Dear [redacted],
Thank you for contacting SmartPay support. I want to apologize for any confusion regarding your 24-payment SmartPay lease to own plan and BuyOut Option. For your reference, I have attached a copy of your Lease Terms and...

Conditions. Please note, these Terms have always been available for your review on your customer dashboard, located smartpaylease.com/login.
As per your lease agreement, you agreed to make 24 payments of $78.84 (with the exception of your upfront payment), and at the end of the term, you would own the items listed below:
- Samsung Galaxy S6 - $549.00
- Samsung Galaxy S6 - $451.00
Scheduled payments include rental fees and taxes, in addition to a portion of the retail price of the items.
An BuyOut/Early Payoff allows you to purchase the items prior to the end of your lease term by processing a lump sum payment for the remaining retail value of the items leased. This option is available at anytime during the lease term.
(Your SmartPay offer included a promotional BuyOut Option with a fee of 20% of the retail value of the items.)
On December 28, 2015 you requested to process a BuyOut for the amount of $1,003.32.
By processing a BuyOut, you saved on total fees. Since your scheduled payment includes rental fees and taxes in addition to a portion of the retail price of the items, a Buy Out allowed you to save on these fees for future months.
As the BuyOut was requested (and processed within the promotional BuyOut period), we are unable to refund you for a portion of the payment. We apologize for any inconvenience this may cause.
You can view your SmartPay account information, including your payment dates and Terms & Conditions, by logging into your dashboard at SmartPayLease.com/login. For further questions, contact us at XXX-XXX-XXXX or visit SmartPayLease.com/help.

Dear Mr. [redacted],
Thank you for contacting SmartPay support. I want to apologize for any confusion regarding your SmartPay Lease. Due to state regulations, we are unable to offer residents of [redacted] a lease to own program. This...

information, as well as the terms of your SmartPay lease are explained in detail in your lease Terms and Conditions and on the screen when you applied and accepted the terms online. For your reference, I have attached a copy of your Lease Terms and Conditions. Please note, these Terms are always available for your review on your customer dashboard, located smartpaylease.com/login.
As per your lease agreement, you agreed to pay $86.97 for the first 9 months of the lease, and if you chose to return the items during the lease period, you would pay, an Early Termination Fee equivalent to fifty percent (50%) of the cost of the leased equipment. After the first nine months of the Initial Term, you may terminate this Agreement and cease incurring further rental charges by returning the Property to us, however you will remain liable for rental charges incurred prior to returning the Property to us.
Below is a list of the items SmartPay leased to you:
*Samsung Galaxy Note 4 4G LTE*
As of today, you have made 3 lease payments. If you would like to terminate your lease early, you may do so by returning the items and paying an Early Termination Fee of $299.50. We have enclosed a return label for your connivence.
If you do not wish to terminate your lease, you may keep the items, and continue paying rent. In 6 months, your early termination fee will no longer apply, and at that time, you may return the leased items at no additional expense.
Thank you again, and I hope this information is helpful.
Best,

(The consumer indicated he/she DID NOT accept the response from the business.)
SmartPay Lease, I feel misled by your terms and by the application process. If I would have known I would be renting a phone I would have NEVER came to the application.
And has a result of it, losing a customer for the fact of the application did not state the terms that you mentioned from the State of [redacted].
You are here by notified through Revdex.com that you are NOT authorized to bill the credit card on file since your company refuses to remove the credit card and I was refused to pay the total of the bill. Any attempt to bill the credit cards on file will be subjected to fraud by SmartPay Lease company.
From this point on everything by your company will be sent directly in writing via US MAIL including billing.
Your representatives lied to me in writing from the online chat sessions and NEVER mentioned I would be leasing from Quality One Wireless since Quality One Wireless got paid by you at SmartPay.
My lawyer will be in touch soon after review since your really Smart RipOff that hides behind a desk. Further adding a report will be made on ripoff report.com regarding your poor company standards.
Close the case unless you want to settle this immediately.
Under no circumstances has any legal issues been filed regarding this issue at this time.
FYI: I was approved for $700.00 for over a $1000.00 during the course of the yearly payments of 12 months even after the initial down payment. Never no interest percentage stated or balance of said product.
Thank You
Sincerely Yours,
Final Business Response /* (4000, 9, 2015/08/06) */

On 3/13/14, the following email was sent to the customer:
Hi [redacted]
My name is [redacted] and I'm in charge of handling complaints filed with the Revdex.com. I've had a chance to review your complaint and your history with us....

As you have noted, the payment plan that allowed you to leave the store with the phone for a lower price than the full price of the phone is the SmartPay lease-to-own program, and the payment you made was the first of 10 payments of $132.82 required to complete the lease (with the option to pay off early at any time).
To date, you have completed 4 of the 10 payments of $132.82 and you are $199.23 (1.5 payments). Once you have brought your account up to date, you have the option of paying the lease off early, which is a cheaper option than paying all 10 payments all the way through.
Furthermore, we have reviewed your contacts with us and we have only one record of a call from you to our call center. Our notes show that the call was made on February 24th and the agent informed you of the option to pay off early.
Please feel free to respond with any questions or concerns.
Thank you,

Dear [redacted],
Thanks for contacting SmartPay Support.
We take helping our customers very seriously, and when a customer reports an error like this, we want to make certain we investigate it properly and correct it as soon as...

possible. In order to do this, we will need a copy of the following documents:

3. If your debit card information was stolen, we need a document from the bank stating that the card was compromised because of fraud and cancelled.
Please fax a copy of the document to XXX-XXX-XXXX, ATTN: Customer Support. Dear [redacted],
Thank you for contacting SmartPay support. I want to apologize for any confusion regarding your 18-payment SmartPay lease to own program. For your reference, I have attached a copy of your Lease Terms and Conditions....

Please note, these Terms are always available for your review on your customer dashboard, located smartpaylease.com/login.

*Motorola X (1st Gen)*
As of today, you have made 7 of your 18 payments. As stated in the Terms & Conditions you agreed to when you applied for SmartPay, the payments are due *every other week*. Below, please find a list of your remaining payments and their due dates.

Your SmartPay lease agreement allows you to purchase items by leasing over a set period of time, but it also allows you to terminate your lease at any time. You may do so by choosing one of the following options:
1. Processing an Early Payoff
An Early Payoff allows you to purchase the items prior to the end of your lease term by processing a lump sum payment for the remaining retail value of the items leased. This option is available at anytime during the lease term. As of today, your Early Payoff amount is $118.01. Due to the confusion regarding the Early Payoff Option and your lease, I can offer you a temporary discount. If you process a payment for $104.52 before 01/06/2016, we will consider your lease complete and you will own the items listed above.
If you wish to take advantage of this offer, please reply to this email with the date you would like the payment processed.
If you decide to accept the offer, we will apply your scheduled payment due on 12/30/2015 toward the Early Payoff amount (if it is successfully completed).
2. Returning the Leased Items
You may terminate your lease by returning the leased items at anytime during the lease period. Once the items are received in good, working order, your SmartPay lease will be terminated, and you will not be charged for any future lease payments. For your convenience, I have attached a pre-paid FedEx label, if you chose to exercise this option. Please be advised, in order to suspend your payment due on 01/08/2016, the items must be received by 01/06/2016.
Thank you again, and I hope this information is helpful.

Initial Consumer Rebuttal /* (3000, 7, 2016/01/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This is not a question of the payment schedule. As stated in the initial claim, the companies website showed that there was an early pay off option for the amount of 56.41 until 12/18/2015. when I went online to do the payment of 56.41 the company changed the amount of the payment and the date that was allowed. In the lease contract it shows that I had until 12/25/2015 to do a 56.41 payment for early buy out. I even received a phone call from [redacted] ([redacted], whom is part of the companies collection department she informed me. She looked over the lease contract and said "I agree that the lease shows you have until 12/25/2015 to make a $56.41 early buy out payment, but I spoke to my manager and I am not allowed to honor that lease agreement." I had the phone call on speaker phone so that other parties could hear the entire conversation. So the issue still remains that if their own employee sees that I was supposed to be allowed to make a $56.41 payment for the early buy out, and is aware that someone at their company changed the date and amount on the website to benefit the company, why is the company not honoring the very lease that they gave me. I am still more than happy to hold my end of the lease and pay the $56.41 - 17.42 (12/30/15 payment that has been processed) for a total of $38.99 as of now. I am going by what the companies own lease states and what I am told from one of their collections department employees has said. If you look at the terms of lease it also states under (section .23)that a payment of $17.42 would be due (per month). The company has been deducting that amount bi-weekly. so this company has not held up their own lease in more than one way. I would really like to know how many other customers they have tried to do this to also.
I have sent 10 emails to this company regarding the issue at hand. I have not received any valid response too this issue. I have asked many times for a contact number other than the customer service number so that I can talk to someone that can help resolve this issue. I am told that there is no contact number and that all contact has to be made through email. I have sent many emails with no response from them.
Final Business Response /* (4000, 10, 2016/01/07) */
Hi [redacted],
We are willing to make an exception in this case and extend the offer until 01/15/2016. However, you do have a scheduled payment due on 01/08/2016 (not on 01/15/2016). What we can do is apply that payment to the $87.10.
(This means that if the payment due on 01/08/2016 is successfully completed, we will collect $69.68 on 01/15/2016 from your "Primary" payment method on file.)

I do not accept the response from smart pay because I never agreed to lease a cell phone or rent a cell phone which is what I was told by smartpay. metropcs and smartpay both know that there was never a rental or lease as metropcs doesn't rent or lease anything. I even went to the store and told them that smart pay stated that I was renting the phone and they had never heard of a rental agreement. so the information that was provided by smartpay is false and fraudulent and the phone only costs [redacted] not 1071
I also had a witness with me when I went to the store and my witness will tell you also that metropcs told me to my face that they never heard of a rental agreement or lease agreement

Dear Ms. [redacted],
Thank you for contacting SmartPay support. I want to apologize for any confusion regarding your 12 month SmartPay lease to own program. For your reference, I have attached a copy of your Lease Terms and Conditions. Please note, these Terms are always available for your review on your customer dashboard, located smartpaylease.com/login.
As per your lease agreement, entered into on April 22, 2015, SmartPay purchased the items listed below for a retail value of $473.98 and you agreed to make 1 payment of $71.09 and 23 payments of $43.46, and at the end of the term, you would own the items.
It appears you decided to exercising your Early Payoff Option on July 21, 2015. This option allowed you to save $503.90 over the course of your lease. It also completed the purchase of the items from SmartPay.
Just for your reference your SmartPay lease agreement allows you to purchase items by leasing over a set period of time, but it also allows you to terminate your lease at any time. You may do so by choosing one of the following options:
1. Processing an Early Payoff
An Early Payoff allows you to purchase the items prior to the end of your lease term by processing a lump sum payment for the remaining retail value of the items leased. This option is available at anytime during the lease term.
2. Returning the Leased Items
You may terminate your lease by returning the leased items at anytime during the lease period. Once the items are received in good, working order, your SmartPay lease will be terminated, and you will not be charged for any future lease payments.

galaxy s4 dimend case

Thank you again, and I hope this information is helpful.

Final Consumer Response /* (4200, 20, 2015/08/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Smartpay continue to stress about terms and contract but I was never aware of the terms and agreement from the retailer. He simply said I have 90 days to pay off the item in full that's the purchase price he was referring to and I specifically asked him if I had to pay any interest he said NO . That was not the case he lied . That's very misleading to customers . The pamphlet at store also says no interest same as cash. Meaning the purchase price of the item and nothing extra so that's misleading . Customers are not aware of what they are getting themselves into when purchasing items on credit. Some retailer's are very misleading just to make a quick buck. Terms should be explained to customers and not be hidden or changed to trick customers. This is very unfortunate and I've learn my lesson . I will not be doing business with smartpay ever again and I'll be informing others not to as well.

(The consumer indicated he/she DID NOT accept the response from the business.)
They offered to cancel the last payment which is simply not good enough.I have already paid this company $392.40 as of January 17,2014.The phone only costs $299 retail price, $331.00 after taxes according to the boost mobile/ smart pay receipt which I still have.As January 2014 Boost mobile no longer does business with this company because of their very shady business practices. They have continued to charge my account for the past 5 months in the amount of $78.48 per month which totals another 392.40. The least amount of money I will accept is $250.00. If this issue can't be resolved soon I will be contacting my lawyer to see about suing this company for emotional distress.
Final Business Response /* (4000, 9, 2014/06/17) */
customer was responded to via e-mail

SmartPay is a scam....period. I cancelled my order before the phone was to be shipped but SmartPay debited my credit card anyway and won't refund the money. Worse yet they refuse to cancel future payments from my CC even though I cancelled my order and never received a phone. Read all of the complaints about this company before you place an order. They are numerous and consistent.

The following email was sent to the customer on 7/14/15:
Hi [redacted],
My name is [redacted] and I'm in charge of handling complaints filed with the Revdex.com. I've had a chance to review your complaint and account history and...

wanted to clarify a few things.
Per the Terms & Conditions associated with your lease, which were agreed to at the time you agreed to the lease, the dates that your lease payments would be collected on are as follows:
"4. RENEWAL PAYMENTS AND ELECTRONIC PAYMENT AUTHORIZATION: You are not obligated to renew this Agreement beyond the initial term. However, you can renew this Agreement beyond the initial term, or beyond any subsequent renewal term, by making an advance rental payment on or before the renewal date.
Your renewal payments are due Renewal dates: 02/19/2015, 03/19/2015, 04/16/2015, 05/14/2015, 06/11/2015, 07/09/2015, 08/06/2015, 09/03/2015, 10/01/2015, 10/29/2015, 11/26/2015"
Please note that the Terms & Conditions were available as part of the application before the lease was agreed to, continue to be available in your online SmartPay account, and have been included as an attachment to this email for your convenience.
Lease payments for your lease are collected once monthly as a result of a choice that was selected in your SmartPay application. Additionally, as you now know because you have exercised this option already, lease payment dates can be adjusted up to 7 days for your lease, if requested at least 2 days before the collection date.
Please do not hesitate to contact us with any other questions or concerns.
Thank you,

I went to Metro PCS on [redacted] in [redacted], Fl and purchased a phone under the services of SmartPay. They offered me the option of a payment under 90 day same as cash, but when I went home and contacted SmartPay I learned that id was a scam. They refused the 90 days same as cash payment. They tried to make me go through all the payments, which included the $630.00 for the phone, 20% of interest, and the additional $120.00 I had already payed previously as a down payment; despite and on the contrary of the information they had provided me with.
