This change was made in an attempt to assist Mr*** with allowing for more usage on his data card However, the phone he has does not have data capabilities We have credited $*** which covers the difference in his charge for this month and the previous months before the change
was made We hope this resolves the issue

At this point, C Spire has compensated Ms*** $for this issue Ms***' account was past due at the time and has been past due at billing for several months While we did make arrangements with her for the day after the incident, her time without service was minimal We
feel the compensation we have already granted is generous given the fact that the account has been past due for several months If Ms*** will pay her account in full by March 8th, she should not have this issue going forward

C Spire only charges for international usage that is recorded and sent to C Spire by the international roaming partner C Spire is a CDMA carrier In order to use international services, a customer must have a phone that has international capabilities through a dual SIM card C
Spire does not sell international phones but sells phones that have international capabilities should they be needed In Ms***'s case, C Spire received records showing that she used over megabites on one of her phones internationally These are billed at $per megabyte which is clearly notated before a customer takes a trip If Ms*** does not believe she used this data, C Spire will be happy to provide her with the data detail report of times and data consumption amounts

Ms*** purchased a new Samsung Galaxy on July 1, 2014. On August 18, she returned to the store to notify us that the phone was not charging properly. When inspected, there was a crack in the screen of the device. When there is physical damage on a device, the manufacturer's
warranty is no longer in effect. Damage can cause problems with the phone's charging port. C Spire offered to replace the phone for the repair cost of $***. C Spire is still willing to complete this transaction. The phone in question had an original cost to C Spire of over $***

When Ms. [redacted] purchased the new device in April of 2014, C Spire discounted it substantially below our cost in lieu of this agreement.  By investing again in this relationship, one that had been active for almost 2 years, we were operating under the assumption that Ms. [redacted] would fulfill her part of the agreement.  C Spire is willing to discount $150 of this bill if Ms. [redacted] will pay the balance.

This account was closed February of 2013 and most records are unavailable.  C Spire does offer and support nationwide service.  In Mr. [redacted]'s case, he simply had a phone issue while he was off network.  Certain programming fixes cannot be downloaded to a phone while it is off of the...

owned and operated C Spire network.  When this was explained, we also explained a requirement we had at the time for our customers to use over 50% of their usage on the C Spire owned and operated network.  Mr. [redacted] chose to take his business to another carrier.  We see no notation in the account history where Mr. [redacted] was told that a contract was not in effect.  Mr. [redacted] has had a balance of $286.62 since February of 2013.  If Mr. [redacted] will pay $140 of this, C Spire will waive the remaining amount and declare the account settled.

As Mr. [redacted] stated, this account is not in his name.  We cannot produce a bill for him due the requirements of Customer Protected Network Information established by the Federal Communications Commission.  If he can get a power of attorney from his sister, we can provide him with this...

information.

We replaced 2 of Mr. [redacted]'s devices on November 28.  We hope this has resolved the issue.

When Ms. [redacted] activated service with C Spire, she purchased her phone at a substantial discount in exchange for an agreement to keep it active for 24 months.  Customers are also granted a 30 day period to decide if they enjoy the service.  After a year of service, Ms. [redacted] decided...

to purchase new phones with an another discount and updated her agreement for the next 24 months.  Failure to keep them active during those 24 months results in an early termination fee.  If Ms. [redacted] can return the devices she purchased at this discount, we will credit any early termination fees.

There appears to have been a misunderstanding with a price discussion with Ms. [redacted].  She was discussing a shared data plan.  The amount for the bucket was discussed but the amount for each phone was not clearly understood.  A credit for $33 was granted.  Since this time, Ms....

[redacted] has disconnected her services with C Spire.

It appears that Ms. [redacted] made payments through our automated system and these went through twice.  We cannot deduce the cause of this.  The monies have now been refunded and all is corrected.  We would like to offer Ms. [redacted] $150 in compensation for the issues she has had....

 The phones she has were purchased at significant discounts in lieu of keeping them active for 24 months.  We will not be able to meet her requests of free upgrades.  If she does accept this money and should decide to upgrade, her account will need to be brought current as it is past due at the time of this response.

I am rejecting this response because: The terms are different from my previous account that I had when the company was still Cell South. I kept that plan when the company changed to CSpire. This is a plan that I had for several years and was unlimited. I was then tricked this year to sign a different plan. I was assured that this plan was unlimited everything. It was even advertised in that manner. The plan did recently change in August when my contract was up. So my current plan is the same as the previous one I was tricked into signing earlier this year but different from the one I had prior to these two plans. I feel this company practices very poor business ethics and definitely false advertising. Doesn't this sound like a company that is currently in trouble with the federal trade comission?

We actually spoke with Ms. [redacted] on Monday to confirm the check has been processed and mailed as of February 24th.

C Spire does not process warranty claims for phones that are damaged.  We can work with Ms. [redacted] on repair costs if she is interested in that option.

Mr. [redacted] signed up for service with C Spire on April 8, 2013.  It was not on a prepaid service.  He was on a normal post paid service and, according to the order information C Spire has on file, paid $0 the day he signed up.

July of 2014.  Due to the fact that he did not fulfill the 24 months he agreed to, he was billed for early termination fees on all three lines totaling $449.40.  He was charged for no services past the date of July 11, 2014.  His ports were completed on July 10, 2014.  If Mr. [redacted] has any proof that he paid up front for service on the day of his activation, we will be glad to see this and investigate.
