information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has had equipment complications with her security system that have not been resolved Ms. [redacted] desires cancellation of her Vivint Agreement without penaltyVivint’s records indicate that Ms. [redacted] signed a System Purchase and Services Agreement on August 8, 2014 with an initial term of sixty (60) months, a monthly services fee of $53.99, plus any applicable taxes, during that term. Vivint provides a Right of Rescission period immediately following installation of the equipment, during which time a customer may cancel the Agreement for any reason, and this period is extended for elderly customers.  Cancellation of Ms. [redacted]’s agreement without penalty is not warranted at this time. Vivint was not notified of any equipment issues until recently. Vivint’s records show that Ms. [redacted] first notified Vivint of her equipment concerns on June 6, 2017. Mr. [redacted] cancelled his account within the three-day cancellation period and is requesting compensation for the damage done to his walls. A representative from Vivint has recently contacted Mr. [redacted] in an attempt to resolve this concern. Concern:  I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that she cancelled her System Purchase and Services Agreement (“Agreement”) but Vivint has not provided her with confirmation that her Agreement has been cancelled. Ms. [redacted] desires a letter confirming her cancellation, a copy of her Agreement and verification of all monies paid to Vivint. As a gesture of goodwill Vivint agrees to cancel Ms. [redacted]s Agreement without penalty. May this letter serve as confirmation that Ms. [redacted]s Agreement has been cancelled, as of the date of this letter she has no further obligation to Vivint. Vivint’s records indicate that Ms. [redacted] entered into a second Agreement on April 14, 2014 for an additional forty-two (42) months. A copy of this Agreement has been sent to her by mail. In exchange for Ms. [redacted]s new Agreement term Vivint provided her with an upgraded security panel, extended the warranty of her equipment and locked her monthly rate in at $49.99. Ms. [redacted] contacted Vivint on December 12, 2016 to inquire about cancelling her Agreement but she did not have her verbal password. Without a verbal password Vivint’s representatives will not provide any account information. Nevertheless, Vivint agrees to the above resolution. Ms. [redacted]s billing information can be found on her online account, a Customer Care agent will be able to assist her in finding this information. Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she has been experiencing technical concerns that Vivint has not been able to resolve. Ms. [redacted] desires the cancellation of the agreement without penalty. Vivint’s records indicate that that Ms. [redacted] contacted Vivint on August 3, 2015 to report a concern with her doorbell camera. A Vivint representative attempted to troubleshoot the doorbell camera over the phone, but was unable to resolve the concern. An appointment with a Vivint field service professional was scheduled for August 6, 2015. On August 7, 2015, Ms. [redacted] called Vivint to report the doorbell camera was still experiencing difficulties. A Vivint representative scheduled a field service appointment for August 14, 2015. The field service professional noted that the doorbell camera needed to be replace, but did not have and extra one with him. The doorbell camera needed to be ordered and sent to the technicians in the area; however Vivint was experiencing an equipment shortage with their doorbell cameras and was unable to fulfil the order at the time. On August 26, 2015, Ms. [redacted] called Vivint Customer Loyalty department and spoke to a representative named Shade as mentioned Ms. [redacted]’s complaint. From review of the call, Shade offered a service visit and credit to the account, and Ms. [redacted] accepted. No cancellation was offered during this call. Vivint attempted to dispatch a field service professional on September 5, 2015, but no one was home when the field service professional arrived. Furthermore, Vivint’s records indicate that prior to the installation of any equipment; Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on July 14, 2015. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Cancellation of the agreement without penalty is not warranted at this time.A representative of Vivint has recently attempted to contact the account holder in an effort to resolve these concerns. Vivint believes in repair, rather than cancellation is the proper course of action. Vivint has agreed to schedule an appointment to resolve the doorbell camera concerns. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. Ms. [redacted] desires her Agreement cancelled without penalty. Vivint believes this matter has been previously resolved. Ms. [redacted]’s Agreement has been cancelled as of June 10, 2016, and Ms. [redacted] has no further obligation to Vivint. Vivint’s records indicate that Mr. [redacted] entered into an Agreement with Vivint on August 7, 2012 with an initial term length of forty-two (42) months. By signing the Agreement Mr. [redacted] agreed to pay a monthly monitoring fee of $49.99 plus any applicable taxes each month during that term, and that service would continue year to year after the initial term of forty-two (42) months, unless cancelled in writing no less than 30 days before the next renewal term (Vivint Purchase and Services Agreement, Section 2.4). Vivint received Ms. [redacted]’s notice of cancellation on May 10, 2016. Thank you for response. After I filed this complaint, VIVINT did finally agree to allow me to cancel without penalty, refund what I have paid and pick up their equipment. They are scheduled to pick up the equipment on Friday Oct 2 and refund $187. As long as that occur, the following statement is true. reviewed the information provided by Mr. A[redacted] and appreciate the opportunity to respond. In his complaint, Mr. A[redacted] alleges that he had a flood at his home, and that his flood sensor from Vivint did not properly notify him of the incident.  Mr. A[redacted] desires cancellation of the Agreement without penalty.  Vivint’s records indicate that Mr. A[redacted] signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  This Agreement states that Vivint does not warrant that the system will always detect, or help prevent, any burglary or other such event.  As such, cancellation of Mr. A[redacted]’s Agreement without penalty is not warranted at this time (Section 3, Vivint Purchase and Services Agreement). A representative from Vivint has recently contacted Mr. A[redacted], in an effort to resolve these concerns.  A Field Service representative has been dispatched to Mr. A[redacted]’s home to inspect and repair the system as needed, and Vivint’s Home Damage department has been notified of the flood damage and the request for compensation is being reviewed.  Further, in an effort to assist Mr. A[redacted], Vivint has offered to reduce his monthly monitoring rate by 50% for the remainder of the initial term of his Agreement.  Mr. A[redacted] has accepted this offer, and the change has been made on his account.  A credit has been applied to cover the month of September as well.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal. 9, 2016           To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was advised at the time of sale that his system would work without Wi-Fi, but after several visits from technicians it was clear that the system would not work and Vivint refused to cancel his Agreement.  Mr. [redacted] desires a refund of all payments made to Vivint.At this time, to resolve this matter Vivint agrees to remove Mr. [redacted]’s account from collections and cancel the remaining term of his Agreement without penalty.Vivint’s records show that Mr. [redacted] signed a Purchase and Services Agreement upon installation of his Vivint system, in which he agreed to an initial term of forty-two (42) months and a monthly services fee of $70.99, plus applicable taxes, during that term.  This Agreement states that some device features may require an internet connection and any charges for same will be Mr. [redacted]’s responsibility. Revdex.com: I have reviewed Mr. W[redacted]'s response in reference to complaint ID [redacted]. I would like to inform Vivint that I have been able to successfully plead my case before the Nassau County Police Department Permit Department and they have voided the $300.00 fine assessed against us. Therefore, I would like to thank Vivint for the offer but I am not eligible for the $150.00 reimbursement offered to me.Having said that I would like to take this opportunity to request Vivint to review their procedures regarding permits and guide their consumers prior to installation rather than relying on a standard form contract clause(s) once consumers are hit with a fine. I have been practicing law for many years and was able to read the local codes and successfully plead my case. I am pretty sure many consumers do not have the ability, time or knowledge to read local codes and figure out what to do.Our overall experience with Vivint's product and services was great and we were planning to add more services offered by Vivint until we faced this issue and the way it was dealt with initially. Recently, representatives from Vivint’s Scheduling department called and left messages for Mr. [redacted], to offer him an expedited appointment for a service visit.  Mr. [redacted] returned the call to Vivint and confirmed the offered appointment.  The return call from Mr. [redacted] indicates that he received messages left by Vivint’s representatives.  A Field Service Professional was dispatched to Mr. [redacted]’s home on May 1, 2015, and the panel was replaced and tested on site that day.  If Mr. [redacted] is having further issues with his panel, I would advise him to contact Vivint’s Customer Care department at [redacted], and request a follow-up appointment.Vivint has applied a total of two (2) months of credit to Mr. [redacted]’s account, in an effort to assist him.  Pursuant to the signed Purchase and Services Agreement, cancellation without penalty is not warranted at this time.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal. They further allege that the balance on their online account shows a balance of $191.00.Vivint’s records indicate that the check for $169.99 was sent on 1/14/16. This check should be received within ten business days of 1/14/16. Vivint’s records further indicate that the payment of $191.00 was taken before Mr. and Ms. [redacted] were invoiced. That is the reason “make a payment” is showing up on their payment activity. However, their balance is currently zero.       To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she had equipment complications and requested cancellation of her account, but was advised that she had signed an Agreement with Vivint and could not cancel it.  Ms. [redacted] has been contacted in efforts to collect a debt, and she desires cancellation of her agreement without penalty. Vivint’s records show that on August 11, 2007, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of sixty (60) months.  Vivint spoke with Ms. [redacted] regarding her alarm service on January 25, 2012.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. The term of Ms. [redacted]’s extended agreement with Vivint is due to end on July 24, 2015, and as such, Ms. [redacted]’s account has not yet been eligible for cancellation.  A representative from Vivint has recently contacted Ms. [redacted] in an effort to resolve this concern.  In an effort to assist Ms. [redacted], Vivint has agreed to cancel her agreement without penalty at this time.  Ms. [redacted] has no further contractual obligation to Vivint, and her past due balance has been forgiven.  No further attempts will be made to collect a debt.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal. have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he was told by the sales representative that if Mr. [redacted] canceled the account that Vivint would reinstall his old system. When Mr. [redacted] canceled his Vivint service that did not happen and his door bell will not work. Mr. [redacted] requests that his old security system reinstalled and his doorbell replaced.A representative from Vivint has recently contacted Mr. [redacted] over email in an effort to resolve his concerns. Vivint does not have any records or any promises made by the sales representative outside of the written contract. Vivint technicians are only licensed to work on Vivint equipment, therefore Vivint will not be able to install Mr. [redacted]’s old security system. Vivint advices Mr. [redacted] to contact his old security company to reinstall their system. In an effort to assist Mr. [redacted] Vivint has sent a check for $50 to help with Mr. [redacted]’s doorbell or for him to use however he see fit. I am rejecting this response because: I see that no attempt to get vivint to investigate what the rep told me at time of installation is going to happen. There are multiple complaints online of the same thing I am talking about. They claim I signed a contract for 42 months and I say the contract and the rep stated 24 months. I am legally bound to the terms they are producing and have no other options here but to pay it. I have read a lot of complaints where people are having a difficult time getting vivint to stop billing when contracts are up. I would really like someone to look into all the accusations against them. The best thing I can do now is become very vocal about what has happened to me and warn people of this business. I would like it to go on record that at the end of their "42 month contract "  I want all billing stopped immediately . No written letters to stop it that drags on for many more months at a time. This is the worst company I have ever dealt with in my life and I have never filed any type of complaint before. If anyone is thinking about using this company please do some online investigating before you sign and get a copy of the contract on the spot. Read very carefully what is written vs. what you are being told.
