We’ve taken steps to resolve this situationOn March 31, 2017, we closed the client’s Paychex account and refunded the $monthly maintenance fee for February on April 6, Therefore, we now consider this case closed. I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me However, I wish to qualify what their 'reaching out to me was': a telephone call in which I was told that the status of my claim had been changedFor the proceeding hours according to my online account, nothing was differentI have since gotten additional information from my doctor in order to process that claim, and it was reimbursedMy complaint was more towards the point of their lack of indication initially, on the delay, and that delay significantly changes my cash flow in order to make ends meet

I appreciate Paychex response, however, Paychex has not performed the Florida Tax filings correctly Paychex did not communicate any rejected 2013-filings by the state of Florida In August of a executed Florida Power of Attorney was sent to Paychex giving them the permission to file our payroll taxes If the account was closed, why didn't the tax department call me and let me know what was happening I believe that this would of saved us alot of time and trouble IF our Customer/Tax Dept Repwould of called us or contacted us.Paychex had a lack of communication

Mr*** ***, an employee of our client *** *** *** LLC, contests that Paychex has not handled his 401(k) deferral in a satisfactory manner.*** *** *** LLC, offered a 401(k) plan with an auto-enrollment feature that automatically enrolls eligible employees in the plan with a one percent deferralPaychex notifies the client monthly of any newly eligible employees; and, per the service agreement signed by Ms*** *** with *** *** ***, the client is responsible for notifying employees when they become eligibleMr*** became eligible in July 2015, and was auto-enrolled in the 401(k) planHe had days from the first payroll deferral to opt out and take a permissible withdrawal of his contributions.Mr*** contacted the Paychex Client Service Center on March 16, 2016, and a representative explained the auto-enrollment process and how to take a distributionPaychex mailed paperwork with instructions on how to request a distribution from the 401(k) plan directly to his home address, which we verified during the callOn April 1, 2016, Mr*** called again to state that he never received the distribution paperworkOnce again, Paychex mailed the paperwork to Mr*** *** *** LLC terminated the 401k plan in August 2016, and a distribution notice was sent to all plan participants.On September 13, 2016, Mr*** called Paychex to opt out of the plan, which was no longer an optionOur representative explained that the plan was terminated and he could take a distributionMr*** asked to speak with a supervisor, however, he disconnected the call before the supervisor came on the line.I called Mr*** on Thursday, September 15, and again on Friday, September 16, 2016, and left messages with my contact information and asked for him to call me back at his earliest convenience so I can assist him with the distribution process.If you need additional information or have questions about this complaint or Paychex’ resolution of this compliant, please feel free to contact me at ###-###-####, ext***.Sincerely,Nekada S*Client Product Relations Representative

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. We spent months trying to get PayChex to close all services provided by them with *** *** including this one. When, after almost a year of trying to close our 401K, we were finally told it was closed by PayChex, we asked their 401K department what else we needed to do to close any related services. They said that "everything" was closed. This "insurance product" was solely issued for their 401K and as such as a related service. We were informed by PayChex that all services related to the 401K were closed, but clearly they weren'tThen when they tried to renew this "insurance product" we declined to renew it and stated that it should have been closed as we requested previously. They acknowledged our not renewing it but then renewed it and billed us for it. We are demanding both a written confirmation that the account has been closed AND A FULL REFUND of all fees back to the point where we closed the 401K that this "insurance product" is associated with.In reality we should be asking for all fees related to this and the 401K from the point a year prior to its closure, when we tried to close it, but we'll settle for this at this point. Thank you for your inquiry regarding Mr*** ***Paychex takes complaints from our clients very seriously, and we appreciate the opportunity to help resolve any disputes that may occur.It is my understanding that Mr*** *** stated he applied for a 401(k) loan on 1/19/and on Monday
1/22/he called Paychex Retirement Services and was told at this time the loan request cannot be cancelled which resulted in a loan check being mailed to himHe stated he deposited the loan check so he could then send a payment to pay-off the loan balance in full and has requested for the $loan processing fee to be refundedHe stated Paychex is dishonest as the loan fee was unclear as it was written in fine print. As of today, I was able to confirm he requested a loan on 1/19/via the Paychex website and after reviewing the Paychex Retirement Services website there are several times in which the loan processing fee is disclosed and it is not presented in fine printSince the fee is disclosed several times during the online loan request process and loan contract is legal and binding we cannot refund the loan processing fee.
