Mr [redacted] signed up for a year contract on 6/8/The signed contract is attachedHis website was built and published on 6/13/The website that was generated was the same website that was shown to Mr [redacted] during the sales presentationHe had full access to the PropertyPulse back office to make updates to his website, but any changes outside the template would incur a graphic design charge as that is not included in the PropertyPulse packageAll clients have access to inbound phone support Monday – Friday and email support at [email protected] show that Mr [redacted] did utilize phone support some times and his calls were always answeredWe also show that he utilized the email serviceWe could not find any requests that have been unaddressed and we would like to find out how he was contacting Zsince we were unable to find any records outside the ones that have been answeredWith the program there are some automated emails that are sent from client accounts to their contacts that show the latest homes on the MLS home searchThese emails are sent from a noreply email address, but all other emails sent on Mr [redacted] ’s behalf had a reply optionThe program is also an organic product so it does not come with automatic lead generationIn order to see results, clients do need to spend at least 2-hours per week marketing their websiteHowever, we show that Mr [redacted] generated 30+ leads in January aloneNot all of these leads will be ready to buy a home immediately and some leads will be fake as is the nature of working with online leadsMany online leads are in different states of the home buying processZResolution: Mr [redacted] is currently ineligible for a full refundMr [redacted] is generating leads (even though that is not a requirement of the contract), has a working website and a functioning PropertyPulse accountHe has unlimited access to inbound support at 800-899-xor [email protected] Mr [redacted] is still under contract until June and in order to cancel, he will need to place a verbal cancellation request to the number listed above as per #in the attached contractWe would, however, like to offer Mr [redacted] a free month of hosting for his April chargeWe will submit that waive immediatelyWe look forward to hearing from Mr [redacted] and helping him get the most out of the leads he is currently generating

Majority of MLS boards require a broker signature in order to provide IDX on an agent websiteThis is standard in the industry and if a Realtor went to any website vendor they would have to complete the same paperwork and the same processThis is rules dictated by the MLS and not by ZWe do inform the client that they must complete IDX paperwork in order to obtain the home search but this information is considered a courtesy since it is an industry standard practice and a rule in place for any website company and real estate agentMs [redacted] signed up in April and the website was canceled in June so she was not a client long enough to see resultsHer account is a website and social media package that depends on organic results and does require interaction and effort from the client in order to see resultsMs [redacted] did not sign up for a paid traffic program that automatically generated leads with no effortOverall, we do not guarantee results and we do not promise full refunds if no results are generated.Resolution:The initial offer still standsThe account is canceled and there will be no additional bills from ZMs [redacted] is not eligible for a refund of her setup fee as her website

At this point Ms [redacted] is not eligible for a full refundWe have provided the contract and the audit report that shows that Ms [redacted] did in fact review the terms and conditions, signed them and was emailed a copy right after signing themWe also made several attempts to get in touch with Ms [redacted] to get her account setup but it was she who declined because she wanted to speak to her sales repMs [redacted] will not receive any additional charges from Zmoving forward

We canceled Ms [redacted] 's account on 8/15/16, however because of our day notice, we always provide a full days of service from the last bill dateThat means Ms [redacted] 's account wasn't officially deactivated until 9/25/So by the time of this response, that request has been taken care ofWe also searched the entire system and do not see the double charge that Ms [redacted] was referring toHowever, a bank statement was produced by Ms [redacted] that does indeed show a double charge so as an act of good faith we will refund $49.99.Please allow 7-business days for this to appear back on the credit card

The recordings of the sales call and the Fast Start appointment with the account manager were reviewed again and it was clearly stated that the program was for guaranteed trafficAt no time did the sales rep nor the account manager say the program guaranteed qualified leadsOur average clients see a 5-10% lead conversion rate which is what the client may see with the programIn the original response, we stated this was a average and Mr [redacted] may see 10-leads a monthThis was never guaranteed and the results will vary month over monthIn June Mr [redacted] received leads and in July he received leads so he is very close to the overall averageThe program drives paid traffic using [redacted] and [redacted] Adwords to the clients sitesWe run sponsored ads that are served to prospects based on their [redacted] or [redacted] search criteria and past historyThe prospect is then driven to a landing page where they input their information then are automatically forwarded to our clients websitesWe cannot provide any leads where they haven't voluntarily submitted their contact informationKeep in mind with internet leads, some leads will be fake and others will be valid and most take several months to convert into a home saleWe cannot and do not guarantee that all leads will be qualifiedOur policy, which is standard with any company that records calls, is to not provide recorded calls to clientsThe original resolution still stands and Mr [redacted] is still under contract for his SEM program until November when his program will convert into a month-to-month agreement until a verbal cancellation request is madeWe would, however, like to spend more time with Mr [redacted] reviewing the program and the best practices for working internet leadsMr [redacted] has already received leads so far this month (organic, paid) with 1/weeks left of his traffic cycle so we would love to help him get the best outcome from his current results

ZResponse:Mr [redacted] signed up with Zon 2/24/and signed Terms and Conditions which are attachedMr [redacted] claims that his identity was stolen and this is how he got signed up with ZAlso attached is the audit history of the Terms & Conditions that shows his hotmail email address and an IP that tracks to his area in AZ opened, viewed and agreed to Z57's termsThe client also provided a .csv file of his contacts to upload to the system on 2/25/Mr [redacted] notified Zof his "identity theft" in Febat which point his account was immediately canceled.ZResolution:While Zbelieves that Mr [redacted] was in fact the person who signed up since we were provided his credit card, his contact database , agreed to terms from an IP in his area, etc., we are sympathetic to his recent challenges We are more than happy to comply with his request to deactivate his website, stop all automated emails and discontinue and marketing done on his behalfZwould like to wish Mr [redacted] the best of luck

They don't answer the phone, after just several days of realizing I had been taken, I tried to cancelThey make it nearly impossibleI was told there was no way out, I signed it and now I owe them the full amount for a yearIf I don't pay them they are sending the debt to a collection agencyI believe the way this company does business is criminalI would rather take several thousand dollars they claim I owe them and organize a class action lawsuit with all the offices and agents they prey on around the CountryThey have so many complaints on the web that they (in my strong opinion) put up a bogus review page of agents happy with their service to trick an unsuspecting person into their web of liesI want to be released from the contract at no cost as I have been trying to do just days after being lied to and tricked into signing it Regards, [redacted]

Z57 Response:Ms. [redacted] signed up for a Elite package on 2/11/16. She signed up for a one year contract which is attached. Also attached is the audit history of the electronic signature which shows the email address that opened and signed the agreement as well as the IP address associated. After... reviewing the recorded sales presentation it is confirmed that the sales rep verbally confirmed the 1 year contract with Ms. [redacted] during the sales presentation and she confirmed she understood. He also went through her through all the other major items of the contract including the $25 admin fee charged clients who opt to do a split setup payment (Payment is charged over two months instead of in one lump sum), the cancellation policy and copyright infringement. Ms. [redacted] was not signed up with IDX at the point of sale. Ms. [redacted] was told during her sales presentation that we can setup IDX on her MLS board with a direct fee of $10 from RealComp and a $10 pass thru fee charged by Z57, which would be an additional $20 per month. Ms. [redacted] opted out of this so the showed Ms. [redacted] several examples of framed in solutions that use the standard RE/MAX home search. Ms. [redacted] was not only verbally shown this information but also visually shown the framed in search using a Join.me presentation. After purchasing the product, Ms. [redacted] said she would like to transfer the domain that she had been using with Web.com. Any time you make an update the DNS (Domain Name Servers) to publish a new site there may be a change or drop in Google rankings. That would happen with any company that makes a change to the DNS. The initial website we provide is always the basic one and Ms. [redacted] would need to work with customer service to add on any of the custom information she wanted. This information was clearly communicated to her during the onboarding call. She was also on the phone with a onboarding rep when her site was published to the internet and agreed to that. SEO optimization does take time and we always quote worst case scenarios and it can take 6-10 weeks for a site to be re-indexed by Google and more time to regain previous ranking. Overall we provided Ms. [redacted] with the service she was sold. Z57 Resolution:Z57 provided all the correct expectations to Ms. [redacted] so she is ineligible for a refund. Her account was shutdown to do non-payment so her account currently has a past due balance of $409.48 which she is still liable for. We have still never received a cancellation phone call from Ms. [redacted] so she will be responsible for payments when her account was still active.

Because Mr [redacted] exercised his day right of rescission, the request had to be processed by his original sales repThere was a delay in getting the correct information to the sales department which caused a delay of the refundWe sincerely apologize that Mr [redacted] had to wait to received the refund he was eligible forHis request should have been handled within business hoursZhas refunded Mr [redacted] 100% of what he paid and he should already have that amount back on his cardThank you

Ms. [redacted] signed up for services on 9/8/2015 and agreed to terms and conditions the same day. The original transaction and sales pitch was for 1 MLS board to have IDX and the second board would have a "framed" in public home search. This is verified by call notes and the original receipt that Ms.... [redacted] referenced her complaint. I have attached a copy that shows only 1 MLS board associated with her purchase. If she had purchased more than 1 IDX feeds she would have paid an extra $20/month for each MLS board. The sales rep provided detailed information to the website production team on the date of sale stating to frame in the home search for the Itasca board and use IDX for RMLS. This was explained during the initial sales presentation as well. We did research into providing IDX to the Itasca MLS at the request of Ms. [redacted] on 10/1/2015. Ms. [redacted] was emailed on 10/2/15 by Z57's IDX Admin, stating that we would not be able to move forward with providing IDX to her MLS board. Z57 cannot move forward with this MLS board because there are not enough members to justify the development work it takes to sync up a new MLS board. This was explained again to Ms. [redacted] on 11/24/15 by email. Z57 Resolution:We would like to extend Ms. [redacted] 2 options.1) Keep her account and work with Z57. By agreeing to keep her account active we would be more than happy to extend 2 free months of service as a courtesy. OR2) We can provide a contract buyout option if Ms. [redacted] would like to discontinue services. She would need to cancel, pay a required 30 day notice plus a $150 early contract termination fee. If Ms. [redacted] takes option 2, she would see a refund of $569.94 This takes into account 5 months of service (4 total +30 day notice) + $150 buyout fee. We look forward to hearing Ms. [redacted] ' response.
