we have not received any payment as promised after signing the 1099 that Meritage asked us to sign in order to process the payment for restitution. We sent an email yesterday asking the status, and have not received a response to that either.

complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Meritage does seem to finally want to resolve a few things, only after I contacted the Revdex.com.During my correspondence with them, we had another significant water intrusion.  This time, it was into the master bedroom.  The carpet was saturated in the corner of the room and it was discovered that water was leaking down from a defect in the roof.  Turns out, that part of the roof decking was omitted, leaving a place where there was only tar paper and shingles, no roofing OSB decking.Meritage has been guarded and slow in getting this item, and others fixed.   We were told they would come out and have it fixed.  We wait around all day.  Nothing.  I leave two messages with the contact person, only to get a return call at 6:30pm saying they wouldn't be able to come out that day.  Both the point person and the local worker from Meritage told us, that it would be addressed that day.  Yet again, nothing.  So water continually leaks into the house while we wait for them.  What is our time worth?  We wait around all day only to be no-showed?  Instead, we get an email trying to blame us for why they wouldn't come out like they promised.Meritage finally comes late the next day, and we are given a time-frame of how long it will take.  2-3 days.  Well, it is going on 10 days and it is still not fixed.  Parts of it (of this latest water intrusion) have been addressed, but we are still waiting for Meritage to do what they said they were going to do.  Meritage will send us a detailed game plan of what is going to be completed, and by whom.  It sounds great.  However, the MO is to not be able to follow their own schedule.  Meritage is mostly concerned about covering themsleves legally, rather than doing what is best for the homeowner, and fixing the problem in a timely and CORRECT manner.  We are given excuses of weather, however, we have multiple days of weather in the 60's and no one is at our house working.  We have 3 kids sleeping in one room, we are displaced out of our room.  Our kids are young, and their sleeping patterns are significantly impacted with all of this.  Still, we wait.At this point, I think it appropriate for Meritage to compensate us for our time.  I think it appropriate for Meritage to buy back this house, or pay us for every hour that we have had to continually beg them to fix things correctly.  It has turned into a full time job.  We already have responsibilities and four kids.  We have notified Meritage of all of these issues for months.  They never fixed most of the issues and instead told us things were installed correctly.  If that was the case, why are they fixing them now?  It is not normal to have water raining down out of the oven hood, but that is what they told us.   It is not normal to have water pooling on the window sill of windows.  They tried to blame our whole house humidifier.  We don't have a whole house humidifier.  Water was leaking into the attic for 6 months, and they didn't want to investigate to see what issues that created.  Turns out that NONE of the pipes coming out of the roof were ever sealed!  All of them were an issue, according to the worker who came to fix things.  I asked multiple times.  Now they want to do air sampling.  Air sampling (according to their own IH) is ineffective this far after the event.  I get the feeling they know this, and are just trying to protect themselves.I am asking for Meritage to buy the house back and compensate us for all of the improvements we have made.  Lemon laws are designed to cover things like this.  Meritage has failed to properly fix items after many failed attempts.  It is not one issue.  It is not just one problem they have mislead us on.  It is many items that they have not fixed correctly, ignored and been negligent on.  They were informed of all of these water issues, and the impact it was having on us, and they did nothing.  If they are confident in the quality and safety of this house, they can own it.  Because of the many issues, we have not been able to move forward.  We can't even sell the house because they take so long to fix things.  Our master bedroom is torn apart.  We wanted to be out of this house (selling it) by now, but can't even list it because of Meritage's slowness.  We have another house that we would love to make an offer on, yet can't because our own house isn't and can't be listed on the market.When is enough enough?  When is Meritage held responsible for building a house with so many issues, refusing to fix the issues, and fixing some of the issues incorrectly multiple times?  We have done our part.  We have put in warranty requests multiple times.  Meritage ignored them.  Having four significant water intrusions that they ignored and/or wanted to turn a blind eye to, has had an affect on my family.  This is unacceptable. Again, I am asking Meritage to buy back this faulty house.  I appreciate any help you can give in this area.  Sincerely,[redacted]

Letter to Meritage CEO:
My wife and I purchased our Meritage home in 2008 in the [redacted] where Meritage had built a large number of homes during 2007-2009. Our neighborhood has generated national and international attention and in interviews with local and foreign media we have expressed our satisfaction with Meritage overall – process, personnel, construction quality, etc. – we’re happy customers. This was the fourth home I have had a home built and was by far the best experience.
Recently we discovered water damage to the lumber above our garage opening. This was caused by caulking that had failed. We notified local Meritage Warranty Dept. and were told that this was not covered by warranty, that home owner was required to re-caulk annually. That didn’t seem reasonable so we checked building codes which seemed to indicate that garage opening and windows required metal flashing. Walking around the neighborhood we noted:
- SOME Meritage homes had windows and garage openings caulked and SOME were flashed.
- ALL other builders, then and now, used flashing.
- Same building code applied to all builders.
This was pointed out to [redacted], Director of Construction, [redacted] and [redacted], Division President, [redacted]. I offered to walk the neighborhood with either or both of them but have had no response.
It might be that Meritage employees were either confused about code requirements or were negligent in performance of their jobs. In any case we expect Meritage to return and complete building our home properly – remove damaged wood and replace it with the addition of appropriate flashing.
Note that homes with flashing show NO damage and homes with caulking ALL show water damage.
CEO response was dismissive - no action will be taken

Do Not buy from this builder. You will regret it. Don't let the sales people fool you. We purchased more than 1.5 years ago and have had problems ever since. It's not work the headache. All they want to do is get your money, build a low quality house, and then provide the worst customer service you can imagine. I could go on and on about the problems we have had and the ongoing issues we continue to deal with. You can also ask anyone else in the Lafayette, CO, Silver Creek development and I guarantee you will hear the same. Check all reviews first before you buy and make a large mistake that will be a headache for a long time.

Our community is open and the public has the ability to drive to each lot. We most certainly do not agree that we held any information form the...

customer, we did indeed disclose everything. We understand the customer is disappointed with the lot they selected but again, Meritage had no influence one way or another on their choice of homesite. Most buyers visit the community and drive it in its entirety before entering into a contract. We do want our buyers to be happy with their new home and as a courtesy we have ordered the tree's to accommodate their request. We decline their request for monetary compensation.

I have received two phone calls from this business over the last several days, and returned their call today. I had to leave a message on the answering machine. To this point I have not spoken with anybody at Meritage and I'm still looking for resolution.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

We feel strongly that it was Mertiage Homes responsibility, as a developer of this community, to inform buyers that telephone, internet, and cable connectivity was an ongoing issue. I was informed by [redacted] Vice President of Meritage Homes on Thursday, September 18, 2014 via a phone call, that Meritage had been trying to obtain service in their model home offices at [redacted] since April 2014.  Since this was an obvious problem for Meritage's on-site sales office, it would obvisiously be a problem for homeowners. Since Meritage knew of this problem and did not disclose this issue to us or any other homeowners (or potential homebuyers) we feel that this was a breach of good faith and poor business. 

We understand that convincing [redacted] to connect the development will be difficult for Meritage, however, it will be even more difficult for us as a single home owner to provide the needed pressure to [redacted]. Therefore, as Meritage failed in their duty to inform homeowners  it is now their responsibility, as the developer of this community, to bring to bear all pressure that a National Builder and Community Developer can to persuade [redacted] to fix this problem in a timely manner.

To sum it up, why would anyone buy a new home in this community when their is no telephone, internet or cable?  All we are asking is for Meritage to follow through as a land developer/homebuilder and provide it's homeowners with the option of [redacted], as promised when signing a contract and paying for a new home.  We are asking for weekly written updates to show the progress.

I just closed on my new house 5 days ago, we have no irrigation system working properly, water heaters were damaged, a lot of workmanship details around the entire house.

But drop that overflow the cup, was an internal water leaking on the upper floor, now all kitchen ceiling needs to be removed.

But what is bothering me most is the unprofessional way this has been handled, so far no serious response or even an apology from any Meritage representative.

I would return back this house immediately if I could, and reading the reviews on Revdex.com , I am kind of loosing any hope.

I should have known better.

Meritage Homes inspected the complainants concerns, offered advice, reviewed recommended maintenance and per the complainants notes, offered additional courtesy assistance. This is not a warrantable matter and the complainant refused our courtesy offer; therefore we do consider this matter resolved. No further action will be taken.

Meritage has been nothing but an awful experience and we are now questioning the integrity of our new home. They are completely unprofessional and unethical. Our home has been left unfinished and it has been two months since we have been in our home and they keep saying they will come to finish things and never do. Huge structural cracks and a big chunk of cement missing from our front door step are just a few of the many. We are wishing we never bought the house at this point and I would not recommend this company to anyone looking to buy or build a house. It has been an absolute nightmare and I wish we had listened to the other bad reviews they have received. Big company or not, they are awful!!!!

reviewed this complaint in great detail. The contract clearly states the buyer is responsible to secure financing within a certain amount of time and therefore was not entitled to a refund of the earnest monies. However, we understand the miscommunication and disappointment expressed with this transaction due to the transition of ownership and process changes during their purchase experience. 

As a measure of goodwill we will refund the complainants earnest money and hope that in the future he will consider Meritage and allow us a second opportunity to make the right impression.  We wish the complainant and his family the very best.
