Review: I took my 2014 [redacted] in for appraisal and was given an offer of $23,200 by the pre owned sales manager. One week later I took it in to sell the veh to them. The preowned manager was not there and I spoke to the assistant manager and a salesman. They found a piece of paper that verified the number of $23,200. They told me accounting was already gone so I can pick up my check for about $150 the next day as that was the difference in what they were offering and what was owed on the vehicle. I also informed them that the next day was the due date of the vehicle payment so if they could contact [redacted] and let them know that this was happening and they assured me they would and send the payment right away. They gave me my plates and told me to return them to motor vehicles. The next morning the first stop I made was returning these plates and removing my insurance from the vehicle. My fiancé then gets a call from [redacted] about payment so I call in to the used car department to make sure all is ok, and am told that they put the car on the lift and found an issue with the exhaust and I would have to pay them $1500 instead of receiving a $150 check that would of been the difference in what I owed on the veh. VERY BIG DIFFERENCE. At this point I asked over the phone if there was any other way and their response was you can put your plates back on it and take it. Based on the number of $23,200 I had purchased another vehicle and returned my plates. I let them know this and they said "I don't know then". Obviously I felt as I had no choice but to write them a check that I did not agree with. Because I was unhappy and frustrated with the situation I brang them the check and tried to hurry and leave the dealership as quickly as possible. I work at an [redacted] dealership and consulted our general manager about this situation and she said "it was a bogus move" what they agreed on is what I should of been paid. If I arrived there before the accounting department was closed then I would of been cut a check and we would not be having this situation. they informed me that the vehicle would need a new exhaust for them to sell or certify it but when I checked the inventory they are selling it with the same exhaust and not certified. What was my additional $1567 for then? Profit. I called the general manager/owner directly and explained to him the situation. He stated that he has been working with the preowned sales manager for years and he was confident in his ability to handle the situation fairly. I told him I contacted him directly to avoid the middle man and to avoid he said she said arguments. He said that wont be the case. when I spoke to the preowned sales manager that is exactly what happened. We went back and forth and he says my mistake was bringing the car in on his day off. Seriously??? Your staff isn't capable of handling that transaction? When ever I would bring up the name of the salesperson helping me he would say forget that person. How can we forget that person when that is the person who told me 80% of the information. I felt like I had no other choice but to cut the check in what feels like a bait and switch scenario and the only form of help I was offered by the pre owned sales manager was if I needed any service done "he would help me out on that". I SOLD YOU MY SUBARU AND WORK AND ANOTHER SERVICE CENTER HOW IS THAT HELPING ME IF I DONT EVEN OWN A SUBARU!. At the end of our conversation he became condencending would not let me speak and repeated frequently this transaction is over.Desired Settlement: I would like my $1567 back. I feel I am also entitled to the $150 that was agreed upon but am willing to live with out that.

Response:

The complainant was told $23,200 "pending inspection". These vehicles are often modified by the young men who typically buy them and this case was no different. The complainant had put on a non stock exhaust which had a leaking fabricated knuckle. In addition, the headlights and tail lights were blacked out all in violation of ** and ** law. These modifications would have caused it to fail both ** emissions testing and NY state inspections. After he dropped it, we told him of the situation and offered him to pick up the vehicle.

A week later, he called me to complain of the situation. Why it took a week, I do not know. All in all, he had an opportunity to take back the car. He knew of the inspection prior to a final value. He used to work at a Subaru dealer and currently works at an [redacted] dealer. We gave him more money than both of those dealers and he's still not happy.

I'm very sorry but I think that our reputation and A+ rating speaks for itself in this matter. This is simply a young man looking to get more out of a car that has nothing left to give due to the modifications he has made and we have to undo.

I wish you good luck.

I am rejecting this response because:

I was never told pending inspection. The pre owned manager admitted this when he stated that he told the assistant manager to call me right away when he found out he told me it would be 23,200 period. I worked previously at a Subaru dealership and never took it there for an evaluation so where they got that information from is beyond me. I never got it appraised at the current dealership only asked if the original offer was fair and they said yes. My current dealership does not typically deal with off brand vehicles unless they are luxury which a Subaru is not. I stated why it took me a few days. I felt wronged and I asked people in the same business and same position if I had a right to speak and was told by numerous people that the move they pulled was a bait and switch and very wrong. The modification of the exhaust is a Subaru part that is in subarus catalog. The tail lights would not cause emissions to fail in ** and as far as in ** I am in familiar so I can not comment on that matter. I was told that the difference I had to pay was to put on a new exhaust and certify he vehicle. Neither were done the car is being sold with the same exhaust and not certified. Twice I was lied to about involving money. Once on the value they would give me and 2 what my money would be used for. I was never offered a ride to pick up the car simply told you can pick up the vehicle if you don't like it. I had already returned my plates whether I liked it or not I can not drive a veh with no plates according to law in ** or ** or any other state. The A+ rating is nice but does not change he fact that in this situation I was wronged. Reputation is only as good as your last customer.

Sincerely,

Response:

The complainant had every chance to take the vehicle back after we gave him the post inspection price. In fact, he can still come pick up the car and I will give it to back to him at the same price. If work has been done to it by now, I will charge that at cost. As stated before the parts were not installed properly and that is what the main discrepancy is. We may certify the vehicle still, but we do that based on the buyers preference before delivery not before we put the car on our lot.

We are sorry that Christian feels wronged by this but we gave him a very fair deal.
