We sent you an email last week. I was copied on it so I know for a fact it happened. And we do not rip anyone off. As you can see, we are willing to address your concerns in writing. We do not guarantee any level of response. We guarantee distribution. We cannot force, threaten, coerce or otherwise intimidate consumers to walk in your door. No one can ethically guarantee a change in human behavior. However YOU can change your coupon and make a different offer that might entice new clients to try your service. However, as stated in our contract, you are in charge of your ad copy. If you do not request changes to the ad, it will print as-is.All RTUI can do is distribute your coupons. You are in charge of your offers. If you are not getting responses, I recommend that you try different offers on your coupon before the deadline. Our deadline for changes in next tuesday, June 9, 2015. If you would like to try something different this is your chance to make changes. Perhaps try a more aggressive offer. But we need you to change your offers by that deadline or the ad will print as-is.I hope you will take this opportunity to help yourself. I discussed pricing with Ann [redacted] on this deal and we agreed to give her special discounted rates to get the store over 12k and give the realtor lots of exposure.  Ann [redacted] confused the pricing that we discussed for the header and applied it to the larger positions. ...

Once I learned about the pricing to be on 100% of the carts I notified Ann [redacted] that we would not accept this contract as it was way below any pricing that I had done in my 5.5 years here ($2250 for 100% of the larger positions (I can't remember if it was directory or front).  After explaining to Ann [redacted] in detail our possible discounts she asked if I would explain this to the customer.  I agreed that I would. I believe that I contacted the customer within 24 hours of her signing the contract.  I explained that there was misunderstanding about possible discounts and that our company would not be able to honor the pricing that was on the contract.  I further explained that Ann [redacted] was an Independent Representative and that her contracts have to be approved by corporate and that we could not approve it as it was well below any pricing that we do with [redacted].  I also explained that this exposure package usually goes for around $8400, so $2250 wasn't even close to that.  However, since we had written a contract for $2250, I would still honor getting her on every cart with the header position.  It was at this point that Hina started to and continued to speak over me without listening.  She insisted that the error was not her fault (I agreed) and that the rep should have to cover the mistake.  I tried to explain that this was just an error and that we could still get her excellent coverage but she continued to talk over me and say that I was trying to get more money out of her.  I assured her that this wasn't the case and that we could still get her great coverage for her contract amount.  She continued that Ann [redacted] signed and approved the contract.  I tried to explain that all contracts are approved in Houston and that Ann [redacted] was not authorized to approve a contract.  As an Independent Representative, she can only submit contracts for corporate approval and that we could not approve this.   At this point, Hina was raising her voice at me and insisting that we honor the pricing.  Further, she would not let me speak.  Finally, I asked her to please lower her voice and let me respond.  She told me that she was very upset with us not honoring our commitment and that she honors all of hers.  I mentioned that contracts often get rejected for typos and mistakes and she insisted that when they do that she would financially cover any mistakes and that she expected Ann [redacted] to do the same.  I tried to respond but she continued on and at this point I mentioned that since she was again raising her voice and not letting me speak that I was going to have to go.  I was polite and we ended the conversation.   I believe that she knows that she got a crazy deal out of Ann [redacted] and I think that she is trying take advantage of this.  Unfortunately, she is not willing to work with us at a reasonable rate.  Ann [redacted] did not run the card and we have not submitted the contract due to the pricing.  I have gone over pricing and discounts with Ann[redacted] so this will not happen again.   Please feel free to call me with any questions. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  This will be my final response.I spoke to [redacted] today and he is now aware of all aspects of the complaint, they are trying to resolve with the possibility of more ads for free but to be quite honest I do not wish to do any more ads after our contract is up even if they are free of charge.  [redacted] was very nice but when I advertise I normally see my ads with each publication - not some of the time.  No where on the contract does it say they are only responsible for some of the days it states that they ( [redacted] ) are not responsible for the 3rd party ( [redacted] ) not installing the paper with the ads in their machine.  Since I had a bad experience from the beginning I will not be satisfied unless the contract was terminated - which it cannot ( and that is CLEARLY stated in contract ).  As a side note - no one admitted fault just pacification.

straight. I do not know what [redacted] told you, but we do not take advantage of anyone, elderly or not. We investigated your claims and found that [redacted] did not misrepresent this. He discussed the program with [redacted] and [redacted] made a decision to purchase an advertisement from us on his own. While there surely are unsavory players in the market who will take advantage of the elderly, that is not us. The services we sell are marketed for businesses and we only **ntact business owners/managers. [redacted] did not seem to be in**herent or near death during the interaction. He actually seemed quite vibrant and able minded, as he was operating your business at the time. He was informed of our terms and **nditions, including our cancellation policy at the time of sale. He agreed to all of these terms. There is not a 3 day **oling off period for this transaction and for that reason your initial cancellation request was denied. That said, in light of the news of his death we will allow you to terminate the **ntract after one cycle.  We will require that a total of $800.00 be paid to **ver services rendered. To date you have paid $100.00. We will settle the ac**unt if you pay the production charge ($125) plus the **st of the advertisement (675.00) that is running now. This means that you will only owe an additional $700.00 for the services rendered. We in turn will cancel the last 9 months of your **ntract and you will not be billed the remaining balance of $2,025.00.We are sorry to hear about your loss. I know this offer is not what you are looking for, but this is fair **nsidering the circumstances. While we do understand the frustration our client is expressing, there are no guarantees with advertising.  We contracted with Paleo Pet Goods, to place their ad on register receipt tape.  For our part, we are 'advertising' the business and have done so for one year.  We are not an...

enforcement or transportation agency, we cannot drive people to this business.  We believe, as does every advertising firm, that business grows by making the public aware of their product.  We see our role as the facilitator for that exposure, not through magazines or billboards, but through receipt tapes at the local grocery store where this client's potential customers shop daily.  Our sales presentation is based on 25 years of advertising on register tape.  It does not work for every business.  it does work for many, that is why we are still in business 25 years in.  All our terms are written out for the client PRIOR to contract signing.  We do not hide anything, including our non-cancellation clause.  Results included in our sales presentation are based on similar business results.  We have many pet supply stores throughout the country who do very well on the receipt tapes.  This client signed an agreement to pay $4272.  We have provided the one year of advertising exposure.  We expect to be paid as promised.

I only required CARTVERTISING to take the responsibility for the promise their representative signed with me. How can you ask about $2,500 at the time of signing a contract and then require a small business like me to pay you another $6,500 for a mistake that I wasn't a part of. To me, that was FALSE advertising to secure a contract. Had I make a mistake, I would have paid.

I will do my best to address your complaint.
Our contract with you stated that your ads would start approximately
the week of June 6, 2015. The ads were actually delivered to the store on June
10, 2015. They started distribution on or about...

that date. The service started
on-time. We sent you proofs on May 18, 2015 and August 6, 2015. I’m sure other
attempts to reach you were also made by email and/or phone. Whether or not you
chose to approve your ad is not relevant to this discussion. We made attempts
to provide you with the artwork and solicit changes to the ad. We disclosed our
deadline to you.
You stated you called our company and you got a disconnect
tone. I don’t know what happened here. Our number has never been disconnected. I
apologize if you experienced some sort of technical difficulties reaching us.
Our service works great for small businesses. Considering
the timing of your business closing, it sounds like our advertising may have
been ordered too late to help you turn things around. We have had many vapor
shops get fantastic results from the program when it has had the opportunity to
work.
I disagree that we were “irrational”. We were able to
address your concerns because we are professionals and it is our business. It
is as if one of your customers came in with questions about vapor supplies.
You would be able to answer those questions with ease. We can answer questions
about our service with ease as well.
Now you had a “non-cancellable” contract with us in which
you reserved the space for one year. We did not put you out of business. We
provided the service you ordered, at the location you ordered it, within the
time-frame we said we would provide it. In your service contract you purchased
one year of advertising at a specific location for a specific period of time.
We do not guarantee any level of response, and state so explicitly in our
contract terms. Having a contract is not an indication that we are taking
advantage of anyone. The contract is there to protect both our companies so we
can look back months later and see what we mutually agreed upon. You agreed to
all the terms, including our cancellation policy. You stopped payment on the
account in July and you were sent to collections for failing to uphold your end
of the contract. You are not a victim. We are not scammers or immoral as you
suggest. In fact, I feel that this dispute is immoral seeing as how you are
trying to bully us out of this contract by using a third party rather than
taking care of your obligations.
We called you for 2 full months to resolve this before we
finally reached you by phone in September, after we spent money to print your
ad for the second 3 month cycle. When we
finally got you on the phone, on the 27th attempt to contact you,
you berated our company rather than accepting responsibility for your business
or try to work something out. Is this how you treat all of your vendors? I pray
that they are as merciful as we are.
Considering that you have paid for what ran, we will
consider your account with us paid in full. We accept your terms to discontinue
the advertisement (effective at the next printing which hits stores
approximately December 6) and zero the balance. I will personally pull your
account back from the attorney. However in the future I would suggest you talk
to your debtors about this kind of thing rather than avoiding them for months
and then filing a complaint with the Revdex.com to bully your way out. Other companies
may not be so kind.

However, if additional disputes are opened or existing disputes (such as the one with the Revdex.com) are reopened we may reconsider our position on this matter. My question is why there even is a case? And again, why do you think this is a systematic problem that needs to be addressed by the Revdex.com? We were not even given the opportunity to address your concern before you opened your case. As I stated earlier, we are addressing your complaint. We are attaching the written contract between RTUI and [redacted].  The contract states in writing, 5 qtrs. of advertising, including 3 months free, for our summer promotion.  The price of the contract is $2400.  This is written in 3 places on the contract: Total Price (mid...

page), Price (next to the store and 5 qtrs) and Billing Scheduled (bottom left, next to customers signature).  RTUI is up front with our clients about the cost of the advertising and what we will provide for that price.  All this information was on the contract before signing.  We have attempted several times to communicate this to our client, and we are told different amounts each time we communicate with her.  RTUI will honor the terms written on the contract.  Regardless of the length of advertising the client believed she was signing for, the amount of the contract is clearly written in 3 places on the contract.This advertising began running in August.  Client has made only the down payment at contract signing.  RTUI has proceeding in good faith with our contract, and we believed the client would honor her signature.  Client provided a credit card for the monthly payments and initialed the 'auto payment' option just above the billing schedule.  Client also initialed that she read and understood all our terms.  If there were any questions the client could have clarified prior to signing.

Excuse me. We are not con artists or criminals. I am highly offended that you would suggest such a thing. We have already told you how to resolve this situation. Our salesperson stated he does not even drink and he explained everything to your employee, whom you yourself told me is in charge of purchasing your advertising.  You stated you have video which contradicts our salesperson's account of events. Please send us a copy of that video so we can see for ourselves if he was acting with integrity as all representatives are instructed to do, or if he acted as you have claimed.Thank you[redacted]

We are not in the wrong and have not been paid for services rendered. Our attorney will be in touch this week.

These Con Artists have taken advantage of a young employee and tricked him in to signing a 12 month contract when he was only inquiring about a month trial. This is un-ethical and un-professional.  The sales person was also intoxicated during the visit to the store o feel this to be also very disrespectful. I hope these criminals get what they deserve.
