Review: I requested the account be cancelled in the month of Jan- 2013, Re: [redacted]. I provided a detailed medical letter substantiating request.

The person informed me that in 2 days it will be resolved. I awaited the 2 days called, was told it was resolved.

January- April I received no DEBITING on my Checking account from Retro Fitness in the amount $20.89 which is the cost for my type of Membership.

I Was stunned when in the month of MAY **-2013 I see a debit from Retro fitness 20.89, I called in and asked why? the person stated I needed to come

in and speak to [redacted]. ( Manager).

I went in to speak to Manager [redacted], the request to have a doctors letter faxed or emailed was again requested. I obliged and was told

that I had nothing to worry about, it will be resolved. I mentioned that I was charged for a service I can no longer use for Medical Reasons. **. [redacted] said

it will be reimbursed once it goes to FINANCIAL dept who is the one who handles this part.

He said, "Oh I see what happened they froze your account for 4mths," I told him this is not what I wanted.

The letter clearly states CANCEL membership. I verbally stated via phone, email, FACE TO FACE that it needs to be cancelled, As I handed them the letter

in the month of january 2013. from Jan-April no charge because it was frozen But from May -Current I have been Charged $20.89 every month.

I went to Dr. office to request a letter again, scanned it and emailed

it to [redacted] ([redacted]t).

I have sent 5 emails to them it has not been resolved, I called 4x's there after not resolved.

I have all proof required if needed.

I called in again today 11/*/2013 emailed him again today. Advised him clearly I will reach out to Revdex.com.

so far they have Taken $125.34 + November [redacted] is the next bill date 20.89 will be deducted again without my authorization at this point.

Bringing it to a total of $146.23 + the time off to go speak to them.Desired Settlement: Cancel my account and Refund the entire charge from May 2013- $125.34 up to October, if not resolved before Nov [redacted] the total will be $146.23.

Review: Good evening,

I have been receving constant collection notices on behalf of Retrofitness over the past month. Back in early April my husband received deployment orders and we made arrangements for the assignment. We stopped by retrofitness where it was decided to terminate my contact. The female manager informed she understands the situation had us fill out a small white paper and informed us I would be charged dues for the month of April. We initially did not notice until Aug we were still trying to be charged until a collection email was received. My husband called the company's number when he was told "the cooperate office does not have any control over branches as each franchise is independently owned. My husband would have to go into the gym in Freeport discuss the matter with them". This request is impossible as we have changed duty assignments. He has called from the deployment and so has our credit card personnel to dispute the charges. We continue to receive email and messages threatening legal action / negative credit reporting against me. I am so frustrated, we paid the 2 months as promised.Desired Settlement: Hopefully we may resolve this matter soon. My husband was a member for many years and suggested this gym when I moved to the area. This may be a simple mistake just slipping through the cracks. Thank you.

Review: I am simply trying to cancel my membership with this facility. I contacted them via email and by phone, and was told I would have to come to the gym personally. When I arrived to process my cancellation, I was told that they would cancel in 60 days, and I would be charged for that period of time. When I refused, they told me that it would go to collections if I did not pay.I refuse to be taken hostage by a fitness center. It is a membership, not a lifetime commitment. I shouldn't be penalized or charged to cancel, or told when I can cancel. This behavior is abhorrent, and I for one, will not tolerate it.I have seen similar online postings about this company and the way they handle cancellations. I don't think I should be charged for two months that I do not intend to use the facility. Please adviseDesired Settlement: I just want my agreement to end. Without penalty, and without having to send a certified letter. I think cancelling in person should be enough, should not be questioned, and certainly does not entitle this company to charge me for a cancellation.

Review: I was a member of this gym for a year. Around the ending of May, 2015 I went to check the status of my account and my sons account at the gym. I was asked for my debit card by the Representative. I provided him with it and he informed me that my membership expired and that I could continue on a month to month basis. I told him I would like to cancel my sons membership but I would continue. He then told me as per the contract that it would be a $60.00 cancellation fee. I said that I would cancel it at a later date due to I had no money in my bank account. He said okay and went to the computer to look something up on my account and swiped my debit card for my sons cancellation fee. I asked him what he was looking up and he said that he was cancelling my sons membership. I then informed him again that there was no money in my account and that now I was going to have an overdraft fee. He said he forgot and said he could reverse the transaction. I asked if it would go through tonight because it was already past 8 pm. He said yes. The following day I occurred an overdraft fee for $35. I had other bills coming out of that account and I deposited money for them the following day, not knowing that I occurred an overdraft fee due to my card being swiped. Due to that I occurred 5 overdraft fees totaling over $200. I would like for the gym to reinstate my membership for the time equaling the overdraft costs or to provide me back with the money. I tried speaking to the Manager there and she refuse to come to an agreement. I also tried to contact the corporate office with no response. The message box is always full and no one answers.Desired Settlement: Refund or membership back equivalent to money owed

Business

Response:

I spoke to Tywana Y N[redacted] on the night in question. She came into the club and asked about canceling her son Jayden N[redacted] account. One of our employees told Miss N[redacted] it was a 60 day cancellation and it would cost her $39.98. At that point she handed over her credit card and he swiped it. After it was swiped, she said she didn't have any money in her account. He told her it would take 3-5 business days for the funds to go back on to her account. I refunded her the $39.98 back to her card and she left. The next day, I got a call from Miss N[redacted] demanding we pay her overdraft fees. I told her I couldn't do that and that I told her she was told it would take 3-5 business days for the money to go back to her account. She then said my employee asked her for her card and wasn't supposed to take any money out of it. I told her I was there and saw everything and I asked her why she gave him the card. She didn't know what to say. She started yelling at me and saying my employee told her it would be refunded immediately. She called the club again a few more times. I spoke to her and again and told her I couldn't pay her overdraft fees. She said she was going to cancel her credit card and come into our club for free if we didn't give her money back. I told her she wouldn't be allowed in the gym unless she is all up to date with her payments. I also told her if she cancelled her credit card, after three months she would end up in collections. She hung up the phone and I never heard from her again. I looked into her and her son's account and they're both in collections. She also has another account that went into collections in 2012.

Review: We joined this Club in 2012 but moved away in 2013. After purchasing our home this past summer, we called to cancel the membership. We were told to send them a letter, which we did. In the letter we requested cancellation effective November *, 2014. Their billing company is [redacted] and they call several times a day on our house phone. My wife and I both work and I am not only upset at the fact that the accounts have not been cancelled, but the fact that they are disclosing personal information about the account including threats that they will report this to the credit bureaus and destroy our credit to anyone that answers the phone. We have three minors ages 12 and 14 and a disabled adult who live with us and we have been told by three of the four about the calls and what they are being told. Needless to say my 12 year old step son has been a nervous wreck thinking they were going to lock us up. Not sure where he got that notion, but that is is fear.Desired Settlement: We followed their instructions about cancelling, we want the collection calls stopped, the memberships to be cancelled effective 11/*/14 and full write-off of all amounts they claim we owe.

Review: I have a high risk pregnancy and was advised by my doctor not to work out but the gym is unwilling to cancel my account with out charging me for additional fees.Desired Settlement: I just want to cancel the account with out being charged

Business

Response:

[redacted] and his wife, [redacted] were both members of my facility.

[redacted] is pregnant, she was cancelled immediately.

[redacted], her husband, is still in the one year contract that he signed and agreed to upon signing up for Retro Fitness.

This complaint is clearly a lie, HE is not pregnant.

We made a courtesy in cancelling his membership but made him follow our corporate procedure of a 60 day cancellation. Which still gets him out of his agreement before the membership is even valid for cancellation.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved. Thank you for your time and effort. It is sad that it came to this to have an easy problem resolved. And thank you for helping me keep this a civil matter as you can tell they can be very nasty, rude and difficult to deal with.

Sincerely,

Review: I have been a member of retro fitness Williamsburg since June of 2014. I started working there as a personal trainer in October of 2015 I stopped working there November [redacted], I followed procedure I have in my two weeks notice. I was still a paying member after I stopped working there and while I was working there(which they should not have been charging me for). Yesterday(January [redacted]) I was told by the General manager Catherine that they were cancelling my membership because I stopped working there. It has been almost 2 months since I've stopped working there and now they decide to cancel my membership. They have not cancelled the other two male members membership who stopped working there. They are discriminating against me because I am a female. It is not stated anywhere in my membership contract or the working papers I signed that if I don't work there anymore they are allowed to my membership. They cancelled my membership anywayDesired Settlement: Legal action be taken, It is not stated anywhere in any document that they are allowed to do such thing and I want to be reimbursed for this past month I was charged as well as the two months I was working there,

Review: We joined this gym in 2012 and canceled our member ship when we moved to california may [redacted] 2015. Retro fitness continued to charge our credit card every month. Each time I saw (which was twice a month and random fees,) I called them. Customer service is very rude. told me I had to come into retro fitness and cancel again. I have already moved to california. again the following month, two random fees were charged again - and they charged this on an expired credit card. somehow the managed to continue to charge our bank even though the atm card was expired. I called again and they said email them and they would cancel. but the didn't. they continued to charge my expired card and still continues to charge it. They owe me a total of $378.07Desired Settlement: I want a refund of $378.07 the total for all of the months they kept charing my bank and lied saying they would canceled account but never did.of it totals $378.07

Review: I have been a member of Retro Fitness since January of 2012. I went to the gym to cancel (their policy is they only accept in person cancellations) on April **, 2015 with a typed cancellation letter. I met with the owner, and she told me there was a 60 day cancellation policy so she debited my account in May and June. She told me I could use the gym until July *, which I didn't do, and then it would cancel. She again debited my account on July *. I called her on July * and she said it was no problem, she would delete the charge. I waited several days - charge still on my account. I called my bank, [redacted], on July ** and started a claim. After much follow-up, my bank told me on Tuesday, July **, that the charge stands. I called Retro Fitness today, left a message for the owner, no returned call. I am still pursuing this with my bank. I need this charge reversed and my membership cancelled. Also, is there any law in NYS as to how much notice is needed to cancel a membership? I thought 60 days was a lot.Desired Settlement: I would like my membership cancelled and my July dues refunded. Would also like to know if it is legal to tell a customer there is a 60 day cancellation policy rather than 30. Every gym I have ever know has a policy of 30 days notice.

Review: I cancelled my membership in May of 2014. I was informed that as per my contract I would continue to to pay for my membership for 60 days. After paying for June and July, I was continued to be billed in both August and September of 2014. I called the gym personally to ask why this had happened and was assured that a refund would be issues right away. After waiting 7 business days like I was told, I had noticed that I was still not refunded for the two months. I called the gym again numerous times, spoke to over 4 different employees including [redacted] the [redacted]. She personally assured me that a refund was processed and would be in my account in 3-5 Business days. This was 2 weeks ago. I called over 8 different times in the last week only to have employees and the [redacted] dodge my calls. I left 5 messages for [redacted] to call me back so that we can find out what was going on. She has yet to return my call (not even one time)Desired Settlement: I am requesting a FULL refund in addition to the overdraft fee that I incurred for this unauthorized transaction in the amount of $34

Review: I called up Retro Fitness to freeze an existing memebership because I was moving. It was a temporary move out of state for a seasonal job in Vermont, where I was unable to use a Retro Fitness facility. As par my phone conversation, the branch in [redacted] did not comply with my request (January **, 2014) and continued to charge me the full membership amount for the duration of my stay out of state. When I returned back home to Long Island April **, 2014, I spoke to the supervisor over the phone, [redacted], to address the charge. She assured me that as a courtesy she would credit back my account. However our conversation also included my interest in cancellation due to moving to Boston for a job opportunity. She then began to berate me in my request and threatened to continue charging me due to "company policy" and insisted that that I provide a copy of my lease. I gladly emailed her my lease. Upon calling on April **,2014 to verify delivery of my lease, she responded with continuing the charge to my account for the next 3 months. The membership charge is still being applied to my inactive account and I have not used the gym facility/service from January. I researched some other previous patrons reviews on [redacted] to only find that this problem of cancellation is not only shared by me, but by many. If you call to address your account with Retro Fitness in [redacted], they will disregard your authorization completely and continue to unlawfully charge you.Desired Settlement: It is my only request that I am refunded the total amount of 19.99 per month charged to my account , which was unauthroized, from the period of February 2014 through May 2014, and that all future charges are null and void to my personal account.

Review: Initially signed up for gym membership later was interested in trainer sessions at $160 a month

6 months later I was instructed to bring in a doctors note to excuse me from the gym as a whole

2 months later I begin to receive billing letters that funds are due

Went in person to speak to Trainer Manger [redacted] that informed me the person in charge of my account Luis H. had never froze the account or put letter on file.

3 months later again I receive letters in the mail attempting to collect funds

I have cut Retro fitness off from having financial information and can not seem to solve this issue with the gym itself or corporate

I have gone in person made phone calls and emailed all that I can and am still being sent letters when in the contract medical reasons exclude you from having contract with the gym / trainer. Furthermore My Trainer [redacted] is no longer in business with the gym. I have become disgusted with the unprofessionalism of the gym. I have called been left on hold, promised phone calls in return, hung up on yet I receive letters in the mail. I have tried even reaching the billing for retro fitness which is [redacted] and no luck there either.Desired Settlement: trainer sessions cut and late fees so I can continue if desired to attend lightly at the gym recreationally for the $20 monthly fee

Sincerely,

Review: Hi, In July 2015 I tried to cancel my membership to Retro Fitness. When I first asked at the facility I was told I have to pay for two more months plus a fee of 250 not sure on amount but over two hundred. I told my Dad about it and he went to the facility on August [redacted] 2015, and spoke with a Mgr named Loraine M[redacted]. She told my dad to pay 2 months 41.78 which he did, and my membership would end Oct ** 2015. I did not sign any contract. I don't know why I have to pay this. With that the manager would not sign on the receipt that this was a cancellation fee nor put anything in writing that my membership is cancelled and satisfied. When you call [redacted] phone number [redacted] who handles there collections they say the same as Retro, and they would not give me a cancellation confirmation. [redacted] sent me an email stating amount past due $.00 , and account balance is 239.21. Retro and [redacted] collections are not clear. They tell me on the phone not to worry the account is closed with no further monies due. But they refuse to put it in writing. I believe I should receive something in writing.Desired Settlement: I want confirmation from Retro Fitness that with the fee I paid 41.78 on August * 2015 that my account is closed and satisfied, and that I do not owe any other monies as I was told by the Manager of Retro Fitness Loraine M[redacted]. I was also told verbally on the phone by ABC that the account is satisfied and closed. They have not put that in writing either

Review: I have not used this gym in over two years. I called to cancel and they keep telling me that I have to come in to fill out a paper in which my work schedule will not permit being that I work far from home. I called corporate and they refused also. I never had this problem cancelling a membership and they are continuously taking monies out of my account. They are [redacted] and I found that out when I tried to use one of their personal trainers which turned me off from them. I branched out and got my own personal trainer in which I'm happy with. I shouldn't have to go through all of this to cancel a membership that I'm not using.Desired Settlement: I want them to cancel my membership

Business

Response:

The business has responded. Please see below:[redacted] is claiming that Retro Fitness is making it difficult for her to cancel, which is incorrect. I am extremely sorry that she had that experience, however, we here at Retro Fitness pride ourselves on customer service and we try very hard to make every aspect of membership as smooth as possible, including cancellation. She claims that due to her work schedule she can not make it into the club to fill out the cancellation paperwork, however, Retro Fitness is open from 4am to Midnight Monday through Friday, from 6am-10pm on Saturday and from 6am-8pm on Sunday. Therefore, we are available for her to come cancel either before work, after work, or on one of her days off. This should not be a tremendous inconvenience considering that [redacted] lives less than a mile away from the club. Therefore we do not find it to be unreasonable to ask someone to come in and cancel. It is important for us to have their cancellation in writing because our agreements are legally binding contracts, therefore we need to keep their records complete and accurate. However, as detailed in her contract, should she not be able to make it in person she can always send a letter, certified mail to the clubs address requesting cancellation. Also, at no point did she ask to speak with the manager, because this is the first I am hearing about this attempted cancellation. As detailed in her contract she can cancel at any time after her minimum one year commitment by providing a 60 day notice. I will take her complaint with the Revdex.com as a request to cancel and put in her 60 day notice effective immediately. As such, she will be responsible for the months of October and November for a remaining total balance of $39.98, because this is a cancellation notice and not a penalty, she will have club access until December [redacted] and should feel free to use the club until then. Should she have any further questions, she can feel free to reach me directly at ###-###-#### between the hours of 11am and 8pm or via email at [redacted]. All the best, Iliana D[redacted] - General Manager of Retro Fitness of New Rochelle

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.

Sincerely,

Review: I signed up for a one-year contract with Retro Fitness last year in February. They told me that I would only be paying for 12 months and would have access to the gym for another two months after my year was up and I would not have to pay any additional payments for those two months. They told me I needed to pay for the first and last month, which was a total of $40.00. I paid that day. After my 12 months were up, they continued to charge me $20.00 for two months after my contract was supposed to be done, total of $40.00. I went into Retro Fitness and told them I wanted to cancel my membership because my year had been finished two months prior and I was still being charged; those two months were supposed to be free. I signed a cancellation form in May of 2014. The woman that was helping me gave me the form and told me to write down the reason for canceling and sign it. So I wrote why I wanted to cancel and signed my name at the bottom. She took the forms back and said it was to write her initials. I took my copy and left. For a couple of weeks now I have been getting calls from the Collection Agency. I did not recognize the number so I did not pick up but when the calls got excessive I finally answered. The representative on the phone told me that my balance with Retro Fitness is $108 and change at the moment. I then looked at the cancelation form that I signed 3 months prior, and it said to cancel my service as of July 2014. That was not written on the cancellation form when I signed. So they had charged me for 4 months and added up late fees, adding up to $108 and change. The representative that I spoke to, from the Collection Agency, was really rude and was not willing to listen to me at all.Desired Settlement: I want my bill to be waved and I want the Collection Agency to stop calling me. The employees at Retro Fitness have always been rude to me and did not help me when I had a problem with them, they did not try to make it right. I do not want to pay that gym $108.00 because I feel like they were being dishonest.

Review: My husband, [redacted], visited this location on January *, 2014 and filled out paperwork cancelling his membership. The employee told him he would still be charged for 2 months, and his last charge would be March *, 2014. However, we were still charged in April and May. We called the [redacted] location in May and spoke with a [redacted] - they said they would stop billing us, and we would be refunded for April and May. It is now July - not only were we NOT refunded, but we were also charged for June and July. I have been calling the location and leaving messages for a [redacted] to call me back, but have not gotten a response. The employee I spoke with today, Friday, said a [redacted] was only in for 4 hours today, and will not be in again until Monday afternoon. This is very frustrating and I would like it to be addressed so we can get refunded! There is no corporate number to call, so I am stuck waiting for a [redacted] to eventually get back to me - and in the past that has not been successful in fixing this issue.

Thank you!!Desired Settlement: We would like to be refunded for April, May, June, and July - and to stop getting charged from now on.

At this time, I have not been contacted by Retro Fitness regarding complaint ID [redacted]. I did call them again to inquire about my request, and I was told the account was finally cancelled. However, we did not receive the 79.96 refund we were supposed to receive weeks ago. A [redacted] was supposed to return my call, and I have yet to hear from her for about 2 weeks now. I will continue calling until we receive the refund for the 4 months we were incorrectly charged for.

Sincerely,

Review: I joined Retro Fitness in April of 2013 for exactly 15 minutes. I decided not to be a member after 15 minutes and [redacted] ripped up my membership and took back my swipe card saying"No problem." She never took my charge account number out of the computer so as of now I have been billed for 5 months of membership without ever being a member. [redacted] has been stealing my money because I am not a member.Desired Settlement: I want a credit card refund and I want her to stop charging my credit card for a membership I don't have. She is stealing my money.

Review: In April 2013, I cancelled my GYM membership with Retro Fitness in East Meadow NY. My GYM membership included myself, and my son at $19.99 each. When I filled out the cancellation form, they explained that their cancellation policy included a 60day period from the date of the cancellation form in which I would still be charged my monthly fees by ABC Financial. I was told that after that time period, the membership would cancel without any further action needed. On or about July *, 2013, I contacted Retro Fitness of East Meadow NY to ensure that both accounts were in cancellation status. They assured me that the both memberships were cancelled and that I would not be billed anymore. Today, July **, 2013 I checked my online banking statement, and it shows a charge for $19.99 by ABC Financial. This is unacceptable. I have taken every measure possible to avoid this. I continue to get the run around and I have spoken with [redacted] the manager at Retro Fitness in East Meadow who continues to reassure me that everything will be fine but I get no results. This is a common problem with Retro Fitness as well as ABC Financial. I have called the Customer Service numbers for Retro Fitness as well as their Corporate offices and no one returns my call. Based on my research online, there are many consumers experiencing this same problem with this company.Desired Settlement: I want a refund of my $19.99 that I was charged in error. I want ABC financial to stop billing me. In addition to my refund that I am due, I want monetary compensation for the inconvenience that this has caused. I use this same account to pay my bills and with ABC Financial withdrawing money out of my account, it is setting me back financially.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]

Retro Fitness failed to inform you that although they claim the cancellation was processed, they are still charging me after the fact. Based on their 60 day cancellation period, the last charge should have been on June **. However, they charged me $19.99 on July **.
