I am rejecting this response because: Prior to taking any action to resolve this matter, two customer service representatives for Nutrisystem as well as the Vice President of Legal and Corporate Compliance told me I was wrong in how I understood the termsI had clearly described the matter and the company had my information on fileThey blamed my negligence and told me I was misreading their terms and conditionsThree people told me this and I had to be persistent to get any tractionThey insulted my ability to read their terms and only took action to remove their incorrect charge after my repeated emailsThis was a terrible experience and the company charged my card for the fee without taking my concerns seriouslyAdditionally, I have now read additional consumer complaints regarding the company incorrectly charging cancellation feesIf a company will incorrectly charge a fee -without looking into the matter or keeping track of client information they collect, then defend the charge and blame the consumer, then remove the charge only after repeated emails, this is an unethical business.

According to Nutrisystem’s records on August 12, 2014, *** enrolled in the NutriSystem Auto-Delivery Program by telephone. With the current Auto-Delivery program, customers get a 20% discount off the month to month program price and free shipping within the Continental US when they remain on the program for at least shipments. Customers are automatically shipped their 28-Day order once every four weeks, and charged accordingly, unless they cancel. Customers are sent an e-mail reminder or given a telephone call when their next order is to be shippedCustomers can edit, customize or delay their Auto-Delivery order, simply by calling ###-###-#### or visiting nutrisystem.comTo cancel their Auto-Delivery order, customers must call ###-###-####. If a customer cancels prior to paying for their second 28-Day program delivery, their payment method is charged for Continental U.Sshipping (if applicable) and the amount of the auto delivery discount they received on their first 28-Day program delivery. The Terms and Conditions of the Auto-Delivery Program are posted on the website and were reviewed with *** via telephone. *** was shipped his first order on August 12,
On September 8, 2014, *** was sent an email indicating his second was being processed for him. On September 11, *** was shipped his second order
On October 6, 2014, *** was sent an email indicating his third order was being shipped to him. On October 13, 2014, *** was shipped his third order
On October 21, *** contacted Nutrisystem and cancelled his Auto-Delivery Program. *** requested to return both the September and October orders that were shipped to him. *** indicated that he was informed that the total cost for three (3) orders was $314.99, rather than $each. *** was informed that he could return the third order he received for a refund, however he was not eligible to return the second order that was shipped to him as it was outside the day return policy.
*** returned the third order that was shipped to him and was issued a partial credit in the amount of $on November 5, 2014. *** was charged a $return shipping fee for the return
Nutrisystem records all telephone calls for quality assurance and training purposes. After receiving ***’s complaint I requested a review of the call when *** placed his orderNutrisystem has reviewed the call. *** was informed that the price for the Nutrisystem program was $or about $a day. *** did indicate that he expected to be on the program for months. But, the customer service representative did not indicate to *** at any time the price was $for the duration of the months he planned to be on the program. *** was also informed that he would be charged for the discount he received on his first order if he did not accept and pay for his second order.
We are sorry for any misunderstanding that occurred when *** placed his orderNutrisystem cannot issue *** a credit for the two (2) months of food he already receivedHowever, in the spirit of good consumer relations Nutrisystem has issued *** an additional credit in the amount of $for the return shipping fee incurred after returning his last order. We wish *** continued success with his weight loss goals

If our customer’s purchase a one-time order or a la carte order they do not receive the discounted price that our auto-delivery customers receive. On June 4, *** *** purchased the NutriSystem Auto-Delivery Program at www.nutrisystem.com. With our Auto-Delivery Program, customers receive a 35% discount off the full retail value of a 4-week plan with every auto-delivery purchaseThey also receive free shipping (Continental US). By clicking the Submit My Order, customer’s authorize us to automatically charge and ship their order every weeks unless they cancel. If they are not 100% satisfied, they can call ###-###-#### within days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping. If our customers decide to cancel before the second shipment and after the day guarantee period, they authorize us to charge a $early cancellation fee. If they cancel any time after they receive their second month there is no fee. After reading this language, customers click to “submit their order”. The terms and conditions of the auto-delivery program have always been posted throughout the website (please see the attached page)However in response to customer complaints and inquiries Nutrisystem has added additional language and information throughout the website to make it clearer to our customers that they are choosing the Auto-Delivery program and agreeing to the terms and conditions of the program, including the $cancellation charge before they make their purchase. Specifically, the auto-delivery terms and the cancellation fee are conspicuously displayed at the “submit my order” button (please see the attached page) and if the customer clicks on the Auto-Delivery option the benefits of auto-delivery as well as the cancellation fee are clearly stated (please see the attached page). *** *** submitted his order and agreed to the terms and condition prior to his purchase. *** *** received his first order on June 8, On June 25, 2016, *** *** was sent an email indicating his second order was being processed for him. On June 26, 2016, *** *** contacted Nutrisystem to cancel the second order and his auto-delivery program. *** *** was informed that he would be charged $if he chose to cancel his auto-delivery program before accepting and paying for his second order. *** ***’s program was cancelled and he was charged the $cancellation fee in accordance with the terms of the auto delivery program. *** *** contacted Nutrisystem on June 28, to reactivate his account and request a second shipment. *** ***’s account was reactivated and a request for a refund of the $that was charged to MrWorkley was submitted. Nutrisystem takes spam emails and the sending of them very seriously. Nutrisystem is unable to determine the origin of the emails from **[redacted]' complaint, but if **[redacted] could forward the actual emails to me, we would be in a better position to determine who the third party is that is sending them. In the meantime, Nutrisystem has placed **[redacted] email address on its own "Do Not Email" list

On April 4, 2014, [redacted] was sent an email indicating her fourth order was being processed for her. Nutrisystem was unable to obtain payment from [redacted] for this order and attempted to contact her by telephone
On April 11, 2015, [redacted] contacted Nutrisystem and indicated she wanted to cancel the program. [redacted]'s Auto-Delivery Program was cancelled, however the order that started being processed on her on April 4, was not cancelled in error
On April 17, 2015, [redacted] was shipped her fourth order.
On April 21, 2015, [redacted] contacted Nutrisystem regarding the order that was in transit to her. [redacted] was informed by the customer service representative that they would attempt to contact [redacted] to have the package returned to Nutrisystem
On April 27, 2015, [redacted] contacted Nutrisystem and indicated the order had been delivered to her. The Customer Service Representative that [redacted] spoke with apologized that the package was delivered and [redacted] was informed that [redacted] would come to pick up the package at Nutrisystem's cost
The package was returned to Nutrisystem on May 4, and [redacted] was issued a full credit in the amount of $on May 5, 2015. Depending on [redacted]'s banking institution it could take [redacted] 7-business days to see the credit applied to her account. Nutrisystem strives to promote good customer service. We apologize to [redacted] for the delay in the refund to her account and for any inconvenience it has caused her.

[redacted]'s Auto-Delivery program was cancelled and [redacted] was charged for the discount that he received on his first order ($92.49) in accordance with the terms of the Auto-Delivery Program
Under the terms and conditions of the Auto-Delivery Program that [redacted] enrolled in [redacted] was required to purchase two (2) orders in order to receive the discounted price that he received on his first order. [redacted] was informed of these terms when he enrolled in the program and when he called to cancel his second orderHowever, Nutrisystem has issued Mr. Russell a refund for the $charge that was made to his account because he indicated the program did not well with him. On March 27, 2016, Ms[redacted] sent an email to the customer service department to request the cancellation of her program. Ms[redacted] indicated she was unaware that she had signed up for the auto-delivery program and had experienced some physical problems with program. Nutrisystem responded to Ms[redacted] and asked her to contact Nutrisystem via telephone if she wished to cancel her program
Ms[redacted] responded via email on March 29, indicating that she did not want to call Nutrisystem and speak to someone to cancel her account. Ms[redacted]'s auto-delivery was cancelled at this time and she was charged the $cancellation fee
Ms[redacted] was not eligible for the Money Back Guarantee when she contacted Nutrisystem on March 27, because she did not contact Nutrisystem within days receipt of her order. However, the customer service representative that responded to Ms[redacted] could have offered to waive the $cancellation fee since Ms[redacted] indicated she had physical problems while on the program. We apologize that this was not done. In the spirit of good consumer relations, Nutrisystem has issued Ms[redacted] a refund for the $cancellation fee. Ms[redacted] should see the credit applied to her account within 5-business days. We wish Ms[redacted] continued success with her weight loss goals.

On December 9, **[redacted] contacted Nutrisystem and indicated she did not receive the order that was shipped to her. The customer service agent she initially spoke with apologized and offered to have the order reshipped to **[redacted]. **[redacted] agreed and a new order was placed for **[redacted]. **[redacted] contacted Nutrisystem about an hour and a half later and indicated she did not want the order that was being shipped to her and she requested that her Auto-Delivery program be cancelled. The Customer Service Representative she spoke with cancelled the order that was in the process of being sent to **[redacted] and cancelled her Auto-Delivery program. The Customer Service Representative also charged **[redacted] for the discount she received on her first order ($84.99).
Nutrisystem apologizes to **[redacted]. **[redacted] should have received a full credit under the Money Back Guarantee and should not have been charged for the discount she received on her first order ($84.99). Nutrisystem issued **[redacted] a full credit in the amount of $on December 29, 2014. **[redacted] should see the credit applied to her account within 3-business days depending on her financial institution. We wish **[redacted] continued success with her weight loss goals.

Customers are automatically shipped their 28-Day order once every four weeks, and charged accordingly, unless they cancel.  Customers are sent an e-mail reminder or given a telephone call when their next order is to be shipped. Customers can edit, customize or delay their Auto-Delivery order, simply by calling ###-###-#### or visiting nutrisystem.com. To cancel their Auto-Delivery order, customers must call ###-###-####.  If a customer cancels prior to paying for their second 28-Day program delivery, their payment method is charged for the amount of the auto delivery discount they received on their first 28-Day program delivery.   **. [redacted] was shipped his first order on April 16, 2015. 
 
On April 20, 2015, **. [redacted] contacted Nutrisystem and indicated he wanted to cancel his Auto-Delivery Program and return the first order he received.   **. [redacted]’s Auto-Delivery program was cancelled and he was issued a [redacted] label to return the unused food products to Nutrisystem for a refund. 
 
**. [redacted]’s order was returned to Nutrisystem’s warehouse on May 4, 2015.   It appears that **. [redacted] spoke to two representatives following the return of the food to determine when credit would be issued to his account.   However, the credit was not issued to his account in error.  
 
We apologize to **.  [redacted] for any delay in getting his credit issued.  It is unclear as to why his credit was not issued when the return was received at Nutrisystem’s warehouse.   Nutrisystem issued **. [redacted] a full credit in the amount of $249.99 on June 15, 2015.   **. [redacted] should see the credit applied to his account within 5-7 business days depending on his financial institution.  We wish **. [redacted] continued success with his weight loss goals.

This price included an auto-delivery discount of 20% off of the regular program price, an introductory discount of $59.97, a free week of Fast and free shipping**[redacted] was sent an email confirming her order shortly thereafter.
**[redacted] contacted Nutrisystem later that day indicating that she believed that her monthly charge would be $rather than the $month that was indicated in the confirmation email she received. **[redacted]'s call was escalated to supervisor who applied an additional discount to **[redacted]'s account to give her the $price**[redacted]'s order was shipped on November 7,
On November 18, 2014, **[redacted] contacted Nutrisystem and requested to return the order she received. **[redacted] also requested to cancel her Auto- Delivery Program. **[redacted]'s Auto-Delivery Program was cancelled and she was provided with a return authorization number to return the unused food products she retained. **[redacted] was informed that she would be issued a refund within 7-business days after the order was returned to Nutrisystem.
We apologize to **[redacted] for any difficulty she experience in reaching a representative that could assist her and for not sending a confirmation email. It is unclear why the representative did not provide the cancellation number to **[redacted] over the phone when she cancelled her program on November 18, 2014. **[redacted] was not charged for the discount she received on her first order as she returned her first order. **[redacted] was issued a full credit in the amount of $for the order she returned to Nutrisystem on November 25, 2014. On January 27, 2016, [redacted]’s order was returned to one of Nutrisystem’s warehouses.  It usually takes our customers 7-14 day to see the refund applied to their account once their return is received.   However, due to a warehouse error the return was not credited To [redacted]’s account within that time frame in error.  [redacted] was issued issued a full refund (less shipping $19.99) in the amount of $309.99 on February 22, 2016.   We apologize for the delay in the credit being applied to [redacted]’s account.   In the spirit of good consumer relations we issued an additional credit of $19.99 to [redacted] on March 7, 2016 for the return shipping charge she incurred.  [redacted] should see that credit applied to her account within 5-7 business days.  We wish [redacted] continued success with her weight weight loss goals.

was for her second shipment and not the first shipment.            After calling and explaining that
she received an auto-delivery confirmation that her 28-day order was shipped,
and that she changed it to lunches and snacks, 
[redacted] decided to cancel her order.  The call was reviewed and [redacted] should have been told that she would receive her money back as she was under

second shipment and after the 14-day guarantee period, they authorize us to
charge an early cancellation fee.  This cancellation fee is a portion of the

According to Nutrisystem’s records, on June 4, 2015 [redacted] enrolled in the NutriSystem Auto-Delivery Program through the Nutrisystem website.  With the current Auto-Delivery program, customers get a 20% discount off the month to month program price and free shipping within the Continental US when they remain on the program for at least 2 shipments. Customers are automatically shipped their 28-Day order once every four weeks, and charged accordingly, unless they cancel.  Customers are sent an e-mail reminder or given a telephone call when their next order is to be shipped. Customers can edit, customize or delay their Auto-Delivery order, simply by calling ###-###-#### or visiting nutrisystem.com. To cancel their Auto-Delivery order, customers must call ###-###-####.  If a customer cancels prior to paying for their second 28-Day program delivery, their payment method is charged for the amount of the auto delivery discount they received on their first 28-Day program delivery.   The Terms and Conditions of the Auto-Delivery Program are posted on the website where [redacted] enrolled in the program.  [redacted] also indicated that he read and accepted the Terms and Conditions when he submitted his order for processing. [redacted]’s first order was shipped to him on June 5, 2015.
 
On July 16, 2015, [redacted] contacted Nutrisystem to request that his Auto-Delivery Program be cancelled.  [redacted] was informed that he would be charged for the discount he received on his first order ($77.50) if he chose to cancel before accepting and paying for his second order.   [redacted]’s Auto-Delivery Program was cancelled and Nutrisystem attempted to charge [redacted] the $77.50.  However, Nutrisystem was unable to obtain the payment from his method of payment.
 
Under the terms and conditions of the Auto-Delivery Program that [redacted] enrolled in [redacted] was required to purchase two (2) orders in order to receive the discounted price that he received on his first order.  However, in the spirit of good consumer relations Nutrisystem has waived the charge for the discount [redacted] received on his first order. [redacted] was not charged, nor will he be charged for the discount he received on his first order.  We wish [redacted] continued success with his weight loss goals.

Under the terms and conditions of the Auto-Delivery Program that [redacted] enrolled in [redacted] was required to purchase two (2) orders in order to receive the discounted price that he received on his first order.  [redacted] was informed of these terms when he enrolled in the program and when he called to cancel his second order. However, Nutrisystem has issued Mr.  Russell a refund for the $92.49 charge that was made to his account because he indicated the program did not well with him.  [redacted] should see the credit applied to his account in 7-10 business days depending on his financial institution. We wish [redacted] continued success with his weight loss goals.
