service Department is answering owners questions the best to their ability. If the owners are not getting the answers they need from this department they may contact the Resort Manager, [redacted], who will try to inform them the best she can. The Board of Directors meetings are listed on Lost Valley Lake Resort’s web page, in the new letters that are mailed to all owners quarterly and also in the yearly calendar. As it has been in years past, we strongly encourage all owners to attend the meetings to stay up to date on the current Resort events. If the [redacted]’s wish they may attend the next Board of Directors meeting being held here at the Resort on May 20th at 10am to have her concerns addressed by the Board. All Board meetings are held on Saturdays, normally mid-morning, making it easier for owner’s attendance.   To the owners that failed to attend the Board meeting, held on January 21st, 2017, a letter depicting the increase in dues will be included in the annual billing statement. Dues for all owners increased for the following reasons: New Sewer Treatment Plant: The current usage exceeds current plant capacity by almost doubling the gallons per day used. Recognizing this fact, the Board retained MECCO Engineering to develop a plan for meeting the Club’s needs in accordance with new Missouri Department of Natural Resources and Federal Waste Water discharge requirements. Our Current plant permit expires on November 1st, 2018, so a new treatment plant must be operation by then. With an estimate build time of six months, it is imperative we fund this project now. New Swimming Pool: The Board has exhausted all efforts to maintain the swimming pool in sufficient working order, but our thirty-year old pool now has to be replaced. The pool leaks up-to 10,000 gallons of water per day and the filtration system cannot keep up with the demand upon it. Construction is planned to start after Labor Day 2017 and to be completed by Memorial Day 2018. Again, it is imperative to fund this project immediately. Again, this information plus an additional three pages depicting the increase was enclosed in the annual statement or it may be viewed on line at LostValleyLake.com.   Article VI Section 3, mail notification of meetings, “This violates Article VI Section 3 regarding how notice of meeting is to be given”.  Article VI Section 3 states “meeting of the membership”. The recent meeting on Jan 21st was a regularly scheduled Board of Directors meeting, not a membership meeting need no vote from the owners was imputed. The BOD meetings are the same time each year and widely published, all owners are encouraged to attend. In fact, there were 20+ owners present at the Jan 21st annual meeting.   According to the Rules, Regulations and Bylaws, given to all owners at the time of closing, not listed in the Retail Installment Contract: Dues may be increased by the Board of Directors, provided, however, in no event may the dues of any one member be increased without increasing the dues of all members proportionately. Fees, if any, for Club activities shall not be deemed to be dues or assessments, and the same shall be determined by the Board of Directors. Dues shall be used for the operation, improvement, and maintenance of the Club and the Club property and for no other purpose.           The Board of Directors is committed to maintaining the dues at the lowest possible rate while also protecting the health and welfare of LVL and maintaining our excellent rating in the camping industry. The Board anticipates this short-term dues increase will be sufficient to cover the cost of the sewer treatment and swimming pool projects. We are expecting the dues to decrease for the year 2018. Any and all changes or adjustments to the dues was ran through the Resorts legal advisor before being passed by the Board of Directors. A special BOD meeting was held on Jan 18th which was a closed session, minutes are published on LVL website for review. The BOD only received the final project costs and recommendations from the engineering company hired for the project on Jan 18, 2017. Time was of the essence for the Board to determine funding for the projects which would be discussed and settled at the annual BOD meeting open to all owners on Jan. 21, 2017. Due to the time constraints mandated by Federal and State regulations, the sewer treatment facility must be completed by Nov 1, 2018 there was not time to spread the increase out because funds are needed to start and complete the projects in order for the resort to maintain a safe environment for all owners. With that being said payment plans were designed to help owners with the increase.   Lost Valley Lake Resort is allowing owners who can’t pay the increase in dues before April 1st, to be set up on a payment arrangement. As long as a minimum payment of $150.00 is made in the month of March and every 30 days thereafter, owners may still have access to the Resort with the exception of major holidays until the balance is paid in full.     Lost Valley did increase transfer fees in 2015. This was made aware to all owners in the quarterly news letters that are mailed and also on our website at LostValleyLake.com. I have enclosed a resale packet for review. At this time Lost Valley is currently handling, on average, about six successful transfers per week. New memberships continue to be sold in the $8,000.00-$12,000.00 range, depending on the amenities selected. The $1,500.00 administrative charge for “transferring ownership” was implemented to cover the expense of introducing and transitioning new members into the Resort. This charge has not prevented individuals from selling their undivided interests in the real property on which the Resort facilities and amenities are located. review. If the [redacted]’s wish to take advantage of the Early Termination of Ownership Agreement this will need to be done before the experation date of March 14th, 2017. After this time they will be responsible to locate a buyer for their ownership and pay the early maintenance fee. Lost Valley has never taken back interest from owners as we are currently still selling new ownerships. The Early Termination of Ownership is a one time offer that normally isnt given. Lost Valley requires all owners to locate buyers so we can continue to operate with the annual dues received each year. As far as speaking with a man about relinqishing owership rights, there are no men that work in the Customer Service / Credit Department. I am unaware of where the [redacted]’s are recieiving their information from.  The Resort has hired an outside company to sell Coast to Coast, a discounted traveling package. Within this traveling package are also different perks with the home park that their orginal wilderness ownership doesn’t have. In fact, your comment of doing so are listed right here on the Revdex.com website!  LVL is discriminating against me and cherry picking who they will allow out of these contracts and THAT is against the law.  LVL set precedence by allowing others out for the exact same reason as I want out.  I do not use this membership, I live too far away to travel to your DUMP, and I surely cannot pack up a king size therapeutic mattress Ina Ford Focus!!!Erica's response of LVL not being a Hilton is accurate, it is a dump and I wish to Dump it back on LVL for the same options as given others which is between No charge, $108.00 or $1,683.20. I am done with this place- they are rude, inconsiderate to work with.  They operate on the fringe of the law and are unethical in their pursuit of making a dollar. They tell you they are transferring 5, 10, no maybe 30 memberships a week ( depending on which complaint they are answering) which in reality are most likely transfers back to them from owners who have bought the option to walk away - No one in their right mind would pay $10k+ for a membership there when Craigslist is dripping wet with owners begging for someone to take the damn thing off their hands for FREE and help pay for transfer fees!!!I will keep complaining and writing and posting and telling people just how HORRIBLE Lost Valley Lake truly is until I am released of this hellhole all while NEVER using it or paying another dime - I have nothing for you to take from me and I have nothing to lose. I choose taking care of my family over feeding into a never ending black hole that can't even be given away!If Lost Valley Lake was so great it'd be sold to capacity with potential buyers standing in line hoping to get a shot at a deed. According to the Acknowledgments listed in all owners files line item 6: We understand that our individual interest can be willed or sold by notifying Mid-America and the Club. Mid-America, its employees or sales representatives will not re-purchase or re-sell this ownership. Also stated on line item 8: We have not in any manner been “high pressured” or coerced into purchasing. We attest that this purchase is being made for recreational usage as opposed to an investment, and that this presents no undue financial burden to us. Lost Valley Lake Resorts slogan is “A World of Outdoor adventure.” We are not the Hilton and don’t provide owners with temperdic mattress. If the [redacted]’s are uncomfortable with their stay they may bring out toppers for our mattress’s or request maintenance to switch out the current mattress they are unhappy with.   I have enclose a copy of the Resale packet for review. Lost Valley Lake Resort is finalizing on average about five (5) transfers per week. Upon locating a buyer the [redacted]’s will need to contact the Resort so we may assist them in the transfer process. I have enclosed a copy of the Acknowledgment and a Resale packet for their review.If Mr. and Mrs. [redacted] would have contacted the office we could have gone over other options their ownership allows. On April 18th, 2002 the [redacted]’s signed an Advantage Plus Ownership Addendum. In this Addendum the [redacted]s have the right to Quit Claim the property back to Lost Valley Lake at no additional charge. According to the contract, in order to receive a Quit Claim Deed no money can be owned against the account. This process must be started on or before February 28th, 2017. Come March first the maintenance fees are due and the [redacted]’s will be responsible to pay them in full before terminating their ownership. I have enclosed a Quit Claim Deed for their signing to terminate the ownership agreement. Thirty days will be given for the notarized signing of the documents and for the Resort to be in receipt of them. The meeting Mr. and Mrs. [redacted] attended on January 27th,
2017 was for Coast to Coast, which is a discounted travel program. This program
should have been purchased for the use of travel with perks pertaining to the
Resort. In one of the Addendum clauses it states that if the owner purchases
Club Premier they can Quit Claim their interest back to the Resort after
certain conditions are met. Each contract varies depending on the level of
Coast to Coast they sign up for. Lost Valley Lake Resort did receive the
