(The consumer indicated he/she DID NOT accept the response from the business.)
Thisseems to be a generated response I see on every complaint ive readi feel like this company depends on misinformed people and getting anything they can before people catch on to whats happeningi seen a similar case where the customer was lied to about credit reporting practicesin my response you say you reserve the right, but you are not reporting at this time and of course put the blame on the storeyou also send the generated message about terms and conditionsnowhere in the terms and conditions does it say you dont report to creditalso the store owner filled out the credit application with me and my wifes info and told us what amount we were aproved forit wasnt untill after the transaction we seen the terms and conditionsat least you can have some empathy for someone that put good faith into your partnership with the store and expected something that was promised in exchange for the exceptionally high priced terms to have the credit reportedNow you are telling me in the email you apologize for any confusion regarding this matterevery response ive seen starts like that, and then states the options everyone hasplease have some empathy for people that trust in your services, and when they are mislead and lied to for the sake fo self gain instead of actually offering a good solution with a single positive be more acceptable of making it rightalot of people that use your services are low income or lower credit holding people trying to better their situation or just trying to obtain a phone
now if you care about you Revdex.com rating of how a customer has been deceived between your business and the storefrontinstead of blaming each otherjust implement a way that storefronts address the trems and conditions BEFORE they approve and sign contracts
at least I would have offered a partial refund of 50% since the fault could be equally on both our parts
The phones were safely repackaged and sent out days agoi hope we can come to a settlement on this matter for me and my wifes account and this case doesnt end up unresolved like every other case on here

We were unable to locate an account in our system associated with this customer's information
If they provide the name, email address, phone number, or application number associated with their account, we'd be happy to look into
their case
In addition, their desired solution only said "For them to come up with some type," which we assume was cut off earlyIf the customer responds with a complete request, we would be better equipped to serve them

The following email was sent to the customer on 5/19/15:
Hi ***,
My name is *** and I am contacting you in response to your complaint with the Revdex.comIn reviewing your complaint, it seems as though there was
some confusion with regards to the terms of your lease
The lease you agreed to came with a days BuyOut Option that ended 05/06/2015, not a days same-as-cash optionThis means that if you were to make payments equivalent to the price of the phone including a 20% BuyOut fee before 05/06/2015, there would not more lease payments due on your lease
This information, and other information about your lease, is included in the Terms & Conditions associated with your lease (attached to this email) that was available before the lease was agreed to and continues to be available in your online SmartPay account at https://home.smartpaylease.com/login
If you feel that you were misinformed about the terms of your lease, we suggest that you return to the store where you agreed to the lease and speak to a store managerWe find that this is the most effective way to resolve issues like this
Please do not hesitate to contact us with any other questions or concerns
Thank you,

Good morning:
My name is *** ***, I currently have an open complaint against SmartpayI have a Balance with them of $I have made numerous attempts to make my payment of the remaining balanceIm honestly terrified to leave my debit card on file, with the fear that they would withdraw future unauthorized paymentsThere website is set up for payment of $that I never agreed toI don't want this to affect my credit historyThere representatives are rude and agrressive when you speak to themI would like to resolve this issue as soon as possible
Final Business Response /* (4000, 12, 2015/05/27) */
The customer seems to have directed one of their complaints relating to another company to ours (something to do with shipping boxes)In response to their other complaint, the customer is claiming that SmartPay is denying them a days same-as-cash option, which in fact was never part of their leaseThis was communicated to them in the Terms & Conditions associated with their lease as well as on several calls the customer made to our customer support centerAn excerpt from an email sent to the customer on this matter:
Additionally, our records indicate that on February 7th, you called our customer support center inquiring about return optionsThe notes from the call show that the day BuyOut option was discussed, as well as the deadline (5/6/15), as well as the 20% fee that comes with it
The next day, on February 8th, our records show that you called again to set up the BuyOut option and the notes show that it was communicated to you that the BuyOut needs to be requested manually before the deadline when you are ready to complete it and that it comes with a 20% fee

Dear ***,
I want to apologize for any confusion regarding your month SmartPay lease to own programFor your reference, I have attached a copy of your Lease Terms and ConditionsPlease note, these Terms have always been available
for your review on your customer dashboard, located smartpaylease.com/login(I've attached a copy of it to this email>)
As per your lease agreement, you agreed to make payments of $18.36, and at the end of the term, you would own the items listed below:
Samsung Galaxy Avant blue hard case*
Scheduled payments include rental fees and taxes, in addition to a portion of the retail price of the items
You should have received emails and text messages from us regarding your payments
When you called us on 08/29/2015, you had completed out of paymentsA Customer Support Agent reviewed your lease details with you over the phone, and at that point, you requested to process a BuyOut for the amount of $to complete your lease
By processing a BuyOut, you saved on total feesWith the BuyOut option, you paid a total of $(If you had remained on your original payment schedule until all payments were completed, you would have paid a total of $
Therefore, we are unable to refund you the amount requested
I apologize for any inconvenience this *** cause
Thank you very much for using SmartPay

Customer was sent the following email on 4/15/15:
Hi ***,
My name is *** and I am in charge of handling complaints filed with the Revdex.comI've had a chance to review your complaint and wanted to reach out to you
to clarify a couple of items
Although you cannot make custom payment amounts, you can make as many payments equalling to your regular monthly payments as you wantBy using these payments you can incrementally reach the early payment amount you wished to pay (example: making $payments to cover a $early payment that you might want to make)
Separately, the BuyOut option for your lease expires on XXXXXThis means that should you wish to pay your lease off early, you still have plenty of time to do so within the BuyOut period
Please do not hesitate to contact us with any other questions or concerns

(The consumer indicated he/she DID NOT accept the response from the business.)
the smartpay website would not allow me to change my payment method when I went to do that before my payment was dueI wanted to change the card that was going to be charged and it would not allow thatThere is no reason that my efforts to pay this off early should be so frowned upon
my point is when I went to put the down payment on my phone it said the total would be $nowhere did it say I would be charged more than $for a $phone
Final Business Response /* (4000, 9, 2015/04/17) */
The following email was sent to the customer on 4/15/15:
Hi ***,
With regards to the issues you are having with changing your payment method, I'd be happy to call you directly and help you do that from our end
Regarding your second claim about the price of the phone, the lease payments we charge are for use of the leased items over the length of the leaseYou can end the lease by making all payments over the next year (which, like you stated, would total $805.28) or you can exercise an early purchase option at any time, which would cost less in fees depending on when you did it (if this is done before 06/17/the fee would be an additional 20% for a total of $644.84)
All of this information was summarized in the checkout page of the StraightTalk website (as well as in the Terms & Conditions), before you agreed to the leaseThis information is also available in your online SmartPay account at https://home.smartpaylease.com/loginWe designed the summary to be as clear and informative as possible and feel that in combination with the Terms & Conditions document, fully describes the terms of the leaseIf you feel that it is misleading, we are happy to accept any feedback you may have
Please do not hesitate to contact us with any other questions or concerns

Our system shows that you were leasing the following items:

SmartPay is a lease-to-purchase program that spreads the cost of your smartphone and other items over multiple payments(Your total number of payments depends on your lease term and approval amount.) EMAIL RESPONSE FROM SMARTPAY CUSTOMER SUPPORT ON MARCH 13, 2014:
Hi ***
Thanks for contacting SmartPay Customer Support
You can save on total fees when you request an Early Payoff
Here's how it works:
An Early Payoff made within the "same-as-cash" period means that you will pay only for the retail price of the phone (as if you had paid for the phone in cash at the store)Monthly payments already made are applied to this retail price
Customers on a 6-payment plan have a days same-as-cash period
Customers on a 10-payment plan have a days same-as-cash period
If your "same-as-cash" Early Payoff period has already passed, you can still save on the total fees by paying off earlier than the term of your leaseSince your monthly payment includes rental fees and taxes in addition to a portion of the rental price each month, an Early Payoff allows you to save on these fees for future months
An Early Payoff, including the day and day same-as-cash option, is NOT automaticIf you don't request an Early Payoff, you will remain on your original payment schedule
An Early Payoff must be requested (at least hours before your next due date), and it is processed as a single transactionIf a payment is already in progress, you will not be able to process an Early Payoff until the payment is completed
Also, if you have any overdue payments, you will need to make those payments before processing your Early Payoff
Your Early Payoff Amount is: $
Your same-as-cash period ends on: 04/02/
To authorize your Early Payoff request, please contact our Customer Support Team or follow the steps below
To process an Early Payoff:
Go to home.billfloat.com
Enter your email address and password
Click the purple "Make Payment" button at the bottom of the page
A window will pop upSelect "Early Payoff Amount."
Check to see that the correct debit card is selected from the drop-down list
Click "Make Payment"
Once finalized, an Early Payoff request can't be cancelled
If you decide not to process your Early Payoff, please note that you are on a 10-month payment plan and have payments left
Payments are collected approximately every weeks, based on the pay date that you indicated during the application process
Your monthly payment includes rental fees and taxes, in addition to a portion of the retail price of the phoneFor further details, please review the Terms & Conditions you signed when you applied for SmartPay
Here are the due dates for your remaining scheduled payments:

In regards to your question about the details of your lease, as I mentioned in my previous email, SmartPay is a lease not a loanWith a loan, you are given actual funds that you can spend on what you'd like and you repay that amount with interestWith a lease like SmartPay, you are approved for a leaseThis means that you can use the funds you are approved for to select certain items to leaseIn your case you were approved for redacted for privacy which you used to select a redacted for privacyThis item was purchased by SmartPay from the store and leased to youThe payments you are making to SmartPay are lease payments which, if made in full, culminate in you owning the leased itemsIn total, the lease payments amount to more than the in-store price of the phone, however a free day BuyOut option (ability to pay for the items at their in-store price) was also available
The screenshots I provided explain why the payments we collected were done so on certain datesIf you need any more clarification, please let me know and I'd be happy to explain any parts that are unclear
Thank you,
SmartPay Customer Support Team

* An Early Payoff is NOT automatic
* If you don't request an Early Payoff, you will remain on your original payment plan

Final Consumer Response /* (4200, 11, 2015/11/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I want a recording of that phone call because the only time the full terms of the entire contract was went over with me was when I called in last monthother than that I was only told that I was paying a month until the bill which was only around dollars was paid in fullAt no time was it mention that it was payments or that there was an outrageous rental feeI have explained what I wanted to happenI was not confused by anythingI was misinformed and lied towhen I first made my complaint I cintact ed your company and spoke with a gentleman who wouldn't not give any payment information over the phone which I found oddhe said that he would email and mail that information to meI have not received said information at allI am contacting my local news outlet today about thisI have already sought legal counsel and if a penny more of the original amount of the phone and accessories is taken out of my account I will have to seek further legal actionI have been lied to and I am considering this fraudNowhere else is there a rental fee that will cost the same amount of the items you purchased once you are done paying for itthat's all I will say about this matter until I need to again which I hope will not have to proceed with any legal action

This company is horrible, a bunch of scam artists After realized they were trying to dupe me out of for a $phone, I immediately canceled But it was too late, they already charged my card $for the first of payments I am stil trying to get that first payment back, and all I can get are dead end automated email responses and the run around on the phone Also, corporate DOES NOT HAVE A PHONE NUMBER only an email DO NOT do business with these scammers, they need to be shut down
