Thank you for the opportunity to respond to this complaintOur records show that the account was assigned to collections on 11/19/for radiology services performed on 6/20/The consumer's complaint background history of talking with our company on 9/1/and 9/15/cannot be accurate since we didn't have his account in our office on those datesHis account was assigned with a post office box in Queen Creek provided by Gilbert Hospital where the services were deliveredMedical Diagnostic Imaging did not have a valid address nor did our agency until Mr [redacted] called us when he discovered the account on his credit reportThe account was already past the timely filing deadline for [redacted] insurance when it was assigned to our officeMr [redacted] called us on 7/8/to give us his [redacted] insurance information and on 7/25/16, Maria from [redacted] called us to confirm that he was eligible on the date of serviceWe have contacted Medical Diagnostic Imaging and have gotten authorization to cancel this accountThe cancelation will delete the item from Mr [redacted] 's credit record.We apologize for the inconvenience, however, we see no way that any of this could have been avoided given that the address from the facility was not correct and no insurance information was provided to Medical Diagnostic Imaging when the services were provided.We are sending verification of the cancellation to Mr [redacted] and trust that this complaint is now resolvedThank you

Thank you for the opportunity to respond to this complaintAs the attached documentation bears out, our response to validation of the consumer’s debts were made well within days of receiving her response even though this day requirement is for the validation period (defined as days following the first notice of delinquency being mailed)All three accounts had been assigned to the agency over three years ago when the disputes were received.There are two types of debtsThere are Oral Agreements and Written ContractsWhen a person presents themselves for services at an emergency department for care, they arrive on the Oral Agreement that they are requesting servicesThe expectation is that those services need to be paid for.The conditions of admission at the facility where the services are delivered clearly state that the patient is financially responsible for payment of services and that physicians delivering services are likely not employees of the facilityWhether the conditions of admission are signed or not, the Oral Agreement still applies because services were delivered at the behest of the patient’s presentation of injury or illnessIndeed, many patients arriving for emergency care may not be able to sign due to the severity of their condition on arrivalHowever, the Oral Agreement established by necessary services delivered is still bindingWe are attaching the full validation of the debts and the second response we sent to the consumer as required per FDCPA statutes.The consumer may request additional information regarding identification information presented on the dates of service in question and her care by going to [redacted] to fill out the form to receive her personal informationHIPAA statutes prevent the agency from obtaining any further information than the billing detail necessary for obtaining payment.Upon seeing the admission documents, if the consumer feels there is a case if ID theft, we would direct her to go to www.ftc.gov/idtheft to use a secure online affidavit form that she can have notarizedThis affidavit, along with a signed Law Enforcement Report can be submitted to the Credit Reporting Agencies to have her accounts reviewed for deletion as ID theftThe deletion order will then be transmitted to the agency from the Credit Reporting Agencies.Barring an ID Theft Determination by Law Enforcement, we would invite Ms***s to call [redacted] to make a payment arrangement on her accounts.In light of the apparent confusion on verification of debt requirements, we will delete the items from her credit profile when paidPlease let us know if there is any additional information needed from our office to close this complaint

Thank you for the opportunity to respond to this complaintNotably, according to our records, we have ot received any phone calls from Ms [redacted] on either of these accounts since the initial phone conversation on 9/12/There was no indication at that time that she was not responsible for her bill with Emergency Professional Services for the 8/22/date of service.We want to confirm that we have previously verified this debt with Ms [redacted] via mail on September 8th and on September 22, through the CFPB after receiving additional information that allowed us to locate the accountsAt that time, we responded with full verification of the debt and also sent the signed contract from the facilities where these emergency physician services were deliveredThese documents are the full requirement for verification of debt per FDCPA statutes.We are attaching all of them again with this response and are also mailing them again for her records.If Ms [redacted] feels there has been a criminal theft of her identification, she should file a police report of identity theftInstructions for this process can be found at [redacted] There is an online affidavit available to submit to the credit bureaus in order to report the id theft crimeThe affidavit must be notarized and accompanied by a law enforcement report.If Ms [redacted] would like further information about the nature of the services delivered during her visit at the facilities, she may request the medical records at the hospitals for detailed physician notes.We again invite Ms [redacted] to contact our agency at [redacted] for assistance in setting up a payment arrangement that will resolve this debtWe have temporarily suspended credit reporting of the debt for days to allow Ms [redacted] time to call us with payment arrangements and will delete the item from her credit profile once paid (unless the account is reported to us by the credit reporting agencies as being an ID theft case with a police report).Please let us know if there is any further way we can assist with resolving this complaint

Our records indicate that the account was paid on 11/13/and that we electronically transmitted a deletion order to the credit bureaus on 12/1/If this consumer sees this item on one of her credit reports, the error is with the bureau listing itWe sent the deletion order and it shows deleted on our systemThere is no method of deleting the account twice.Please contact the credit bureau that shows the error and dispute their listingThey will send the dispute to us for verificationOr, have the errant credit bureau contact us via phone to confirm that we ordered the deletion.Thank you!

In both cases when I asked for Validation that these were my accounts the creditor has failed to provide me proof of my signatureI have asked in both the letters they have attached in all three cases to provide me with proof of signature showing I have an obligation to pay these debts and to validate that they are mineThis has yet to be resolved and is way over the allotted time frame provided by the Fair Reporting ActI am not satisfied which merely a letter or a statement and my request for validation is legitimateI will take further action if these are not removed from my credit reports at this time

The services were delivered by Medical Diagnostic Imaging Group at [redacted] on 4/18/2009. We have attached an... itemization of charges for the consumer in order to verify this debt.Our first notice was returned In the mail by the USPS with a forwarding address of [redacted] . Subsequent notices were mailed to the [redacted] address with no return mail. No response was made to our notices nor voicemall messages.The first communication with this consumer was on March 181h 2015. The consumer left a message to call [redacted] An agent from the agency called that number back at 10:14AM the same day and left a message for a return call. We have no record of a response to our call.On March 10,20!S, we received a dispute through E-Oscar (web-link to all 3 credit reporting agencies). The consumer stated 11Provlde or confirm complete 10. This collection does not belong to me. I do not live in [redacted] or [redacted] . I have not done business with Medical Diagnostic Imaging Group, Advanced Radiology Heatthcare, Focused Imaging of AZ or Vascular and lnterventional Physicians.Per federal statute, a debt collector has 30 days to respond to a dispute. The account was scheduled for debt verification when we received this complaint. On April!,201S,we received a similar dispute through E-Oscar. We are fulfilling our obligation of responding to these disputes with the enclosed itemized statement of charges.This debt is not a situation of being past statute. The [redacted] Statute of limitations would lapse on April 18th 2015, however, when an account is listed on the credit report, there is another statute of limitation of 7 years from the listing date which,In this case,would be 12/2/2015.Please be advised that we have ordered the item deleted from the consumer's credit profile in consideration that the itemwould be scheduled to delete as past statute in December.We trust this deletion resolves this consumer's dispute. So, I still have a few issues with the "itemized list".For one, the charge from 01/07/simply states EMERGENCY DEPT VISITPEMS, the company charging me, is charging me for a hospital visit that occurred during my time visiting a friend at [redacted] hospitalI had fainted and vomited, and never requested to be admitted to the hospitalI literally woke up in the ER, against my willI was never diagnosed during my stay, and I've already had [redacted] , the hospital itself, agree that I should not have been charged for my stay at allI don't have health insurance, do not have any source of income, and am a full-time student, spending whatever loans I am able to secure on college tuition For the second charge, from 08/21/2013, the charges should be adjusted to reflect that I still have bruising from the numerous attempts from Interventional Radiology's staff attempting to insert this device time and time again, and failingI endured severe pain from this, and my family members witnessed it allIt is one of the reasons I'll never, as long as I live, return to a [redacted] hospital for anythingI want to also reiterate that I'm not sure how you expect a student with no income to pay for services that he never authorized, and requested to decline, against doctors' ordersThere's also a description of a service title "0" that I am apparently expected to pay $forPlease let me know what you can do for me, as I was not conscious during my admittance to either hospital, and asked to leave upon regaining consciousness at both hospitalsInstead of heeding my requests, these hospitals kept me there and failed to even diagnose what was wrong with me in the first placeIn turn, I've had both hospitals retract any and all claims for payment to them, as I did not sign anything stating that I agreed to pay for said services, nor did I even request the services of either hospital in the first place
