itself make any rentaldecisions; rather, our customers use the information in the TSR, among otherthings, to make informed decisions about whether a tenant applicant isqualified for a particular apartment or property.  Each TSR has a section forcredit history information, a section for information about certain civilrecords (which are non-criminal in nature), and a section for criminal recordinformation.  It is perfectly normal for a TSR to contain detailedinformation in one section but not in others—for example, a TSR might containdetailed credit history information, no civil information, but some criminalhistory information.  YRS prepares each TSR in accordance with the [redacted]

[redacted]).  YRS followsdetailed procedures to ensure the maximum possible accuracy of the informationcontained in each TSR.    From time to time, however,information furnished to YRS and included in a TSR may be inaccurate orincomplete.  When this happens, consumers can dispute the inaccurate orincomplete information, and YRS follows specific, detailed procedures requiredby the FCRA and either investigate the dispute and/or forward the dispute tothe source that provided the information to YRS, depending on thecircumstances.  The FCRA further protects consumers by requiring disputeinvestigations to be completed within 30 days. In the case of Ms. [redacted], YRSprepared her TSR on April 18, 2015.  Certain sections of the TSR had noresults, and other sections did have results.  Again, this is not unusualor inconsistent because the different categories of information (credithistory, criminal records, and non-criminal records) are very different. In any event, the TSR about Ms. [redacted] contained her credit history, returned noresults in one category, but did contain a result in the other category. Ms. [redacted] disputed that result. Ms. [redacted] emailed YRS onMonday, April 20, 2015, to initiate her dispute.  YRS followed itsdetailed procedures and in this case both forwarded her dispute forinvestigation to the source that provided the information to YRS, and initiatedits own investigation into the accuracy of the record.  Four days later,on April 23, 2015, YRS completed its own investigation, deleted the disputedrecord from the TSR, notified Ms. [redacted] and the property where she applied thatthe record had been removed, and provided Ms. [redacted] and the property with a revisedTSR.  YRS Consumer Relationsrepresentatives can be reached by telephone at ###-###-#### Monday throughFriday from 10:00 AM to 3:00 PM Eastern Time or by email at [redacted].

Thank you for the opportunity to address this consumer's concerns.  RentGrow was contacted directly by the consumer and has initiated a dispute, which is currently being processed.  RentGrow does not publicly discuss disputes but works directly with each consumer that initiates a dispute....

 The dispute acknowledgment that the consumer has received from RentGrow explains the process and next steps, but the consumer is also welcome to contact RentGrow directly with any additional questions at ([redacted] (option 2) Monday through Friday from 9:00 am until 9:00 pm Eastern Time.  Please note, however, that RentGrow does not approve or deny any rental applications and does not set the eligibility criteria for any rental property.  All eligibility criteria are set, and all rental decisions are made, by the property owner or management company where an applicant applies.  Thank you again for the opportunity to address this issue.

I want to thank
Yardi for expediting my dispute and fixing their mistake. However,
this is a problem that shouldn't happen. For a company that promises
"Confident, Reliable screening" they are falling way short
of the mark. They also advertise "Criminal screening using the
most accurate national, state, and county databases". I
personally ran background checks on myself using 3 different sources
and did not have any information come up that was not correct. As I
stated I have no criminal history and the fact that 3 other checks
verified that, it makes me wonder about the accuracy of the data this
company is providing. The legal “catch alls” that the company
uses are the following:TSRs are prepared in
accordance with the Fair Credit Reporting Act, 15 U.S.C. § 1681 et
seq. (as amended) and any other applicable laws and regulations.Although a CRA
generally has 30 days to investigate disputes, YRS understands that
when you are applying for an apartment it is important to resolve
problems quickly. That is why YRS will try when we can to expedite
the process.Just because
something is legal doesn't make it right, morally or ethically. While
the company may be following the minimum legal requirements, they are
not providing the service that they are advertising, which should be
an issue as well and is probably why the company has already faced
lawsuits. This complaint is based solely on the fact that the company is
not providing accurate data. In no way has this issue been addressed
other than stating the minimum legal requirements that they by law
have to comply with. If the data was accurate to begin with, this
would not be a problem, but Yardi already has a track record for this
same problem and does not appear to have done anything to correct the
issue. I am currently 2 days behind the time that I should have been
in my apartment. With the weekend coming it may be 2 or 3 more days
before I can move into the apartment that Yardi's false data has
caused denied access. As I stated before, Yardi needs to be held
accountable for their actions and my costs are $70 per day for
lodging directly related to Yardi's negligence. At this point we are
at $140 and more added each day for costs that I should not have
incurred. My request is for $70 per day until I am able to occupy the
apartment, the delay is a direct result of Yardi's negligence and not
providing the service as advertised.

Yardi Resident Screening (“YRS”) prepares tenant screening reports based on information obtained from various consumer reporting agencies (“CRAs”) but does not maintain databases containing consumer information.  In accordance with the Fair Credit Reporting Act and other applicable regulations (the “FCRA”), YRS strives to ensure the maximum possible accuracy of the consumer information contained in each tenant screening report.  If a tenant applicant believes any information reported by YRS is inaccurate or  incomplete, he or she can dispute the information directly with YRS, which works diligently to correct inaccurate or incomplete information.

I have reviewed the response submitted by the business and have determined that the response does satisfy my issues and/or concerns in reference to complaint #[redacted]. I understand that by choosing to accept the business response that my complaint will be closed as resolved.
