While rejecting USTRP's response to their *** complaint, the complainant expressly states "I understand that (name left out per *** rules) exceeded her level of authority during this debacle, and her actions will be dealt with internally." This is an internal matter that has nothing to do with USTRP and should not be the basis of a complaint to the ***. As previously stated, USTRP presented a one page agreement to the signatoryAlso as previously stated, should the complainant merely allow USTRP to perform its services, the administrative fee is not dueNevertheless, USTRP will reach out to the customer directly in an attempt to resolve this matter

RE: Complaint ***, 2nd response Dear Ms***: As previously stated, an appointment to review our services was scheduled on December 7, and a salesman met in person with the signatory on December 16thA copy of the executed Comprehensive Service Agreement" was subsequently emailed to the same personA follow up email confirming the review date in February was also sentThe company voluntarily allowed the salesman to enter the premises and present the agreement for reviewAdditionally, the one page agreement clearly states the "parties represent and warrant each has read and has the authority to sign this agreement"There are no deletions from or additions to the original wording of the agreement by the signatoryIt is only upon cancellation that the clearly stated administration fee is applicableThe company has cancelled the agreement and USTRP is merely attempting to reschedule so that it is able to pet-form its services and thus avoid the administrative feeRespectfully,*** *** *** ***Vice President

I am rejecting this response because, I was not aware of the fee and that was not the agreement between Mr*** and myselfI may have signed a form, however as I stated before, I do not believe it was that agreementIf you look at the attachments I sent before, Mr*** did not sign the document the same day as I did and did not give me a copyI sincerely feel that these people have taken advantage of the situationI do not know any company that if you sign an "Agreement", that they do not sign it and provide you with a copyI have no way of knowing or proving that my signature was not copied onto that agreementIt is only my word against theirsThere is nothing right about this whole matterThis has all been based on deception from the beginning and I have certainly learned a valuable lessonWith that being said, unfortunately I feel I have no choice, but to accept the offer of providing copies of the invoices for review as Ms*** ***(email attached) offered in her email dated December 14thI have no way of proving my conversation and the agreement between Mr*** and myself and this going back and forth with people that were not even involved is ridiculousSo I would prefer to just get it over with and move on

I am rejecting this response because: again the company is mis-stating information and twisting what was written and represented by their representative 1st fact, I mentioned to their representative that I could not authorize (only the owner of the business could authorize) the review, of which was agreed verbally 2nd fact, no fee was ever discussed for cancellation or presented on the signature page in the company's possession - I still do not see any information indicating fee on the document presented to myself on the the day in question3rd fact, The US Tax Recovery were supposed to contact us and ask for a date, never did A note was sent indicating to a date in which US Tax would arrive This company is acting in bad faith and mis-representing itself to the public

I am rejecting this response because: the fact still remains that the person who signed their form does NOT have, nor was she ever given the authority by Custom Mold & Design, to sign such a document on behalf of Custom Mold & Design
The fact also still remains that a member of USTRP hand-wrote on the document "*No money or credits found no charge" and followed it by his or her initialsThe manner that I interpret that hand-written statement is that he or she did not find any money or credits and is signing off that there isn't any chargeSo why is my company still being harassed by individuals from USTRP?
The reason I stated that the person who signed the document is a receptionist is because that is a primary function of her position with Custom Mold & DesignShe is the employee who answers phone calls and greets visitors when they come through the front door of the businessIsn't the term "receptionist" what many businesses use for the individual performing those duties? It was while performing this receptionist function that Ms*** first encountered the USTRP individual and informed the employee of USTRP that she did not have the authority to sign their agreementAt that point, why didn't the employee of USTRP ask to be put in contact with the individual who DID have the authority to sign instead of pressuring and coercing the first person they came in contact with? Asking Ms*** to put them in contact with the appropriate individual would have been the professional approach
The stationery of USTRP states "Non-Invasive, Risk-Free Sales & Use Tax Refund Reviews"Non-Invasive is often interpreted as "not entering", "not intruding", or "not opening" so it's unclear how a review of sales & use tax could be performed by truly "non-invasive" methodsThere are some individuals that could potentially see the use of the term Non-Invasive by USTRP as advertisingSince USTRP wants to hold others accountable to the exact wording of their document, they should hold themselves accountable as well
Although *** *** ***, Esqremarked that the signatory's email signature states that Ms*** is "in charge" of Accounts Receivable and Accounts Payable, I would reply that I can provide many months of emails from Ms*** where her signature line simply states "Accounts Payable/Receiveable" [please note that the spelling of "Receiveable" is Ms*** spelling of it] It's unclear to me how that description in her signature line would indicate that Ms*** is "in charge" of those functionsHer work is being reviewed by her supervisor and frequently by myself indicating that she does not have ultimate control of the invoices USTRP would like to review
I understand that Ms*** exceeded her level of authority during this debacle, and her actions will be dealt with internally at Custom Mold & DesignThat has no bearing on the decision that Custom Mold & Design does NOT authorize USTRP to perform any services on our premises
Please stop harassing Custom Mold & Design and its employees

I am rejecting this response because: I am not the Controller of the company and I never said I was the Controller of the company. I specifically told USTRP's representative that I was not the Controller and that I did not have the authority to initiate or authorize a service such as they offered. The "Contract" was presented as a place holder document in such a negligent manner as if to say, "that it was only a formality, nothing important.".

I am rejecting this response because:In review of all the complaints filed with the Revdex.com against this company , they give the same sorry response. You have no costs to recoup because you performed no services. A representative came to our company to pitch the companies services, so no service was performed. Again, the companies practice is to have someone sign a paper that they state is just for scheduling purposes and then tries to get you to pay a ridiculously high cancellation  fee saying it is a binding contract. We do not wish to work with a company that tries to deceive and scam people. If they are such a reputable business, why do they have to try to trick people into using their services?

were identified. Complainant has since remitted payment to USTRP for a portion of the benefits. A credit memo was issued for the fuels credits USTRP identified subsequent to the company showing where they had taken the credit and it is defamatory to say it was fraudulent; complainant knew the credit was issued prior to filing this complaint yet still chose to file this complaint.The agreement is one-page and the expense reduction areas to be reviewed are clearly presented. The company gave USTRP access to its documents and a customized report was remitted. This is a collection matter in an attempt to renegotiate the terms after USTRP has either performed or has been stopped from performing. Merely stating no benefits were received because complainant has refused to cooperate does not mean the amounts are not due. It means the complainant has breached the contract.

the complainant to terminate the agreement and pay an administrative fee upon cancellation prior to services being performed. USTRP would prefer to perform its services as agreed in order to recoup expenses already incurred and to find savings for complainant that may be lost forever. If that is not an option, the fee is due and payable.
