Ms [redacted] signed up with Zwith a one year contract on 10/11/The agreement she signed on 10/14/stated that she is responsible for full year of services with ZIf she canceled prior to that year she would still be responsible for payments for the remainder of the yearWe have attached a copy of the electronic terms Ms [redacted] signed as well an audit history with IP address time stamps for the signatureThe client then completed a hour Marketing Appointment on 11/1/which is after the date she states she canceled in this complaintThe client then called in to cancel her services on 11/20/due to "personal reasons" but a Client Development Representative let her know that she is in a one year contract and that if she canceled that day she would be responsible for the remainder of her contract in one lump sumThe client was not pleased with this answer but agreed to stay on board Ms [redacted] was then sent an email on 11/21/at 5:33pm that confirmed that she decided to keep her account open with ZThe first line of the email reads:Thank you! We are pleased that you decided to continue your relationship with Zand reinstate your ZprogramEffective immediately, we have rescinded your day cancellation request and have re-enabled all features and services of your programIf for some reason you have received this email in error, please contact us immediately so that we may rectify the situationIn order to cancel your account with Z57, you need to make the request via telephone to a Client Development RepresentativeAs of today, Ms [redacted] has not placed this call to cancel her servicesResolution:We will be more than happy to discontinue Ms [redacted] 's account once she places a verbal cancellation request as per the terms and conditions by calling 800-899-x

When Ms [redacted] signed up she signed up for one MLS board and that was RMLSOn the sales receipt Ms [redacted] attached to her rejection you can see that IDX functionality is only listed next to RMLS and there is no quantity listed as Itasca MLSThe sales rep made it very clear from start that she would only have IDX on RMLSMsStolz informed her sales rep that agents in their area enter all their listing into both MLS boardsMs [redacted] came on board knowing that we would only provide IDX to RMLSAt this point, we are still willing to offer the contract buyout but we can also waive the day noticeMs [redacted] requested to cancel her service on 10/but decided to stay on board with the solutions providedShe was sent a confirmation email at this time stating she had rescinded her day notice to cancelBecause she was happy with the product & solution at this time we are unable to provide her with a full refundResolution:Contract buyoutMs [redacted] has not called into request her cancellation but she notified us by email of her displeasure on 12/3/We will accept that as her cancellation dateThis means she would pay for Sept - NovWe previously calculated the refund amount incorrectlyMs [redacted] would be charged for months of service + the contract buyout amount of $This would provide her with a refund of $

Ms [redacted] signed up for a executive package with a one year contract on 6/2/Ms [redacted] exercised her day right of rescission on 6/5/and that request was sent back to her sales rep to addressThe sales rep called Ms [redacted] on 6/7/to address the requestIn the end, Ms [redacted] decided to continue with the cancellation and a full refund was submitted on the account on 6/The refund does take about 7-days to show up back on the Ms [redacted] 's credit card1-of those days is to account for internal processing and 3-days for the credit card company to processWe will ensure the refund is processed by the Finance department todayUnfortunately, we cannot speed up the time it takes the credit card company to processWe do show that Ms [redacted] did not sign the one year contract so she is correct as we do not have one on fileWe apologize for the misinformation as well as any issues you had with your sales rep and sales manager

The support staff at Zis trained to address issues domain registrars and will often make the changes necessary to make a new website live on behalf of clientsMs*** had her domain registered with *** ** which has no phone support and is based internationallyThe support staff at Zmade all the necessary changes to make her website live but there were errors on *** **'s endWe cannot be liable for 3rd party products that Zis not affiliated withAnd any changes made to the Domain Name Servers (DNS) will automatically take email down for 24-hours worst caseThis downtime would be experience by any company making this same type of change and is not specific to ZMs*** did request to cancel her services on 12/and on 3/The first request she decided to stay on board with Zand canceled on the second requestHowever, she would have been liable for the remainder of her contract regardless of the domain situationWe could have purchased Ms*** a new domain name if her domain registrar was not able to allow the specific DNS and CNAME changes we need to make to get her site live with ZWe also notice that Ms***'s website is NOT currently live to the internetWe can honor the original cancellation request date but she would still owe us for the same amount of money that she has already paidZResolution:If Ms*** would like to come back to Z57, we would purchase her a new domain at no cost or get www.westchaserealty.com live to the internet since it is now registered with Godaddy who provides much better service than her previous registrarWe would also waive any setup fees necessary to reinstating her account and provide her with a upgraded Premiere design site at no cost ($value)She, however, is still liable for the $of her contract and is not eligible for a refund based on challenges with a 3rd party company in no way affiliated with Z

Zreviewed the account again and determined that the initial response is correctWe received the initial request to cancel l on 11/11/where she rescinded her cancellation request and agreed to stay on boardThe next phone call with Zwas on 1/11/where she requested to speak to a manager regarding her accountWe are more than happy to take 1/11/as the official cancellation date instead of 1/24/17, however, the final payment date of 1/30/will stay the sameWe received no phone calls between the call on 11/11/and 1/11/Zmaintains it's original response

This is a bold face lie! This company told me when they signed me up that I could cancel at any time! When I tried exercise that option they used every deceptive technique to not honor the verbal agreement given to meIn addition I had called them late last year and they verbally agreed to cancelThis company deceives and lies to you verbally and refuses to deal in writingThey should have anything but your lower Revdex.com rating! Mr*** signed up with an Executive Social Package on 8/30/The signed terms are attachedOne of the features of the social program is the connection to RSS feeds to keep the Facebook business page constantly updated with contentThe product hooks up to generic sources for all clients
that include HGTV, This Old House, Tech Crunch, etcAll clients are given the same feed at the time of build, however, we encourage all clients to switch them out for more local personalized feedsThe customer support team will assist in finding other RSS feeds to useMr*** called in on 1/13/and asked to have his feeds updated which the rep did at that timeHe requested an RSS feed for millennials a home repair one and an interior design feedMr*** then signed up for the Search Engine Marketing Program (SEM) on 11/18/The signed terms are attachedThe program guaranteed Mr*** paid and organic visitors for each traffic cycle or he would not be charged his $monthly chargeThe contract was for full billing cyclesThe program does not guarantee leads nor does the program guarantee the quality of the lead as this is very difficult to do with online lead generationEven though it isn’t a guaranteed, Mr*** received at least 3-leads he month he had the SEM program runningZResolution:Mr*** SEM program was shutdown due to non-payment prior to the end of his month contractWe have waived the remainder of his contract because of his financial situation and he doesn’t own any additional money for this programWe wish Mr*** all the best in his next endeavor

Ms*** requested to cancel her service on 7/which is well outside the day right of rescissionZResolution:Zwill not be issuing a full refund at this time because Ms*** signed the terms and conditions which states the cancellation policy and confirmed verbally she wanted to get started within the next weekHer cancellation request was processed on 7/1/and she will be responsible for the day notice

Development via telephone at ###-###-#### so that we can authenticate that you are the authorized account userAll cancellation requests must be verbally communicated directly to a ZClient Development Representative."Mr*** emailed ZClient Development on 3/14/at 6:53pm PT stating: "Hi, I decided to get our of real estate so I don't need the service if I am getting out the Real EstatePlease cancelThanks."On 3/15/at 9:40am PT, a ZClient Development representative responded to Mr***'s email stating: "Hello, We are sorry to receive an email from you requesting to discontinue your servicesFor the security of your account and to process your request, the account holder will need to contact our On Demand Client Development Team at ###-###-#### Option In compliance with the User Agreements as well as the security of your account and website, we do not accept emailed requests and the On Demant Team is the only team that can process a verbal request by the account holder."Mr*** responded to the email on 3/15/at 11:30am PT stating: "Hi, I will forward your email to the Revdex.com and the California department of consumer affairs."ZResolution:Mr*** did not call in to request a cancellation until 5/11/even after being reminded of the policy on 3/15/17. Zwill take 5/11/as his official cancellation date since email cancellation requests are not acceptedMr*** will be responsible for his past due amount totaling $as well as the final monthly payment that falls within his day notice
