I read that to mean that they want me to pay shipping plus 25% of the value of the plantsTy Ty claims that they are asking for 25% of the value AS the shippingI'm afraid I know of no reason to think that shipping costs are based on a products PRICE, but instead is based on the package WEIGHT In addition, their reasoning for making me send in a replacement form is so that they can deterimine if the plants were purchased within the last months, and for the proper planting ZoneThey ALREADY know that information as they are the ones who shipped them here! Also, their returns site says that replacements will begin shipping December 15th through April 15th! I live in Illinois, I can't re-plant trees in the WINTER Finally, I will accept the free replacement palms that Ty Ty has offered, as long as that offer does not include me having to pay them $(25% of the price) for the replacementsThe fronds were dead and pulled out of the trunk Regards, [redacted]

Ms [redacted] , Thank you for purchasing your Tulip Poplar Trees 4-5ft tall from Ty Ty Nursery this past seasonI am sorry to hear about your experience, as this is now what we like to hear or read about when doing business with usI do see on 5-30-we replied to a Plantsurance Claim with a response that it was too early to tellWe ask that customers give the plants adequate time when transplanting for them to sproutAs in the majority of time the trees are sitting dormant and are still alive just taking long to leaf out their first yearThe only way to to tell at this point would be to lightly scrape the bark of the tree with your thumb nail to reveal the color of the cambium layer underneath the barks layer, if green it is alive if brown it is deadAt this time of the year this can be a frequent question by customer because the established plants in customer's landscapes have already leafed out and the "ECO-Wise" plants we shipped to you have notWhen transplanting plants in this state it is not uncommon for them to sit dormant for an extended period of time, does not mean they are deadInstead, they would be putting on root growth first them leaf out Needless to say that process should have been avoided when you call after receiving the shipmentOur phone representative must of mis-understood your concern because our policy and practice of handling situations like this is 100% different than describedOur representative should have filed a damaged package claim for your shipment and immediately shipped you another set of trees, with no chargeI can not explain why this was not done, but can assure your I will look into this matter and have it resolved as to avoid situations like this from arising againI am very sorry that your concern was mishandled from the beginning and would like to make this right for youI would like to send you a refund check not for the amount requested but for your entire order amount of $228.37, I would also like to ship you new plant free of charge, and give you a $gift certificate for youI will scheduled a shipment of new trees for the beginning of April, 2017, because we are not able to ship them now per regulationsWe will start shipping approx 12-12-and this date is very weather dependentBy this time of the year you will probably be to cold to plant, thus the spring shipmentAgain, I do greatly apologize for your experience, if the shipping date discussed is not acceptable with you please contact me directly to schedule a more suitable date Sincerely, [redacted] Manager

Ty Ty nurseries was terminating the business relationship when demanding I fill out MORE paperwork with information TY TY nurseries already had (stall tactic), THEN finalized the termination when I was hung up on when I phoned in trying to find out HOW I was to send in ANOTHER letter (stall tactic) WITH the dead tree that I had already spent a half day digging up and shipping back at MY cost! Very sorry, there is NO ConfidenceWhy would it somehow be "ok" to ship a tree now when it was SOMEHOW NOT "OK" last summer? Ms***, Thank you very much for your business and we are sorry to hear that some of your trees did not survive transplanting this past springWe do not have a replacement guarantee as mentioned we have a Plantsurance Policy that is extended on all plants we sell their first yearThis insures the amount of money you spent on the item, and if the item does not survive you will be give store credit for the value that you paidWe went to this Insurance based guarantee because more and more customers where not wanting to get the exact same thing replaced they want to go up in size, down in size or get a completely different type of plant all togetherSo we decided we will give the customer the store credit and let the customer decided how to spend it We ask for pictures in order to verify the plants are deadJust because a plant has not produced leaves and it is August or September does not mean it is deadThe first year of transplanting it is not uncommon to hear an ECO-Wise plant did not sprout and that it is aliveWe planted a pecan tree orchard and had that did not sprout the first yearWhen we scratched the bark the cambium was green meaning alive and sure enough a year after they were planted the leafed out and are still growing and producing 100's of lbs of pecans to this dayIf you scratched the bark of your plant and the cambium was green your tree was alive, it was just dormant and that would have prompted the response that you received I do see where on 8-8-@ 1:131PM you were issued a store credit for $and this would be for the value of Chinese Elm Trees and Weeping Willow TreeI assume that updated pictures showing the cambium to be brown must of been provided this prompting an approval of your Plantsurance Claim and the issuing of you a store credit for the items that did not survive transplantingYou may use this credit to purchase whatever items you would likePlease do not hesitate to me if you have any further questions regarding your concerns Sincerely, [redacted] Manager
