After verbally clarifying with Mr***, exactly what his rejection was referring to, the following is what he is still trying to obtain answers to:-M&T's response states that the consumer's insurance policy was cancelled and they cannot provide a reason why, however they stated there is still a need for the insurance -The consumer provided a copy of the letter from the insurance company dated 10/2/indicating the reason for cancellation: "Because of an over payment on your accountWe are sending you a refund in the amount aboveWe have checked below the apparent reason for the over payment(3) Your policy was cancelled, and the return premium from the insurance company was greater than the amount necessary to pay off the loan amount -Mr [redacted] would like to know why was an insurance policy necessary if his payoff amount was much less than the actual cost of the insurance policy? Mr [redacted] insists he had tried on multiple occasions (5-calls) to obtain a payoff from M&T and could not obtain oneHe says M&T finally provided a payoff, after he filed with the Revdex.com, and after they included new insurance policy escrow figures, which he believes were all unnecessary Mr [redacted] also stated he tried to tell M&T bank, that if he really needed to obtain this insurance policy, even though he was trying to payoff the mortgage since it was such a small amount, why couldn't he obtain it through his insurance company, as it would be much cheaperHe says M&T insisted since they were already working on it that he had to go with their policy and figures -According to M&T's response letter dated 3/27/18: "As Mr [redacted] failed to provide proof of new coverage when his hazard insurance was cancelled, M&T exercised their right under the original loan documents to obtain insurance coverage Mr [redacted] would like to know: does that document include the necessity for insurance coverage, if the amount necessary to pay the insurance premium was greater than the amount necessary to pay off the loan amount, especially given the consumer was seeking an accurate payoff statement? Why wouldn't M&T just let him payoff the mortgage balance and not obtain insurance coverage? - Mr [redacted] would also like to know: If insurance was deemed necessary per the Deed of Trust, please tell him exactly what dates the policy covered so he can understand why he is being charged this large amount of money and why his refund is so little? Mr [redacted] believes his refund should be much higher than the amount he received for a refund, which was $Mr [redacted] indicated he never had an escrow account prior to this -Mr [redacted] did confirm with [redacted] Bank, who issued the bank checks that he sent to M&T for $each, one dated October 2, and the other dated February 14, 2018, have not shown up as cashed(one you returned to him) He has not received the second check back from M&T, nor has it been returned as undeliverable mail, this check was dated 2/14/( a copy of 2nd ck is his documents previously sent with copy of first check) -Mr [redacted] also stated he had concerns about the amount of interest he had been charged, year over year, on his mortgage as he indicated he paid monthly on the principal and also made large payments toward the"principal only" and he believes he was overcharged in interest as well( I informed him he would need to provide proof and I wasn't sure he could bring that up now that he paid the mortgage offI told him I thought he should have verified his year end statements, each year, against what he paid each year, as it may be too late to look into that

Since Nov of last year, M&T has provided payoffs in the amount of roughly $170,to me and my attorneys for my mortgage that was allegedly modified thru the Obama restructuring program while I was going through my divorceI continued to ask if that amount included everything as I could not stand to lose any money due to the sale of the house or divorce I sold the house and nothing showed on any of the payoff statements until the title company closed the sale and ran title, nothing was even showing on my credit report regarding this additional lienThere was an additional lien on the property by NOVADNovad had said that M&T sent the balance of the restructure loan to themNovad said what was not valid was that M&T bank made an error in the payoff figures and it was M&Ts responsibility to notify me of the amount, not Novad'sI am requesting from M&T that they stick to their word and confirmation of original payoff amounts given just prior to the sale of my property and closingNovad said M&T should have notified me of the second lien and who to contact in regards to this payoffM&T continued to maintain that no loan modification was ever made

I called my account on the 27th and noticed there was extra money in there I spoke to a representative and asked if this was correct she said yes but then on the 31st they over drafted my account spoke too another representative who was very nice and she said there was nothing she could do so I asked too speak to a supervisor who was very nasty and disrespectful and very unprofessional

Dear Ms [redacted] I am writing in response to the reply I received from you [redacted] on behalf of M&T Bank in response to the complaints I filed with the Better Business Bureau ("Revdex.com") and the Consumer Financial Protection Bureau ("CFPB") Yes, it is true that my complaints stated that I sought to apply for a Small Business Administration ("SBA")- Guaranteed loan through M&T, but according to the denial letter a loan entirely unrelated to my project an Express Business Installment Loan application was submitted against my consentShannan [redacted] , Branch Manager of the M&T Kirk Avenue branch, did contact me in response to my inquiry regarding an SBA- Guaranteed loanYes, I did advise Ms [redacted] that I wish to purchase investment real estateHowever, I did not inform her that I wanted an SBA line of creditI told her several times that I wanted to apply for a term loan to better accommodate my business ventureA line of credit and a term loan are different since with a term loan I would receive a lump sum of money, get it all at once and pay it back over a specific termMs [redacted] you state that M&T does not offer an SBA-specific application for any product I do not believe this statement since the M&T banks application has several Business credit requests such as Line of Credit, Term Loan, Equipment Lease, Letter of Credit, Commercial Mortgage, and otherThe M&T Bank website also list several loan types including the three products options you list and three types of SBA Guaranteed Loans to chooseAlthough you state M&T policy is to submit all request as potential conventional credit applications, I was never informed of this policy until I spoke with Michael N [redacted] If this were the case, I would have never proceeded with the application which is evident of the type of loan I advised, requested and consented toMs [redacted] did not in her initial conversation with myself advise me that the first step would require submitting a conventional loan application nor did I receive a conventional loan applicationMs [redacted] did not explain that I would not be directly applying for an SBA loan eitherNor did she advise me that M&T does not provide businesses with lines of credit to purchase investment real estateThat is a contradiction and statementIt would and is irrelevant to my request which is evident by my application I submitted to Ms [redacted] It is also a statement since there is an SBA Guaranteed loan called SBA Express that has a choice between a Line of Credit or Term LoanShe did recommend that I apply for a commercial mortgage on an individual property, but I refused her recommendation since it would not serve my request according to my application and business planShe also advised me to register with SBA for an Article of Organization because of my requestI have emails as proofMs [redacted] , it is clear that you are making statements about the type of application I submittedThis does not advocate for me the customer and deem you unfit for such dutiesYou state multiple times I submitted an application for a line of credit and towards the end of your letter you state I applied for a business installment loanMy application clearly shows a request for a term loan not a line of credit nor a business installment loanMs [redacted] did advise me that I may not be approved for an SBA loan for the purpose of purchasing real estateThis was a statement Ms [redacted] and Mr [redacted] made to me in personI never presented an application for a loan at the M&T Bank during my visitMs [redacted] already had my application for the term loan I submitted to her by emailMs [redacted] had no right to process my loan application as she feltThat is my right and a violation of the Consumer Credit Protection ActI am authorized to use my social security number and credit accordinglyThere is obvious discrimination by the representatives handing my application prohibiting me from applying for the type I loan I requested in violation of the Federal Equal Credit Opportunity ActI was denied the right to apply for the loan I requestedA loan provides financing to new and existing businesses that may not qualify under conventional bank termsWorking capital can be used for operating expenses, and there are no listed restrictions against real estateI would be using the working capital to operate by purchasing real estate to increase income I requested of Michael N [redacted] specific reasons why credit was denied under the terms for which I had appliedNot reasons for why the application was declined for an Express Business Installment LoanAn application which did not include a request for a business installment loan evident by my application for a term loan for working capitalBoth bank representatives have violated my rights that are protected by the Consumer Credit Protection ActThe actions of the bank representatives of the M&T Bank are violations of The Equal Credit Opportunity Act, and M&T Bank Corporation is subject to fraud and civil liability for actual and punitive damages I request and am entitled to a specific reason why credit was denied under the terms for which I had appliedI request a copy of the said M&T policy for all request for conventional loan applicationsI also request corrections of M&T's credit reporting of the Express Business I requested the above to close my checking account on 09/02/via letterI requested the account be closed due to astronomical fees which were not explainedI haven't heard anything from bank until I received statement for Aug-Sept in which I was charged an unexplained fee of putting my account (which I requested be closed) in the negative (6.56)They are trying to be able to charge me additional fees for having a closed account with a negative balanceThere is no justification for this charge Please remove fee and close account

One of the pictures is proof that there was no pending transactions and that my account is positive on the other picture it shows you that I was charged an overdraft fee which shouldn't be especially if I have no pending transactions and the gtl was paid for already I'm hoping I won't receive another overdraft fee for ic solutions

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is acceptable but enraging.In response to MsP***'s lies to try to save face, there was no other customer, and she did not ask me to sit down and wait, she is attempting to portray me in a light that conserves her employment, which I don't entirely blame her for, self preservation and all When she told me the process involved filling out a request form and waiting a minimum of two days I stated I would just call the customer service phone number listed on the mailing instead since they could probably handle my request faster, which was true, they gave me a definitive 'no' much faster than the wait the request takes So in short, your customer service is terrible, and you're bankers are willing to lie to make themselves look better I'm also a huge fan of "As a courtesy we gave you back the money we stole from you." Not entirely sure how you think that charging me the equivalent of over %100,APR and refunding it when I contact the Revdex.com is a courtesy but I think you should be strung up next to the horse thieves of old and left to rot for the crows Bravo, M&T, bravo Regards, [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID 12674531, and find that this resolution is satisfactory to me I would argue that speaking with the M&T representative who stated we where still in forbearance until March, I asked for clarification on when the payment needed to be paid, he explained that the September payment would be due April not March as indicated in this letterAlso inlight of the over-estimated fees and the monies that have been applied toward our principle that Bayview did not apply properly, I should expect NO further penalties to our credit(This was in a letter dated March 8, from Bayview Loan Services)Thank you for resolving this issue quickly Regards, Joshua Thomas

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowRegards, [redacted] M & T Bank continues to repeat the same story that is not accurate First of all, I never disputed that due to martial problems I had to enter into a modification, and made every payment as required by law I never denied that it was my understanding that a portion of the modification would be added at the end of the loan, and that is the reason for me requesting updated payoffs almost on a monthly basis from November - October to avoid any surprises whenever my home sold On more than one occasion, M & T Bank's Customer Service Department debated with me that I had never been approved for or participated in a modification whenever I would ask them if the payoff figure they were providing to me was accurate and included anything additional from the modification Since November, I have been assured in writing that I would only be required to pay the amount they were providing me with, and there was no one else for me to contact If I cannot rely on the information they were providing to me, then who was I suppose to contact? I totally disagree that M & T Bank provides excellent Customer Service because that was not my experience They failed to provide me with the information I needed to confirm an accurate payoff when I repeatedly asked them to do so, and the $gift card they offered to me in August, was allegedly to correct the misspelling of my county residence Now, they are stating another reason for sending me the offer of the $ I maintain that every decision I made regarding selling my home and making future plans were based on the inaccurate information they provided to me and to my title company, therefore, they should be required to eat the lost I was faced with, and that responsibility should not be on my shoulders This is the same bank who settled an approximate $million lawsuit out of court with the government in May as a result of they way they handled FHA loans, now I have this horrible experience with them too They should be held liable and required to do the right thing, and reimburse me for their error M & T never even acknowledge the modification existed until the title company discovered the lien they placed on my property I cannot understand how they or anyone would agree that their Customer Service Department should not be held liable for providing inaccurate information to a client who was doing everything right and continuously seeking guidance from them to determine an accurate payoffM & T Bank even accused the lien holder of being responsible for sending me a payoff every time one was requested from M & T Bank, and I learned from the lien holder, after I sold my home, that M & T Bank had not been honest with me This is a very unethical group of individuals, if they can stand by this type of behavior, and maintain that they should be held blameless After the error was discovered and I called M & T Bank to confirm my payoff, then they stated that the modification amount was not included It was simply too late at that point, but they were trying to do damage control

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below They said as of July my account was past dueHowever, in July, as they said, state farm made a payment in the amount of $12,I was told that it didn't matter who made a payment, M&T still received one for the month of JulyIn fact, it was well in excess of the monthly payment Also, I didn't continue to receive monthly bills, final notices, or any statements after July, the month following the total loss of the [redacted] ***I, nor my co-signer, have ever received a letter to contact them to discuss a payment plan or arrangements to pay of the balanceI have been on the phone with them frequently so that is something that should have been mentioned on the phone or via e-mail since they hadn't heard a response from meThey had all of my contact informationOn phone calls I have asked about a payment plan due to the fact I can't afford two nearly $car payments, one for a totaled car and for the car I had to purchaseThe statement they said they sent on November 30, was never received On said phone call on December 15th, GAP did say they couldn't pay for the extension, which I knewThe extension was two payments and what the balance was was far more than those two extension paymentsThey also left out that I said I would not be making further payments until the insurance claim with GAP was closed, which it still is not, according to GAP agent Erika L [redacted] The statement sent to me in December still didn't include the payment from GAP insurance, so I still had not received anything about what I actually owe Again, I asked for a breakdown of the remaining balance on the loan, so it could I could pay it off in full on April 18thI also requested that they remove it from my credit for the full repaymentI sent an email and/or left a voicemail for Doug B [redacted] , Jeff A***, and Mark L***None of them got back to me in any formSo, on April 19th around noon, I called all of their numbers againMark L [redacted] was the only one that answered, he said he would have Doug get back to us and that they all received the e-mailsMark denied the request for a breakdown of payments so I know what I am paying forNo one has got back to us still and it has been two and a half weeksI'm sure they aren't concerned, as these continued late charges and miscellaneous added fees do not affect them The pay-off amount is currently over $2,500, so again, I would like a break down of how it went from $1,to over $2,I'd also like to know how the account is now showing a charge off for November and April, but but credit report on April 10, said "Paid as Agreed" which I can get you a copy of next weekGAP also took nearly months to pay on the dart from the date of total lossThroughout that time I was told that it was GAP insurance's loan to pay unless I had a remaining balance after the factI should have continued receiving bills, statements, notice of charge off, etc as to where all of these charges are coming fromI'd also like to know how they can ad $in principle and interest and countless late fees on a on the initial remainder balance of $in July/August? That is more than 50% of the remainderI was told that after an account is charged off and in collections can no longer accrue interest and principle, legallyWhich mean the loan balance should be the balance after GAP paidRegards, [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted] After reviewing the banking information for July from my financial institution, there was an automatic direct deposit into my checking account for the amount of $and the $ACH payment withdrawal on the same date Per the banking representative, there is no way to as whether the chicken or the egg came first since this is nineteen months post date and the bank has since updated their archives We chose accept the offer presented to pay the single late fee of $with the remainder of the fees being waived On Friday February 3, I spoke with the Laura, the contact person presented in the resolution I was informed the only method of payment to resolve this was via check and was assured when it was received, the check would be applied to the account and the fees removed I was given a direct person (David [redacted] , Project Manager 4) to send payment to in the Buffalo NY M&T Bank corporate location The same day I drafted a certified bank check in the amount of $67.17, and sent it USPS via overnight service (I paid an $for this) assuming my expedited service would assure this would be resolved quickly My tracking showed the FedEx envelope being received on Tuesday February 7, at 10:26am I called on Tuesday to ensure it was received and to discuss the time frame for resolve A customer service representative, Melissa, assured me the check would take no longer than 24-hours to process and that once receiving the check in hand, David [redacted] , would remove the fees from the account Our account was not clear, or resolved until FRIDAY February 10, It took FOUR days to process a bank check and remove fees from an account I find this absurd I also find it disheartening that as a dissatisfied customer, who has already expressed re-financing the loan to take my business to another lender, I would not be given better, more timely service Per Laura, once the check was delivered to David [redacted] (which did not happen until Wednesday February 8, - a FedEx PRIORITY shipment, sent direct to him), he then had to send it to another department to be processed, and only after that could the fees be removed I'm unsure why I sent it to him in the first place This type of service is horrible Not only are we happy to take our loan to another institution, but we will never use or recommend M&T Bank to any friends, business colleagues, and we will be leaving a poor review publicly now that this has been fully resolved Thank you Revdex.com for your assistance with this complaintSincerely, [redacted] ***

I have attached pictures of the paperwork we discussed on the phoneI have also attached the paperwork for the original date I paid for the stop payments which was 12-14-& 12-15-2015, weeks prior to when the charges where allowed to be debited from my account I called to find out why the charges were able to clear, I was told by an M&T representative that the previous representative who filed these stop payments did them incorrectlyThere was not supposed to be a specific amount on the stop payment because the amount was always different when the companies charged my account The way M&T bank is presenting the dispute on the signed papers(which I have not sent to M&T bank) is that I called the companies, [redacted] loans, [redacted] ***, and [redacted] and told them not to charge my M&T bank accountThat is not what happenedI paid M&T bank to stop payment of these charges and they let them clear anyway I am going through a debt consolidation company to pay these companiesI needed to make sure I was not going to double pay themI did my part by paying for the stop payments and M&T dropped the ballThey have been extremely difficult to deal withThey have allowed other stop payments to come through putting my account in the negative only to return it a full business day laterThese charges total $and because that money was allowed to be removed from my account, I had other charges clear that they charged me overdrafts of $per item totaling $This may not seem like a lot to M&T bank, but I am a senior citizen and it is a lot to meSincerely, [redacted]
