I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I appreciate the response from Meritage Homes, but until I am contacted and presented with a legitimate solution to this issue, this complaint will not be resolved.  Them telling me they are “in the process of reviewing the warranty history of this home” without telling me how long this process will take gives me no confidence there is really anything that will come of this standardized response.  Their local warranty department has been giving me the run-around for more than 2.5 years; why should I expect anything else?After I filed this complaint on January 13, 2015, I was contacted by a structural engineer just six days later, on January 19, 2015.  The man I spoke with said he was asked by [redacted], my local Meritage warranty representative, to set up an appointment to come and look at my home.  So, after not being able to get any response from Meritage for over 2.5 months, they have a third party contact me about this issue.  I assume this move was made as a result of me filing this complaint, but the fact I still have not been contacted directly by a Meritage representative demonstrates their continued disrespect toward me and their lack of taking this issue seriously.  On January 27, 2015 I spoke to [redacted], the structural engineer who contacted me on January 19, 2015, and I told him I would agree to an appointment for him to come out on Monday, February 2, 2015, contingent upon someone from Meritage contacting me directly, prior to that date.  As of today, January 31, 2015, I have not spoken to anyone from Meritage Homes.The fact that Meritage continues to refuse to make direct contact with me is rather concerning; I feel that I they are continuing to avoid this warranty issue instead of dealing with me directly and facing it head-on.  Once again, until someone from Meritage contacts me and gives evidence of real concern on their part, as well as whattheir specific intentions are going forward, I will not be satisfied.  At some point, I will no longer be able to tackle this issue my own.

We purchased a Meriatge Home in July 2010. Since this time our AC has gone out 4 times, the hot water heater has gone out 3 times and we have had several small repairs that have taken over three years to have completed. I spoke to [redacted] who finally got someone out to repair the small things but they will have no part in fixing anything else. To date we have exceeded 1200.00 in repairs and countless hours of frustration. I am not looking for anything from Meritage ( as if we would get it) just want consumers to know the quality of home they build will not last you more than 2 years...or until the warranties fall off. I see them putting up several developments and just want the public to be aware of the high cost and low value of the homes.

Meritage is lying to you. They did not inspect the shower before I removed FOUR tiles and the backing to look under our shower bench. Meritage also has failed to tell you that other construction companies and [redacted] Insurance has been to our home and cited faulty construction and Meritage responsibility. They have also failed to respond that the City of Converse finds them responsible as well. There will be no resolution until the pay to fix our bathroom that is ruined due to Heritage's faulty construction. The local news will be in the neighborhood soon to discuss our home and multiple other ones in the neighborhood so that the San Antonio community can make up their own mind rather or not they wish to buy poorly constructed homes from Meritage. If Meritage fixes our bathroom and the other homes' issues, then there won't be a televised complaint.

Meritage Homes proudly builds for families just like ours. Their is no way we would ever deliver a home with the alleged debris. We inspect the home thoroughly; our attics are part of the homes spray foam insulation envelope system that ensures our energy efficiency...

ratings. We certainly understand the frustration the complainant expressed however we delivered the home in 2014; its is now 2016 and we have no way of knowing whom may have had access to their attic over this period of time. 
We wish them the very best in their new home and wish to remind them their homes warranty is transferable to the new homeowners. The new homeowners may contact our warranty department to inquire about the remaining warranties, we also encourage the complainant to provide them with their New Home Warranty Manual. The manual is full of helpful tips and maintenance details to keep the home performing at its best.

The complainant did indeed experience an unfortunate event just a few days after they moved into the home. A main sewer line backed up and as a consequence a pipe broke. This was nothing that could have been foreseen and we share in their...

disappointment. However, this happened on a Sunday and Meritage did act immediately ensuring the leak stopped and the pipe was fixed the same day. We could not fill the hole at that time because it was filled with water. We did pump the water out and backfill the hole as quickly as possible. This is an anomaly and rarely happens, the community this home is in is right next to a lake, therefore the water table is high. That is why we were unable remove the water any faster. Meritage did perform per the context of our hew home warranty and sincerely apologize for the inconvenience the Kura family experienced. We trust they will enjoy their new home and we assure them we are here in the event they have any questions or concerns now or in the future.

This customer's builder was BK Residential Construction, LLC, Legendary Homes.

size="2">Meritage purchased Legendary Homes in 2014, but did not assume responsibility for their existing built homes.
Meritage did not build their home nor do we oversee their homes warranty; therefore we request this complaint be removed from our file.
Legendary did provide a 2-10 year warranty with their homes. The company is 2-10 Home Buyers Warranty. The customer should have received their warranty details with the closing of their home.  Their contact number is [redacted]

Meritage Homes understands that out of pocket expenses related to home repairs can be a difficult experience. Our homes are backed by a two year major mechanical warranty which is pretty common within the industry. All mechanical components of a home require routine...

maintenance. While we are not implying that the complainants unit was not maintained, it is often the reason one unit requires repair earlier than another. Changing air filters on a monthly and yearly basis for Merv 8 filters and seasonal inspections are also homeowner responsibilities that are often overlooked or delayed due to our busy lifestyles that greatly reduce the units performance and life. The complainants unit does have a manufacturer warranty that covers many parts, however labor and top off of Freon is usually not covered. Our team did advise the complainant to review his manufacturer warranty and consult a licensed HVAC professional to inspect his unit as it had surpassed its two year builder functionality warranty. Again, we empathize with his disappointment that his unit required service, but this is not a defect of the unit or lack of performance on the part of Meritage Homes. The homes remaining warranty is structural in nature and expires on the ten year anniversary of the original close of escrow date.

Meritage is correct. We asked for additional concessions due to the state they have left our home the past several months as a result of them excavating our yard and leaving it in this unsafe condition.  We have 7 children to protect from the state of our yard. See attached.

This is not a warranty issue. However with regard to Meritage's position that they do not warranty the oven we purchased from them, we made multiple contacts with Whirlpool starting on 4/19/16 and culminating on 5/24/16 in which we spoke to "Chad" and his supervisor. They confirmed Whirlpool cannot issue a refund under the warranty because the builder (Meritage) purchased the oven either directly or through a whole sale supplier and therefore Meritage, as the builder, is the only one who can replace or issue a refund. Again, this per Whirlpool whom we worked with by Meritage's direction.
We still maintain that the oven we have is an unacceptable product and that we would have not selected it- regardless it operating within any accepted standard as claimed by Meritage - were we allowed to inspect that model at the time of product selection. We had no reasonable opportunity to inspect or evaluation the oven.
We appreciate Meritage to continue to work in good faith with us and their understanding that we are unhappy.

The customer purchased a completed showcase home therefore the cabinets were completely installed and accepted by the complainant prior to purchase. 
Our team has had considerable communication with the complainant over their dislike of their homes cabinetry....

The cabinets are not defective; their character and color show transition seams, again the cabinets were installed prior to purchase and these seems were noticeable. Our team has gone above and beyond to handle their warranty repairs as efficiently as possible. In addition, we have added extra lights, moved outlets, replaced flooring and even granite countertops above and beyond the guidelines of our warranty to satisfy them. Unfortunately they remain unhappy with the cabinets. As a courtesy, the manufacturer has agreed to contact the complainants to hear their concerns.  Meritage has fulfilled our obligation and no further action will be taken regarding the cabinetry.

The homeowner continues to reschedule repairs which obviously cause delays with our vendors as well.We are working to resolve this matter - but require the cooperation of the homeowners. I trust the Revdex.com will consider this matter satisfactorily resolved -

Meritage Homes did respond directly to the complainants letter on behalf of our CEO weeks ago. The reason provided by the complainants for cancelling their contract to build a home do not entitle them to a refund of the earnest monies but rather forfeited the funds...

as liquidated damages. While Meritage has no obligation or responsibility for the development of any adjacent properties to our community we have provided all current and prospective residents that have expressed interest in the [redacted] Apartments with information provided to us by the developer. The following is an excerpt from the letter provided from the [redacted] Apartments;  
The [redacted] Apartments project is new construction of a 264-unit family apartment

community located at Cosmopolitan Circle and Vienna Street in Parker, Colorado. The project

includes a mix of one, two, and three bedroom apartment homes.

The [redacted] Apartments is not a Section 8 Project-Based Rental Assistance property. In addition to the residential buildings, the project will include a fully furnished clubhouse (leasing

offices, resident lounge, business center, game room, and fitness center), heated outdoor saltwater

swimming pool, playground, and approximately 72 garages and 64 carports (in addition to 340

open parking spaces on site).

Meritage stands behind our community and we continue to both sale and build beautiful homes for families excited to own.  
The complainants exercised their righto cancel and Meritage exercised the right to retain the earnest monies as liquidated damages. No further action will be taken in this matter.
