US Tax Recovery Partners, LLC (USTRP) has received a copy of the above referenced complaintThank you for forwarding to our attentionPlease note, in the latest three year period we have performed over 4,reviews and satisfaction of our customers is our highest priorityUSTRP has noticed the majority, if not all, of the companies who file Revdex.com complaints, either before or after USTRP has performed its services, use the same standard line that they did not read the agreement nor understand the one page document to renegotiate the terms upon USTRP's findings of substantial savings for their companyThe findings USTRP identifies for the company would have been lost forever but for USTRP's services in identifying, stopping statute, and recovering the amountsThese attempts to renegotiate after the services have been performed have affected our Revdex.com rating in a negative way and it appears the complainants are likely reviewing the prior complaints to create their own set of circumstancesComplainant's company allowed USTRP to schedule an appointment where the agreement was reviewed and signedThe one page agreement states the "parties represent and warrant each has read and has the authority to sign this agreement'An executed copy was remitted and as complainant states, the company gave their permission for USTRP to review their accounts payable files for findings such as overpayments and duplicate payments, including waste and telecomm as stated in the signed AgreementUSTRP identified approximately $73K in overpayments and complainant has paid a portion of amounts due to USTRPIt was only after USTRP identified substantial savings which generated an invoice that complainant chose to file with the Revdex.com in an attempt to renegotiate the agreement termsUSTRP has contacted the customer to attempt to work out a payment plan but complainant refuses to satisfy its obligations under the agreementRespectfully, [redacted] , EsqVice President

Complaint: [redacted] I am rejecting this response because: The facts that Ms [redacted] is stating in her response is incorrectI had to contact USTRP to get a copy of the one page agreement that I signedThe only thing I am embarrassed about is that I did not read the agreement more carefully and that I did not look at the Revdex.com website before the original meeting! USTRP did not educated me on the identified areas of savings that were going to be reviewedAs I stated before I was told that the only thing that would be reviewed it sales and use taxI am being billed for something that was not agreed uponIn regards to the energy and waste "benefits" that I am being billed for, which is the topic of this dispute, I was told by a couple members of USTRP team that it is a potential benefit and not an actual benefit because these rate were not actually negotiatedOur company is not receiving any benefits that USTRP has identified, except for one vendor refund of $for sales tax over payment I have tried to contact the office but they have refused to speak with me Kind regards, [redacted]

This is a valid and enforceable business to business transaction in which a written agreement was signed by the company allowing USTRP to perform servicesAn appointment was pre-scheduled and an agreement was presented for review and signatureIt is an affront to all parties that the complainant (not the signatory who has never disputed signature) claims the agreement is not legalServices were performed and expense reductions in the thousands of dollars were found, under the terms of the agreementOnly when paperwork was presented for signature to continue to perform did the complainant (not the original signatory) file this complaintIt must be noted, the expense reductions found by USTRP as stated in the customized report presented to the complaint are found moneyThe company overpaid expenses and now that these mistakes were brought to their attention did they decide to not continue the agreementIt is our opinion that, for whatever reason including possibly embarrassment, they wish to sweep our services under the rug in an attempt to not pay per the terms of the agreementThe agreement is one-page and does allow the complainant to terminate the agreement and pay an administrative fee upon cancellation prior to services being performed however subsequent to USTRP's presentation of the work product showing exactly the areas of savings to be obtained, cancellation without compensation would give an unfair advantage to the complainant

US Tax Recovery makes pre-scheduled appointments with business professionals to present services to be performedThe complainant has already admitted he "signed without clearly reading" the one page document presentedAs previously stated, USTRP is still interested in performing services however it is clear the complainant desires to cancel the agreement.There is nothing more we can do,

I am rejecting this response because: of the original complaint I issued. The document was misrepresented. It was only to allow an appointment to be set up not an absolute contract. I was pressured to sign it before he would leave after about a minute appointment and not given a chance to read it. I trusted the representative. He did not tell me about a cancellation clause nor did he tell me about extending the fees from his company to cover four years into the future, whether I really had savings or not. (What if I changed utility companies at a lower rate.) None of this was addressed in the response. I consider this an intentional deception on the part of this company, it appears to be their way of obtaining business, especially if they can collect $7,for doing nothing, and I do not trust them to look at any of our records after seeing how they do businessSeeing the other complaints registered with Revdex.com on this company, it is obvious it is a pattern with them

I am rejecting this response because: Previous communications from you were routed to my Junk Mailbox, so this is the first I have seen any message from the Revdex.com. My response to the attorney response is that, yes, our company did allow US Tax Recovery access to the building and files to conduct a Sales Tax Audit, after which the representatives said that all appeared to be in order and that US Tax Recovery could do nothing for the company. Our company never authorized US Tax Recovery to investigate contracts with supplies and does not have a valid, signed contract. The “signature” on the contract is not mine, nor that of any other Optimum Controls employee.*** * ***

In addition to the fact that the agreement was never effective because the employee that signed was not authorized to sign contracts, SALT representative’s business behavior was manipulative and unethicalA representative called from our lobby phone with no appointment, and asked for “just five minutes of your time” Our employee let him in and briefly met with the representative and signed a documentHe was lead to believe that the document presented was just to get us on their scheduleThe representative didn’t make the point that the document was a contract and also didn’t point out the cancellation feeFor all the above reasons we expect SALT to cease following up on an invalid and unethically created contract

I am rejecting this response because:USTRP misrepresents my complaint, just as they misrepresented their own fee structureMy complaint is that USTRP represented to *** Door that their fee was 40%, but then manipulated the calculation to instead charge a fee of more than double that rateAfter which, they sent a sloppy, incomplete refund request to the State of Utah, and asked me to clean up the mess afterward and provide hours of research to collect the information their associate didn't gather when she was in our officeAnd they want me to do all this work and then hand over almost the entire refund to them

I am rejecting this response because: The agreement is not clear on the procedure regarding the telecommunication and waste renegotiationIt was never mentioned in the original meeting and I believe it was intentionally misleadingThe only thing mentioned was use and sales taxThe benefit you are billing us for is, is not an actual benefit to us because we are not getting a refund or savingsAs I mentioned to several people at US Tax Recovery I am not in a position to renegotiate rates on telecommunication or waste so I would have never agreed to such termsAlso, Our business location may be moved out of state within the next year and because of this I asked US Tax Recover not to peruse any negotiations on rates.This is not just an attempt to not pay the invoiceI believe that US Tax recovery intentionally mislead me to sign a document that was vague and did not correspond to the verbal agreement that was made in the original meeting.Also, US Tax Recovery is billing us for "benefits" from sales and use tax portion of the reviewWe have only received $from a vendor, one other vendor will not refund us, and our energy provider has no respondedI have paid $2,US Tax Recovery so far to receive a benefit of $Now we are getting billed for over $72k for benefits we will never receive.I have spoken to US Tax Recovery regarding the outstanding balance and I told them I would not pay/make payment agreementsI feel I have been harassed and told "you're the one that signed the agreement" several times with no room for settling the issue.I ask the Revdex.com to please review this case.
