As such, Mr. [redacted] requests that his last monthly payment of $53.08 be refunded back to him.A representative from Vivint has recently attempt to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s records indicate that this matter is being resolved to Mr. [redacted]’s satisfaction. A refund of $53.03 has been issued back to Mr. [redacted]’s checking account that Vivint has on file. Ms. [redacted] requests that Vivint cancel her account.   At this time, Vivint offers to send a technician at no cost to fix the volume on the panel, notifications and emergency function.   Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] signed a System Purchase and Services Agreement (“Agreement”).  Every customer must sign this document, and if a customer does not, Vivint will not install any equipment in the customer’s home.  The purpose of the Agreement is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] signed the Agreement on February 23, 2016.   Upon signing the Agreement, Ms. [redacted] represented that she understood and agreed to the initial term of forty-two (42) months.  She also represented that she would pay a monthly monitoring fee of $60.99 each month during that term. reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. After further review, Vivint’s records show that Mr. [redacted]’s agreement with Vivint was cancelled on December 15, 2017. Vivint’s records show that on August 29, 2011, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  As such, the initial term of the agreement would have lapsed on February 29, 2015.  However, Vivint spoke with Ms. [redacted] regarding her alarm service on February 28, 2015.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a sixty (60) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement sixty months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint.  Despite the validation of the above verbal extension, Mr. [redacted]’s agreement with Vivint has been canceled. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. She explains that all this damage has been repaired by Vivint save for damage to an intercom system in her home. Ms. [redacted] requests that Vivint arrange for repairs to this intercom system.Vivint’s records indicate that Ms. [redacted]’s home damage claim was assigned to a Vivint Claim Manager. This representative was unable to locate a contractor willing to provide an estimate or complete repairs to Ms. [redacted]’s intercom system. To proceed with this home damage claim Vivint requires that Ms. [redacted] obtain estimates from two contractors to repair the damage. Once Vivint has received these estimates from Ms. [redacted] they will proceed with resolving Ms. [redacted]’s claim. Alternatively Vivint has offered Ms. [redacted] $250 to resolve this claim. As a result, Ms. [redacted] has now stopped payments to Vivint and has now received collection notices. Ms. [redacted] desires the cancellation of her mother’s account and the removal from collections. A representative from Vivint has recently been in contact with Ms. [redacted] in an effort to resolve her concerns. At this time, Vivint is currently waiting on Ms. [redacted] to provide documentation as to the diagnosis of her mother’s illness. However, Vivint’s records indicate that Mr. [redacted] canceled this appointment prior to the technician’s arrival. Mr. [redacted] notified Vivint of his equipment concerns on April 18, 2017, and an appointment was scheduled for April 20, 2017. During this appointment, the Vivint technition replaced Mr. [redacted]’s element thermostat with a new Vivint Element Thermostat. Mr. [redacted] again notified Vivint of his equipment concerns on April 25, 2017, and an appointment was scheduled for April 29, 2017. However, Vivint’s records indicate that Mr. [redacted] canceled this appointment when the technician arrived to his home. Additionally Mr. [redacted] was offered a credit to his billing account to cover two (2) months monitoring fee to which Mr. [redacted] declined.Vivint would like to ensure that Mr. [redacted] is able to utilize his system as intended, and will send a field service professional to his home at no charge. have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she was misled by Vivint regarding the terms of her agreement, and the capabilities of the system. Ms. [redacted] desires the cancellation of the agreement without penalty.Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of forty-two (42) months.  She also represented that she would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  Ms. [redacted] contacted Vivint on February 9, 2015, to request cancellation of her account. During this conversation with a Vivint representative, Ms. [redacted] was informed she is still within term and of her payoff amount if she wished to cancel early. Ms. [redacted] later contacted Vivint on July 15, 2015 and reported an issue with her garage door sensors. Ms. [redacted] requested a Vivint service appointment. As stated in Section 5 of the agreement, Vivint applied a $49.00 copay for a service. Ms. [redacted] asked for this fee to be waived. Vivint agreed to lower the fee to $24.00, and scheduled the appointment for July 24, 2015. On July 21, 2015, Vivint received a request to cancel the appointment. Vivint’s records further show that Ms. [redacted] stopped making her monthly payments after March 2015.  As such, the account was cancelled for non-payment on July 30, 2015, and was sold to an outside collections agency in September 2015. Cancellation of Ms. [redacted]’s account is not warranted at this time, but Vivint would like to assist Ms. [redacted]. Vivint has agreed to forgive the past due amount and reactive her service with Vivint. Vivint has also agreed to give Ms. [redacted] premium service on her account for free. With premium service Ms. [redacted] can request a service visit with a Vivint Field Service Professional for free at any time. Mr. [redacted] states that he has attempted to cancel but his account has still been debited. As such, Mr. [redacted] desires cancellation of his System Purchase and Services Agreement (“Agreement”) and a refund of all monthly services charges since he initially requested cancellation. Vivint agrees to refund Mr. [redacted]’s final payment of $[redacted] and cancel his Agreement without penalty. As of the date of this letter, Mr. [redacted] has no further obligation to Vivint. Vivint’s records indicate that Mr. [redacted] contacted Vivint on September 23, 2014 requesting cancellation of his Agreement. He was informed at that time that Vivint requires a written Notice of Cancellation. Vivint received Mr. [redacted]’s Notice of Cancellation on March 27, 2016. Pursuant to Vivint’s thirty (30) day cancellation policy, Mr. [redacted]’s Agreement was scheduled to be cancelled on April 27, 2016. Mr. [redacted] request a refund of every payment made after February 2017. In Vivint’s previous responses, Vivint reported that Mr. [redacted]’s system signals were being received up until February 4, 2017. Vivint indicated they were waiting on Mr. [redacted]’s decision how he would like to proceed given his previous panel was being shut down due to the cell unit was no longer being supported. Vivint attempted to follow up multiple times with Mr. [redacted] to offer an upgraded panel or cancellation of the account; however, Vivint records indicate they never received a follow up call. As such the account remained active. This was until Vivint received Mr. [redacted]’s rebuttal on May 12, 2017. In this rebuttal, Mr. [redacted] requested the cancellation of the account as he had recently tested the system, but did not receive a call after an alarm was triggered. Although Vivint had previously informed Mr. [redacted] his system would not work given the cell unit was out of service in February 2017, Vivint agreed to close the account. Vivint stated this would be done in their May 2017 response. Vivint has not drafted a payment from Mr. [redacted] since May 12, 2017. the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that his equipment has malfunctioned numerous times. He also expresses concern that he must be home in order for a technician to reboot and repair the system.  Mr. [redacted] desires cancellation without penalty and a refund of all monies paid to Vivint. Vivint agrees to cancel Mr. [redacted]’s account without penalty provided Vivint can remove the security equipment from his home. Customers must be present and able to handle the system as some issues can be repaired over the phone by troubleshooting. It is also policy to have the account holder present if it is required that a technician be dispatched to assess the repair. Vivint’s records indicate that on March 9, 2016 a technician was dispatched and repaired Mr. [redacted]’s security system. Vivint has been providing monthly monitoring service to Mr. [redacted]’s security system since install.
