business transaction in which a written agreement was signed by the complainant allowing USTRP to perform expense reduction services. An appointment was pre-scheduled one week prior to the meeting. Per our records, the complainant explained the amount and type (scanned) of records to be reviewed and noted their multiple company physical locations. The agreement is one-page, clearly states the scope of the services to be performed and the payment terms and does allow the complainant to terminate the agreement and pay an administrative fee upon cancellation prior to services being performed. The agreement also states the signatory has read and understands the agreement.USTRP is interested in performing the services and will reach out to the complainant in an attempt to resolve the matter.

I am rejecting this response because:There are so many untruths to their statement. Yes, a 5 minute meeting was scheduled for the company to come by and tell us about their services, but we were told that we were under no obligation for any of their services even by signing the agreement which clearly stated that we set up a tentative meeting. As I said originally, I told [redacted] that I was not authorized to set up a meeting or to sign. Hr said it did not mean anything and that all I needed to do was call him once I spoke with the owner and let him know. He said that if the owner was not interested that it was fine and that he would cancel the tentative appointment. No questions asked.I spoke to the owner and she informed me that she was not interested. I immediately tried to call Howard. I was never able to get ahold of him. I left several voicemails. No call back. I called the headquarters and spoke to Lee. I explained the situation and he said he would contact [redacted] and get back with me. It was later that day that I received a copy of the signed document by email. The document was signed by an officer of the company, which was not the case when the the document was given to me to sign they day that [redacted] came to our office. He took that document, which he said I didn't need because it didn't mean anything and it was just for his records. So Yes I did contact the company and try to resolve this BEFORE I received the signed document. I responded back by email to the person that sent me the document to no avail. They never responded back to me. I called and tried to speak Lee again with no luck. I even tried to call [redacted] again. I couldn't get anyone. I feel that they were definitely avoiding me. This is why I contacted the Revdex.com.  NEVER have I received any contact from the company to try to get this resolved as they stated.  I would appreciate it if they would contact me.  This needs to be handled in a professional manner and I feel that they need to stick by the verbal words of their salesman. Even if the document says something different than what his verbal agreement was.   He told me that the written dicument didnt matter because he understood my situation and he would just wait to see what the owners decision was. Instead, he didn't follow through on his word and submitted the document and then had no contact with me.   I trusted him to do what he said.

I am rejecting this response because I was not made aware of the cancellation fee, I had advised the representative I would have to get an approval from the owner to see if they would be interested in such an audit as I did not have the authority to make that decision. He wanted to set a tentative date and told me that's all I was signing. He did not give me a copy and if you look at the attached copy it was not signed by him until a few days later. I'm not sure that is the same paper I signed. I agree, shame on me for signing anything I did not read, however I don't feel I signed anything stating there was a cancellation fee of $7500 to the company. I am attaching a copy of the emails of their offer to me, when this was supposed to be a "RISK FREE", their solution is to force me to have an audit and pay 40% of their findings. I feel my signature has been cut and pasted onto this agreement, why else would I not receive a copy and he not sign the agreement in front of me?

would like to state for the record, that I adamantly refute the statements
below:
1)    
That there was a pre-scheduled
appointment.  In actuality, the salesman called stating he was in the area
and could he drop by for a few minutes and leave his brochure.  That is
all I agreed to since they kept calling our business. 
2)    
An agreement was presented to
me.  This NEVER happened.  The salesman did give me a brochure and highlight the services they
perform.  I immediately told him I did not feel there was much savings to
be had for either of us and why I felt that way.  I also told him that I
was not authorized to legally bind our company to an agreement with his
company.  Only the owners could do that and they were not available at
this time to talk with him.   This was all in the presence of our
company AP clerk who is willing to submit a statement to this effect.
3)    
As far as my signature on a document, this
is not true.  My legal signature is in cursive and I did not sign a
document for him.  Once I informed him I was not authorized to sign for
the company he asked me to discuss with the owners.  I agreed to do
this.  He suggested that we agree to a tentative date in the event the
owners were interested in the services he provided.  He specifically
stated that if they were not interested, I could call and cancel.  The implication was, no obligations.  I agreed to a tentative date.  It was at this time he
asked me to sign the paper with the tentative date written on it.  It was
the first I had seen the "agreement".  I said that I would not sign any
document.  He said it was only for contact information and showed proof
that he had stopped by our business and talked with us on the specified date.  I printed my
name, title and date.  Nothing else was filled in, nor did he leave me
with a copy.  I admit I did not read the document.  I assumed he was
honest and representing himself and his company with integrity.  I followed
through with what I agreed to do by speaking to the owners.  They were not
interested in the services provided by USTRP and I made contact with them in a
timely manner to let them know.  I have phone records to show that this
call was made substantially before the June tentative date.
It
is the opinion of SPF America, that we were never in any kind of legal contract
with USTRP and that there is nothing for USTRP to legally write off for
any kind of tax purposes.Respectfully,

majority, if not all, of the companies who file Revdex.com complaints, either before or after USTRP has performed its services, use the same standard line that they did not read the agreement nor understand the one page document to renegotiate the terms upon USTRP's findings of substantial savings for their company. The findings USTRP identifies for the company would have been lost forever but for USTRP's services in identifying, stopping statute, and recovering the amounts. These attempts to renegotiate after the services have been performed have affected our Revdex.com rating in a negative way and it appears the complainants are likely reviewing the prior complaints to create their own set of circumstances. Complainant's company allowed USTRP to schedule an appointment where the agreement was reviewed and signed. The one page agreement states the "parties represent and warrant each has read and has the authority to sign this agreement'. An executed copy was remitted and as complainant states, the company gave their permission for USTRP to review their accounts payable files for findings such as overpayments and duplicate payments, including waste and telecomm as stated in the signed Agreement. USTRP identified approximately $73K in overpayments and complainant has paid a portion of amounts due to USTRP. It was only after USTRP identified substantial savings which generated an invoice that complainant chose to file with the Revdex.com in an attempt to renegotiate the agreement terms. USTRP has contacted the customer to attempt to work out a payment plan but complainant refuses to satisfy its obligations under the agreement. Respectfully,[redacted], Esq. Vice President

An agreement was presented for review and signed although complainant clearly states she "signed without reading the entire document". A copy of the executed "Comprehensive Service Agreement" was subsequently emailed to the same person. It was only later that the complainant chose to cancel the agreement.The one page agreement states the "parties represent and warrant each has read and has the authority to sign this agreement" and includes an administrative fee for cancellation. Specifically, the agreement states "If provider identifies or obtains refunds, savings, credits, duplicate payments and/or reduces current payments, liabilities, or assessments, including penalty and/or interest, (hereinafter collectively "Benefits") on Client's behalf, Client agrees to pay Provider... USTRP identified Benefits for the customer. They now choose not to pay according to the terms of the agreement.

I am rejecting this response because:  As stated in my complaint.  The representative from US Tax Recovery led me to believe that I was under no obligation to have this review done.  I clearly remember telling him that I was not authorized to give an...

affirmative decision until it was discussed with the owner of the corporation on his next scheduled visit.  The representative said, "oh, that's fine, I understand you need to speak with him, let's just set up a tentative date so if he agrees to have the review done, we can have you on the schedule".  He then slid the form to me and stated that I was just signing for the tentative date he penciled in.  He did not indicate that I was signing the "contract".   I feel this was dishonest on his part.  This was just a copy of a form, it did not even look like a formal contract, that is why I thought he was being honest.  The response from US Tax Recovery also states that this was a previously scheduled appointment, we received several sales calls from their office and the last one indicated that the person was just going to drop off some literature that we may find helpful.  We did not solicit their services.   As stated to [redacted], who has been calling and e-mailing from b2b Prospecting (not sure how this company is related to US Tax Recovery), we are not interested in their services and do not feel we should be threatened with a huge cancellation fee due to the fact that their representative clearly indicated that he understood I was not able to make the decision to have this review without speaking with the owner.  We have asked to have this representative contact us to clear this up but are told that this is not possible.  I feel as though this representative is running his own scam on behalf of US Tax Recovery and because of this we do not want to continue any type of relationship with them as we do not feel they are a trustworthy company.

I am rejecting this response because:We have repeatedly informed multiple members of this company that we need to speak to [redacted], the sales person who came to the office as this is not consistent with what was discussed during the meeting. Our company has also requested he present the original - and they have not done so. We do not wish to do any business with this organization.

I am rejecting this response because: as previously stated, the signatory of the so-called agreement was not authorized to commit our company to legal agreements of any description, in addition to which USTRP subsequently altered the agreement by writing in and forging a fictitious job title for the signatory - a job title which the signatory has never had, and which has never existed at our company. USTRP also attempted to use deceptive practices to obtain a signature on their contract.

during the visit that I was not authorized to initiate or authorize a service such as offered. With these facts in mind, the contract should be made null and void.

I am rejecting this response because: The facts that Ms. [redacted] is stating in her response is incorrect. I had to contact USTRP to get a copy of the one page agreement that I signed. The only thing I am embarrassed about is that I did not read the agreement more carefully and that I did not look at the Revdex.com website before the original meeting! USTRP did not educated me on the identified areas of savings that were going to be reviewed. As I stated before I was told that the only thing that would be reviewed it sales and use tax. I am being billed for something that was not agreed upon. In regards to the energy and waste "benefits" that I am being billed for, which is the topic of this dispute, I was told by a couple members of USTRP team that it is a potential benefit and not an actual benefit because these rate were not actually negotiated. Our company is not receiving any benefits that USTRP has identified, except for one vendor refund of $281.94 for sales tax over payment.  I have tried to contact the office but they have refused to speak with me.

US Tax Recovery's response stated we were still interested in performing services for the complainant and would reach out to discuss a mutually acceptable conclusion. I did not say we would continue to pursue reimbursement The complainant actually accepted our offer on the same day they filed the Revdex.com complaint then later rejected my response to their Revdex.com complaint. Such actions by the company representatives clearly show they are using the Revdex.com as a public forum to renegotiate the terms of the agreement they signed. There is nothing more we can do.

An agreement was presented and signed with a review date of May 18th. A copy of the executed Comprehensive Service Agreement" was subsequently emailed to the same person. It was only months later that the complainant chose to cancel the agreement. The one page agreement states the "parties represent and warrant each has read and has the authority to sign this agreement's and includes an administrative fee for cancellation. USTRP has contacted the customer to reschedule and is merely attempting to perform its services under the agreement.

We stand by our earlier responses. Without the complainant's cooperation, there isnothing more we can do.As previously stated, this is a business to business transaction in which a writtenagreement was signed by the complainant allowing USTRP to perform services. Anappointment was pre-scheduled and an agreement was presented for review andsignature. The complainant expressly states she did not read the document prior tosigning.The agreement is one-page and does allow the complainant to terminate the agreementand pay an administrative fee upon cancellation prior to services being performed.USTRP would prefer to perform its services as agreed in order to recoup expensesalready incurred and to find savings for complainant that may be lost forever.

This is a valid and enforceable business to business transaction in which a written agreement was signed by the company allowing USTRP to perform services. An appointment was pre-scheduled and an agreement was presented for review and signature. It is an affront to all parties that the complainant (not the signatory who has never disputed signature) claims the agreement is not legal. Services were performed and expense reductions in the thousands of dollars were found, under the terms of the agreement. Only when paperwork was presented for signature to continue to perform did the complainant (not the original signatory) file this complaint. It must be noted, the expense reductions found by USTRP as stated in the customized report presented to the complaint are found money. The company overpaid expenses and now that these mistakes were brought to their attention did they decide to not continue the agreement. It is our opinion that, for whatever reason including possibly embarrassment, they wish to sweep our services under the rug in an attempt to not pay per the terms of the agreement. The agreement is one-page and does allow the complainant to terminate the agreement and pay an administrative fee upon cancellation prior to services being performed however subsequent to USTRP's presentation of the work product showing exactly the areas of savings to be obtained, cancellation without compensation would give an unfair advantage to the complainant.
