Lobel Financial has reviewed the complaint in detail.  Following the reposssesion and sale of the financed collateral, the Explanation of Calculation of Surplus or Deficiency was generated and mailed on 2.12.05.  This was returned to our office, REFUSED.  The co-debtor, [redacted]...

[redacted], was personally served at 7:06a on 4.9.05 and judgment was entered on 8.9.05.  As the judgement was set to expire and the debt had not been satsified, our office requested a renewal of judgment, thus extending the judgment an additional 10 years as allowed by the state of California.  The court granted our judgement renewal in the amount of $13,233.65.  Though Lobel Financial followed the normal and standard legal procedures, we will as a courtesy, agree to settle the debt for the amount of $3,350.00.  This amount will be valid until 9.30.15 otherwise the settlement offer will be null and void.  The customer should contact our Legal Department directly at (714) 995-3333 to discuss in detail.

Lobel Financial would like to direct the customer to his billing statements as we have fully complied with his request as outlined in the original complaint.  Should the customer have any questions, we welcome him to contact our office directly to discuss.  We will also mail a history statement as supplemental proof to the address on record.

Lobel Financial has thoroughly reviewed the customer’s
account. The financed collateral was repossessed on 6-24-15 for
non-payment of the amounts owed for the customer’s 4.30.15 and 5.30.15
payments.  Our office made numerous
attempts since May 11, 2015 to contact the customer and collect...

the amounts due.  In addition to attempts via phone, our office
generated statements detailing the amounts due.
As our office was in compliance with all applicable laws, we would be
unable to reimburse any fees incurred as a result of the customer’s default.

Lobel
Financial disagrees with the customer’s contentions therein.  The financed collateral was repossessed for
non-payment on 02-23-2016.  We made numerous
attempts to contact the customer beginning 12-09-15.  In addition to our attempts to contact via
phone, we mailed statements...

on 12-22-15, 1-21-16 and 2-22-16 all of which reflected
the past due amount.  Following the
repossession of the collateral, the customer confirmed he no longer retained
the telephone number on record and updated his account with a new telephone
number.  The customer has since paid the
necessary amounts to redeem the collateral.

customer’s insurance policy became effective 10-24-14 and cancelled on 6-2-15.  On 9-23-15, our office verified directly with [redacted] that the customer’s policy with their office became effective 6-25-15.  Our office has since made the necessary adjustments to the customer’s account.  While the customer is still responsible for a pro-rated amount from 6-2-15 through 6-24-15, the adjustments made did positively affect the status of the account.  As a result, our office requested that the credit bureaus remove the negative 30 day mark reported for the customer’s September 2015 payment and be updated to reflect as CURRENT.

Hello, Please find Lobel Financial’s response below: Lobel Financial does not agree with the customer’s contention.  The customer has since paid the loan in full and we have released the title and issued a paid in full letter.    Thank you,  Lobel...

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Problem:a sum of $3,350.00 was agreed upon brokered thru the Revdex.com ([redacted]), but when our house sold, they took $6,616.82 which was over the amount they had agreed on. they also did not give credit for the $800.00 paid for 4 months prior to the close of escrow. we feel they received $4,066.82 more than they originally agreed. as senior citizens living on a fixed income we feel they have taken advantage of us and selling of our home. they gave us an account number of 249060, with payments due on the 20th of each month starting 9/2015. we followed this for 4 months as stated and received no credit for the payments.Translate Desired Resolution / OutcomeDesired Resolution:RefundselectDesired Outcome:$4,066.82 refund of overpayment the charged.

Hello,Please find the company’s initial response to complaint ID# [redacted] below:  Management has reviewed the customer’s complaint in detail.  As is standard on simple interest loans, upon receipt of a payment, our office will first apply any interest and outstanding fees (if...

applicable).  Any and all amounts remaining are then automatically applied to reduce the principal balance.  For billing and statement purposes, any amounts received in excess of the regular monthly payment are applied as a credit towards the next monthly payment(s).  This results in an adjusted or lower current amount due on their statment for the next scheduled payment.  As long as the customer continues to pay the regular monthly amount, any additional funds are automatically applied to their principalbalance.  If a customer  ignores  the adjusted amount due and pays the full monthly payment (or more) they will receive the benefit of paying down/towards their principal.  However, if the customer chooses to pay only the adjusted current due, they will lose the savings on the principal.  While our office only reflects one request from the customer for a copy of the application of her payments, which was sent on 12-11-2015, we are happy to generate an additional copy should the customer require it.  The customer has since paid the loan in full and the title was released/mailed on 1-19-2016.  Thank you!

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action and, if it does, will consider this complaint resolved.

Lobel Financial has contacted the customer’s insurance company, Western General, and received the appropriate information for insurance coverage.  We have verified that the customer’s coverage for the financed collateral became effective on 4-19-17 through 5-20-17 and was reinstated on...

5-27-17.  Coverage is currently valid until 10-19-17.  We have made the necessary adjustments to the customer’s account and notified the customer directly on 6-23-17.

Management has reviewed the customer’s account in
detail.  The financed collateral was
repossessed on 4.28.15 for breach of contract as the customer failed to pay the
first payment listed on the installment contract.  The customer was provided redemption information
verbally and...

written documentation detailing the amounts necessary to recover
the financed collateral was also mailed to the address on file.  We have also reviewed the agreements with the
customer as disclosed on the installment contract that he signed at the time of the
purchase.  Our office has spoken with the
customer on multiple occasions following his complaint and confirmed he is
unable to redeem the collateral.

Lobel Financial has thoroughly reviewed the customer’s
complaint and account in detail.
The financed collateral was repossessed on 7.2.15 for the
amounts owed for his March, April, May and June payments.  While the customer has consistently reflected
insurance coverage throughout...

the term of the loan, our office did generate notices
in the event we received notices issued by the insurance company informing us of
cancellations and/or expired coverage.  From
the inception of the loan, the customer’s account has only been billed for a
lapse in coverage from 5-2-15 to 5-21-15. Upon receipt of the customer’s
complaint, our office contacted the customer’s insurance company, SafeAuto.  We have since confirmed that the policy only
lapsed for 2 days in June of 2014 but had coverage for the periods in May of
2015 and have made the necessary adjustments to the customer’s account.  As the financed collateral was repossessed
solely for non-payment of the delinquent amounts owed since March and amounts billed
for physical damage protection had no bearing on the status of his account, our
office would be unable to refund any monies.
If the customer is interested in redeeming the collateral he should
contact our office immediately to discuss his options.

Please find Lobel Financial Corporation’s response below: Following the receipt of the customer’s final payment, Lobel Financial issued a refund check to the customer on 3-21-17.  The customer contacted our office on 3-30-17 and informed the representative that she had not received the...

refund check.  A stop payment was placed and a replacement check was issued.  When the customer did not receive the replacement, a third check was issued.  Our office has confirmed that the most recent reimbursement check was received and cashed.  Thank you, Lobel Financial Corporation

Lobel Financial Corporation disagrees with the customer’s contentions.  We previously responded to the customer under separate cover regarding this matter.   Lobel Financial Corporation has proceeded at all times as provided by law.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I am not accepting their requests because Lobel financial is a very dishonest company. They never stated to me that they had not received my request for removal, this is the first time ever hearing that the check was received by the dealer. In fact they informed me that the dealer MUST send written documentation to Lobel Financial because they were the ones who reported the repossession and that they could not remove it from my credit file without the Dealers permission, that it is illegal to do so., I spoke with both Business owners of the car dealership and so did Lobel Financial who stated they never reported the vehicle as a repossession and requested Lobel financial correct their mistake. ,When I contacted Lobel Financial on May 14, 2015, the Legal Department, the male assured me that the item was removed from my credit file and the business that they deal with takes 7 business days to remove it. I asked him if it was updated or deleted, he assured me that it was deleted from my credit file.  I asked if they could please mail me a copy for my records and he answered yes. I followed up via telephone, on May 27, 2015, with Lobel legal Department due to not receiving any documentation in the mail, I was told that the people that they deal with, cleared it from my file on today May 27,2015, and had not yet mailed anything out, that I would be receiving something via mail soon. To date I have not received any documentation reflecting any changes, in which Lobel Financial Legal Department has promised and has not delivered. Lobel Financial lacks integrity and ethical business practice. They play game after game after game. At this point I do not trust them, their word means absolutely nothing and holds no weiight and for them to be so horribly dishonest with a company such as the Revdex.com, is awfully terrifying. I have already contacted them requesting what they are so proudly telling me to call for, in all dishonesty, only to make my life a living hell. If they are disgruntled about my returning the car, they should be disgruntled with the Business owners at the car dealership, the car was in bad mechanical condition. They are disrespecting the Revdex.com and me as a consumer and could give less care about it. I have been dealing with this company for months now, with no resolution. I cannot even go and purchase a vehicle due to their lack of consistency, no one will sell me a car due to the repossession they have placed on my credit file. I am suffering and must get to medical appointments. This has been a very unnecessary difficulty in my life, not to mentionthe inquiries on my credit file, rebuilding my credit and lacking knowledge that I had a illegal repossession on my credit. That has desperately affected my livlihood. I am experiencing a negative change in my health due to the dramatical charades they are playing.
