reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In his complaint, Ms. [redacted] alleges the initial term of the Agreement with Vivint was misrepresentative by her sales representative. Ms. [redacted] further alleges she was offered a free move of her system. Ms. [redacted] desires the move fee to be waived. Vivint’s records indicate that prior to the installation of any equipment; Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on August 18, 2015. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.     Vivint has not record of an offer of a free move made to Ms. [redacted]; as such the move fee of $99.00 applies. However in an effort to resolve this matter, Vivint has agreed to cover the cost of half Ms. [redacted]’s move fee. She states that the appointment was missed on July 15, 2016 to pull the equipment. She further states that she was told she would receive a full refund of $163.86 which she states she has not received.Vivint’s records indicate that Ms. [redacted]’s account was cancelled on July 19, 2016. Vivint’s records also show that Ms. [redacted]’s equipment was pulled on July 22, 2016 at 6:12PM. A Vivint scheduler attempted to contact Ms. [redacted] on her primary number on July 21, 2016 to confirm her appointment but she did not answer. The rep left a voice mail and contacted the secondary number who was her son, who then confirmed the appointment on July 22, 2016 to pull the system. On July 24, 2016 a refund for $163.86 was processed to the checking account on file. On July 25, 2016 a legal assistant reached out to Ms. [redacted] to go over her Revdex.com complaint but Ms. [redacted] did not answer. The Legal representative left her a voice mail with her contact information. A second refund was processed on July 25, 2016 for $163.86 to the checking account on file. The same legal representative reached out to Ms. [redacted] on August 2, 2016 and left a voice mail and also sent her an email.Vivint feels this matter has been resolved to Ms. [redacted]’s satisfaction. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that Vivint has failed to provide a functioning system despite her attempts to work with Vivint for repairs. She further states that Vivint sent her case to a collections agency who has been harassing her for a $3,000.00 charge. As such, Ms. [redacted] is requesting that Vivint collect the equipment and waive any charges owed. Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $49.99 each month, plus applicable taxes and equipment fees, during that term.  By signing the Agreement, Ms. [redacted] further represented that she understood and accepted all the terms contained within. As stated in the contract, Vivint does not warrant that the system cannot be defeated or compromised or that it will always operate. However, Vivint does guarantee technical assistance over the phone or via a service appointment. Vivint’s records indicate that assistance was provided over the phone, per the contract. Furthermore, Vivint’s records indicate that the only appointment scheduled with Ms. [redacted] was successfully completed on June 22, 2017. reviewed the information provided by Mr. G[redacted] and appreciate the opportunity to respond. In his complaint, Mr. G[redacted] alleges that he was not contacted in a timely manner in response to his change in payment methods and that Vivint has recently made multiple attempt to contact him from an unknown number. Vivint’s records indicate that in October of 2014 payments to Vivint ceased. Vivint continued to attempt to withdraw funds from Mr. G[redacted]s bank account, each attempt resulting in an error. Vivint had made multiple attempts to contact Mr. G[redacted] to resolve the issue. Vivint was unable to make contact with Mr. G[redacted] and the account was submitted to collections on Febuary 27, 2015. On March 09, 2015 Vivint received a payment by check in the amount of $[redacted], this reinstated service and billing with Vivint continued. Mr. G[redacted]’s payment information was still not updated in order for Vivint to withdraw funds automatically. Vivint has continued to provide service to Mr. G[redacted] and has received no payments toward his monthly service fee. Currently Mr. G[redacted]’s past due balance stands at $[redacted].Since it is the customer’s responsibility to make sure that Vivint is made aware of any account and or billing changes cancellation without penalty is not warranted at this time. May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that she has requested Vivint to remove her mother’s name from the System Purchase and Services Agreement (“Agreement”) but Vivint has not done so. Ms. [redacted] desires cancellation without penalty. Vivint agrees to cancel Ms. [redacted]’s Agreement without penalty provided Vivint can remove the security panel from her home where the system is installed. A representative will reach out to Ms. [redacted] to schedule an appointment within forty-eight (48) hours. Vivint’s records indicate that Ms. [redacted] called into Vivint to request assistance with her monthly bill. A representative offered to waive her past due balance of $179.69 and lower her monthly rate by $10 as long as she agreed to extend the term length of her Agreement by thirty-six (36) months. Ms. [redacted] agreed to this Agreement extension on January 19, 2016. Ms. [redacted] also received a new alarm panel on February 2, 2016 at no cost to her. I am rejecting this response because: From Mr. W[redacted]'s response it is clear he does not understand my complaint. First, I am not asking about details of the investigation from the company end. Second, I am talking about two separate jurisdictions.  I live in Baltimore City and according to Baltimore City code, the alarm company MUST NOTIFY the consumer before installation of equipment the need to register the alarm and EXACT details and where/how to register. Neither of these things were done by Vivint. For Baltimore County, the alarm company MUST NOTIFY and MUST REGISTER for the consumer. Again, I know for a fact from my friend in Baltimore County that she was never notified of this need.  There is no registration fee for registering the alarm with either Baltimore City or Baltimore County. Again, the fact that he mentioned this as a resolution underscores that Mr. W[redacted] does not know the facts.  I am very disappointed that the company has failed to notify its consumers of the most important element of the alarm system. In Baltimore City, the police WILL NOT COME to any home that is not registered. This is how I found out about the need to register in the first place. In Baltimore County, the police will come to a home even if it unregistered.  Given the push back I have received and the continued lack of information the company seems to have about my situation as Mr. W[redacted]'s response does not know show that he understands my concerns, I would like to refund on my installation fee and activation as the Vivint broke the law in Baltimore City by installing this equipment without telling me about registering or providing information to me. Also, I want to note, on the evening that I made the company aware of my situation, I was told I would be receiving a welcome packet that has the registration information in it--I have never received this, nor have my neighbors who signed up in Baltimore City.  I would like a refund of $237.95.  If the company refuses this request, then I will plan to continue with arbitration and will follow up with my case: (#[redacted]) through the Office of the Attorney General; Consumer Protection Division for the State of Maryland. This case includes my correspondence with the company's customer service agents along with text messages from my sales agent and technician both of whom stated that they did not know I needed to register my alarm which is in direct conflict with Baltimore City law.

As such, Mr. [redacted] requests cancelation of his account and compensation for fines from his city’s police department.A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. In an effort to help Mr. [redacted]. Vivint can cancel the account without any additional charges, if Mr. [redacted] will allow a Vivint technician to come to his home to remove the equipment. After the technician has removed the equipment the account and contract will be canceled. However, due to sections 11 and 12 of the contract stating that Vivint is not responsible for any fines from faults alarms or alarm permits compensation for those fines is not warranted.  February 6, 2015 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has had multiple issues with her Vivint system and service since installation, and that she has now moved from her home and is being contacted by collections.  Ms. [redacted] desires cancellation of her Purchase and Services Agreement (“Agreement”) without penalty and a possible refund of monies paid to Vivint.  At this time, Vivint will waive the remainder of Ms. [redacted]’s Agreement term, and will remove her account from collections.Vivint’s records indicate that Ms. [redacted] signed an Agreement upon installation of her Vivint system, in which she represented that she agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $69.99 each month, plus applicable taxes, during that term.  Ms. [redacted] stopped making her monthly payments after January 2016 and as such, her account was transferred to an outside collections agency after 120 days of non-payment.  By waiving the remainder of Ms. [redacted]’s Agreement, Vivint waives a total of $3,359.52, and no further compensation is warranted.Cancellation of the Agreement without penalty at this time is also not warranted; however, due to Ms. [redacted]’s multiple complications, Vivint agrees to the above resolution.  Ms. [redacted] has no further obligation to Vivint.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-#### attention Department 160 - Legal.
