Again a copy of the warranty was given to the consumer which covers what is listed on the warranty and the leather cracking are not listed. I did enclose a copy of the warranty which clearly shows what is covered.

Again the warranty only covers what was listed on the warranty and the consumer did call in after the 3 years period to report their issue. In our important customer information booklet that’s were it states the RoomStore warrants’ all merchandise that we sell to be free from manufactures defects for a 3 year period from delivery date to the original purchaser. I have also sent copies of this in my 1st response.

The consumers items were pick up on march 3rd 2015 as stated by the consumer and her refund was done on April...

1st 2015 this is with in our refund policy of 10 to 14 banking days as stated in out important customer information booklet. (See attach) if there are any other question please have the consumer call the corporate office.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

They still haven't proposed any action. The statement that I got mad and hung up before any option could be given is ridiculous. They told me numerous times there was nothing they would do. Whether the smell is a normal part of their manufacturing process or not is irrelevant. If you're using overtly toxic chemicals to manufacture your products then that's on you to deal with the consequences when customers complain. It's extremely unethical to sell products that start to give off toxic odors after an extremely short 5 day return period, then refuse to do anything about it. It's equally unethical to tell customers that the smell will go away, just wait it out till after the return period is over, then tell them tough luck, now you're stuck with our product since you listened to us and waited.

The items that the consumer purchased was in factory wrap and were new from the manufacture. They were delivered on August 7th 2014 and the sofa was exchange on august 8th 2014 as the springs were making noise we have look at the sofa that has come back and there were no bed bug in the item. At this...

time I believe that the bed bugs did not come from the RoomStore.

The consumer did refuse service and we will still send out a technician however if the stain has been removed the RoomStore has honored their part of the warranty. Please call customer service if you would like to set up an inspection. Also a copy of the warranty and the address to the committee of owner was provided to e-mail address [redacted]  as directed by the consumer. If the consumer did not receive this information we have no way of knowing unless contacted by the customer, I will send the address again.   Thank you, The RoomStore

The consumer purchased items In September of 2010 along with a 5 year extended warranty which only cover what is listed on the warranty. (A copy will be enclosed). The consumer called in May of 2014 with a complaint that the leather head rest had stain, body oil this is not covered under the 5 year...

warranty but is only covered 3 years through the RoomStore. (Copy will be enclosed.) The consumer was notified by customer service.

the 5 year extended warranty which only covers what is listed on the warranty was enclosed with my first response along with the 3year warranty this gives details of what was covered and what was not and the customer was given this at time of purchase and at time of delivery.

The RoomStore has filed chapter 11 bankruptcy and can not refund the money at this time all we can do is to repair the items that are defective until we have a ruling from the courts. I do apologize fore the inconvenience this has caused our customers. Also we do not know about the 5 year extended warranty.

First of all, while there is a listing of what is covered on the 5-year warranty, there is nowhere on any of our paperwork that states that the warranty on the leather ends in three years.  It is NOT STATED.  Just another loophole to catch someone who thinks they have a valid 5-year warranty for which they paid $229.    Judging by the other complaints read on Revdex.com's site, Roomstore has a hard time covering any of their warranties.  Now the 5-year warranty which we purchased included a UV3 kit which states right on the bottle "When used regularly, it will keep leather soft, supple and prevent drying or cracking."  it also states it s a highly effective and easy-to-use formula that conditions without clogging the pores of leather.  Since none of the other pieces (Couch, rocker-recliner, and the other half of the contested loveseat) are showing any wear and tear, it is obvious that this piece has defective material.  Defective period.  Not misused or abused.  RoomStore should back that up, especially since it does not say coverage ends at the three year mark.  We discovered the splits just before the 3-year mark but thought we had a 5-year warranty.  This case will be taken to Small Claims court if this is not taken care of satisfactorily.

The documentation that I have does not stet that the delivery charges will be deducted for the amount of the purchase. It also does not state that the delivery charges have become part of the purchase price of materials. In addition, I was told by ** and [redacted] that a "FULL REFUND" will be issued within the time limits of the information on the invoice. The partial amount was received but still short the $65.00; (sixty fie dollars). I still expect a full refund as the amount of refund is only partial of what was paid. Again, it does not state that the delivery charges will be converted to another item so you can keep it from us. I will continue the process until you provide my FULL REFUND. Thanks, [redacted]

The delivery is free if the consumer keeps the merchandise if it is returned there is a delivery charge when pick up. At this time the delivery fee is not refundable.

Although, I appreciate the response, this resolution is unacceptable.  I purchased this item in good faith.  The salesperson stated to me that this piece was good quality and workmanship.  I am being fair and am only asking for an exchange.  After spending what I did on furniture, I would hope that the roomstore would stand behind the quality furniture that they sell.  Again, I feel I am being fair and I would only assume that a business would do the same.  This experience will cause me to shop elsewhere.  I am extremely saddened that  the roomstore has forced me to look for another furniture store to purchase from.  I hope that the roomstore will stand behind their furniture and offer an exchange of the piece that they originally stood behind as quality furniture.
