After reviewing ***’s complaint I contacted our Customer Service Department to determine if they had a listing for *** or his email address ***. ***’s email address is not registered with Nutrisystem and Nutrisystem has no profile for *** in its database. Based on the information that *** provided, he appears to be receiving emails from third party which contain some type of Nutrisystem advertising.
Nutrisystem takes spam emails and the sending of them very seriously. Nutrisystem is unable to determine the origin of the emails from ***’s complaint, but if *** could forward the actual emails to me, we would be in a better position to determine who the third party is that is sending them. In the meantime, Nutrisystem has placed ***’s email address on its own “Do Not Email” list

If our customer’s purchase a one-time order or a la carte order they do not receive the discounted price that our auto-delivery customers receive. On March 14, Ms*** purchased the NutriSystem Auto-Delivery Program at www.nutrisystem.com. With our Auto-Delivery Program, customers receive a 35% discount off the full retail value of a 4-week plan with every auto-delivery purchaseThey also receive free shipping (Continental US). By clicking the Submit My Order, customer’s authorize us to automatically charge and ship their order every weeks unless they cancel. If they are not 100% satisfied, they can call ###-###-#### within days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping. If our customers decide to cancel before the second shipment and after the day guarantee period, they authorize us to charge a $early cancellation fee. If they cancel any time after they receive their second month there is no fee. After reading this language, customers click to “submit their order”. The terms and conditions of the auto-delivery program have always been posted throughout the website (please see the attached page)However in response to customer complaints and inquiries Nutrisystem has added additional language and information throughout the website to make it clearer to our customers that they are choosing the Auto-Delivery program and agreeing to the terms and conditions of the program, including the $cancellation charge before they make their purchase. Specifically, the auto-delivery terms and the cancellation fee are conspicuously displayed at the “submit my order” button (please see the attached page) and if the customer clicks on the Auto-Delivery option the benefits of auto-delivery as well as the cancellation fee are clearly stated (please see the attached page). Ms*** submitted her order and agreed to the terms and condition prior to her purchase. Ms***’s order was shipped to her on March 16,
Ms*** contacted Nutrisystem on April 4, requesting the cancellation of her Auto-Delivery programNutrisystem records all calls for quality assurance and training purposes and has reviewed this call. Ms*** was properly informed that she signed up for auto-delivery and she would be charged a $cancellation fee if she chose to cancel before accepting and paying for her second order as per the terms and conditions of the auto-delivery program. It was explained to Ms*** that our customers receive a discount on their first order if they choose to enroll in the auto-delivery program. Our month to month customers do not receive a discount on their first order. The terms and conditions of the Money Back Guarantee were also reviewed with Ms*** during this call. In order to take advantage of the Nutrisystem Money Back Guarantee our customers must call within days receipt of their order and return the remaining food products in order to get a full refund (less shipping). This information is also posted on our website (please see attached) Ms***’s auto-delivery program was cancelled and she was charged the $cancellation fee at this time. Ms*** did not request to return any food products during the call. Ms*** appeared to be satisfied at the end of the call. I wish I would have read all of the reviews because I had the worst experience I would never recommend this company to anyone I made sure I asked all the right questions or at least I thought they where I was never informed about the cancelation fee I asked when I made the order if I don't like the program or if it do not work for me what happen the lady said nothing just call and stop the program Lie number then I asked if I don't like the first set of food for the next order can I customized it she say sure I'll put it and the system now that customer wants to customize next Order lie number then I asked for you guys to send the next order I will have to confirm it she said yes nothing would be sent or charged until you put your second order in lie number worst company ever then I called in say all of this stuff to the representative she say not sure who you spoke to but that not how it works so I said you guys record all conversation and write notes you can simply look in see who I was talking too THE WORST EXPERIENCE EVER

I have been a Nutri System customer several times during past years Always reaching my goal...but life happened...and my "evening munchies" got the best of me My weight gain wasn't ever Nutri System's fault...I just have a hard time with "willpower"! But, there is no other way for me to lose the weight I LOVE the Nutri System program...and since I have recently upgraded to the Uniquely Only frozen foods program, I look forward to meals every single dayNutri System has treated me very fairly They are an honest company that strives and exceeds in customer service I know that from personal experience It was very hard for me to read the three negative reviews below I want to ask you not to take a lot of stock in what those three people have written Time after time, over the years, Nutri System has gone far beyond for me Once, just recently, I called Nutri System to check on my order as it was a bit late In a few days, I received my order...not only one month...but TWO months worth of food I called Nutri System to report the mistake and to offer to pay for the additional month's food that I received Nutri System wouldn't take payment as they said that it was their mistake and thanked me for my honesty in reporting and offering to payYes, Nutri System is a great company that will treat you right And their weight loss program works!

Under the terms and conditions of the Auto-Delivery Program that *** *** enrolled in *** *** was required to purchase two (2) orders in order to receive the discounted price that she received on her first order. As indicated above this information is posted on the website and *** *** indicated she agreed to the Terms and Conditions of the program when she submitted her order. It is unclear as to why *** *** was unable to view the Terms and conditions on her mobile device. The terms and conditions are viewable on all devices. In the spirit of good consumer relations Nutrisystem has issued *** *** a refund for the discount she was charged for in the amount of $84.99. According to Nutrisystem’s records on May 29, 2014, *** contacted Nutrisystem regarding promotional email he received for 50% off. The Customer Service Representative that *** spoke with informed *** that the promotional email was only supposed to go to new customers, however since Nutrisystem sent the email in error, the Customer Service Representative applied the discount to ***’s next order. The next order was due to be shipped to *** on June 1, 2014.
According to Nutrisystem's records, on June 2, 2014, *** contacted Nutrisystem and indicated that the 50% discount was not applied to his account and he requested that his order be cancelled. The Customer Service Representative that *** spoke with informed him he would be charged for the discount he received on his first order if he did not accept and pay for his second order. ***’s account was cancelled and Nutrisystem attempted to charge *** for the discount he received on his first order ($92.49), however Nutrisystem was unable to obtain payment.
Nutrisystem has reviewed ***’s account and retrieved the two (2) Gift Card Numbers and pin’s associated with them. It appears that there was some miscommunication between *** and the Customer Service Department. We apologize for any confusion that occurred. Nutrisystem has contacted *** and provided him with his gift card numbers and pins. Nutrisystem also informed him that he would not be charged for the discount he received on his first order.

Ms*** was informed she would be charged for the discount she received on her first order ($102.10) if she chose to cancel her Auto-Delivery program before accepting and paying for her second order. Ms***’s Auto-Delivery Program was cancelled and she was charged for the discount she received on her first order ($102.10).
Under the terms and conditions of the Auto-Delivery Program that Ms*** enrolled in Ms*** was required to purchase two (2) orders in order to receive the discounted price that she received on her first order. As indicated above this information is posted on the website and Ms*** indicated she agreed to the Terms and Conditions of the program when she submitted her order. However, in the spirit of good consumer relations Nutrisystem has issued Ms*** a refund for the discount she was charged in the amount of $ Ms*** should see the credit applied to her account within 5-business days depending on her banking institution. We wish Ms*** continued success with her weight loss goals

After reviewing *** ***’s complaint I contacted our Customer Service Department to determine if they had a listing for *** *** or her email address ***@***.***. According to Nutrisystem’s records, *** *** purchased the Nutrisystem program on August 30, and received two (2) ordersWhen *** *** enrolled in the Nutrisystem Auto-Delivery program this prompted Nutrisystem to begin sending transactional and marketing emails to *** *** “on an established business relationship” under current Telemarketing Rules
*** *** contacted Nutrisystem on October 8, and requested to cancel her program and return the second order that was shipped to her. Nutrisystem has no record of *** *** contacting Nutrisystem to request that her email address be removed from the Nutrisystem database
Since receiving *** ***’s complaint, Nutrisystem has removed *** ***’s email address from the database. We ask that *** *** allow 7-business days to go through our internal systems and update accordingly. We apologize to *** *** for any inconvenience the emails have caused her and we wish her continued success with her weight loss goals
